laying down certain conditions for granting aid for the supply of fruit, vegetables, milk and school products and amending certain related regulations of the Government
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 179 / 2014 Coll.:

ČÁST PRVNÍ

Establishment of certain conditions for granting aid for the supply of fruit, vegetables, milk and school products
§ 1
Subject matter
This Regulation lays down the conditions for granting aid to:
(a) the supply of fruit, vegetables and processed fruit and vegetables to primary school pupils in accordance with the directly applicable Regulation of the European Union19), including the preparatory classes of primary schools or the preparatory stage of specialschools 2) (hereinafter referred to as the School Fruit and Vegetables Scheme),
(b) the supply of milk and milk products to primary school pupils under the directly applicable European Union19), including the preparatory classes of primary schools or the preparatory stage of primary schools of special2) (hereinafter referred to as the School Milk Scheme); and
(c) accompanying educational measures;
(hereinafter referred to as the school project).
§ 2
Objective of aid
(1) The aid provided for in Article 1 is granted for the following products:
(a) fresh fruit and vegetables listed in Parts IX and XI of Annex I to Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended,
(b) packed fruit purges and mixtures of fruit-vegetable purposes17) containing at least 50% of the fruit component (hereinafter referred to as "fruit purposes18" and packaged fruit and vegetable juices 18) listed in Part X of Annex I to Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended, unless they contain preservatives;
(c) drinking milk and its lactose-reduced variants; and
(d) non-flavoured milk products referred to in Article 23 (4) (b) of Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended, which may contain added substances as referred to in the second subparagraph of Article 23 (6) of Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended, in accordance with the limits for salt and fats referred to in Decree No 282 / 2016 Coll., on food requirements for which advertising is permitted and which may be offered for sale and sold in schools and educational establishments, the quantity of added sugar being zero.
(2) Aid shall be granted in addition to the products referred to in paragraph 1 for the accompanying educational measures referred to in Article 3 (1) of Commission Delegated Regulation (EU) 2017 / 40, as amended.
(3) Dairy products listed in Annex V to Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended, may be used for the implementation of the accompanying training measures referred to in paragraph 2.
(4) The products referred to in paragraph 1 shall be delivered free of charge under the school scheme. The accompanying educational measures referred to in paragraph 2 shall also be carried out free of charge in the framework of the school project.
§ 3
National aid
The Czech Republic shall contribute to the school project to the implementation of the support provided for in Article 2 and to the monitoring, evaluation or promotion of the school project by national support provided for in Article 23a (6) of Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended, from the budget chapter of the Ministry of Agriculture through the budget of the State Agricultural Intervention Fund ("the Fund ').
§ 4
Transfer of funds between projects
The Ministry of Agriculture may determine the amount of funding to be transferred between School Fruit and Vegetables and School Milk projects up to 20% of the allocated indicative allocations for each project as referred to in Article 23a (4) (a) or (b) of Regulation (EU) No 1308 / 2013 of the European Parliament and of the Council, as amended.
§ 5
Aid for the supply of products
(1) Amount of aid to be granted for:
(a) 1 piece of fruit or vegetables of a minimum weight of 100 g;
(b) the corresponding number of pieces of fruit or vegetables with a minimum weight of 100 g,
(c) a package of fruit puree with a minimum weight of 100 g,
(d) packages of fruit or vegetable juice with a minimum volume of 200 ml;
(e) packaging of table milk of a minimum volume of 200 ml,
(f) a package of milk product based on fermented milk with a minimum volume of 200 ml,
(g) packing of yoghurt of a minimum weight of 150 g,
(h) a package of sour milk product with a protein content exceeding 5,6% with a minimum weight of 140 g;
(i) a package of curd or fresh cheese of a minimum weight of 80 g; or
(j) packaging of other cheeses weighing not less than 80 g,
(hereinafter referred to as "portion '), is set out in Annexes 1 and 2 to this Regulation, in a distinction by organic products and by number of pupils in school15, on 1 September of the school year concerned.
(2) The applicant is required to include fresh fruit and vegetables or drinking milk in supplies.
(3) The proportion of portions of packaged fruit and vegetable juices and fruit puree may not exceed 25% of the total number of portions of products referred to in Article 2 (1) (a) and (b) delivered to each primary school with which the applicant has a contract to supply the products during the relevant school year.
(4) The share of portions of fruit and vegetable products referred to in § 2 (1) (a) and (b) originating in countries outside the European Union may not exceed 10% (6) of the total number of portions of such products delivered to primary schools with which the applicant has concluded contracts for the supply of products during the relevant school year.
(5) Any packaging of a product or transport packaging in the case of non-packaged products referred to in Article 2 (1) shall bear the inscription "School project '.
(6) The proportion of portions of products referred to in Article 2 (1) originating in organic products13 must be at least 10% of the total number of portions of these products delivered to primary schools with which the applicant has a contract to supply products during the school year concerned.
(7) In the event of failure to comply with the minimum proportion of portions of organic products, the Fund shall reduce the funds for the supply of the products referred to in Article 2 (1) (a) and (b) and the products referred to in Article 2 (1) (c) and (d) corresponding to the approved applicant in the given school year by:
(a) 10% in the case of supplies of products from organic farming of 5% and less than 10%;
(b) 20% in the case of the supply of organic products of less than 5%.
§ 6
Application for approval of an aid applicant
(1) An application for approval of an aid applicant ("application for approval") may be submitted by the person supplying the products pursuant to Article 5 (2) (c) of Commission Delegated Regulation (EU) 2017 / 40 ("the applicant").
(2) The application for approval shall be submitted by the applicant to the Fund on the form issued by him by 28 February of the calendar year if the applicant intends to start supplying the products from the school year beginning in that calendar year.
(3) The application for approval shall include, in addition to the obligations under the directly applicable European Union Regulation (7), the applicant's undertaking to carry out accompanying educational measures and to deliver products under the notification of the Fund on the minimum number of deliveries of products for the month of the school year concerned to each school with which the contract for the supply of products is concluded during the school year referred to in Article 7 (2). The delivery of products means an advance during which the applicant ensures the delivery of a maximum of 2 portions at the same time under the School Fruit and Vegetables Scheme or the School Milk Scheme to every school with which he has a contract to supply the products for the current school year.
(4) The application for approval shall include an indication of the name of the list of products referred to in Article 2 (1) (b) to (d) which the applicant intends to supply to schools. For each such product, the applicant shall indicate:
(a) the name of the manufacturer and, where applicable, the name and surname and, where applicable, the business name and place of permanent residence or name, or business name, and address of the registered office;
(b) mandatory food information 20),
1. name of the food,
2. the list of ingredients; and
3. nutrition information,
(c) a description of the packaging of the milk product supported, including the characteristics of the packaging used;
(d) the method of distribution of the product, including storage conditions; and
(e) in the case of milk and milk products or fruit and vegetable products (17), (18), whether it is a local or regional product, a supply carried out through a short supply chain, comprising not more than one intermediary between the manufacturer of the approved product and the school or a product recognised under the quality scheme in accordance with the directly applicable European Union rules governing agricultural product quality schemes and food 16).
(5) In the case of milk products, the applicant shall accompany the application with a protocol from an accredited laboratory containing an analysis of the salt and fat content of the milk product. In the case of microbiological testing, it is necessary to follow Commission Regulation (EC) No 2073 / 2005 on microbiological criteria for foodstuffs, as amended. In addition, the applicant shall demonstrate compliance with paragraph 4 (e).
(6) Each product included in the application for approval referred to in paragraph 4 shall be accompanied by a preview of the packaging of the product.
(7) The Fund shall approve the applicant if it fulfils the conditions set out in paragraphs 1 to 6. The decision approving the applicant shall include an indication of the products for which it has been approved. The Fund shall publish, in a way that allows remote access, data on the applicant who has been approved as an aid applicant (hereinafter referred to as the "approved applicant ') and the form for applying for a school registration to an approved applicant.
§ 7
Approved applicant
(1) By 30 September of the relevant calendar year of the Fund, the authorised applicant shall deliver, on the form issued by him, information on the number of schools with which he has contracts to supply the products for the current school year and the total number of pupils in those schools, certified by the person authorised to act on behalf of the school. The information shall include a statement from the school that, for the relevant school year, the products are always taken from one approved applicant for the School Fruit and Vegetables Scheme or for the School Milk Scheme.
(2) The approved applicant shall start supplying the products to schools from 1 November of the school year concerned and undertake accompanying educational measures from the first day of the school year concerned. The eligible costs referred to in Article 4 (1) of Commission Delegated Regulation (EU) 2017 / 40 for the supply of products or accompanying educational measures per pupil shall not exceed the limit per pupil for the relevant school year referred to in Section 8.
(3) By 15 May of the relevant calendar year of the Fund, the authorised applicant shall deliver a plan of accompanying training measures, together with a quantification of the financial intensity and cost of each accompanying training measure for the following school year, including any draft teaching material. By 15 August of the relevant calendar year, the Fund shall notify the approved applicant whether the proposed accompanying training measures are eligible for aid.
(4) Where an approved applicant intends to change the range of products supplied referred to in § 2 (1) (b) to (d) or to modify the composition of the product delivered referred to in § 2 (1) (b) to (d), he shall submit an application to the Fund on the form issued by him; the application must include the information referred to in Article 6 (4) to (6).
(5) Where an approved applicant intends to terminate the supply of a product referred to in Article 2 (1) (b) to (d), he shall notify the Fund without delay.
(6) The approved applicant shall inform the schools of the accompanying educational measures available.
§ 8
Determination of limits
(1) No later than 1 September of the calendar year concerned, the Fund shall notify each approved applicant of the minimum number of deliveries per month in the period from 1 November of the school year concerned, according to the amount of funding allocated for the school year concerned. If the minimum number of deliveries per month of products is not complied with, the Fund shall reduce the funds allocated to the approved applicant in the given school year.
(2) By 31 October of the calendar year concerned, the Fund shall notify each approved applicant of the limit on products per pupil for the relevant school year. In setting the limit on the Fund's products, it shall be based on the proportion of the total aid fixed for each project4) and the number of schools with which the approved applicant has a contract to supply products resulting from the information referred to in paragraph 7 (1), minus the associated costs, including the costs of accompanying educational measures (8).
(3) By 15 August of the relevant calendar year, the Fund shall notify each approved applicant of the limit for accompanying educational measures per pupil for the relevant school year. In setting the limit on accompanying educational measures, the Fund shall be based on a proportion of up to 15% of the final grant of support for the Czech Republic for individual projects4), to which the national aid earmarked for accompanying educational measures for the school year concerned and the number of pupils enrolled in the project during the previous school year.
§ 9
Application for aid for products
(1) An application for aid for products shall be submitted by the approved applicant for each calendar month of the school year (9) (hereinafter referred to as "delivery period") during which he supplies school products.
(2) The application for aid for products shall be submitted by the authorised applicant to the Fund on the form issued by him after the delivery period, within a time limit set by the directly applicable European Union10).
(3) In addition to the elements mentioned in the directly applicable European Union11, the application for aid for products also includes:
(a) an overall overview of the different types of products delivered for the delivery period and their quantities; the data are submitted in electronic form,
(b) the total number of pupils for whom aid is claimed for products for the delivery period; the data are submitted in electronic form,
(c) confirmation of taking over the product by the school during the delivery period; that certificate is submitted in electronic form; and
(d) a notice of withdrawal from the contract for the supply of products where the school concerned has decided to terminate the procurement during the school year; that notification shall be submitted in electronic form.
(4) An approved applicant supplying organic products must accompany the aid application with a copy of the certificate of origin of all organic products delivered, issued by the authorised person (13) or similar documents issued by a Member State of the European Union, provided that the aid application is submitted for the delivery period during which the approved applicant began to supply those products. The approved applicant supplying organic products shall not attach the aid application for the next delivery period to the document referred to in the first sentence, unless it has been amended. The document referred to in the first sentence may be replaced by an electronic verification of the relevant data by the Fund.
(5) Aid shall be granted to an approved applicant pursuant to Article 6 (1) for the products referred to in Article 2 (1), equal to the amounts set out in Annexes 1 and 2 to this Regulation.
§ 10
Application for aid for accompanying educational measures
(1) The approved applicant shall submit to the Fund, on a form issued by him, within a time limit set by the directly applicable European Union10) an application for aid for accompanying educational measures for the past calendar year period.
(a) from 1 September to 31 December;
(b) from 1 January to 31 March; or
(c) from 1 April to 30 June.
(2) The approved applicant shall accompany the application for aid for accompanying educational measures:
(a) confirmation by the school of the accompanying educational measures implemented, indicating the number of pupils participating in the accompanying educational measures;
(b) invoices relating to accompanying training measures carried out during the relevant period referred to in paragraph 1 and paid by the approved applicant on the date on which the application for aid was submitted in accordance with the limit laid down in Article 8 (3) or proof of the amount of costs incurred for accompanying training measures;
(c) a copy of the report of work and documents relating to the wage costs of the approved applicant relating to the accompanying training measure carried out;
(d) a copy of the bank account statement showing payment of invoices for accompanying educational measures referred to in (b);
(e) documents proving the procedure for selecting the supplier; and
(f) for products not approved in the decision approving the applicant pursuant to Article 6 (7) or in a decision made following an application pursuant to Article 7 (4), technical documentation including a view of the packaging of the product; in the case of milk products, the applicant shall also attach to the application a protocol from an accredited laboratory containing an analysis of the salt and fat content of the milk product and, in the case of flavoured milk products, an analysis of the added sugar content of the milk product.
§ 11
Promotion
(1) The Fund shall ensure that the poster is printed (14) and shall forward it to the authorised applicant.
(2) The approved applicant shall ensure that any school with which he has a contract to supply products uses a European Union poster "School project" in accordance with the directly applicable European Union14).
§ 12
Approval withdrawn
In addition to suspension and withdrawal of approval pursuant to Article 7 of Commission Delegated Regulation (EU) 2017 / 40, the Fund shall withdraw approval from the applicant who:
(a) intends to terminate the supply of products and to notify the Fund without delay; or
(b) no school shall conclude a contract to supply the products for the school year concerned and shall not submit the information referred to in Article 7 (1) by 30 September of the calendar year in question or following the year of approval.
§ 13
Transitional provisions
(1) The application for approval of an aid applicant pursuant to Article 6 for the school year 2017 / 2018 shall be submitted by the applicant to the Fund on the form issued by him by 30 April 2017.
(2) For the school year 2017 / 2018 for the purposes of price regulation pursuant to Article 2 (5), the Fund shall communicate the amendments referred to in Article 7 (4) and (5) to the Ministry of Finance by 30 June 2017.

§ 14
In Government Decree No. 478 / 2009 Coll., laying down certain conditions for granting aid for fruit and vegetables and products of fruit, vegetables and bananas to children in educational establishments, as amended by Government Decree No. 157 / 2014 Coll. and Government Decree No. 166 / 2016 Coll., the following Section 5a is inserted after Section 5, which includes the title:
„§ 5a
Specific provisions
Applications pursuant to Articles 3 (2), 4 and 4a (1) may not be submitted to the Fund for a period beginning in the school year 2017 / 2018. ';
