of 29 March 2010
amending Government Regulation No. 266 / 2009 Coll., on technical requirements for marine equipment
The Government orders pursuant to Section 22 of Act No. 22 / 1997 Coll., on Technical Requirements for Products and on the Amendment and Addition of Certain Acts, as amended by Act No. 71 / 2000 Coll. and Act No. 205 / 2002 Coll., (hereinafter "the Act ') to implement Section 12 of the Act:
Government Regulation No. 266 / 2009 Coll., on Technical Requirements for Marine Equipment, is amended as follows:
1. In footnote 1, the sentence "Commission Directive 2009 / 26 / EC of 6 April 2009 amending Council Directive 96 / 98 / EC on marine equipment is added to the new line. ';
2. Annex 1 shall read as follows:
"Annex No 1 to Government Decree No. 266 / 2009 Coll.
Technical requirements, test procedures and conformity assessment procedures for marine equipment
1.
Life-saving appliances
A.1 / 1.1 Rescue rings
1. The life-cycle shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 7, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Resolution MSC.48 (66) - (LSA Code) I, II; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of the life-cycle shall be carried out according to Module B and, at the choice of the manufacturer or his authorised representative, according to Module D or E or F.
A.1 / 1.2 Lifeguards with automatically lighting lights for lifeboats and rescue boats, liferings, lifejackets
1. Life-saving appliances with automatically illuminating lights for survival craft and rescue boats, life-jackets, life-jackets shall comply with the requirements set out in:
(a) Regulations III / 4, X / 3, III / 7, III / 22, III / 26, III / 32, III / 34 of the SOLAS Convention;
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) II, IV; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out according to:
(a) IMO MSC Resolution. 81 (70) a
(b) ISO 24408 (2005).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.3 Automatically activating smoke signals for survival rings
1. Automatically activating smoke signals for liferings shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 7, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Resolution MSC.48 (66) - (LSA Code) I, II; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.4 Lifejackets
1. The life jackets shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 7, III / 22, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) I, II,
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8,
(e) IMO MSC / Circular 922.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.5 Marine life suits and weather protection suits not classified as life jackets: insulated or uninsulated
1. Marine life suits and weather suits not classified as life jackets: insulated or not insulated shall comply with the requirements set out in:
(a) Regulations III / 4, X / 3, III / 7, III / 22, III / 32, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Resolution MSC.48 (66) - (LSA Code) I, II; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.6 Marine suits and weather suits, classified as lifejackets: isolated or not
1. Marine life suits and weather suits, classified as lifejackets: insulated or not isolated shall comply with the requirements set out in:
(a) Regulations III / 4, X / 3, III / 7, III / 22, III / 32, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Resolution MSC.48 (66) - (LSA Code) I, II; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70)
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.7 Thermal protection devices
1. The heat protection devices shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 22, III / 32, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Resolution MSC.48 (66) - (LSA Code) I, II; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.8 Rocket parachute flares (pyrotechnics)
1. The rocket parachute flares shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 6, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) I, III; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.9 Signal torches (pyrotechnics)
1. The signal torches shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) I, III; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.10 Floating smoke signals (pyrotechnics).
1. Floating smoke signals shall meet the requirements set out in:
(a) SOLAS Regulations III / 4, X / 3, III / 34; and
(b) IMO Resolution MSC.48 (66) - (LSA Code) I, III.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.11 Cable throwing equipment
1. The cable-throwing equipment shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 18, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) I, VII; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.12 Inflatable life rafts
1. Inflatable life-rafts shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 13, III / 21, III / 26, III / 31, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) I, IV,
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8; and
(e) IMO MSC / Circular 811.
2. The examination of compliance shall be carried out according to:
(a) IMO MSC Resolution. 81 (70) a
(b) ISO 15738 (2002).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.13 Fixed life rafts
1. Fixed life-rafts shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 21, III / 26, III / 31, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) I, IV,
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8; and
(e) IMO MSC / Circular 811.
2. The examination of compliance shall be carried out according to:
(a) IMO MSC Resolution. 81 (70) a
(b) IMO MSC / Circular 1006.
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.14 Automatically pressurising life rafts
1. Automatically inducing life-rafts shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 26, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) I, IV,
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8,
(e) IMO MSC / Circular 809, including Appendix 1; and
(f) IMO MSC / Circular 811.
2. The examination of compliance shall be carried out according to:
(a) IMO MSC Resolution. 81 (70),
b. IMO MSC / Circular 809, including Appendix 1;
(c) IMO MSC / Circular 1006; and
(d) ISO 15738 (2002).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.15 Double-sided life-rafts with protective shelter
1. Two-way life-rafts with a protective shelter shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 26, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8, Annex 10;
(c) IMO Res. MSC.48 (66) - (LSA Code) I, IV,
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8, Annex 11,
(e) IMO MSC / Circular 809, including Appendix 1; and
(f) IMO MSC / Circular 811.
2. The examination of compliance shall be carried out according to:
(a) IMO MSC Resolution. 81 (70),
b. IMO MSC / Circular 809, including Appendix 1;
(c) IMO MSC / Circular 1006; and
(d) ISO 15738 (2002).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.16 Automatic life rafts (hydrostatic release devices)
1. Automatic life rafts shall comply with the requirements set out in:
(a) Regulations III / 4, X / 3, III / 13, III / 26, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) I, IV,
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8; and
(e) IMO MSC / Circular 811.
2. The examination of compliance shall be carried out in accordance with IMO MSC Resolution. 81 (70).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, in accordance with Module D or E or F.
A.1 / 1.17 Lifeboats
1. Lifeboats shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 21, III / 31, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Resolution MSC.48 (66) - (LSA Code) I, IV; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out according to:
(a) IMO MSC Resolution. 81 (70) a
(b) IMO MSC / Circular 1006.
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, under Module D or F. Where maritime equipment is manufactured individually or in small quantities, the manufacturer or his authorised representative may carry out conformity assessment according to Module G; in this case, the sentence of the first paragraph shall not apply.
A.1 / 1.18 Fixed rescue boats
1. Fixed rescue boats shall meet the requirements set out in:
(a) Regulations III / 4, X / 3, III / 21, III / 31, III / 34 of SOLAS,
(b) IMO Res. MSC.36 (63) - (1994 HSC Code) 8,
(c) IMO Res. MSC.48 (66) - (LSA Code) I, V; and
(d) IMO Res. MSC.97 (73) - (2000 HSC Code) 8.
2. The examination of compliance shall be carried out according to:
(a) IMO MSC Resolution. 81 (70) a
(b) IMO MSC / Circular 1006.
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, under Module D or F. Where maritime equipment is manufactured individually or in small quantities, the manufacturer or his authorised representative may carry out conformity assessment according to Module G; in this case, the sentence of the first paragraph shall not apply.
A.1 / 1.19 Inflatable lifeboats
1. Inflatable lifeboats shall meet the requirements set out in:

2. The examination of compliance shall be carried out according to:

(b) ISO 15372 (2000).
3. Conformity assessment of such marine equipment shall be carried out in accordance with Module B and, at the choice of the manufacturer or his authorised representative, under Module D or F. Where maritime equipment is manufactured individually or in small quantities, the manufacturer or his authorised representative may carry out conformity assessment according to Module G; in this case, the sentence of the first paragraph shall not apply.
A.1 / 1.20 Fast rescue boats
1. Fast rescue boats shall meet the requirements set out in:
(a) Regulations III / 4, III / 26, III / 34 of SOLAS,
(b) IMO Res. MSC.48 (66) - (LSA Code) I, V,
c. IMO MSC / Circular 809, including Appendix 1;
