on the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics on the Simplified Way of Crossing State Borders for Citizens with Permanent Stay in the Border Municipality
On 6 December 1985, the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics was signed in Prague on a simplified way of crossing state borders for citizens with permanent residence in border municipalities. The Agreement entered into force on 25 March 1986 pursuant to Article 16 thereof.
The Czech version of the Agreement is hereby published at the same time.

AGREEMENT
between the Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics on the simplified way of crossing state borders of citizens with permanent residence in border municipalities
The Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics, led by the desire to further develop and deepen brotherly friendship and cooperation between the two states, in order to allow, under simplified conditions, the crossing of the Czechoslovak-Soviet state borders of the citizens of the two States who are resident in the border municipalities or participate in joint joint joint joint cooperative actions at or near state borders, in accordance with the Treaty between the Czechoslovak Socialist Republic and the Union of Soviet Socialist Republics on the regime at the Czechoslovak-Soviet state borders, cooperation and mutual assistance in border issues of 10 February 1973, have been agreed as follows:
(1) State citizens of the Czechoslovak Socialist Republic and the Union of Soviet Socialist Republics who are resident in border municipalities or participate in joint joint collective actions at or in the immediate vicinity of national borders may, in accordance with the provisions of this Agreement, cross national borders in a simplified manner.
(2) The list of border municipalities is set out in Annex 1.
Simplified crossing of state borders takes place on the basis of an identity card (for CSSR citizens) or passport (for USSR citizens) and a single border pass or a namelist annexed thereto.
A single border pass shall be issued by the competent authorities of the Contracting Parties. These authorities shall exchange models of a single border pass.
(1) A one-off border pass authorises the crossing of national borders and the stay in the border municipalities in that pass. The holder of this pass may cross national borders within two weeks of the date of issue. The duration of stay in the border municipalities listed in the single border pass shall not exceed seven days; in specific cases, this period may be extended with the agreement of the competent authorities of the Contracting Parties.
(2) The names and surnames of children of CSSR citizens under 15 years of age, and the names and surnames of children of USSR citizens under 16 years of age travelling with parents or legal representatives, are entered in their pass.
(1) A one-off border pass shall be issued to the State citizen of the CSSR or the USSR referred to in Article 1, who intends to visit his relatives who are resident in the border municipalities listed in Annex No 1, if he intends to marry, give birth of a child, death or serious illness.
(2) Relatives referred to in paragraph 1 shall mean parents, children, siblings, grandparents, grandparents, grandchildren, grandchildren, husband, wife, son-in-law, daughter-in-law, brother-in-law, sister-in-law and father-in-law.
Disposable border passes shall be issued on the basis of written requests by state citizens of the CSSR or the USSR. Applications shall be accompanied by a telegram or letter from relatives, containing the reasons for the visit referred to in Article 5 (1), certified by the competent authorities of the Contracting Parties.
(1) A one-off border pass shall be issued to the group leader for joint collective actions at or in the immediate vicinity of the national borders, the name of the participants in the action being certified by the competent authorities. The group leader and other participants in the action shall carry with them a document verifying their identity.
(2) National citizens of the CSSR or the USSR who are not resident in the border municipalities listed in Annex 1 may also be entered in the list.
(1) Simplified crossing of national borders takes place at the places listed in Annex 2.
(2) In specific cases, border agents of the Contracting Parties may, by mutual agreement, authorise one-off crossing of national borders beyond the places listed in Annex 2.
(3) Simplified crossing of state borders takes place between dawn and dusk.
Delegations and groups of state citizens of the CSSR or of the USSR in the framework of cooperation and friendly contacts of party authorities in border counties may cross national borders in the places listed in Annex 2 in the manner laid down in the Agreement between the Government of the Czechoslovak Socialist Republic and the Government of the Union of Soviet Socialist Republics on the conditions of reciprocal travel between citizens of both States of 17 December 1981.
Where emergency medical assistance is necessary, health professionals may cross national borders by mutual agreement between border agents of the Contracting Parties and outside the places listed in Annex 2 and at any time on the basis of an identity card or passport.
Citizens of one State who cross national borders in a simplified manner are obliged to register and withdraw their residence in the territory of another State. The border agents of the Contracting Parties shall inform each other of the arrangements for applying and checking out the residence of these citizens.
In the event of a loss of a single border pass, the holder shall immediately inform the border authorities of the State in whose territory the loss occurred.
(1) National citizens of the CSSR or of the USSR who cross national borders in a simplified manner are subject to border, customs and foreign exchange control, which shall be carried out in accordance with the relevant provisions of the Contracting Parties.
(2) The items of personal needs, gifts, national currencies, valuables and foreign exchange assets exported and imported by CSSR or USSR citizens crossing national borders in a simplified manner shall be released on the basis of the customs and foreign exchange rules of both States and the relevant agreements.
(1) Citizens of one State who reside under this Agreement in the territory of another State are obliged to comply with its national law.
(2) Border agents of the Contracting Parties shall inform each other of cases of non-compliance with the provisions of this Agreement and shall, where necessary, take the necessary measures.
(1) In order to protect health, veterinary and plant protection, each Party may temporarily restrict the effectiveness of this Agreement.
(2) The Contracting Parties shall immediately inform each other of the measures taken pursuant to paragraph 1.
This Agreement shall be subject to approval in accordance with the national legislation of the Contracting Parties and shall enter into force on the date of the exchange of notes informing of such approval.
This Agreement shall be concluded for a period of 10 years and shall be automatically extended for a further period of five years, unless it is terminated by one of the Contracting Parties not later than six months before the expiry of the relevant period of validity of the Agreement.
