DECLARATION
Ministry of Industry and Trade
of 12 April 1994
implementing certain provisions of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material and supplementing Act No. 455 / 1991 Coll., on Business Business (Trade Act), as amended, and Act No. 140 / 1961 Coll., as amended
The Ministry of Industry and Trade provides pursuant to Article 33 of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material and on the Addition of Act No. 455 / / 1991 Coll., on Business Business (Trade Code), as amended, and Act No. 140 / 1961 Coll., Criminal Act, as amended ("Act '), in agreement with the Ministry of Foreign Affairs, the Ministry of Defence and the Ministry of Interior:
The list of military equipment referred to in Section 5 (4) of the Act is set out in Annex 1 to this Decree.
The relevant military material under Section 20 (4) of the Act is listed in Annex 2 to this Decree.
The model of the application for authorisation to trade in military material pursuant to Article 9 (5) of the Act is set out in Annex 3 to this Decree.
The model of the licence application pursuant to Section 15 (4) of the Act is set out in Annex 4 to this Decree.
This decree shall take effect on the day of its publication.

LIST OF MILITARY MATERIALS (hereinafter referred to as "SVM ')
SVM 1
Weapons and specially designed components therefor
(a) rifles, carbines, revolvers, pistols, automatic pistols, machine guns and machine guns, with the exception of weapons manufactured before 1890 and their replica
(b) Smooth weapons specially designed for military use
(c) weapons using non-combat ammunition
Technical Note
Smooth weapons specially designed for military use [as specified in subheading (b) above] are those which:
(a) are tested at pressures above 1300 bar; and
(b) operate normally and safely at pressures above 1000 bar; and
(c) they may use ammunition of more than 76,2 mm (i.e. 12 calibre).
Parameters according to this technical note shall be measured according to CIP standards (Commision internationale permanent)
Notes:
This item does not cover the following weapons and components:
1. weapons not capable of full automatic firing and meeting the following additional conditions:
(a) arms with grooved main, specially designed for sporting shooting as defined by the rules of the UIT (International Shooting Federation)
(b) arms with grooved main, specially designed for hunting purposes, having a magazine not exceeding 5 rounds
(c) multi-barrel hunting weapons having one or more grooved main and at least one smooth barrel
2. smooth-bore weapons of a kind used for hunting or sporting purposes. These weapons shall not be specially designed or modified for military use or of a fully automatic type
3. firearms specially designed for training ammunition not capable of firing with sharp ammunition
4. firearms not using medium-fire ammunition and not fully automatic
5. revolvers, non-fully automatic pistols and parts thereof intended for retail sale in the importing country
SVM 2
Large-scale equipment or weapons and projectors and specially designed components therefor
a) cannons, howitzers, canes, mortars, tank shooters, projectile shooters, military flamethrowers, gliders
(b) military smoke, gas and pyrotechnic devices and their developers
Note: this subheading does not cover signal pistols
SVM 3
Ammo and specially designed components therefor for the weapons specified in SVM 1, SVM 2 and SVM 23.
Notes:
1. specially designed components means:
(a) metal or plastic products, such as spools, ball bowls, hub cells, rotary tapes and metal parts of ammunition
b) safety and safety devices, detonators, sensors and connections of the explosive bridge
(c) sources of high one-off operational performance
(d) flaming casings
(e) parts of ammunition, including cassette ammunition and guided projectiles, with the exception of parts of ammunition using exclusively lead core
2. this subheading does not cover ammunition and components thereof, provided that they are intended for weapons within the meaning of Notes 1 to 5 of the entry SVM 1
SVM 4
Bombs, torpedoes, missiles and missiles and specially designed components therefor
(a) bombs, torpedoes, grenades (including smoke grenades), smoke tanks, rockets, mines, missiles, depth charges, incendiary bombs and military demolition charges, equipment and sets, pyrotechnic light signalling equipment for military use, cartridges and simulators
(b) instruments and apparatus specially designed for handling, controlling, activating, driven by a single operational power, erasure, laying, extraction, removal, detonation or detection of the items specified in subheading (a);
Note:
This item includes the following:
a. Mobile liquefaction devices, specially designed for military use, capable of producing 1000 kg or more gas in liquid form daily
b. Floating electroconductive cables suitable for magnetic mines
(c) nozzles of tactical missiles and the front of strategically returnees and their fine-grained artificial graphite having all of the following characteristics:
1. a density of 1,79 or more (measured at 293 K)
2. tensile strength to damage 0,7% or more (measured at 293 K)
3. heat expansion coefficient 2,75 x 106 or less to 1 Kelvin (range 293 - 1255 K)
