The Czech Office of Geodetic and Cartographic provides in an agreement with the Federal Ministry of Technical and Investment Development and with other participating central bodies pursuant to § 22 (a) of Act No. 46 / 1971 Coll., on Geodesy and Cartography:

Introductory and general provisions
§ 1
Purpose and scope of the Order
The decree regulates the process of the authorities and organisations of the Czech Geodetic and Cartographic Office, as well as investors, general designers and supplier organisations ("construction participants") 1) in the implementation of geodetic works in construction.
§ 2
Geodetic works under construction
(1) Geodetic works form a geodetic base or part of the preparatory and project documentation of buildings. Geodetic works are also work of outlaying, work of control and geodetic work forming part of documentation of actual construction implementation. 2)
(2) The results of the verified geodetic work3) can also be used, according to their nature, as a basis for adjusting property relations, for state maps and for maps of the surface situation in accordance with the upper legislation.4)

Obligations of construction participants
§ 3
Ensuring the professional performance of geodetic works
(1) The construction participants are obliged (§ 4-6) to ensure the performance of geodetic work by responsible geodeses. In the case of buildings that require simple geodetic work only, regional geodetic and cartographic management (5) may decide according to the place of work, after prior expression by the construction office, that the professional performance of geodetic work may be ensured by qualified personnel without the appointment of responsible surveyors.
(2) The responsible geodesy can only appoint a worker with an completed higher education in the geographical direction with six years of experience, of which at least three years of experience in construction, who successfully passed the test for responsible geodeses. For the construction of the activities of organisations referred to in § 37 (1) of the Mining Act (6), responsible surveyors may also be appointed under similar conditions by staff with completed higher education at the Mining, Mining or Technical University. Exceptions, in particular as regards practice and examination, are permitted by the Czech Office of Geodetic and Cartographic. The examinations are held before a commission appointed by the Chairman of the Czech Geodetic and Cartographic Office.
(3) Construction participants may ensure the performance of a responsible geodette through another organisation. For several participants, or for all participants in the construction, the function of responsible geodette may be provided by one organisation. However, a supplier organisation worker may not at the same time perform the function of a responsible investor or general designer.
§ 4
Obligations of the investor
The investor is obliged
1. in the processing of preparatory and project documentation:
(a) provide geodetic evidence;
(b) to check the completeness of the geodetic works forming part of the dossier;
(c) ensure timely and cost-effective preparation of geodetic materials for the removal of land from land funds and for the adjustment of property relations; 7)
2. in the implementation of the construction:
(a) to ensure, as appropriate, the establishment, protection against damage or destruction, and control against the supply of construction works, in advance of their transmission;
(b) ensure the participation of the responsible geodesy in the protocol transfer of the site to the supplier;
(c) participate in the field control measurement carried out by the contractor when taking over the site;
(d) ensure, in accordance with the territorial decision, the early establishment of the spatial location of the objects (main position lines or main axes and main points of the routes, main height points) (8) and the marking of existing ground lines on the surface, where the construction activities may be affected;
(e) ensure the cooperation of the responsible surveyor with the investor's technical supervisor in the supervision of compliance with the spatial location of the objects; check the position and height orientation of underground lines and objects before covering them; check the orientation of the field modifications carried out; check the geodetic documentation of the actual implementation of the construction taken over from the suppliers of the construction;
3. when processing documentation of actual construction: 9)
(a) ensure the comprehensive processing and archiving of the documentation of geodetic works forming part of the documentation of the actual execution of the whole construction according to the evidence of the supplier's responsible geodesy for construction and the results of its own control or supplementary measurements;
(b) ensure that the documentation can be used for the purposes set out in Article 2 (2) of this Decree.
§ 5
Obligations of the Director-General
The general designer is obliged
1. in the processing of preparatory documentation:
assess the completeness, accuracy and suitability of the geodetic material and its effective use;
2. when processing project documentation:
(a) take care of the economic use of previously carried out geodetic works and of the necessary addition of geodetic materials for project activities;
(b) to draw up, stabilise, and ensure the draft budget for such work;
(c) ensure the stabilisation and targeting of all points used for design purposes and may be used in the setting, control and documentation of geodetic works and their transmission to the investor;
(d) ensure the cooperation of the responsible geodesy on the various parts of the project, in particular in the processing of outlay drawings of individual object10);
(e) ensure the processing of the coordination drawing (construction) 11) and the coordination of the spatial location of ground, ground and above ground objects and equipment;
(f) to carry out coordination and control of geodetic work forming part of projects processed by another organisation;
3. in the implementation of the construction:
ensure the participation of the responsible surveyor in the authoritarian supervision of the general designer as necessary.
§ 6
Obligations of the supplier organisation
(1) The supplier organisation shall:
(a) cooperate on a geodetic basis in taking over the site and carry out control measurements of the terrain with the investor;
(b) take over and maintain points of the grid from the investor, or any other usable points of the point field during the construction period;
(c) take over from the investor the setting of the spatial location of the objects;
d) ensure, according to the project documentation, detailed identification of the building site facilities and detailed identification of the building and other buildings;
(e) to transmit to another supplier the layout of the spatial location of the object and the supporting documents for the detailed identification of the object of its supply;
(f) carry out control geodetic work to the extent of own supplies and subdeliveries;
g) provide geodetic methods of positioning and height orientation of the actual execution of completed objects or parts thereof, including field modifications to the grid by the project (in the case of underground lines and objects before covering);
(h) ensure numerical and graphical marking of the actual execution of the work so that the documentation can be transmitted to the investor on surrender and delivery; 12)
(i) ensure archiving of measurement records and sketches for the work carried out, enable the investor to take a look at these materials, where appropriate, to obtain extracts and copies and to offer them to the investor or user before shredding.
(2) The obligations referred to in paragraph 1 (d), (f), (g) shall be fulfilled by their suppliers.
(3) If the supplier organisation provides project documentation for the buildings, it also has obligations under Section 5.

