DECLARATION
of 30 April 2014
amending Decree No. 252 / 2004 Coll., laying down the hygiene requirements for drinking and hot water and the frequency and scope of control of drinking water, as amended
The Ministry of Health provides, pursuant to Article 108 (1) of Act No. 258 / 2000 Coll., on the Protection of Public Health and on the Amendment of Certain Related Acts, as amended by Act No. 274 / 2001 Coll., Act No. 320 / 2002 Coll., Act No. 274 / 2003 Coll., Act No. 392 / 2005 Coll., Act No. 222 / 2006 Coll., Act No. 151 / 2011 Coll. and Act No. 223 / 2013 Coll., ("Act No. 120 / 2008 Coll.,") for the implementation of § 3 paragraphs 1 and 3 and § 4 Sb., Act No. 146 / 2002 Coll., Act No. 274.
Čl. I
Decree No. 252 / 2004 Coll., laying down hygiene requirements for drinking and hot water and the frequency and scope of control of drinking water, as amended by Decree No. 187 / 2005 Coll. and Decree No. 293 / 2006 Coll., is amended as follows:
1. in Article 2 (b), the word "organoleptic" and the words "their natural components or operational parameters," shall be deleted;
2. in Article 2, point (e) is deleted;
Points (f) to (i) shall be renumbered as points (e) to (h).
3. In Section 3, the sentence after the third sentence is inserted: "For crude or drinking waters where the calcium or magnesium content is artificially reduced during treatment, the magnesium content shall not be less than 10 mg / l and the calcium content shall not be less than 30 mg / l after adjustment. '
4. In Article 4 (2) (c), the words "for sources with a minimum frequency of analysis and seasonal operation of up to 6 months, which are operated in accordance with § 3 (2) (a) to (d) of the Act," shall be inserted after the words "water."
5. In Article 6 (2), "12 'is replaced by" 6', after the word "indicator 'the word" intestinal' is inserted and "2 complete analyses' is replaced by" 1 complete analysis'.
6. In Article 7, the following paragraph 3 is added, including footnote 10:
"(3) Demonstration that the results of another method, not listed in Section A of Annex 6, are at least as reliable as the results of the laboratory method, the application of which is provided for in this Decree, shall be carried out by the method set out in the technical standard setting out the criteria for the equivalence of the two microbiological methods (10).

7. in the second sentence of Paragraph 8 (1) (c), the word "Further" shall be replaced by the words "Packed drinking water for sale" and the word "Next" shall be inserted after the word "Be."
8. Paragraph 10 (1) is deleted.
Paragraphs 2 and 3 shall be renumbered paragraphs 1 and 2.
9. Annex 1 shall read as follows:

Explanatory notes to the tables:
1. It is determined for drinking water treated directly from surface water or for groundwater affected by surface water. Where the value of this indicator is not complied with, the water source and the adaptation technology shall be examined to determine whether human health is potentially at risk from the presence of pathogenic micro-organisms, such as cryptosporidium in particular. Article 4 (5) of the Act provides for a responsible person's procedure.
2. Applies only to bottled drinking water.
3. Other information obtained in the microscopic analysis may contribute to the interpretation of the results is an integral part of the test result. This verbal description includes, in particular, the composition of the abioseston present (possibly its possible origin), the closer classification of the organisms present and their possible origin (raw water, network reproduction), their affiliation to difficult to remove groups. In the event of the occurrence of live organisms in waters secured by disinfection, it is always necessary to indicate which organisms were involved. In the case of groundwater, the presence of surface water-bound organisms and organisms indicating impaired water quality shall be recorded. Underground water with the presence of surface water-bound organisms must be considered as surface water-affected groundwater (see explanatory note 1).
4. Organisms covered by this indicator are for the purpose of the decree, the sinuses and all eukaryonic organisms (e.g. algae, protozoa, micromycetes, swirlers, tubers). Bacteria (with the exception of sinuses) are given only in the word description but are not counted in the total number of organisms. The microscopic finding of the mass occurrence of organotrophic bacteria (more than 100 individuals / ml) should be considered as exceeding the MH of indicators 6 and 7 respectively. The products of ferric bacteria metabolism are among the asosestone.