(d) military fuel thickeners, including compounds (such as octal) or mixtures of such compounds (such as napalm), specifically formed for the purpose of producing materials which, when added to petroleum products, produce a gel-type ignition material for use in bombs, projectiles, flame throwers or other war vehicles
SVM 5
Fire control systems and sub-systems specially designed for military use, and specially designed components and accessories therefor
(a) fire control, targeting, night vision, missile guidance and target observation equipment
(b) rangefinders, radii, altimeters, targeting devices, detection equipment, recognoscation or identification and sensor integrated devices
(c) electronic, electrooptical, gyroscopic, acoustic and optical sight or observation apparatus
d. Bombing sights, sights, bombing computers, artillery sights and periscopes
SVM 6
Vehicles specially designed or modified for military use and specially designed components therefor
Technical Note
For the purposes of this item, the term "specially designed for military use 'means a structural, electrical or mechanical change involving the replacement of a component, at least one component, specially designed for military use or the addition of at least one such component
(a) tanks and self-propelled guns
(b) armed or armored vehicles or vehicles equipped with a weapon assembly device
(c) armored rail trains
(d) semi-belt vehicles
(e) rescue vehicles
(f) gun carriers and tractors specially designed for towing artillery
(g) ammunition carriers
(h) amphibious and broodable vehicles
i. Mobile repair workshops specially designed for military repair
j. All other vehicles specially designed or modified for military use
Notes:
1. specially designed military material components as specified in this item include:
(a) tyres specially designed to be bulletproof or capable of being used in their emptying, except for types for agricultural, horticultural tractors and agricultural tools
(b) engines for propulsion of vehicles listed in subheadings (a) to (j), specially designed or prepared for military use, including specially designed components therefor
(c) tyre pressure control systems operated from the cab of a moving vehicle, specially designed or modified for military use
d. Large spare hinges specially designed or modified for military use
2. vehicles under sub-heading (j) means tank and heavy artillery landing vehicles, amphibious track-laying vehicles and tractors with high speed
SVM 7
Toxicological agents, tear gas, relevant equipment, components, materials and technology
(a) biological agents, chemicals or radioactive materials prepared for use in war to cause losses on humans, animals or natural products
(b) "tear gases" and "riot agents" shall mean:
1. bromobenzyl cyanide (CR)
2. Chlorobenzylidenemalonitrile (chlorobenzalmalonitrile) (CS)
3. Phenylacyl chloride (CN)
(c) equipment specially designed and intended for the dissemination of products under subheading (a)
(d) equipment specially designed and intended for defence against and detection and identification of products under subheading (a)
(e) components specially designed for equipment specified in subheading (c) or (d);
(f) "biopolymers" specially designed or constructed for the detection and identification of chemical warfare substances specified in (a) and cultures of specific cells capable of producing them;
(g) "biocatalysts" for the decontamination and destruction of chemical warfare substances and biological systems
1. "biocatalysts" specially designed for the decontamination and disposal of chemical warfare substances specified in subheading (a) resulting from direct laboratory selection or genetic modification of biological systems
2. the following biological systems: "pulverising vectors," viruses or cell cultures containing genetic information specific to the production of "biocatalysts" according to (g) (1)
(h) the following technologies:
1. technology for the development, manufacture and use of toxicological agents, the relevant equipment and components specified in subheadings (a) to (e);
2. technologies for the development, production and use of "biopolymers" and cultures of specific cells referred to in subheading (f)
3. techology exclusively for the introduction of "biocatalysts" according to (g) (1) into military support or material
Notes:
1. Subheading (a) also includes O-ethyl- 2-diisopropylaminoethyl methylphosphonite (QL) or methylphosphonyl difluoride (DF)
2. Subheading (d) also includes air treatment equipment specially designed or modified for nuclear biological and chemical filtration
3. subheading (a) does not cover:
(a) cyanochloride
(b) hydrocyanic acid
(c) chlorine
d. Carbonyl chloride (phosgene)
(e) diphosphene (trichloromethyl chloroformate)
(f) ethylbromoacetate
g. Xylylbromide
h. Benzylbromide
(i) benzyl iodide
(j) bromoacetone
(k) Cyanobromide
(l) bromomethyl ethyl ketone
(m) chloracetone
n) ethyliodoacetate
(o) iodoacetone
(p) chloropicrin
4. subheading (d) does not cover:
(a) personal dosimeters for measuring radiation
(b) protective masks against specific industrial hazards such as vapours, smoke or dust in mining, quarrying or chemical equipment; or
(c) gas masks designed for civil use
5. subheading (f) does not cover technologies and cell and microbiological cultures for civil purposes such as agriculture, pharmacy, medicine, veterinary medicine, environmental protection and the food industry.
