of 16 February 2021
amending Decree No 54 / 2004 Coll., on foodstuffs intended for particular nutritional uses and their method of use, as amended
According to Article 19 (1) (a) and (i) of Act No. 110 / 1997 Coll., on Food and Tobacco Products, and amending and supplementing certain related laws, as amended by Act No. 306 / 2000 Coll., Act No. 274 / 2003 Coll., Act No. 316 / 2004 Coll., Act No. 120 / 2008 Coll., Act No. 139 / 2014 Coll. and Act No. 180 / 2016 Coll.:
Decree No. 54 / 2004 Coll., on foods intended for particular nutritional uses and their method of use, as amended by Decree No. 402 / 2006 Coll., Decree No. 473 / 2006 Coll., Decree No. 157 / 2008 Coll., Decree No. 35 / 2012 Coll., Decree No. 46 / 2014 Coll. and Decree No. 39 / 2018 Coll., are amended as follows:
1. footnote 1 shall read:
"(1) Commission Directive 2006 / 125 / EC of 5 December 2006 on processed cereal-based foods and baby foods for infants and young children (codified version)."

For the purposes of this decree, the following categories of food are distinguished:
(a) baby formula,
(b) processed cereal-based foods and food for young children;
(c) low-lactose or lactose-free foods. "
3. The heading of Part Two reads "MILK EDUCATION OF SMALL CHILDREN '.

Requirements for the composition of baby formula
(1) The requirements for the use of vitamins, minerals and other substances are laid down in Annex 3 to this Decree.
(2) The directly applicable European Union regulation laying down specifications for food additives 1e shall apply mutatis mutandis to the purity requirements of the substances listed in Annex 3 to this Regulation.
(3) Milk formula for young children
(a) contain food additives only according to the directly applicable European Union Regulation on food additives (2);
(b) meet the microbiological requirements laid down directly by the European Union Regulation on microbiological criteria for foodstuffs (3);
(c) shall not contain pesticide residues in excess of 0,01 mg / kg of the product as offered for consumption or after recovery as specified by the manufacturer, for each individual pesticide.
(4) Agricultural products treated with pesticides as provided for in Annex 11 to this Decree shall not be used for the manufacture of dairy products for young children. In so doing, a product in which:
(a) the pesticide residue content as modified in Table 1 of Annex No 11 to this Regulation shall not exceed 0,003 mg / kg, which is considered to be the limit of determination when establishing generally acceptable standard test methods;
(b) the pesticide residue content listed in Table 2 of Annex No 11 to this Decree does not exceed 0,003 mg / kg, which is considered a limit of determination when establishing generally acceptable standard test methods.
(5) For the production of dairy products for young children, the specific maximum levels for pesticide residues or metabolites of pesticides listed in Annex 12 to this Regulation shall be complied with.
(6) The pesticide residue content and the specific maximum levels laid down in paragraphs 4 and 5 apply to foodstuffs intended for consumption or prepared for use as specified by the manufacturer. '

Labelling of dairy foods for young children
(1) On the packaging of baby food, it must be indicated:
(a) in the name of the food, the words "dairy baby food," if it is about the nutrition of young children produced exclusively from cow's milk or goat's milk proteins; and
(b) information that food should only be part of a mixed and balanced diet for a small child.
(2) In the case of the dairy diet of young children, the labelling, in addition to the figures for the quantity of vitamins and minerals, may also include the expression of the percentage of the reference value as set out in Table 2 of Annex 5 to this Regulation in 100 ml of the product ready for use as instructed by the manufacturer. '

11. Annex No 4 is deleted.
12. In Annex 5, the heading of Table 2 reads "Milk nutrition for young children '.
13. Annex No 6 shall be deleted;
14. Annex No 14 is deleted.
15. Annex No 15 is deleted.
16. Annex No 16 is deleted.
Transitional provisions
1. If the production and placing on the market of infant formulae and follow-on formulae from hydrolysed proteins is carried out until 21 February 2022 in accordance with Sections 5 and 6, Annexes 1 to 4, 6, 11, 12 and 14 of Decree No. 54 / 2004 Coll., as effective before the date of entry into force of this Decree.
2. Infant formulae and follow-on formulae of hydrolysed protein produced before 22 February 2022 in accordance with Decree No. 54 / 2004 Coll., as effective before the date of entry into force of this Decree, may be marketed after 21 February 2022 until stocks are exhausted.
3. Total diet replacement for weight control produced or labelled before 27 October 2022 in accordance with Decree No. 54 / 2004 Coll., as effective before 27 October 2022, may be marketed after 26 October 2022 until stocks are exhausted.
Efficacy
This Decree shall take effect on the 15th day following its publication, with the exception of points 8 and 15, which shall take effect on 27 October 2022.