5. The limit shall apply only to water-protected disinfectants. Live organisms containing chlorophyll are distinguished by the autofluorescence of chlorophyll. Other, if possible, according to other characters such as especially movement, state of the protoplastic.
6. If it is not possible for a small number of samples to determine if this is an abnormal change for the supplied area, the limit value 200 cfu / ml shall apply.
7. For replacement supplies, for water supplied in air, water and land vehicles and for water from small undisinfected sources producing less than 5 m3 per day, the recommended value shall be up to 500 cfu / ml.
8. If it is not possible for a small number of samples to determine if this is an abnormal change for the supplied area, the limit of 40 cfu / ml shall apply.
9. For replacement supplies, for water supplied in air, water and land vehicles and for water from small undisinfected sources producing less than 5 m3 per day, the recommended value shall be up to 100 cfu / ml.
10. The value applies to the residual concentration of monomer (s), calculated on the basis of the content and possible release from materials (for example, the distribution line) and articles used for the treatment, manufacture and distribution of drinking water which are in contact with drinking water. The determination in drinking water shall be made only if it is not possible to calculate and the substance may be present in water due to the materials used. However, the determination of chlorothene (vinyl chloride) shall also be carried out on new sources before they are put into service.
11. For the determination of benzene, it is necessary to monitor the presence of other aromatic hydrocarbons (toluene, xylenes, ethylbenzene) unless indicated. Attention should be paid to finding these substances. In the case of quantitative determination, findings of specified substances shall be included in the test report.
12. It is always determined at a new source and further where the findings of Be exceed 30% of the limit value.
13. Where possible without reducing the effectiveness of disinfection, efforts should be made to achieve the lowest possible level.
14. No abnormal changes. It may not be determined for sources supplying less than 10,000 m3 of water per day.
15. The condition that the sum of the nitrate content determined in mg / l divided by 50 and the nitrite content determined in mg / l divided by 3 is less than or equal to 1 shall be respected. The sum of ratios corresponds to the highest limit value of its importance. The nitrite content in drinking water at the outlet of the plant shall be less than 0,1 mg / l.
16. Valid as a minimum in the case referred to in § 3 (1). For all waters, where possible, the recommended value should be sought.
17. No abnormal changes. It does not need to be determined if the TOC content (total organic carbon) is determined.
18. The content of free chlorine, chlorites or ozone is only determined when chlorine or products containing chlorine, chloride oxide or ozone are used for water treatment. Water disinfection is also considered to be an adjustment. In the case of the use of bound active chlorine (for example in the form of chloramines) for disinfecting, the limit value of 0,4 mg / l for total active chlorine applies.
19. In cases where higher levels of chlorides are caused by a geological environment, values up to 250 mg / l are considered to comply with the requirements of this Decree. For packaged drinking water artificially supplemented with minerals, the limit value 250 mg / l applies.
20. Water should not act aggressively against materials of the distribution system, including home installations. The assessment of aggressiveness shall be carried out according to TNV 75 7121.
21. In case of doubt during sensory evaluation, threshold numbers 1 and 2 are considered acceptable when determined according to ČSN EN 1622 Water quality. Determination of the odour threshold number (TON) and taste threshold number (TFN).
22. Measured at 25 ° C.
23. In cases where higher levels of manganese in the raw water source are caused by a geological environment, the values of manganese up to 0,10 mg / l shall be considered to satisfy the requirements of this Decree provided that there is no undue influence on the organoleptic properties of the water.
24. The limit value shall be determined on the basis of the toxic effect of copper and shall apply to a sample of drinking water taken by the corresponding sampling method from the faucet so that the sample is representative of the average one-week quantity consumed by the consumer. There may be changes in organoleptic properties of water at concentrations above 100 µg / l. For the control of the quality of drinking water referred to in Section 4, a random sampling method shall be used during the working day, consisting of the collection of the first 1000 ml of tap water (without cleaning the tap and without prior water dissolution or water sampling to determine other parameters). If an excess of the limit value is found during this sampling and it is demonstrated that the internal water supply is impaired, a purpose sampling shall be carried out to determine the average concentration of the substance consumed by the consumer within one week.
