on weapons and ammunition
Parliament has decided on this law of the Czech Republic:

ČÁST PRVNÍ

INTRODUCTORY PROVISIONS
§ 1
Scope of the law
(1) The right to acquire, hold and carry arms is guaranteed under the conditions laid down by this law.
(2) This law implements the relevant European Union1), following up on the directly applicable European Union2) and regulates the handling of arms and ammunition, the operation of the shooting sites and the performance of the state administration on this section.
(3) When dealing with a weapon or ammunition or operating a shooting range of exempted public law institution, which is the Ministry of the Interior (hereinafter referred to as the Ministry of Defence), the Ministry of Defence, the armed forces of the Czech Republic, the Security Council of the Czech Republic or the Czech Office for the Testing of Weapons and Ammunition, this Act shall apply only if it is further expressly provided for.
(4) In carrying out the tasks of an exempted public institution, any person using a shooting range operated under this law shall comply with the operating rules of such a shooting range.
Definition of certain terms
§ 2
(1) The types of weapons, including their regulated components and ammunition, including its active components are set out in Annex 1 to this Act.
(2) For the purposes of this Act, a weapon is a firearm, a gas weapon and other equipment or apparatus which are classified in one of the categories of weapons or to which provisions on the disposal of weapons of a particular category apply pursuant to Section 9.
(3) For the purposes of this Act, ammunition are cartridges, cartridges and active components of ammunition which are classified into one of the categories of ammunition.
(4) The regulated part of the weapon is for the purposes of this Act:
(a) the main part of the weapon;
(b) part of a weapon allowing automatic firing;
(c) the primary part of the weapon;
(d) the silencer; or
(e) an excess reservoir.
§ 3
For the purposes of this Act:
(a) any physical treatment of arms or ammunition, including transport or storage; legal action shall be considered to be the handling of arms or ammunition, provided that specifically provided for by this law,
(b) carrying a weapon means of handling a weapon in which a natural person has it in a place accessible to the public by himself, charged or visible;
(c) the place of residence is the address of the place of residence of the citizen of the Czech Republic or the address of the place of residence of the alien kept in the basic population register;
(d) the place of residence in another Member State of the European Union, the Contracting State of the Agreement on the European Economic Area or the Swiss Confederation (hereinafter referred to as the "Member State"), the address of the residence registered in the passport, the national identity card or any other similar official document issued or recognised by another Member State;
(e) particulars identifying the person, in the case of a natural person, the name and, where applicable, the name, surname, place of residence and date of birth, and, in the case of a legal person, the name, address and identification number of the person, if any; and
(f) collectors' activities consisting of the collection and storage of weapons, their essential parts or ammunition for historical, cultural, scientific, technical, educational or historical purposes.

CATEGORISATION OF WEAPONS AND STRENGTH
§ 4
Weapons and ammunition categories
(1) Weapons are divided into weapons
(a) categories R1, R2, R3 and R4 subject to registration; arms of categories R1 and R2 are prohibited weapons,
(b) the categories of PO subject to notification; and
(c) category NO not subject to notification.
(2) The ammunition is divided into prohibited ammunition of categories S1 and S2 and other ammunition of categories S3 and S4.
(3) The categories of different types of weapons and ammunition are set out in Annex 2 to this Act.
§ 5
Principles for the categorisation of weapons and ammunition
(1) Weapons or ammunition to which different categories can be assigned on the basis of design characteristics or functional principles shall be assigned the category which is most strictly regulated by those categories; This does not apply to weapons of historic or inactive origin.
(2) A firearm which is not listed in Annex 2 to this Act is of the same category as that listed in Annex 2 to this Act, which is closest to its design, function or purpose and effect.
§ 6
Additional technical conditions for the classification of the weapon as PO and NO categories
(1) A weapon which would otherwise be regarded as a category PO or NO, based on structural characteristics or functional principle, but resulting from irreversible modification of a weapon subject to registration, is a weapon of the same category as the weapon subject to registration from which it was modified; This does not apply in the case of a degraded weapon and a cutting of weapons which comply with the requirements of this law.
(2) The Government has, by regulation, established technical requirements for the production of weapons of category PO or NO in order to exclude the possibility of their modification to weapons subject to registration.
(3) A weapon which does not comply with the technical requirements laid down in the Government Decree pursuant to paragraph 2, § 94 (1) or § 95 (1) shall be a weapon subject to registration and shall be classified in the category on the basis of Article 5.

