DECLARATION
of 23 February 2017
amending Decree No. 29 / 2004 Coll., implementing Act No. 149 / 2003 Coll., on trade in forest reproductive material, as amended
The Ministry of Agriculture provides pursuant to Section 39 of Act No. 149 / 2003 Coll., on the putting into circulation of forest reproductive material of forest important species and artificial cross-breeds, intended for the restoration of the forest and for afforestation, and on the amendment of certain related laws (Act on Trade in forest reproductive material), as amended by Act No. 232 / 2013 Coll. and Act No. 62 / 2017 Coll.:
Decree No. 29 / 2004 Coll., implementing Act No. 149 / 2003 Coll., on trade in forest reproductive material, as amended by Decree No. 44 / 2010 Coll. and Decree No. 402 / 2013 Coll., is amended as follows:
1. In Section 8, the words "(K § 13 (4) of the Act) 'are replaced by" (K § 13 (5) of the Act'.
2. in Article 8 (3) (a), the word "overall" shall be inserted after the word "on" and the words "plan or outline" shall be replaced by the words "referred to in Article 13 (2) of the Act."
3. In Article 8, the following paragraph 4 is added:
"(4) If seed sources cannot be clearly identified in the field, they shall be marked by the owner at a height of 130 cm above the ground with the serial number of the source referred to in Annex 20 (5). ';
4. Paragraph 9 (2) is deleted.
Paragraphs 3 to 5 shall be renumbered paragraphs 2 to 4.
5. in Article 9 (4) (a), the words "corresponding to the duration of the plan or outline" shall be deleted;
6. Paragraph 10 (7) reads as follows:
"(7) The parents of the family, orthets and clones recognised as sources of qualified reproductive material shall be identified by the owner in the field by two yellow stripes 5 cm wide with a gap between the stripes 20 cm, the lower stripe being placed 130 cm above the ground. A serial number of the source in accordance with Annex 20 (5) shall be written into the gap between the stripes in yellow. If the parents of the family, orthets and clones cannot be identified in the specified manner, the owner shall mark them with a metal or plastic label or another durable label bearing the serial number of the source referred to in Annex 20, point 5, which shall ensure that the individual is clearly identified in the field. ';
7. In Article 11 (4), the text "§ 9 (5) 'is replaced by" § 9 (4)'.
8. In Article 11, the following paragraph 5 is added:
"(5) The parents of the family, orthets and clones recognised as the source of the reproductive material tested shall be identified by the owner in the field by two green stripes 5 cm wide with a 20 cm gap between the stripes, the lower stripe being placed 130 cm above the ground. A serial number of the source in accordance with Annex 20 (5) shall be entered in the gap between the stripes in green. If the parents of the family, orthets and clones cannot be identified in the specified manner, the owner shall mark them with a metal or plastic label or another durable label bearing the serial number of the source referred to in Annex 20, point 5, which shall ensure that the individual is clearly identified in the field. ';
9. In Paragraph 13, the words "(K § 2i (4) of the Act) 'are replaced by" (K § 2i (6) of the Act)'.
10. in Paragraph 13 (1), the first sentence is deleted;
11. in Article 13 (3) (a), the words "corresponding to the period of validity of the plan or outline" shall be deleted;
12. In Section 14, the words "(K § 20 (3) of the Act) 'are replaced by" (K § 20 (4) of the Act'.
13. in Paragraph 14 (1) (c), "paragraph 2 (h)" is replaced by "paragraph 2 (d)";
14. in Articles 14 (1) (d) and 14 (2) (e), the word "dealing" shall be replaced by "dealing";
15. in Paragraph 14 (2) (c), the words "responsible representative" are replaced by the words "responsible representative of the applicant."
16. in Paragraph 14 (3), "paragraph 1 (e) or paragraph 2 (f)" is replaced by "paragraph 1 (b) or paragraph 2 (c)";
17. in Article 15 (6) (i), the words "put into circulation during the reference period" shall be deleted;
18. Annex 7 shall read as follows:
"Annex No 7 to Decree No 29 / 2004 Coll.
Formula for age labelling and cultivation of planting material
1. The method of cultivation shall be indicated by a formula where the first number indicates the number of growing periods before the training, cutting or incorporation into the packaging, the second number indicates the number of growing periods after this intervention; both are accurate to 0.5 years. The sum of both numbers, in the case of more than one treated, transplanted or cut plants and more than one number, in the formula indicates the time of cultivation in the kindergarten, except for the sawn-off of the poplars where the above part has been cut.
