DECLARATION
Ministry of Transport and Communications
of 6 May 1999
amending Decree No. 108 / 1997 Coll., implementing Act No. 49 / 1997 Coll., on Civil Aviation and amending and supplementing Act No. 455 / 1991 Coll., on Business Business (Trade Act), as amended
The Ministry of Transport and Communications provides pursuant to § 102 (1) of Act No. 49 / 1997 Coll., on Civil Aviation and amending and supplementing Act No. 455 / 1991 Coll., on Business Business (Trade Code Act), as amended, hereinafter referred to as "the Act":
Čl. I
Decree No. 108 / 1997 Coll., implementing Act No. 49 / 1997 Coll., on Civil Aviation and amending and supplementing Act No. 455 / 1991 Coll., on Business Business (Trade Trade Act), as amended, is amended as follows:
1. In Article 1 (1), the words "Article 45 (4) 'shall be inserted after the words" Article 44 (4)';
2. In Article 1 (2), the words "Article 45 (4) 'are deleted.
3. in Article 2 (2), the following point (b) is inserted after point (a):
"(b) where the applicant is not a manufacturer or importer of an aircraft or an aircraft engine and propeller, he shall demonstrate to the Authority a legal interest in the approval of an aircraft or component. In this case, the applicant need not submit the documents referred to in (a), '.
Points (b), (c), (d), (e) and (f) shall become points (c), (d), (e), (f) and (g).
4. In Section 4, the following sentence is added at the end: "At the same time, the aircraft operator shall submit records of aircraft operations, including aircraft maintenance records. '.
5. in Article 6 (2) (f), the words "including maintenance, repair and testing documentation" shall be inserted after the words "list of production and accompanying technical documentation."
6. In Article 6 (1), the words "or to manufacture, repair, test and maintain aeronautical equipment 'shall be inserted after the words" parts'.
7. The reference under the heading § 6 reads:
"(Paragraph 17 (1) and (3) of the Act) '.
8. In Paragraph 8 (1), the last sentence is replaced by the sentence "The same education and practice is required for the post of Deputy Head of the Institute and for the post of Head of Quality Control."
9. The heading of Section 9 reads:
"Technical and operational conditions of each airport type and details of the content of the application to determine the airport type
(to Paragraph 25 (2) of the Act) '.
10. in Article 9 (2) (d):
"(d) an official copy of the territorial decision on the location of the construction of the airport and of the construction of the airport, the official copy of the building permit for the construction of the airport and the official copy of the approval decision for the construction of the airport and the construction of the airport or a certified copy thereof,"
11. in Article 9, the following paragraph 3 is inserted after paragraph 2:
"(3) The technical and operational conditions of each type of aerodrome, the compliance of which is demonstrated by the aerodrome operator under the specific conditions of use of the aerodrome, are set out in Annex 3."
12. In Paragraph 13, the following sentence is added at the end of paragraph 1: "Areas may be used for take-off and landing aircraft in air operations, provided that the use of areas is part of the air traffic permit granted. '
13. in Paragraph 14 (1), point (a), the words "if not carried out by a balloon" shall be inserted after the words "except for sightseeing flights."
14. In Paragraph 14 (4), the words "and on balloon flights' shall be added at the end of the first sentence.
15. in Article 15 (3), the following point (h) is inserted after point (g):
"(h) premises in which emergency operations are carried out in the event of disasters, environmental or industrial accidents, accidents or other hazards requiring the safety of the aircraft involved;"
Point (h) shall be renumbered as point (i).
16. In Article 16 (3), the words "with the exception of the request submitted by the air traffic services unit," shall be inserted after the words "with respect to the application referred to in paragraph 1."
17. After Paragraph 16, the following Section 16a is inserted:
„§ 16a
Characteristics of each type of air services and activities ensuring their provision
(Article 45 (4) of the Law)
(1) Air traffic services are intended to ensure the safety and continuity of air traffic. These services include flight information service, standby service, air advisory service and air traffic control service.
(2) The air telecommunications service is a service intended to transmit information for any air purpose. This service includes fixed air service and mobile air service.
(3) The meteorological service is intended to provide updated meteorological information necessary to ensure safe and smooth air traffic.
(4) The search and rescue air service is intended to conduct search and rescue operations in the event of air incidents.
(5) The aeronautical information service is intended to inform aircraft operators and users of the facts relevant to the provision and security of air traffic.
(6) Pre-flight preparation and flight monitoring services are services intended for air operators and aircraft users to prepare for flight.