Method of carrying out geodetic work
§ 7
Coordinate and height system
(1) Geodetic work under this Decree is carried out in the coordinate system of the Single Trigonometric Catastral Network (S- JTSK system). If there is an extension of geodetic work previously performed in another coordinate system, measurements can be made in this system. If certain geodetic works are used for the purpose of the construction of another coordinate system, the results of such works shall be connected to the S-JTSK system. In the 1942 coordinate system (S-42), measurements shall be made exceptionally for the extension of geodetic work carried out in this system, only with the agreement of the geodesy and cartography authorities, which shall seek the opinion of the Federal Ministry of National Defence in advance. If the work is not taken over or used for state maps and documentation conducted by geodesy and cartography bodies, or for surface maps required by the upper law, 13) the investor's responsible geodesy may use a local coordinate system in agreement with the responsible geodesy of the general designer and under similar conditions, if the connection to the S-JTSK system with regard to the scope and function of the construction would be costly. The coordinate system used shall always be marked in both graphic and written documentation.
(2) The building of a point field is governed by the relevant rules. 15)
(3) For geodetic work under this decree, the Baltic high-rise system - after settlement (Bpv) is used. If there is an extension of construction or installation already related to another height system, this system shall normally be used. Exceptionally, in agreement with the investor's responsible geodesy and under similar conditions, the responsible geodesy of the general designer may decide, with the agreement of the Regional Geodetic and Cartographic Administration, to use the local height system, 14) if the connection to the levelling network would be costly with regard to the scope and function of the construction. The height system used shall be marked in both graphic and written documentation.
(4) Connections to the Czechoslovak single levelling network shall be made in accordance with specific regulations. 16)
§ 8
Map and display materials
(1) The type, scale, scope, content and accuracy requirements of map and layout materials, unless they result from technical standards and relevant regulations, shall be established by agreement between the building participants. If no agreement is reached, the Regional Geodetic and Cartographic Administration responsible for the place of work shall decide. The graphic presentation shall be governed by the relevant regulations and technical standards. 17)
(2) If geodetic materials need to be transferred to a larger scale, the enlargement must be clearly marked with a note: "Semi-copy (altimeter) derived from....... on a scale of....... '.
(3) The points of the grid, including the main height points, are such that they can be used throughout the construction and to focus on the actual construction.
§ 9
Documentation of geodetic works forming part of documentation of actual construction
(1) The documentation on geodetic works forming part of the documentation on the actual execution of the construction shall include numerical and graphical marking of the results of the orientation of the actual position and height of ground, ground and above ground objects and equipment on the points of the grid; the position and height orientation of all underground lines and equipment must be targeted for this documentation always before they are covered. Documentation of geodetic works means a situation generally on a scale of 1: 1000 or 1: 500 with a drawing of all newly built objects and equipment, setting nets, drawings with figures, a list of coordinates and points and a technical report.
(2) If an organisation discovers unknown or inaccurately documented objects and equipment during its activities, it shall immediately inform the investor, who shall ensure that they are targeted and documented as necessary.
§ 10
Signing documentation of geodetic works
Documentation of geodetic works forming part of the preparatory and project documentation and documentation of actual implementation of the construction shall be signed by a responsible geodetic or qualified worker who ensures the professional performance of the geodetic work referred to in Article 3 (1).

Final provisions
§ 11
The decree also covers geodetic works for construction in the field of the Federal Ministry of National Defence, unless they are carried out for the purposes of State defence pursuant to § 6 (3) of Act No. 46 / 1971 Coll., on Geodesy and Cartography.
§ 12
The Directives of the Central Administration of Geodesy and Cartography of 21 December 1964 No 23- 333.1- 13 900 / 1964 for Geodetic Works in Investment Construction (Bulletin of the State Investment Construction Commission No 5 / 1964) are hereby repealed.
§ 13
This Decree shall take effect on 1 March 1974.
