DECLARATION
Federal Ministry of Agriculture and Nutrition
of 31 August 1977
amending Decree No. 63 / 1964 of the Ministry of Agriculture, Forestry and Water Management Coll., on protection against introduction of pests and plant and weed diseases at import, transit and export (external quarantine)
The Federal Ministry of Agriculture and Nutrition provides in an agreement with the participating central government bodies pursuant to § 21 and § 39 of Act No. 61 / 1964 Coll., on the development of plant production:
Čl. I
Decree of the Ministry of Agriculture, Forestry and Water Management No. 63 / 1964 Coll., on protection against introduction of pests and diseases of plants and weeds on importation, transit and export (external quarantine), is amended as follows:
1. Paragraph 9 repeals paragraph 2 and paragraphs 3 to 5 are renumbered paragraphs 2 to 4.

"Customs shall not release goods or objects without a plant health inspection, except where a random inspection is carried out (Annex 2) or is waived (Annex 3). In road transport, the border customs office shall release goods and objects without a plant health inspection in a reference procedure only at the nearest customs office, which shall also be the place of the plant health inspection in this mode of transport (Annex 7). '

"(c) to ensure the transport of goods at points where plant health inspections are carried out by mode of transport (Annex 7) when exported.";
4. Paragraph 23 (2) reads as follows:
"(2) Plant health inspection of seed, seed, malt and all goods carried by means of road transport subject to plant health inspection, shall normally be carried out at the place of loading." Where it requires a State to which seed, seed including hop lard and spices and nurseries are exported, a plant health inspection shall be carried out on crops. The inspector, if notified in due time by the domestic supplier, shall be obliged to carry out these inspections at a time specified by the supplier. ';
5. Article 25 reads:
"Plant health inspections of imported, exported and accompanying goods and articles, except those referred to in Section 23 (2), shall be carried out by mode of transport at the places listed in Annex 7. In travel, a plant health inspection shall be carried out on importation and transit at the border customs office. ';
6. Where the terms "entry and exit points' are used in the Decree, these terms shall be replaced by" plant health inspection points'.
7. Annexes 1 to 7 are replaced by the Annexes attached to this Order.

This decree shall take effect on the day of its publication.

(a) Live pests are assessed at all development stages. For pests identified in text *), both live and dead pests are assessed in all developmental stages.
(b) In the detection of pests in the group And the inspector won't give his consent to a customs hearing.
(c) When group B pests are detected, the inspector shall indicate on the transport document the conditions under which goods and articles may be released for distribution in the country without further control, namely rendering, cleaning or separate storage and preferential processing.

List of goods and articles the import of which is not subject to approval by the Ministry of Agriculture and Nutrition of the Czech Republic or the Ministry of Agriculture and Nutrition of the SSR, which need not be accompanied by a phytosanitary certificate and for which a plant health inspection is carried out at random
1. African grass, gooseberries, artichoke, blueberry-fruits, potato flour, cranberries, chicory pucks, beans-pods, hop heads dried, juniper-fruits, cork and cork waste, dead animal pests in all stages of development with the exception of the pests listed in Annex 1, raw hides and skins, sauteed flowers (excluding chrysanthemums, roses and carnations) imported in the course of the journey, lufa, lard, raspberry-fruits, cucumbers, orobinica, decurled wood and sawn wood, spur-fruit, saffron, piasava, revean- stems, vegetable goods
2. Stocks of food of plant origin of travellers and of crews of means of transport in travel in quantities authorised for import free of duty, excluding plants and parts thereof, intended for further cultivation. The means of transport of all kinds and packaging material of plant origin are also subject to random inspections.

List of goods and articles the import of which is not subject to the approval of the Ministry of Agriculture and Nutrition of the Czech Republic or of the Ministry of Agriculture and Nutrition of the SSR, which need not be accompanied by a phytosanitary certificate and for which plant health inspection is waived
Vegetable goods in a preserved and frozen state, and peat products, which are surprised, candied fruit, fruit and vegetables. Furthermore straw, wood, roots, wicker goods, provided they are preserved by paint, paint or other similar means.