(7) Airport handling services are services provided by:
(a) technical and operational ramp handling of aircraft;
(b) the handling of passengers and their baggage;
(c) cargo and mail handling;
(d) the supply of the aeroplane cafeteria with food and drink;
(e) handling of aviation fuels and oils;
Individual services in the airport clearance process are listed in Annex 4.
(8) For the needs of air carriers, the services at the airport are provided by a legal or natural person under the agreement of the Ministry of Transport and Communications. All groundhandling services at the airport or some of them may be provided by the air carrier itself on the basis of the agreement of the Ministry of Transport and Communications. If the airport service is provided by the airport operator or is provided by a domestic air carrier for its own use, the accounts of those services shall be kept separate from the other activities. ';
18. In Article 17 (2), the words "operating commercial air transport on the basis of a licence 'shall be inserted after the words" the domestic air carrier' and the words "until 31 March 'shall be replaced by the words" until 30 June'.
19. In Paragraph 17, the following paragraph 3 is inserted after paragraph 2:
"(3) Paragraph 1 shall apply mutatis mutandis to the demonstration of financial security for the carriage of the air taxi. ';
Paragraph 3 shall become paragraph 4.
20. in Paragraph 20 (1), point (c) shall be deleted;
Points (d), (e), (f), (g), (h), (i), (j), (k) and (l) shall be renumbered (c), (d), (e), (f), (g), (h), (i), (j) and (k).
21. in Paragraph 20 (2) (a):
"(a) to teach air staff in air schools,"
22. in Article 20 (4), the following point (c) is added:
"(c) operations manual containing applicable aircraft types, flight rules and procedures for each air work and aircraft maintenance manual.";
23. in Article 21 (2), the following point (j) is added:
"(j) the operations manual and aircraft maintenance manual.";

„§ 23
Forms of application for an operating permit for own use
(Article 76 (3) of the Law)
(1) An applicant for the operation of air activities for his own use shall submit a written request to the Authority indicating:
(a) the trade name or name of the legal person, its registered office, legal form and identification number, if the applicant is a legal person, or the name or surname of the natural person, its identification number, birth number, permanent residence or place of business where the applicant is a natural person;
(b) types of air activities;
(c) the types of aircraft to be operated and their registration mark;
(d) a list of each flight crew member to be carried out by air operations;
(e) the designation of the base airport from which air operations will be carried out and where surveillance, parking and treatment of aircraft operated will be carried out;
(f) the way in which aircraft are maintained;
(g) the expected geographical area of the principal operation of air activities.
(2) The application shall be accompanied by the following documents:
(a) a certified copy of the contract or instrument establishing or establishing a legal person, in the case of legal persons registered in a commercial or other register by means of an extract from that register not more than 1 month old;
(b) certificates of registration of aircraft operated;
(c) evidence of the latest airworthiness review of aircraft operated;
(d) air crew licences;
(e) evidence of ensuring the safety of the operation of air activities before unlawful acts;
(f) the names of the persons responsible for the operation and maintenance of aircraft;
(g) evidence of contracted aircraft liability insurance equivalent to the range of air activities;
(h) the opinion of the airport operator;
(i) a directive for each type of aviation activity. "
25. in Paragraph 24 (4), "63" is replaced by "65."
26. in Paragraph 24 (5), "63" is replaced by "65."
27. in Article 24 (6) (a):
"(a) with an auxiliary engine on the back of a pilot, designed as one-seater, having a maximum take-off mass of 170 kg or a two-seater with a maximum take-off mass of 270 kg, and allowing take-off and landing from the pilot's feet; or"
28. In Article 24 (7), the words "in the case of two-digit and 300-kg in the case of one-digit" shall be inserted after the number "450 kg."
29. in Paragraph 24 (8):
"(8) An ultra-light helicopter is an aircraft powered by rotating carrier surfaces, which is designed for up to 2 persons, with a maximum take-off mass of 450 kg for two and 300 kg for one person. '
30. In Article 24, paragraphs 10 and 11 are added:
"(10) The ultra-light engine glider is an ultra-light glider equipped with a propulsion unit that is not more than two-seater, the falling speed of which does not exceed 65 km / h when the propulsion unit is idle, the maximum take-off mass does not exceed 300 kg for one-seater and 450 kg for two-seater.