25. It is determined for drinking water treated from surface water during a period where an increased incidence of sinuses can be expected. Where a person referred to in Article 3 (2) of the Act indicates an appropriate procedure to ensure that the possible presence of cyanotoxins in drinking water is captured and effective measures are subsequently taken to prevent public health risks, the public health authority shall restrict or delete the frequency of the determination.
26. The limit shall apply to a sample of drinking water taken by the corresponding tap sampling method so that the sample is representative of the average one-week quantity consumed by the consumer. For the control of the quality of drinking water referred to in Section 4, a random sampling method shall be used during the working day, consisting of the collection of the first 1000 ml of tap water (without cleaning the tap and without prior water dissolution or water sampling to determine other parameters). If an excess of the limit value is found during this sampling and it is demonstrated that the internal water supply is impaired, a purpose sampling shall be carried out to determine the average concentration of the substance consumed by the consumer within one week.
27. Pesticides are organic insecticides, herbicides, fungicides, nematicides, acaricides, algicides, rodenticides, slimicides, related products (e.g. growth regulators) and their relevant metabolites, breakdown or reaction products. Only pesticides likely to occur in a given source are to be determined, and the absence of pesticide substances is justified.
28. The limit applies to each individual pesticide except for aldrin, dieldrin, heptachlor and heptachlor epoxide, where a limit value of 0,03 µg / l applies.
29. The limit shall apply to the sum of the individual specified and quantitatively identified pesticide substances. If the substance is not quantitatively detected, zero is added to the sum.
30. The limit applies to the sum of quantitatively defined specific substances: benzo [b] fluoranthene, benzo [k] fluoranthene, benzo [ghi] perylene, indeno [1,2,3-cd] pyrene. If other polyaromatic hydrocarbon types are established, their value cannot be included in the PAH indicator.
31. For bottled non-carbonated drinking water and for drinking water transported by containers, pH values from 4,5 may be allowed; for packaged drinking water which is naturally rich or artificially enriched with carbon dioxide, the minimum value may be lower. For waters with naturally lower pH, pH values of 6,0 to 6,5 shall be considered as meeting the requirements of this Decree provided that the water does not act aggressively against the materials of the distribution system.
32. It concerns waters disinfected with silver salts and waters treated with silver containing devices.
33. The sum of tetrachloroethane and trichloroethane concentrations must not exceed 10 µg / l.
34. The limit applies to the sum of quantitatively identified concentrations of trichloromethane (chloroform), tribromomethane (bromoform), dibromochloromethane and bromodichloromethane. If the substance is not quantitatively detected, zero is added to the sum. Where possible without reducing the effectiveness of disinfection, efforts should be made to achieve the lowest possible level.
35. In cases of surface water treatment, water resulting from the treatment plant should not exceed 1,0 PLN. The unit shall be indicated according to the method used to determine: F (t) or F (n), where t stands for a turbidimetric and n non-phelometric method.
36. In cases where higher iron values in the source of the crude value are caused by a geological environment, values of iron up to 0,50 mg / l shall be considered to comply with the requirements of this Decree, provided that there is no undue influence on organoleptic properties of water, even in the form of occasional visible opacity. ';
10. In Annex 2, in the table of Microbiological, Biological, Physical, Chemical and Organoleptic Hot Water Indicators referred to in Section 3 (3) of the Act and their hygiene limits, the word "pneumophila 'in rows 1 and 2 is replaced by the word" spp.'.
11. In Annex 2, in the table of Microbiological, Biological, Physical, Chemical and Organoleptic Hot Water Indicators referred to in Article 3 (3) of the Act and their hygiene limits, the words "microg / l 'are replaced by" µg / l' in row 16.

Explanatory notes:
1. The limit applies to the sum of the following species of atypical mycobacteria: Mycobacterium chelonae, M. kansasii, M. avium, M. intracellulare, M. crophulaceum, M. xenopi, M. fortunitum.
2. The Legionella spp. test need not be carried out when heating is performed at the point of consumption, as in particular by a flow heater.
3. Indicators shall be determined only in the case of hot water production from a source of surface water or mine water, with central heating and distribution.
4. In case of doubt in sensory determination, threshold numbers 1 and 2 are considered acceptable in the determination according to ČSN EN 1622 Water quality. Determination of the odour threshold number (TON) and taste threshold number (TFN).