GENERAL PROVISIONS ON THE LOAD WITH BRANCH AND SILENCE
§ 7
Authorisation to dispose of weapons
The person authorised to dispose of weapons under the conditions laid down in this Act shall be:
(a) R1
1. holder of the ZL1 arms licence;
2. the holder of a ZL2 arms licence to which a category R1 exemption has been granted for the handling of each such weapon;
3. the person authorised to carry out the cross-border transfer of such a weapon; or
4. an unexcluded public body which has been authorised by the Police Presidium of the Czech Republic ("Police Presidium") to the extent that such arms are handled,
(b) R2
1. holder of the ZL1 arms licence;
2. the holder of the arms licence or the holder of the ZL2 arms licence to whom a category R2 exemption has been granted for the handling of each such weapon;
3. the person authorised to carry out the cross-border transfer of such a weapon; or
4. a non-exempted public-law institution which has given consent to the Police Presidium to the extent that such arms are handled;
(c) R3
1. holder of the ZL1 arms licence;
2. the holder of an arms licence or the holder of a ZL2 arms licence issued for the handling of each such weapon of category R3 authorisation;
3. the person authorised to carry out the cross-border transfer of such a weapon; or
4. a non-exempted public-law institution which has given consent to the Police Presidium to the extent that such arms are handled;
(d) R4
1. holder of an arms licence;
2. holder of a weapons licence;
3. the person authorised to carry out the cross-border transfer of such a weapon; or
4. a non-exempted public-law institution which has given consent to the Police Presidium to the extent that such arms are handled;
(e) PO
1. the holder of an authorisation to dispose of weapons of category PO entered in the Central Arms Register (hereinafter referred to as "the registered authorisation");
2. holder of an arms licence;
3. holder of the arms licence;
4. a person authorised to carry out a cross-border transfer of such a weapon; or
5. an undrawn public body; or
(f) NO
1. a fully competent adult natural person who has a place of residence in the Czech Republic,
2. a legal person having its registered office or plant in the Czech Republic,
3. holder of an arms licence;
4. holder of a weapons licence;
5. a person authorised to carry out a cross-border transfer of such a weapon; or
6. an undrawn public institution.
§ 8
Authorisation to dispose of ammunition
The person entitled to dispose of ammunition under the conditions laid down in this law shall be:
(a) S1
1. holder of the ZL1 arms licence;
2. the holder of a ZL2 arms licence to which a category S1 exemption has been granted for the handling of a number of such ammunition;
3. a person authorised to carry out a cross-border transfer of such ammunition; or
4. a non-exempted public-law institution which has given its consent to the Police Presidium to the extent that such ammunition is handled;
(b) S2
1. holder of the ZL1 arms licence;
2. the holder of the arms licence or the holder of the ZL2 arms licence to which a category S2 exemption has been granted;
3. a person authorised to carry out a cross-border transfer of such ammunition; or
4. a non-exempted public-law institution which has given its consent to the Police Presidium to the extent that such ammunition is handled;
(c) S3
1. the person referred to in § 7 (a) to (d);
2. the person referred to in § 7 (e) or (f) handling a weapon of category PO or NO intended for the use of such ammunition;
3. a person authorised to carry out a cross-border transfer of such ammunition; or
4. a non-exempted public-law institution which has given its consent to the Police Presidium to the extent that such ammunition is handled; or
(d) S4
1. a fully competent adult natural person who has a place of residence in the Czech Republic,
2. a legal person having its registered office or plant in the Czech Republic,
3. holder of an arms licence;
4. holder of a weapons licence;
5. a person authorised to carry out a cross-border transfer of such ammunition; or
6. an undrawn public institution.
§ 9
Authorisation to dispose of regulated weapons components
(1) The provisions on the disposal of the essential part of the weapon as a separate item shall apply to the handling of the essential part of the weapon, the main part of which is or is intended to be part. If the main part of the weapon can be used in weapons of different categories and if the category of the particular main part is not determined according to the first sentence, the provisions on the weapon of the category for which that main part of the weapon is originally or usually intended shall apply to the handling of the weapon.
(2) Only a person authorised to dispose of an automatic weapon of the relevant category may be treated with a weapon allowing automatic firing.
(3) Only the licence holder or the person authorised to carry out the cross-border transfer of such a semi-finished vehicle may dispose of the main part of the weapon intended for the manufacture of the main part of the weapon subject to registration.
(4) The provisions on the handling of R4 arms shall apply to the handling of the silencer.
(5) Unless otherwise provided for in this law, the provisions on ammunition of category S2 shall apply mutatis mutandis to the handling of the above-limit container.
§ 10
Some restrictions on the authorisation to dispose of weapons and ammunition
(1) An arms and ammunition dealer shall be entitled to dispose of weapons subject to registration, of PO-category weapons or of ammunition of category S1, S2 or S3 in the manner specified in Paragraph 37 (3) only if he holds a ZL1 arms licence.
(2) An arms and ammunition dealer shall be entitled to dispose of arms of category NO or S4 in the manner referred to in Paragraph 37 (3) only if he holds an arms licence; This restriction does not apply to expansion devices and to such devices designed for cartridges.