6. subheadings (h) (3) and (g) (2) do not cover technologies and biological systems for civil purposes such as agriculture, pharmacy, medicine, veterinary medicine, environmental protection, waste management and the food industry.
7. subheading (b) does not cover tear gas intended for retail sale in the importing country
SVM 8
Military explosives and fuels and "additives'," precursors' and "stabilisers' therefor
(a) "military explosives"
(b) "military propellants"
(c) "military pyrotechnics":
(d) military high energy solid or liquid fuels including aviation fuels of special military composition
Note: this subheading covers only finished products and not their constituents
Notes:
1. "Military explosives," "military propellants" and "military pyrotechnic devices" include substances and mixtures containing:
(a) spherical aluminium powder with a grain size of 60 micrometres or less, made of material containing 99% or more of aluminium (see also category 1.E.1. of Decree No. 50 / 1992 Coll., as amended by Decree No. 505 / 1992 Coll. - "Annex to Decree No. 505 / 1992 Coll.")
(b) metal fuels with a grain size of less than 60 micrometres, whether spherical, atomised, spherical, flaked or ground, made of material containing 99% or more zirconium, boron, magnesium and their alloys, beryllium or powder iron with an average particle size of 3 micrometres or less, produced by reduction of iron oxide by hydrogen
(c) chlorates, hypochlorites and chromates mixed with metal powder or other high energy fuel components
(d) nitroguanidine (NQ)
(e) compounds containing fluorine and one or more of the following elements: other halogens, oxygen, nitrogen
(f) carbonates, decarbonates, pentaboranes and their derivatives
(g) cyclotetramethylene tetranitrozoamine (HMX), octahydro-1,3,5,7-tetranitro-1,3,5,7-tetrazine, 1,3,5,7-tetranitro-1,3,5,7-tetrazacyclooctane (Octogen)
(h) hexanitrostilbene
(i) diaminotrinitrobenzene (DATB)
j. Triaminotrinitrobenzene (TATB)
k. Triaminoguanidinnitrate (TAGN)
(l) any explosive with a detonation speed exceeding 8 700 m / s or a detonation pressure exceeding 34 GPa
(m) other organic high explosive explosives not listed in these notes, giving a detonation pressure of 25 GPa or more and stable at 250 ° C or more for 5 minutes or longer
n) Titanium - Subhydrate for stoichiometry TiH 0,65- 1,68
o) dinitroglycoluril (DNGU, DINGU), tetranitroglycoluril (TNGU, SORGUYL)
(p) any other solid propellant of UN 1.1 class not specified in these notes with a theoretical specific impulse (under standard conditions) of more than 250 seconds for metal-free substances and more than 270 seconds for aluminium-containing mixtures
q) any other solid propellant of UN Class 1.3 with a theoretical specific impulse of more than 230 seconds non-halogenated, 250 seconds metal-free and 266 seconds for metal-containing mixtures
(r) tetranitrodibenzotriazotetrapentalene (2,4,8,10-tetranitrodibenzo- 1,3a, 4,6-tetrazapentalene) (TACOT)
s) diaminohexanitrodiphenyl (DIPAM)

u) 3-nitro-1,2,4-triazol-5-one (NTO or ONTA)
(v) hydrazine 70% or more, hydrazine nitrate, hydrazine perchlorate, unsymmetrical dimethylhydrazine, monomethyl hydrazine, symmetrical dimethylhydrazine
w) Ammonium perchlorate
x) cyclotrimethylenetrinitramine (RDX), cyclonite, T4, hexahydro-1,3,5-trinitro-1,3,5-triazine, 1,3,5-trinitro-1,3,5-triazacyclohexane (hexogen)
y) hydroxylammonium nitrate, hydroxylammonium perchlorate (HAN, HAP)
(z) any propellant, other than those mentioned in these notes, having a specified force coefficient of more than 1 200 kJ / kg
(aa) any other explosives, propellants or pyrotechnic devices not specified in these notes which may maintain a continuous linear burning rate of more than 38 mm per second under normal pressure conditions of 68,9 bar and a temperature of 21 ° C
(bb) an elastomer treated with an emCDB with an expansion capacity of more than 5% at -40 ° C at maximum stress