2. The cultivation method shall be indicated by a formula where the individual symbols indicate:
+ reclamation or incorporation into packaging;
- cutting the roots; it is a mechanical shortening of roots of spatial plants without their extraction from soil (substrate);
f cultivation in an artificial housing (foils, greenhouse, parchment);
for the cultivation of roofed forest wood material without the use of air cutting technology (without cultivation on an "air cushion ');
in the cultivation of roofed planting material by air cutting technology, where the roots grow through the open bottom of the packaging or side crevices and dry at the end due to the flowing air (growing on the "air cushion");
p collection from natural rejuvenation;
of roasting;
r sawn wood;
t topol cutter;
grafting (grafting or vaccination);
e (in vitro).
3. The age and manner of cultivation of seedlings and tree willows from vegetative propagation is defined by a formula where the first number indicates the age of the above part of the seedling, the second number indicates the age of the underground part of the seedling, i.e. the sum of both numbers does not indicate the total age of the seedling and the sign + between the first and second numbers does not mean replanting or nurturing (see example 10 in the note).
Notes:
Model examples for identifying the cultivation methods for forest forest material:
EXAMPLE 1
0,5 - 0,5 is a single-year seedling grown in exposed mineral soil; during the growing season, the root system was mechanically cut.
EXAMPLE 2
2 + 0 is a 2-year-old seedling grown in uncovered mineral soil.
EXAMPLE 3
f1 + 0 is a 1-year-old seedling grown in an artificial housing.
EXAMPLE 4
fv1 + 0 is a 1-year-old covered seedling grown all the time on an "air cushion '(part of the year in an artificial housing, in the rest of the time growing on an outdoor storage site).
EXAMPLE 5
f1 + v1 is a two-year covered seedling; the one-year-old seedling grown in an artificial housing has been transposed into a packaging in which the plant was grown on an "air pillow" for one year.
EXAMPLE 6
fv1 + fv1 is a two-year covered seedling grown all the time on the "air cushion," when a one-year seedling has been placed in a larger container for the second year of cultivation (part 1 and 2 of the year in an artificial housing, in the rest of the time of cultivation on an outdoor storage site).
EXAMPLE 7
r1 + v1 is a two-year covered seedling obtained by vegetative cutting; one year of seasoned plant has been transplanted into a non-growing type of packaging in which it was grown for one year on a "cushion."
EXAMPLE 8
fv1 + 2 - 1 + k1 is the five-year covered rotational yield; one-year-old covered seedling grown in an artificial housing on an "air cushion" has been retrained into exposed mineral soil, after two years the plant has been mechanically cut by the root system, after one year the plant has been picked up and transferred to a packaging where it was grown for one year without the use of air cutting technology.
EXAMPLE 9
p + 0 is the seed collected from the natural rejuvenation (age not given).
EXAMPLE 10
t1 + 2 is the spatial seedling of poplar obtained by cutting with a single year above ground (after the first year cut) and a two year underground part.
EXAMPLE 11
p + z1 is the seedling; the seed that was picked up from the natural rejuvenation was rooted for one year (the age of the seed collected is not given).
EXAMPLE 12
p + 2 is the seedling; from the natural rejuvenation of the collected seed was trained for two years (the age of the collected seed is not given). "
19. In Annex No 16 in Part A, B and the Explanatory Notes to point 17, in Annex No 17 in Part A, B and the Explanatory Notes to point 16 and Annex No 18 in Part A, B and the Explanatory Notes to point 17, the words "EC - PLANT-DOSE PAS 'are replaced by the words" EU - PLANT-DOSE PAS'.
20. In Annex No 16, Part A and B, Annex No 17, Part A and B, and Annex No 18, Part A and B, the words "State Plant Health Administration 'are replaced by the words" Central Agricultural Control and Testing Institute'.
21. In Annex No 16, in Part Explanatory Notes 18, in Annex No 17, in Part Explanatory Notes 17 and in Annex No 18, Part Explanatory Notes 18, the words "State Plant Health Administration" are replaced by the words "Central Control and Examination Institute of Agriculture."
22. in Annex No 20, the text "CZ-2-3-DBZ-00005-06-7-A-G999-1" is replaced by "CZ-2-3-ABC-00005-6-7-D-G999-1."
23. In Annex No 20, point 6, "maximum 'is inserted after" No 83 / 1996 Coll.'.
24. In Annex No 20, point 8, "3 'is replaced by" 2'.
25. In Annex No 20, point 9, the words "maximum 'are inserted after the words" 999-1 ='.
26. In Annex No 22, point 1, the word "wood 'shall be inserted after the words" of the same species'.
27. In Annex 22, point 2, the words "expert opinion of the delegate 'are replaced by the words" authorised person'.
28. In the title of Annex No 23, the word "identical 'is replaced by the word" identified'.
29. In Annex No 28, point 1 (c), the words "public authority 'are replaced by the words" authorised person' and the words "public authority 'are replaced by the words" authorised person'.
30. In Annex No 28, point 3 (c) (II), the word "consequences' is replaced by the word" consequences'.

Efficacy
This Order shall take effect on the first day of the second calendar month following its publication.