(3) A self-loading firearm intended for single ammunition with a central fire in which an above-limit magazine is inserted shall be entitled to be handled by the holder of the arms licence or by the holder of the ZL2 arms licence on the basis of an exemption of category R2 or an exemption of category S2 issued for above-limit tanks.
(4) The acquisition of weapons subject to registration, PO-category weapons, NO-category firearms and ammunition by means of remote consumer contracts shall be prohibited.
§ 11
General obligations for arms and ammunition management
(1) Everyone is obliged
a) present at the call
1. The police of the Czech Republic (hereinafter referred to as "the police") shall have the arms or ammunition which they dispose of, or the associated documents and documents, or
2. The Ministry of Defence has a particularly effective weapon covered by the international control regime, as well as related documents and documents,
(b) notify without delay:
1. to the police, the loss or theft of a weapon, if it is a weapon subject to registration or a category PO weapon,
2. the Ministry of Defence has a particularly effective weapon accident which it handles and is subject to an international control regime where the destruction of such a weapon or its essential component is caused by the accident; or
3. Police use a weapon to fire in extreme emergency or necessary defence,
(c) to fire from the weapon he is handling only in places where he is entitled to do so under this law or under any other legislation;
(d) comply with the organiser's instructions at the site of the action involving arms and ammunition, aimed at ensuring safe handling of arms and ammunition;
(e) comply with the operating rules of the shooting range and follow the instructions of the shooting range administrator to ensure safe handling of weapons and ammunition;
(f) to undergo an examination under the Law on the protection of health against harmful effects of addicts when dealing with arms or ammunition to determine whether it is affected by alcohol or other substance;
(g) in the event that he holds a European arms passport, report without undue delay his loss or theft to the Regional Police Directorate; and
h) notify the police at the border crossing in accordance with the State Border Protection Act that they travel with a gun or ammunition.
(2) Everyone is also obliged
(a) to declare the acquisition and transfer of a weapon or to keep a specified record pursuant to § 70 to 76;
(b) to carry a weapon or ammunition or to display it in public only under the conditions laid down in Sections 80 to 82;
(c) to secure, in accordance with Sections 83 and 84, arms and ammunition against misuse, loss and theft, unless it is under its immediate control;
(d) ensure, in accordance with Sections 86 to 96, compliance with the rules on the marking of arms and ammunition, the provision of the activities of the holder of the arms licence by authorised persons and their regular training, production, irreversible treatment, destruction and manufacture of weapons cuts and ammunition management rules for its development, manufacture, overtaking, delaboration, degradation, cutting or destruction;
(e) comply with the obligations laid down in the directly applicable European Union provisions on the destruction of firearms when dealing with degraded weapons;
(f) in ensuring the transport of arms or ammunition, proceed in accordance with § 111 to 113;
(g) proceed when finding a weapon or ammunition in accordance with Sections 115 and 116;
(h) ensure the destruction of a weapon only in accordance with § 117;
(i) to allow preventive measures to be taken and to comply with the obligations imposed under Sections 122 to 124;
(j) in the event of suspension or termination of the authorisation to dispose of the weapon or ammunition to surrender the weapon and ammunition to the Regional Police Directorate or to allow it to take over or secure it at the site of the existing deposit in accordance with Section 125; and
(k) implement and comply with the remedies imposed on him under Paragraph 140.
(3) No one may:
(a) dispose of arms or ammunition, unless it is authorised to do so;
(b) transfer or otherwise permit the disposal of a person not authorised to do so;
(c) to make available on the market a weapon or ammunition as a weapon or ammunition of a category other than that corresponding to their structural characteristics or functional principle;
(d) dispose of arms or ammunition by endangering the life, health or property of another person by:
1. does not take extreme precautions appropriate to the nature and condition of the weapon or ammunition; or
2. Manipulates a weapon or ammunition under the influence of alcohol or other addictive substances, or if its ability to safely dispose of the weapon or ammunition is reduced by the use of medicines or as a result of its health,
(e) to shoot or carry a weapon under the influence of alcohol or other addictive substances, or if its ability to safely dispose of the weapon or ammunition is reduced by the use of medicines or as a result of its medical condition;
(f) without authorisation to operate a shooting range the operation of which is subject to authorisation under this law;
(g) carry a weapon subject to registration which has not been registered, not for a weapon left by the holder of the ZL1 arms licence;
(h) in any way to disseminate or further provide by the Ministry written tests designed to verify professional competence under this Act;
(i) carry out cross-border transfers of arms or ammunition in breach of this law or other legislation; and
(j) endanger the life, health or property of another person as a result of the use of a weapon or ammunition in a poor technical condition or of a weapon or ammunition which does not comply with the requirements of the Law on the Verification of Weapons and Weapons.