(11) The maximum take-off mass of the sport flying equipment may only be exceeded by the mass of the integrated rescue system in the case of its installation. "
31. in Article 28, the following paragraph 4 is added:
"(4) The minimum start-up age for practical training to obtain a pilot licence for sport flying equipment shall be 15 years, with the possibility of starting such training within 18 years only with the written consent of its legal representatives. Separate flights on motor sports flying equipment may be made after the age of 16. ';
32. in Paragraph 31 (1):
"(1) The minimum amount of the insurance amount for which the liability for damage caused by the operation of the aircraft, i.e. the performance limit, must be agreed shall be:
(a) CZK 1 000 000 for non-powered aircraft;
(b) CZK 2 000 000 000 for other aircraft up to a maximum take-off mass of 1,200 kg;
(c) 3 000 000 CZK for aircraft with a maximum take-off mass of more than 1,200 kg up to 2 000 kg;
(d) 6 000 000 CZK for aircraft with a maximum take-off mass of between 2 000 kg and 5 700 kg;
(e) 100 000 000 CZK for aircraft with a maximum take-off mass of between 5 700 kg and 14 000 kg;
(f) 200 000 000 CZK for aircraft with a maximum take-off mass exceeding 14000 kg. '
33. In Paragraph 31, the following paragraph 2 is inserted after paragraph 1:
"(2) In addition to the insurance referred to in paragraph 1, the insurance of liability for damage caused by the operation of an aircraft with a minimum of CZK 700 000 for each seat on the aircraft designated by the operator for the carriage of persons other than the crew of the aircraft, including sightseeing flights, shall be agreed."
Paragraphs 2, 3 and 4 shall become paragraphs 3, 4 and 5.
34. In the second sentence of Paragraph 31 (4), the words "including a statement of payment of premiums of a specified amount 'are deleted.
35. in the second sentence of Paragraph 31 (5), the words "including a statement of payment of premiums of a specified amount," shall be deleted;

AIRCRAFT PRODUCTS WHICH MAY BE USED IN CIVIL AIRCRAFT, IF THE AUTHORITY HAS BEEN APPROVED OR RECOGNISED TO BE USED IN CIVIL AIRCRAFT
1. Aircraft parts and equipment for which the Authority has approved or recognised the minimum required performance standards as a basis for the approval of their competence for universal target use (i.e. their use is not limited to a specific approved type of aircraft or components thereof),
1.1 Flight control instruments: pressure altimeters, radio altimeters, speedometers, machometers, variometers, relative gradients, turns, accelerometers, artificial horizons, directional flywheels
1.2 Drive unit inspection apparatus: pressure meters, thermometers, fuel meters, consumables, turn meters
1.3 auxiliary energy units (APU)
1.4 Automatic and semi-automatic control systems: auto-pilots, command systems
1.5 communication equipment: VHF and KV on-board radio stations, SELCAL systems, audio-signal switch boxes, amplifiers, microphones, headsets, voice recorders in the cockpit, underwater acoustic location devices
1.6 Navigation equipment: magnetic compasses, radio compasses, VHF navigation receivers VOR and ILS LOC / GS, en route signal receivers, multipurpose electronic displays, GPS satellite navigation system receivers, RNAV spatial navigation systems, anti-collision systems (TCAS), SSR transponders, distance meters (DME), on-board clocks, weather radar systems
1.7 Emergency equipment: lifejackets, rescue parachutes, lifeboats, passenger oxygen masks, protective breathing equipment (PBE), emergency position transmitters (ELT), evacuation slides
1.8 Indicator and recording equipment: Flight data recorders, crash warning devices
Aircraft lights: position, anti-collision
1.10 Interior equipment: seats, beds, seat belts, shoulder harness, containers, pallets and nets
1.11 Electrical system: alternators, dynamos, dynamos, air batteries, static converters
1.12 landing gear system: brake wheels, tyres, skis, floats
1.13 Air conditioning system: combustion burners
1.14 Fire protection system: smoke and fire detectors, portable fire extinguishers
1.15 Fuel system: hoses, filters
1.16 oxygen system: crew oxygen masks, oxygen regulators
2. Aircraft parts and equipment approved for use on a particular type of aircraft or component thereof which will or may be manufactured as interchangeable or modification parts for installation on an approved type of aircraft or component thereof and whose competence is verified within the following systems:
2.1. Fuel systems

2.3. Hydraulic systems
2.4. Air conditioning systems
2.5. Management systems
2.6 defrosting systems

AIRCRAFT PRODUCTS, THE PRODUCTION OF WHICH, TESTS, MAINTENANCE, CORRECTION AND REALIZATION OF MODIFICATION AND CONSTRUCTION AMENDMENTS MAY BE IMPLEMENTED ONLY BY THE LEGAL PERSON TO THIS OPERATIONS
All aeronautical equipment products from Part A and other parts and appliances constituting essential parts of the aircraft or parts thereof, the capability of which is approved in the context of type-approval of the aircraft or components thereof, shall:
