on the fight against accidents in mines and the extraction of oil and natural gas
According to § 6 (6) (a) and (b) of Act No. 61 / 1988 Coll., on Mining Activities, Explosives and State Mining Administration, the Czech Mining Authority provides:

INTRODUCTORY PROVISIONS
§ 1
Subject matter
The Decree sets out emergency prevention requirements and plans for major operational accidents (accidents) (1) (hereinafter referred to as "emergency plan '), as well as measures aimed at saving people's lives and reducing damage in the production and treatment of major operational accidents (hereinafter referred to as" accidents') in organisations (2) carrying out mining or mining activities (hereinafter referred to as "the organisation ') in mines and workplaces in the extraction and treatment of oil and natural gas and in drilling and geophysical works aimed at the exploration and exploration of oil and natural gas deposits and the underground storage of crude and natural gas.
§ 2
Interpretation of terms
For the purposes of this decree, the following shall be considered:
(a) emergency plan - a set of measures and activities aimed at saving the life and health of persons and property in accidents, describing the way in which accidents are fought and a list of means to overcome foreseeable accidents;
(b) accident - an event which has or could be seriously threatened by the lives and health of persons or property; These include, in particular, mining fire, explosion of gases and coal dust, mine shock, rupture of rocks and gases, eruption of oil and natural gas, a cave-in of mining works, a flow of water and mud or chickens, a stopping of the main fan and a serious disturbance in the ventilation system (3) or on the heavy machinery.

COMMON PROVISIONS

HLAVA I

PRINCIPLES FOR THE PROCESSING OF THE HAVARIA PLAN
§ 3
Preparation of the emergency plan
(1) The organisation shall ensure that an emergency plan is drawn up for all foreseeable types of accidents.
(2) The emergency plan must be drawn up in a clear, concise and comprehensible manner, for:
(a) each mine,
(b) each site for oil and gas extraction and treatment, for drilling and geophysical work carried out on drilling for and exploration for oil and gas deposits and for underground storage of oil and gas (hereinafter referred to as "the Operations Centre").
(3) The development of the emergency plan and the implementation of the amendments are attended by staff designated by the race mine or, where appropriate, by the head of the working4) (hereinafter referred to as "racing mine"), the head of the racing mining rescue station and, where appropriate, the representative of the main mining rescue station; where a supplier organisation is also working at the mine or operating centre referred to in paragraph 1, a representative of that organisation shall invite the racing mines to such activities.
(4) The race mine shall ensure that the emergency plan is drawn up in a timely manner, supplemented and modified as necessary.
(5) The racing mine shall ensure that, where an accident at its controlled mine could endanger the neighbouring mine, the emergency plan also ensures the safety of the neighbouring mine and that the racing of that neighbouring mine is immediately notified of the situation.
(6) If a foreseeable accident could be threatened by persons or objects located outside the border of a mine or an operating centre, (5) for which the emergency plan is drawn up, the racing mines shall discuss with the representatives of the municipality concerned and with the owners and, where appropriate, the users of the endangered objects the way in which they are informed of the accident and the measures envisaged by the emergency plan to overcome it.
§ 4
Parts of the emergency plan
The emergency plan shall contain part of the contingency, operational and map. The annex to the emergency plan shall be a separate component containing the other documents and documents provided for in this Order or other legislation. 6)
§ 5
Issue of an emergency plan
(1) The emergency plan issues racing mines.
(2) If the emergency plan identifies the tasks associated with the organisation and control of the accident as well as the employees of the unsubordinate race mine, the racing mine shall ensure that they are also familiar with them and forwarded to them the relevant part of the emergency plan.
§ 6
Obligations of the emergency plan
The emergency plan shall be binding on all those who are present in the premises and premises for which the emergency plan is drawn up.
§ 7
Storage of the emergency plan
The racing mine shall determine the location of the emergency plan, so that the emergency plan is accessible to the driver.

§ 8
Contents of emergency part of the emergency plan
(1) The emergency part of the emergency plan contains:
(a) the list of staff, organisations, legal and natural persons (7) and authorities to be called in the event of a specific type of accident;
(b) a list of staff, organisations, legal and natural persons and bodies to be notified of a type of accident;
(c) the tasks of selected staff in the accident.
(2) The race mines shall identify the employees who will perform the tasks under this decree.
§ 9
List of staff, organisations, legal and natural persons and bodies
The lists of staff, organisations, legal and natural persons and bodies to be called to or notified of the accident in the case of a particular type of accident shall be drawn up in a clear manner and in the order in which they are to be called or informed. The first is always called a worker for the management of the disposal of major accidents (accidents) (hereinafter referred to as "the accident manager ') and the relevant mining rescue station and, depending on the nature of the accident, the health rescue service. For all employees, organisations, legal and natural persons and bodies, the lists shall also include their addresses and telephone links or other means of communication.
§ 10
Staff and other persons
(1) At the time of the accident, workers (8) and all persons present at the premises and premises of the affected or at risk of accidents, regardless of their classification, are bound by orders from the accident manager.
(2) The organisation's technical and economic staff shall report to their supervisor personally or by phone upon receipt of the accident report. The staff to whom the emergency plan imposes tasks shall be notified to the accident manager upon receipt of the accident report.
(3) A staff member, in addition to the obligations imposed on him by specific legislation, (9) shall also immediately notify the inspection service of the accident or its symptoms which he has observed.
§ 11
Head of accident management
(1) For each mine or operating centre for which an emergency plan has to be drawn up, the racing mine shall determine the driver of the accident, unless it fulfils this function itself. The head of the race mining rescue station and the head of ventilation shall not be the driver of the crash. 10)
(2) Only a staff member who is in charge of the destruction of an accident may be perfectly familiar with the local conditions, whose ability to manage the destruction of an accident has been verified by an examination before a commission of the District Mining Office. 11)
(3) At the time of the accident, the accident manager shall not be entrusted with tasks which would prevent him from carrying out the task of the accident manager.
§ 12
Tasks of the accident manager
(1) On receipt of the report on the accident, the manager of the accident is to arrive at his post immediately (§ 13) and to take up the management of the work to rescue and fight the accident.
(2) After analysis of the situation, the accident manager shall assess and, if necessary, adjust the operational part of the emergency plan, determine the means of fighting the accident and issue and, if necessary, check the orders already issued for:
(a) the rescue of persons, in particular their removal, departure or removal from the vulnerable area by means of a rescue mission, and the rescue of property;
(b) the occupation of an emergency rescue station and, depending on the nature of the accident, the fire protection units and the assembly of a mining rescue corps;
(c) the profession of first-aid medical services by notifying medical dispatch, where the accident is at risk of the lives or health of persons, and to secure areas intended for the provision of first-aid,
(d) the notification and, where appropriate, the profession of staff, organisations, legal and natural persons and authorities listed in the contingency plan by type of accident;
(e) the supply of materials and means needed to overcome the accident;
(f) the implementation of other necessary measures for the accident in the operational part of the emergency plan and, where appropriate, beyond those measures.
(3) The manager of the accident's liquidation shall designate the person who shall re-check that the place of the accident has been called and that the staff, organisations, legal and natural persons and bodies listed in accordance with § 9 have arrived.
(4) In order to address the professional issues and problems related to the fight against an accident, the accident manager is entitled to call an emergency committee (§ 26) or, where appropriate, individual experts or professional staff.
(5) The driver of the accident may leave his post before the accident is completed if the persons at risk are already outside the area at risk and for the necessary rest. In such cases, they shall entrust a further management of the accident to their representative in writing (§ 15), who shall confirm receipt of the function by signature in the alert (§ 14 (2)).
(6) The driver of the accident shall determine the date and time of the accident; It shall determine the same data after the accident has been overcome. This information must be recorded (Paragraph 14 (2)).
(7) The accident manager shall maintain and deepen his knowledge of local conditions by regular inspections; their frequency shall be determined by the racing mine.
§ 13
Position of the accident manager
(1) The position of the accident manager is in a room designated by the emergency plan to enable the control of the accident.
(2) The staff of the State Mining Administration and the racing mine may enter or stay in the room which is the office of the crash manager; other persons only with the agreement of the accident manager.
§ 14
Orders from the accident manager
(1) If the situation so permits, the accident manager shall give written instructions. The person to whom the order is addressed and, where appropriate, the person to whom the order is to be transmitted confirms the receipt. The instructions of the accident manager which are transmitted to the staff member by telecommunications equipment shall be repeated by the staff member to confirm their clarity.
(2) The driver of the accident shall ensure that all orders, reports and other relevant facts relating to the accident and its overcoming, even if transmitted by telecommunications equipment, are recorded in writing in chronological order. For orders and reports, the name and surname of the person who gives the orders or reports and who receives them shall also be given. In addition to the written record, an audio record shall be made of the reports received and the orders issued.
§ 15
Deputy Head of Accident Management
(1) The race mine shall be designated in writing by the representative of the accident management.
(2) A representative of the accident disposal manager shall take over the control of the accident in the absence of or at the direction of the accident disposal manager; at that time, he shall have the rights and perform the tasks of the accident manager.
(3) Only an employee meeting the requirements of Paragraph 11 (2) may be a representative of the accident disposal manager.
(4) If more than one representative is designated, the racing mines shall determine in the emergency plan in writing the order in which the control of the accident is taken.
(5) The representative of the accident disposal manager shall not be the head of the race mining rescue station or the head of ventilation.
(6) The representative of the accident management shall maintain and deepen knowledge of local conditions by regular inspections; their frequency shall be determined by the racing mine.
§ 16
Inspection service
(1) A staff member performing an inspection service12) has rights until the arrival of the accident manager or his representative and performs the duties of the accident manager. Other tasks may be determined by an emergency plan.
(2) The inspection service is located at a location designated by the racing mine.
§ 17
Tasks of technical and economic staff
(1) In the emergency part of the emergency plan, the tasks related to the organisation of the accident and the removal of its consequences are specified for other technical and economic staff. In particular:
(a) drawing up a list of persons present at the time of the accident in the affected and vulnerable areas;
(b) ensuring continuous use of the telephone or telephone switchboard;
(c) ensuring continuous operation of important machinery and electrical equipment;
(d) ensuring the necessary security for all persons involved in the fight against accidents (drinks, food, blankets, warm suits, etc.),
(e) ensuring continuous operation in warehouses and staff for the loading and transport of material;
(f) ensuring the availability of the necessary number of means of transport and drivers;
(g) ensuring the necessary material, technical equipment, map documentation, etc.,
h) provision of suitable space for the surface bases of the Mining Rescue Corps, for the Emergency Commission, laboratory, etc.
(2) Staff carrying out the tasks referred to in paragraph 1 shall remain at the place specified in the emergency plan; they may withdraw from it only with the agreement of the accident manager.

HLAVA III

OPERATIONAL PART OF THE HAVARIA PLAN
§ 18
Contents of the operational part of the emergency plan
(1) The operational part of the emergency plan shall include a general solution to all foreseeable types of accidents that may occur at the mine or operating centre for which the emergency plan is drawn up, as well as those arising outside the mine or operating centre, which may, by their consequences, endanger workers. The solutions to the various types of foreseeable accidents can be combined if the rescue measures are identical.
(2) The solution to a particular type of accident in which there is a parallel risk of other types of accidents also includes a procedure for dealing with the coexistence of those types of accidents.
(3) Cases of foreseeable types of accidents shall be systematically organised and numbered.
(4) The operational part of the emergency plan shall determine in particular:
(a) means of quick and reliable communication and recall of workers at risk of accidents from the vulnerable area;
(b) ways of rescuing workers and other persons in the affected and vulnerable areas and identifying rescue routes and emergency exits;
(c) the way and means for the rapid and effective control of the accident.
§ 19
Preparedness of materials and equipment
(1) The emergency plan determines which materials and equipment and in what quantities will be permanently ready to fight the accident and where they will be stored (emergency storage).
(2) The materials and equipment referred to in paragraph 1 may only be used to combat an accident; their loss must be completed immediately.

HLAVA IV

MAP PART OF THE HAVARIA PLAN
§ 20
Contents of the map part of the emergency plan
(1) The map part of the emergency plan is the basic mine map 13) and the crash control map. 14) Where it is necessary to store certain maps separately from the emergency plan, they shall identify the emergency plan instead of the emergency plan, so that in the event of an accident it is possible to ensure that they are delivered quickly to the driver of the accident.
(2) An accident control map is located at the inspection service station from which it is managed at the first stage of the accident.

HLAVA V

MEETINGS WITH THE HAVARIA PLAN AND CURRENT FRAMEWORK
§ 21
Getting to know the emergency plan
(1) The identification of employees, including the employees of the supply organisations, of the part of the emergency plan concerning them, in particular the means of escape, the importance of signalling the removal of workers from the mine or operating centre, the deployment of communication devices, and the way in which workers are to behave during the accident, shall be carried out before their first entry into the mine and the operating centre.
(2) The staff shall be re-introduced to the extent specified in paragraph 1 at each training alarm, every change in the workplace, if any change in the means of rescue is made, after any change in the rescue routes and after any change in the emergency plan, in so far as they are concerned, but at least every six months.
(3) The communication of staff to whom the emergency plan imposes specific tasks shall take place immediately after the emergency plan has been issued, supplemented and amended.
(4) Paragraph 1 shall not apply to mining rescue workers intervening in the fight against an accident.
§ 22
Training alarms
(1) Training alarms shall verify readiness to combat those types of accidents listed in the emergency plan.
(2) All staff involved in the emergency plan will take part in the training alarm. The racing mine shall ensure that workers who have not participated in the training alarm for absence are familiar with the subject and execution of the training alarm after taking up work; these employees will go through the same rescue route they were supposed to go through during the training alarm. For serious reasons and under the conditions set out in the previous sentence, the race mine may allow other staff not to participate in the training alarm. A direct supervisor shall write a record of the replacement meeting of staff members who have not participated in the training alarm for absence, the subject matter and execution of the training alarm and the passage of the rescue route concerned.
(3) The training alarm is carried out with the participation of mining rescue workers.
(4) The training alarm, under the supervision of the accident manager, shall be managed by its representative or an employee in charge of the inspection service, in order to verify their ability to manage the operation of the accident. A chronological record shall be kept of the course of the training alarm.
(5) The organisation shall inform the District Mining Authority and the Main Mining Rescue Station in advance of the performance of the training alarm.
(6) A mining inspector may also declare a training alarm. 15)
(7) The racing mine will evaluate the progress of the training alarm and, if necessary, take measures to remedy the deficiencies identified.

HLAVA VI

AMENDMENTS, ADDITIONAL AND CONTROL OF THE HAVARIA PLAN
§ 23
Changes and replenishment of the emergency plan
Amendments and additions to the emergency plan shall be made without delay and in a clear manner, indicating the date, name, surname and signature of the staff member who carried them out, in all copies of the emergency plan. The map part of the emergency plan shall be supplemented in accordance with specific legislation. 16)
§ 24
Emergency plan checks
(1) The plan shall be regularly monitored and updated by the designated staff member.
(2) In addition to the checks referred to in paragraph 1, the emergency plan shall be checked at least once a year by a committee composed of the staff referred to in Article 3 (3). During this inspection, the members of the Commission shall also verify the compliance of the emergency plan with the actual situation with the inspections of workplaces, rescue routes and means of fire fighting.
(3) The Commission referred to in paragraph 2 shall draw up an alert on the outcome of the check on the emergency plan.
§ 25
Control of emergency plan by Main Mining Rescue Station
Main Mining Rescue Station controls emergency plans 17) at least once every 12 months. In particular, they shall examine the technical means intended for the rapid and effective control of the accident, emergency warehouses and the distribution of the mine fire water pipeline. The result of the checks shall be recorded and transmitted to the racing mine.

HLAVA VII

§ 26
Emergency Commission
(1) In order to address the procedures associated with the fight against accidents, the racing mine shall appoint an emergency committee, which shall be the advisory body of the accident management.
(2) The Commission shall be convened and shall carry out its activities at the direction of the head of the accident or race mine liquidation or at the request of the State Mining Administration.
(3) The emergency committee members are experts who control the means of dealing with different types of accidents, both from their own and from foreign organisations, scientific and research institutes or universities.
(4) The members of the emergency committee may not be members of staff assigned other tasks under the emergency plan.
(5) The opinion of the Commission on the procedure for dealing with an accident is merely a recommendation for the accident manager and does not relieve him of his responsibility for the management of the accident.

HLAVA I

OTHER STAFF TASKS
§ 27
Other tasks of the accident management
(1) In addition to the orders referred to in Article 12, the accident manager shall also issue orders for:
(a) the prohibition of plucking into a mine or part of it, except for mining rescue workers and persons who grope into a mine on its written order;
(b) making records of persons in the mine, in particular in the affected and vulnerable areas;
(c) the awareness of the responsible staff of the neighbouring mine and, where applicable, other persons (paragraphs 5 and 6 of Section 3) which could be jeopardised by the accident.
(2) The accident manager, after analysing the situation, shall determine the extent of the threat, in particular with regard to the occurrence and spread of the pollutants and the risk of potentially explosion, and shall determine the measures to prevent persons from entering the vulnerable area of the whole or part of the mine (patrol, etc.) without its command.
§ 28
Tasks of the fan leader
Head of ventilation
(a) identify the state of the main mine fans and report the result to the accident manager;
(b) monitor the ventilation status of the whole mine, assess and comment on measures related to ventilation;
c) check the stock of material for the construction of wind objects and dams;
(d) ensure the work associated with the collection and dispatch of samples of mining air and the reporting and recording of the results of their analyses;
(e) manage the work related to the modification of ventilation and carry out other tasks assigned to it by the accident manager.
§ 29
Other tasks of technical and economic staff
Technical and economic staff designated by the race mine shall carry out the following additional tasks:
(a) to stop the delivery of mining personal luminaires and indicators and to allow them to be issued only on written order from the accident manager;
(b) keep a continuous record of workers who are ploughing and ploughing from the mine and, in so doing, check the written orders of the accident manager to be ploughed into the mine or, where appropriate, orders for mining rescue workers issued under special legislation (18) and prevent unauthorised persons from entering the mine,
(c) to check the readiness and safety of mining personal lamps for mining rescue workers;
