DECLARATION
of 25 February 2020
amending Decree No. 29 / 2004 Coll., implementing Act No. 149 / 2003 Coll., on trade in forest reproductive material, as amended
The Ministry of Agriculture provides, pursuant to Section 39 of Act No. 149 / 2003 Coll., on the putting into circulation of forest reproductive material of forest important species and artificial cross-breeds, intended for the renewal of the forest and for afforestation, and on the amendment of certain related laws (Act on trade in forest reproductive material), as amended by Act No. 32 / 2013 Coll. and Act No. 62 / 2017 Coll.:
Čl. I
Decree No. 29 / 2004 Coll., implementing Act No. 149 / 2003 Coll., on trade in forest reproductive material, as amended by Decree No. 44 / 2010 Coll., Decree No. 402 / 2013 Coll. and Decree No. 68 / 2017 Coll., is amended as follows:
1. In Article 5, at the end of the text of paragraph 1, the words "which is simultaneously a plant passport under the directly applicable European Union13 Regulation 'shall be added.
Footnote 13 reads:
"(13) Article 78 of Regulation (EU) 2016 / 2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against harmful organisms of plants, amending Regulations (EU) No 228 / 2013, (EU) No 652 / 2014 and (EU) No 1143 / 2014 of the European Parliament and of the Council and repealing Council Directives 69 / 464 / EEC, 74 / 647 / EEC, 93 / 85 / EEC, 98 / 57 / EC, 2000 / 29 / EC, 2006 / 91 / EC and 2007 / 33 / EC.";
2. Paragraph 5 (2) to (4) reads as follows:
"(2) For seed material, a movement certificate shall be drawn up in accordance with the provisions of the directly applicable European Union13) in accordance with the model set out in Annex No 16 or an accompanying certificate for protected zones in accordance with the model set out in Annex No 16a when exported and imported into those zones. A movement note shall be attached to the whole section of the seed material, the copy of which, indicating the relevant section, shall be attached once inside and outside each package of the consignment.
(3) A movement certificate shall be drawn up for parts of plants in accordance with the provisions of the directly applicable European Union13) in accordance with the model set out in Annex No 17 or a movement certificate for protected zones in accordance with the model set out in Annex No 17a when exported and imported into those zones, a copy of which, with the indication of the relevant section, shall be attached once inside and outside each package of consignment.
(4) A movement certificate shall be drawn up for planting material in accordance with the provisions of the directly applicable European Union13) in accordance with the model set out in Annex No 18 or a movement certificate for protected zones in accordance with the model set out in Annex No 18a when exported and imported into those zones, the copy of which, with the indication of the relevant section, is attached to the whole package of the consignment. ';
3. In Paragraph 5 (5), the words "Both parts of the accompanying document may be distinguished 'are replaced by the words" The accompanying document may be distinguished'.
4. In Article 5 (6), the words "the accompanying sheet and the accompanying label as a plant passport (a) for the genera or species of wood provided for in this Regulation 'are replaced by the words" the accompanying sheet is a plant passport under the directly applicable European Union Regulation (13)'.

5. Annex No 16, including the title, reads:

"Annex No 16 to Decree No 29 / 2004 Coll.

Annex No 16 Explanatory notes:
1) The number has the shape of AAAA / BBBCCCCC / DDDD, where AAAA is the number of the single register (CZ and four-digit number indicated in the licence), BBBB is the number of the establishment (allowing a supplier with multiple establishments to distinguish the organisational structure; in the case of a supplier with one establishment, 0000), CCCCC is the five-digit serial number assigned by the supplier within the establishment in an uninterrupted number line, DDDD is the year (full four-digit number of the year in which the accompanying document is issued).
2) In the case of a natural person, the name, surname or, where applicable, business name, place of permanent residence, place of business (if different from the place of permanent residence) shall be indicated. In the case of a legal person, the business name, the address of the business address and the business address (if different from the business address) shall be indicated.
(3) Licence number = "No" (reference number) indicated in the decision of the Ministry of Agriculture to issue the licence.