Armory authorisation

Types of weapons authorisation
§ 12
(1) The arms authorisation is general or extended. If such a law or other legislation requires a natural person to have an armaments permit and does not provide that it must be an extended arms licence, a general weapons licence shall suffice.
(2) The extended weapons authorisation also includes general weapons authorisation. Extended weapons authorisation is required under this law
(a) for the performance of the activities of the Examination Commissioner;
(b) for the performance of the activity of the main arms dealer of the holder of a ZL1 or ZL3 arms licence;
(c) carrying a registered weapon; and
(d) for persons carrying out certain tasks of the holder of an arms licence and for whom Article 90 provides.

Conditions of armaments authorisation
§ 13
Terms and conditions of the arms licence and its issue
(1) An armaments authorisation shall be issued by the Regional Police Directorate to an applicant who fulfils the conditions for the issue and possession of the arms authorisation of the species concerned (hereinafter referred to as the terms of the arms authorisation). The terms of the arms licence shall be met by a natural person who:
(a) has a place of residence in the Czech Republic;
(b) reach a specified age;
(c) is fully competent, if not for the issue of an armaments authorisation under Paragraph 14 (1) (a);
(d) is medically fit;
(e) is fair and reliable; and
(f) is competent.
(2) The Regional Directorate of Police may, in order to protect internal order or security, refuse an application for an authorisation to issue arms, even if the conditions referred to in paragraph 1 are met if the applicant is an alien who is not:
(a) a citizen of a Member State;
(b) a citizen of a Member State of the North Atlantic Treaty Organisation;
(c) a family member of a citizen of a Member State to whom a residence card, residence card or residence permit has been issued;
(d) a stranger who has been granted permanent residence in the territory of the Czech Republic and has been granted a long-term resident status in the European Community in the territory of the Czech Republic or a stranger who has been granted such status in the territory of another Member State and has been granted a long-term residence permit in the territory of the Czech Republic,
