GOVERNMENT REGULATION
of 15 January 2025
o Protected Landscape Area Soutok
The Government orders pursuant to § 25 (3) and § 27 (1) of Act No. 114 / 1992 Coll., on Nature and Landscape Protection, as amended by Act No. 218 / 2004 Coll.:
Protected Landscape Sovereign
To ensure the conservation of nature and landscape, the Protected Landscape Region of Soutok is announced.
Mission and object protection of the protected landscape area
(1) The mission of the protected landscape area is:
(a) maintaining and improving the natural, cultural and historical values and natural functions of the landscape while developing an environmentally optimal use of the landscape and its natural resources; and
(b) the maintenance of the diversity of components and phenomena of non-living nature and of ecosystem and species diversity, in particular the preservation and improvement of the state of the native forms of the relief resulting from the activities of watercourses, the water regime of groundwater and surface water ensuring the existence of indigenous and other water and water-bound communities, including rare plant species, fungi and animals, surface spills in the water streams in flood areas outside the built-up areas, and the installation and restoration of the favourable status of the protected areas of Niva Dyje, the European significant sites of Soutok-Podluží, Ptáčí region of Soutok-Hardonická and Ptáčice ponnik.
(2) Protected landscape areas are the object of protection
(a) a man-made landscape harmoniously connecting cultural monuments from different historical periods with natural sites and targeted vegetation;
(b) a cultural landscape with a typical landscape impact given in particular by the character of the river niva of the rivers Moravia and Dyje and their tributaries with an extensive complex of lowland meadow forests,
(c) mosaics of meadow, wetlands and aquatic ecosystems with a high concentration of cultural monuments and national cultural monuments associated with landscape composites, in particular in the Landscape Monument Zone of the Lednico-valtice and in the Slavic Hradic Areas;
(d) natural features of the landscape, in particular its ecological stability and resilience, migratory permeability, natural water regime with spills, water retention in the landscape, dynamics of river processes of watercourses and valleys;
(e) natural watercourses, periodically flowing or weaned river arms and ponds and other wetlands, and water and wetland communities linked thereto;
(f) forest communities of lowland meadow forests with high biological value and species diversity, hard ludges with oak trees with significant presence of senescent trees and smoldering wood, mixed ash-allied meadow forests, sown almonds and virgin duoborns, and to them a linked biota with rare plant species, fungi and animals;
(g) non-forest grassland communities, continental native meadows, mesophilic oats meadows and specific steppic vegetation on the above-laid sites, and the biota linked thereto;
(h) trees growing outside the forest, in particular solitaries and groups of old trees in the native meadows; and
(i) natural habitats and habitats of species which are the subject of the protection of the European Sovereign and European Sovereign sites of Niva Dyje.
Definition of the protected landscape area
(1) The protected landscape area is situated in the territory of the South Moravian Region.
(2) The designation of the border of the protected landscape area on the basis of a copy of the cadastral map is set out in the Annex to this Regulation and, including the electronic form, it is stored in the central list of nature protection1).
Breakdown of the protected landscape area
(1) The territory of the protected landscape area is divided into 4 zones of graduated nature conservation.
(2) In the I. zone, areas with the most significant natural values, high biodiversity or high ecological stability of the landscape, partly protected or proposed to be protected in one of the categories of small-scale specially protected areas, in particular naturally meadow sections of watercourses, old river shoulders, watered meadow habitats, preserved grassland crops with a high proportion of indigenous trees, a varied species, spatial and age composition and a high proportion of senescent trees, natural and nature-close meadow ecosystems with the presence of senescent trees and rare and protected species of plants and animals, specific steppic vegetation at the level of the localities and other habitats relevant for biodiversity.
(3) In the II. zone, the territory of economically exploited forest, meadow and aquatic ecosystems with a higher share of the nature of nearby communities, locally preserved natural values, old crops, crops with the presence of Senescent trees or specially protected species, other naturally valuable areas that are economically used by nature in a gentle manner, including some specially protected areas in the natural heritage category, and which are mostly connected to the territory of the I Nature Protection Zone, and areas of value from the point of view of the landscape, in particular preserved historical objects, small structures of the Lednicovaltice area with maintained surroundings and meadows with the appearance of individual old dominant trees.