5) In the case of a registration number of a recognised unit originating in the Czech Republic, the Czech shape of the recognised unit shall be completed; in the case of a number of a recognised unit originating in the EC, the number of the recognised unit shall be given according to the data from the accompanying documentation of the reproductive material.
6) Indicate category abbreviation: I (identified), S (selected), K (qualified), T (tested).
7) Indicate the abbreviation of the relevant source: ZS (seed source), PO (crop), SS (seed set), RS (parent tree), KL (clone), SK (clone mixture).
8) In the case of reproductive material originating in the Czech Republic, the natural forest area number shall be given; in the case of reproductive material originating in other countries, the country of origin and other particulars shall be given according to the accompanying documentation relating to the material.
9) Indicate the abbreviation of one of the options: A (autochthonné), NA-... (non-autochthonnous from the region of provenance no.... E.g. NA7 i.e. non-autochthonnous from the area of provenance no 7), N (unknown), I (indigenous), NI-... (non-indigenous from the area of provenance no... e.g. NIC-4 i.e. non-indigenfrom the area of provenance no 4).
10) In the case of raw material, kg shall be indicated to the nearest 1 kg, in the case of seed, kg to the nearest 3 decimal places.
11) The form of packaging is optional.
12) In the case of timber such as SM, BO, MD, if the collection of cones is carried out at the beginning of the new year, the year of maturation shall be indicated in the previous year.
13) To be indicated for seeds and fruits put into circulation. If the germination (viability) and the number of germination (viable) seeds per kg cannot be established with regard to the agreed delivery times, the seed material may be put into circulation provided that the missing data are confirmed by the supplier immediately after the completion of the relevant tests (Section 8 (5) of the Act). For small seed sections, where their weight does not exceed the weight specified in Commission Regulation (EC) No 2301 / 2002, the germination (viability) values and the number of germination (viable) seeds in 1 kg shall not be filled.
14) The correct entry shall be marked in the relevant box with a cross (X), the incorrect entry shall not be completed, i.e. the box remains empty.
15) The "preliminary recognition" shall be provided for cases of tested reproductive material obtained from a source recognised on the basis of the results of early tests - Section 8 (3) of the Act, "genetically modified" - Section 5 (3) (c) of the Act.
16) Optional - the supplier may provide additional information. The section "Plant Health Passport" (paragraphs 17 to 21) shall be completed only by a supplier who is entitled to issue plant passports under other legislation (e.g. Act No. 326 / 2004 Coll., as amended).
17) Plant passport number (s) and the words "Plant passport" or "Plant passport - protected zone" in English ("Plant Passport" or "Plant Passport - PZ") and, if necessary, in another official language of the Union, separated by a slash.
(18) The botanical name (s) of the species (s) concerned or taxon (s) of plants (s) concerned, in the case of plants and plant products, or, where appropriate, the name of the object concerned and, where appropriate, the name of the variety (A).
(19) The two-letter code referred to in ISO Standard 3166-1-alpha-2 (1) referred to in Article 67 (a) of Regulation (EU) 2016 / 2031 for the Member State in which the professional operator issuing the plant passport is registered, the national registration number of the professional operator concerned (letter, numerical or alphanumeric code) (B).
(20) Where applicable, traceability code of the plant, plant product or other object (C).
21) Where applicable, the two-letter code referred to in ISO Standard 3166-1-alpha-2 referred to in Article 67 (a) of Regulation (EU) 2016 / 2031 for the Member State (s) of origin (D). ';

2) In the case of a natural person, the name, surname or, where applicable, business name, place of permanent residence, place of business (if different from the place of permanent residence) shall be indicated. In the case of a legal person, the business name, the address of the business address and the business address (if different from the business address) shall be indicated.
(3) Licence number = "No" (reference number) indicated in the decision of the Ministry of Agriculture to issue the licence.
4) Listed in Annex 1 to the Act.
5) In the case of a registration number of a recognised unit originating in the Czech Republic, the Czech shape of the recognised unit shall be completed; in the case of a number of a recognised unit originating in the EC, the number of the recognised unit shall be given according to the data from the accompanying documentation of the reproductive material.
6) Indicate category abbreviation: I (identified), S (selected), K (qualified), T (tested).
7) Indicate the abbreviation of the relevant source: ZS (seed source), PO (crop), SS (seed set), RS (parent tree), KL (clone), SK (clone mixture).
8) In the case of reproductive material originating in the Czech Republic, the natural forest area number shall be given; in the case of reproductive material originating in other countries, the country of origin and other particulars shall be given according to the accompanying documentation relating to the material.
9) Indicate the abbreviation of one of the options: A (autochthonné), NA-... (non-autochthonnous from the region of provenance no.... E.g. NA7 i.e. non-autochthonnous from the area of provenance no 7), N (unknown), I (indigenous), NI-... (non-indigenous from the area of provenance no... e.g. NIC-4 i.e. non-indigenfrom the area of provenance no 4).
10) Specify the relevant growing formula (Annex 7 to this Decree).
11) Indicate the height range of the above-ground part of the planting material in centimetres.
12) Specify the minimum thickness of the root neck in millimetres.
13) Optional.
14) The correct entry shall be marked in the relevant box with a cross (X), the incorrect entry shall not be completed, i.e. the box remains empty.
15) The "preliminary recognition" shall be provided for cases of tested reproductive material obtained from a source recognised on the basis of the results of early tests - Section 8 (3) of the Act, "genetically modified" - Section 5 (3) (c) of the Act.
16) Optional - the supplier may provide additional information. The section "Plant health passport" (paragraphs 17 to 22) shall be completed only by the supplier who is entitled to issue plant passports under other legislation (e.g. Act No. 326 / 2004 Coll., as amended).
17) Plant passport number (s) and the words "Plant passport" or "Plant passport - protected zone" in English ("Plant Passport" or "Plant Passport - PZ") and, if necessary, in another official language of the Union, separated by a slash.
(18) In the case of "movement note for import into the protected zone, the supplier shall complete the scientific name (s) of the quarantine pest (s) for the protected zones or, where appropriate, the codes specifically assigned to those harmful organisms referred to in Article 32 (3) of Regulation (EU) 2016 / 2031 (XXX)."
19) The botanical name (s) of the species (s) concerned or taxon (s) of plants (s) concerned, in the case of plants and plant products, or, where appropriate, the name of the object concerned and, where appropriate, the name of the variety (A).
(20) The two-letter code referred to in ISO Standard 3166-1-alpha-2 (1) referred to in Article 67 (a) of Regulation (EU) 2016 / 2031 for the Member State in which the professional operator issuing the plant passport is registered, the national registration number of the professional operator concerned (letter, numerical or alphanumeric code) (B).
(21) Where applicable, traceability code for a plant, plant product or other object (C).
(22) Where applicable, the two-letter code referred to in ISO Standard 3166-1-alpha-2 referred to in Article 67 (a) of Regulation (EU) 2016 / 2031 for the Member State (s) of origin (D). ';
