amending Act No. 285 / 2002 Coll., on Donation, Collection and Transplantation of Tissue and Organ and on the Amendment of Certain Laws (Transplant Act), as amended
Parliament has decided on this law of the Czech Republic:
Act No. 285 / 2002 Coll., on donation, collection and transplantation of tissues and organs and on the amendment of certain laws (Transplant Act), as amended by Act No. 228 / 2005 Coll., Act No. 129 / 2008 Coll., Act No. 296 / 2008 Coll., Act No. 41 / 2009 Coll., Act No. 281 / 2009 Coll., Act No. 375 / 2011 Coll. and Act No. 44 / 2013 Coll., is amended as follows:
1. footnote 2 is deleted, including the footnote references.
2. In Article 2, at the end of the text in point (r), the words "first degree of kinship 'are added.
3. In Section 4, the words "minors' are replaced by the words" persons who have not acquired full capacity 'and the words "deprived of legal capacity' are replaced by the words" with limited capacity '.
4. In Article 4 (1), the words "being minors 5), persons with limited legal capacity or persons deprived of legal capacity in full scope (6) (hereinafter referred to as" a person deprived of competence ") or persons' are replaced by the words" who are persons who have not acquired full incapacity or persons with limited incapacity (hereinafter referred to as "a person who is not fully competent") or persons'.
footnotes 5 and 6 are deleted.
5. in Article 4 (1) (d), in the second sentence of Article 7 (1) and in Article 15 (1), the words "a minor or an deprived person" shall be replaced by "a person who is not fully entitled."
6. In Article 5 (1), the words "minors, persons deprived of competence 'are replaced by the words" persons who are not fully entitled'.
7. in Articles 5 (2) (b) and 5 (5) (b), the words "a minor, a person deprived of competence" shall be replaced by the words "a person who is not fully entitled."
8. in § 5 (3), § 7 (6) and in § 16 (1) (c) of the sentence behind the semicolon, the words "minors or persons deprived of competence" shall be replaced by "persons who are not fully entitled."
9. in § 5 (5) of the final part of the provision, § 5 (6) (a), (b) and (g) and § 5 (8), the words "minors, persons deprived of competence" are replaced by the words "persons not fully competent."
10. in Article 5 (6) (d) and Article 5 (7) of the introductory part of the provision, the words "a minor or a person deprived of competence" shall be replaced by the words "a person who is not fully entitled."
11. in Article 5 (7) (a), the words "a minor or a deprived person" shall be replaced by the words "a person who is not fully entitled,"
12. in Article 6 (6), the words "minor or legal representative of a person without competence" shall be replaced by the words "person who is not fully competent."
13. in the fourth sentence of Article 7 (1), in the first sentence of Article 7 (2), in the first sentence of Article 7 (5), in Article 16 (1) of the introductory part of the provision and in Article 16 (1) (c), the words "minor or legal representative of a person deprived of competence" shall be replaced by the words "person who is not fully entitled."
14. in the fourth sentence of Article 7 (2) and in the fourth sentence of Article 7 (4), the words "minor or legal representative of a person deprived of competence" shall be replaced by the words "person who is not fully entitled."
15. in Article 11 (1) (a), the words "a minor or a deprived person" shall be replaced by "a person who is not fully entitled."
16. In Article 15 (2), the words "a minor or a deprived person 'are replaced by the words" a person who is not fully entitled'.
17. in Article 16 (2), the words "a minor or a deprived person" shall be replaced by the words "a person who is not fully entitled."
18. in Paragraph 18 (5), the words "which are intended for direct transmission to the recipient's body" shall be added at the end of the text of points (a) to (c).
19. in Paragraph 21 (b):
"(b) the transplants of tissues intended for direct transmission to the recipient's body report to the National Register of Organ Transplants,"
20. in Article 25 (2) (e), the words "and for tissues intended for direct transmission to the recipient's body" shall be inserted after the word "authorities."
21. in Article 26a (2) (a), the word "10-digit" shall be deleted;
22. In footnote 21, the sentence "Commission Directive (EU) 2015 / 566 of 8 April 2015 implementing Directive 2004 / 23 / EC as regards procedures for verifying equivalent quality and safety standards for imported tissues and cells' is added.
Efficacy
This Act shall enter into force on 29 April 2017.