(4) In the III zone, the human activity is dominated by highly altered and intensively managed ecosystems, including regularly maintained parts of the castle grounds in Lednice and intensely cultivated agricultural land used primarily as arable land, outside built-up areas and not included in other conservation zones.
(5) The IV zone consists of the remaining built-up areas or built-up areas, liner structures, motorways and railways not included in other zones of nature conservation.
Closer protection conditions
(1) Only with the consent of the Nature Protection Authority can the whole area of the protected landscape be protected
(a) to intervene outside the built-up territory in the natural retention capacity of the estuaries of the Morava and Dyje rivers and their tributaries, provided that a change in the water regime can be caused, in particular to carry out land work, land change or mining, similar to them and related work; consent is not required for:
1. terrain modifications carried out on the basis of permits under construction law;
2. operations related to the maintenance, operation or repair of water-borne objects for the production of drinking water; or
3. activities carried out by watercourses managers or water works owners under the Water Act, including activities carried out in connection with flood protection;
(b) to modify or modify the riverbed of watercourses, in particular to create transverse barriers, steps and thresholds, or to move the sediment, unless the activities requiring authorisation or other action under the Water or Construction Act are concerned;
(c) carry out activities which may reduce surface water or groundwater levels or intentionally alter surface water levels outside the built-up territory or in the space to be built, unless such activities require authorisation or other action under the Water or Construction Act or the handling of water levels in accordance with the approved handling order;
(d) to remove coastal areas and floating or immersed vegetation of ponds and other water tanks;
(e) de-mud ponds and other water tanks, store extracted sediment, mine minerals, perform geological work, mining or mining activities;
(f) keeping or releasing wild ducks;
(g) to plant fish outside the fishing zones and water tanks for fish farming;
(h) renew or maintain the elements of drainage, except for authorised objects for water handling according to the approved treatment schedule;
(i) organise and organise events involving more than 500 participants outside the places reserved by the nature conservation authority;
(j) indicate pedestrian, cycling, equestrian, water or cross-country routes and other similar routes, routes and routes outside the infrastructure;
(k) to place information, advertising or promotional equipment outside the built-up territory or the stationary areas;
(l) to place outside closed public lighting objects and other lamps whose luminous flux is directed above the horizontal passing through the centre of the lamp, unless it is temporary portable lighting required by other legislation; or
(m) carry out the aerial application of biocides and fertilisers.
(2) In the territory of the I and II protected landscape area, only with the consent of the nature conservation authority may it be possible
(a) take-offs and landings with sports flying equipment;
(b) operate unmanned systems, except for flights to ensure the safety of the state, the protection of persons and their health, property or public order, and flights for the needs of nature conservation authorities;
(c) to sever grassland on all types of land, to carry out their restoration and attachment;
(d) mulch grassland outside the maintenance of the infrastructure body; or
(e) to carry out random mining of oak, elm, lip, pear and apple trees in crops over 80 years of age and domestic types of poplar and willow crops over 40 years of age, unless it is necessary for the immediate protection of the lives or health of persons or the immediate protection of property.
(3) On the territory of the I. zone of the protected landscape area, intentional logging may be carried out only with the consent of the nature conservation authority, which has not been located in an approved forest management plan or in a taken-over forest economic curriculum.
(4) Only with the consent of the nature conservation authority can up to 60% of the annual volume of intentional logging in the crop be placed in the territory of the II. zone of the protected landscape area, provided that they have not already been placed in an approved forest management plan or in a taken-over forest economic curriculum or have not been placed under an agreement with the nature conservation authority during the period of validity of the forest management plan or forest economic curriculum.
(5) Only with the consent of the nature conservation authority can the area of the III zone be protected
(a) planting plantations of indigenous timber on land not intended for the performance of forest functions; or
(b) to sever permanent grassland outside the built-up areas or areas.
Efficacy
This Regulation shall take effect on 1 July 2025.