List of goods and articles whose introduction into the CSSR is not authorised in principle
1. live oak plants except acorns;
2. live plants of edible chestnut with the exception of seeds;
3. live plants of tobacco of all species (Nicotiana spp.) excluding seeds;
4. live hop plants and their live parts, including seeds;
5. soil and compost excluding:
(a) clay lodged on potatoes up to 1% by weight for seed potatoes, 2% by weight for other potatoes;
(b) clay in potted ornamental plants;
6. live poplar plants (excluding cuttings) and conifer (except ornamental);
7. seed of raspberry and peaches from America;
8. host plants Ervinia amylovora and Grapevine flavescence dorée from countries where the occurrence of these diseases has been detected.

Annex No 5 to Decree No 51 / 1977 Coll.
List of goods and articles the importation of which is subject to special conditions
I. Plants with roots, tubers and onions of plants (excluding drinking vegetables and drugs)
1. they must come from growers whose land is free of bacterial ring rot (Corynebacterium sepedonicum), PWN (Ditylenchus destructor), Meloidogyne and potato cancer (Synchytrium endobioticum);
2. they must come from growers whose land is free of PWN of the species Heterodera rostochiensis and Heterodera pallida, which must be examined by analysing soil samples taken not earlier than 30 days before the mass crop, at the latest at the time of harvest;
3. must come from growers whose parcels have not been found to contain potato cancer and the parcels are not present on the premises of aggressive biopsies.
II. Trainings (seedlings, cuttings, grooves, eyes, cuttings)
1. they must come from nurseries regularly controlled by the plant health service in which, for two growing seasons, Japanese lambs (Leukapsis japonica) and perniciosus have not been detected in the immediate vicinity;
2. they must come from cultures in which the presence of viral diseases, mycoplasmosis and rickettsia listed in Annex 1 has not been detected by the phytosanitary service in the last two years;
3. must come from an area where the occurrence of Japanese listocase (Popilia japonica) has not been detected.
III. Strawberry seedlings must be obtained from meristem cultures or tested according to an approved methodology and found to be free from Phytopthora fragariae.
IV. Reproductive material of plants of the genus Dianthus, Chrysanthemum, Pelargonium, Rosa shall come from growers for which the plant health service has not been established during vegetation the presence of pests listed in Annex 1, Group A.
V. Seeds and seed must come from the crops controlled during vegetation by the plant health service and free from pests transmissible by the seed and seed listed in Annex 1.
VI. Potatoes (tubers of Solanum tuberosum) and grass seed can only be imported into places with which the Ministry of Agriculture and Nutrition of the Czech Republic or the Ministry of Agriculture and Nutrition of the SSR has agreed.
VII. Only an organisation designated by the Federal Ministry of Agriculture and Nutrition may import live pests and dead pests listed in Annex 1 to Group A (in all development stages) only for scientific purposes and with the agreement of the Ministry of Agriculture and Nutrition of the Czech Republic or the Ministry of Agriculture and Nutrition of the SSR.
VIII. Fruit and vegetables affected
1. fruit propeller (Ceratitis capitata) may be used only by canning in plants intended for this purpose by the Director-General of the Conservative Industry, with the agreement of the Ministry of Agriculture and Nutrition of the CSSR or the Ministry of Agriculture and Nutrition of the SSR;
2. the bacterial spots of tomatoes (Xanthomonas vesicatoria), the bacterial defects of tomatoes (Corynebacterium michiganense) may only be used in places with which the Ministry of Agriculture and Nutrition of the Czech Republic or the Ministry of Agriculture and Nutrition of the SSR has given its approval;
3. Quadraspidiotus perniciosus can only be imported without restrictions between 15 November and 1 March. Outside this period they can only be used in places with which the Ministry of Agriculture and Nutrition of the Czech Republic or the Ministry of Agriculture and Nutrition of the SSR has given its consent.
IX. In the event that the specific conditions referred to in point IV are not specified in the phytosanitary certificate, the inspector shall not give his consent to the customs procedure.

According to the agreement of the Central Control and Examination Institute of Agricultural in Prague or the Central Control and Examination Institute of Agricultural in Bratislava with the importer, a plant health check shall be carried out outside the prescribed working hours for rapidly corruptible goods.

Goods of plant origin, the plant health inspection of which has been carried out by the Czechoslovak authorities of the plant health service in the territory of a foreign State with appropriate marking on the transport document (Section 21 of the Ordinance), may be transported to the CSSR through any border crossing point without further plant health inspection.
1) In the case of pests identified in the text 1), the incidence on the educational material (cords, seedlings, grafts, cuttings, eyes) shall be assessed.
2) after opening.
3) In the case of deliveries of more than 5 units of potatoes, these potatoes are checked into the station in Czernolesia (PLR).
