GOVERNMENT REGULATION
of 20 February 2013
amending Government Regulation No 60 / 2012 Coll., laying down certain conditions for granting specific support to farmers, as amended by Government Regulation No 448 / 2012 Coll.
The Government mandates pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll. and Act No. 291 / 2009 Coll.:
Government Regulation No. 60 / 2012 Coll., laying down certain conditions for granting specific support to farmers, as amended by Government Regulation No. 448 / 2012 Coll., is amended as follows:
1. footnote 6 is deleted, including the footnote reference.
2. In Article 7 (2) (b), the words "form proving 'are replaced by the words" document determining the proportion of milk proving'.
3. In Article 7, the following paragraph 3 is inserted after paragraph 2:
"(3) Where the applicant produces and sells milk products from milk produced by dairy cows of the applicant, such milk products shall be considered as having been sold milk as referred to in paragraph 2 (b) and, for the calculation of income or sales, shall be based on monthly reports of direct milk sales pursuant to Government Regulation No 244 / 2004 Coll., laying down closer conditions for the application of the levy in the milk and milk products sector under the common organisation of the market in milk and milk products, as amended, by means of the conversion of milk products into equivalent quantities of milk as set out in the Annex to Government Regulation No 244 / 2004 Coll., as amended, multiplied by the average milk price recorded by the Czech Statistical Office for the calendar year preceding year of application; The Fund shall publish this prize in a way that allows remote access. In this case, the application referred to in paragraph 2 shall also include a calculation showing the proportion of added non-lactic ingredient in the flavoured milk product sold. ';
Paragraphs 3 to 7 shall be renumbered paragraphs 4 to 8.
4. In Article 7 (4), the words "and paragraph 3 'shall be inserted after the words" point (b)'.
5. in Article 7 (5) (a) and (b), the words "and (3)" shall be inserted after the words "(b)."
6. In Section 8 (8) of the introductory part of the provision, the words "and paragraph 3 'shall be inserted after the words" (b)'.
7. in Article 8 (8) (a), the words "and (3)" shall be inserted after the words "(b)."
8. In Annex 1, point 2, the words "after 3 years' are replaced by the words" third year '.
9. In Annex No 1, point 5, the word "pesticides' is replaced by" contained in pesticides authorised for use in the Czech Republic in the relevant calendar year 'and the word "listed' is replaced by" listed '.
10. In Annex 1, point 6, the word "insecticides' is replaced by" contained in insecticides authorised for use in the Czech Republic in the relevant calendar year '.
11. In Annex 1, point 7, "fungicides' is replaced by" contained in fungicides authorised for use in the Czech Republic in the relevant calendar year '.
12. In Annex 1, point 8, the words "authorised for use in the Czech Republic in the relevant calendar year 'shall be inserted after the words" herbicides'.
13. In Annex No 1, in the title of Table 2, the word "insecticides' is replaced by" contained in insecticides authorised for use in the Czech Republic in the relevant calendar year '.
14. In Annex No 1, in Table 3, the word "fungicides' is replaced by" contained in fungicides authorised for use in the Czech Republic in the relevant calendar year '.
15. In Annex No 1, in the title of Table 4, the word "herbicides' is replaced by" contained in herbicides authorised for use in the Czech Republic in the relevant calendar year '.
16. In Annex 3, point 1 is replaced by the following:
"(i) Saaz special."
17. In Annex 3, point 4, at the end of the first sentence, the words "contained in pesticides authorised for use in the Czech Republic in the relevant calendar year 'shall be added.
18. In Annex 3, point 5, the words "the same 'are deleted, the words" the same active substance' are inserted after the words "plant protection 'and the words" the relevant calendar year' are inserted after the words "the same active substance '.
19. In Annex 3, at the end of point 5, the sentence "This shall not apply to plant protection products authorised to be used only once per growing season of the relevant calendar year 'is added.
20. In Annex 3, in the title of Table 2, the words "insecticides, fungicides and herbicides' are replaced by the words" contained in insecticides, fungicides and herbicides authorised for use in the Czech Republic in the relevant calendar year '.
21. In Annex 3, in Table 2, in the sixth column of the second row, the word "peronospore 'is replaced by the word" mold' and in the third line of the sixth column, the words "or phosphorus K 'are deleted.
22. In Annex 4, the following point 16 is inserted after point 15:
"16. Norwegian bovine animals (N) - bull of a breed of Normandy bovine animals of the meat type entered in the herd book of Section A, Unit M. ';
Points 16 to 23 shall be renumbered 17 to 24.
Transitional provision
Applications initiated before the date of entry into force of this Regulation by the Government shall be completed in accordance with Government Decree No. 60 / 2012 Coll., as amended by the date of entry into force of this Regulation.
Efficacy
This Regulation shall take effect on 15 March 2013.
