Head of the Central Administration for the Development of the Local Economy
of 10 October 1963
on the organisation of the housing economy of national committees
The Head of the Central Administration for the Development of the Local Economy provides, pursuant to Section 5 of the Legal Measures of the Bureau of the National Assembly No. 1 / 1963 Coll., on the Central Administration for the Development of the Local Economy:
Preliminary provisions
(1) The National Committees ensure, at the same time as the new construction of flats, economic management and proper maintenance of the housing assets they manage.
(2) These tasks shall be carried out by the national committees directly through their housing organisation or, with less housing property, directly.
Organisation of housing
Establishment
(1) The housing organisation shall be set up by a local national committee for the management of residential property within its area of competence, provided that such property includes at least 200 flats and non-residential units.
(2) Only one housing organisation may be set up within the local national committee. For the management of less than 3000 units, the local national committee shall establish a home administration, and for the management of a larger number of units it shall establish a housing business.
(3) The local national committee is responsible for managing housing assets directly (Section 11).
(4) In justified cases, the local national committee may, with the agreement of the district national committee, set up a home administration for the management of residential property comprising less than 200 units, or entrust the management of such residential property to the organisation of the housing business of another local national committee, in agreement with that national committee.
Legal status
Housing organisations are state economic organisations. Their establishment and legal status shall be governed by the rules governing undertakings managed by national committees.
Internal organisation
(1) The internal organisation of the housing business shall be determined by the director of the holding and, at the home administration, by his head, with the agreement of the local national committee. In determining the internal organisation, it shall take into account the scope of the managed residential property, its territorial distribution, its facilities and the condition of houses and apartments, and the way in which it is maintained and repaired. In doing so, he ensures that the management of residential property is as economical as possible.
(2) The housing business may set up establishments to improve direct contact with users of flats.
Tasks
In particular, the task of organising the housing business is to ensure the maintenance, repair and uplifting of the housing property which it manages, to ensure order and cleanliness in the houses and premises belonging thereto, to provide housing users with housing services and to organise the widest possible participation of residents in housing management and maintenance.
Maintenance and repair of residential property
(1) The organisation of the housing holding ensures that they are carried out in a supplier's way, in particular by district (urban) construction enterprises, according to approved investment plans, modernisation and repair of residential property.
(2) Specific rules apply to the planning and financing of repairs of residential property. *)
(3) In order to ensure maintenance and normal, in particular emergency repairs of residential property, the housing organisation creates its own maintenance centres to the extent that there is at least one maintenance operator per 100 flats. In determining the number of maintenance workers, account shall be taken of the housing condition and equipment.
(4) The indicators of the maintenance centre plan are set by the local national committee. The housing organisation manages and controls the work of maintenance workers and is responsible for the quality and economical implementation of repairs.
(5) Maintenance centres are made up of skilled workers, as well as workers from pensioners and disabled persons. Other professional staff may also be involved in maintenance centres, in particular from residents of administered houses, who work in these centres alongside their employment.
(6) The housing organisation may also make small repairs in apartments to be paid by users of flats under the applicable rules.
(7) Maintenance and repair material is allocated to housing organisations taking into account the structure of the work carried out. At the same time, the organization of the housing economy uses up to old materials derived from demolition, adaptation, reconstruction and materials from local sources.
(8) In order to enhance residential property, apartment users may, with the agreement of the housing organisation, carry out self-help work in the maintenance, repair and upbringing of houses and premises belonging to them.
Housing services
(1) The housing organisation ensures order and cleanliness in houses and premises belonging to them, the supply of heat and hot water and other services for apartment users associated with housing.
(2) Order and purity in the houses and premises belonging to them are provided by cleaning staff or other staff under local conditions.
(3) The housing organisation may agree with the apartment users that they will provide order and cleanliness in the houses entirely or partially themselves.
(4) The housing organisation provides, as far as possible, apartment users with other services related to housing, such as painting of flats, renting tools for cleaning and maintenance of flats, storage of food in refrigerators, cleaning of apartments etc.
(5) The housing organisation allows users of laundry apartments in block or home laundry. In principle, however, these services are not performed in a supplier's way.
Participation of residents in housing management and maintenance
Civil commissions and home commissions are created to enhance the participation of residents in housing management and maintenance.
Civil commissions
(1) Civil commissions are set up by local national committees in the organisation of the housing economy in cooperation with civil committees from members of civil committees and home committees (home confidants).
(2) A civil commission shall be set up for housing businesses at its premises.
(3) Members of civil commissions are elected by citizens at public meetings for a maximum period of two years.
(4) The activities of civil commissions are managed by the local national committee through civil committees.
(5) In particular, the Commission shall carry out the following tasks:
- ensure civil control over the activities of housing organisations (establishments) and organise assistance for citizens in the performance of their tasks,
- in cooperation with the civil committees and home councils, ensure the proper maintenance and repair of residential property,
- discuss proposals for an investment plan, modernisation and repair of residential property,
- monitor the development of housing services and ensure that they are properly implemented, particularly in order and cleanliness in houses and in their premises,
- monitor the efficiency of operation of central (remote) heating and hot water supply, in particular compliance with supply standards, supply, fuel management, etc.,
- organise the participation of apartment users in the maintenance and repair of residential property.
Home Commission
(1) The home commission is an asset of the local national committee and representatives of the collective of residents of the home.
(2) The members of the home committee are elected for a maximum period of two years at the home meeting of the residents of the home.
(3) The local national committee shall direct their activities through civil committees.
(4) The home committee shall, in particular, carry out the following tasks:
- address all issues related to housing, in particular repair plans, central (remote) heating and hot water supply, etc.,
- monitor the performance of the duties of cleaning and house staff in the cleaning and cleaning of houses and in the premises belonging thereto,
- encourage users of flats to respect the principles of socialist cohabitation and to treat housing assets with care,
- cooperate with civil commissions and help them to carry out their tasks,
- organize house meetings.
(5) In houses with fewer flats, the home committee is the home confidant.
Direct management of residential property by the National Committee
The provisions on the tasks of housing organisations, in particular in the maintenance and repair of residential property, the provision of housing services and the participation of residents in the management and maintenance of residential property, apply mutatis mutandis to the direct management of residential property by the National Committee (Section 2 (3)).
Financing of housing
Financing of housing organisations
Housing management managed by housing organisations shall be governed by the rules applicable to the management and financing of undertakings managed by national committees. The same rules apply to the relationship of the financing plans of housing organisations to the national committee budget.
Financing of residential property in the direct administration of the local national committee
The revenue and expenditure of the housing sector in the direct administration of the local national committee are directly included in the budget of the local national committee.
Efficacy
This Decree shall take effect on 1 January 1964.
