on the provisional application of the Protocol to the General Agreement on Tariffs and Trade of 30 October 1947 (No 59 / 1948 Coll.), as agreed in Torquay on 21 April 1951.
Under Section 1 of Act No 66 / 1949 Coll., on the provisional implementation of international economic agreements of a general nature, I declare:
According to the Resolution of the Government of the Czechoslovak Republic of 3 July 1951 and with the agreement of the President of the Republic, the Protocol to the General Agreement on Tariffs and Trade, negotiated in Torquay on 21 April 1951, before the approval of the National Assembly, is given to all the Contracting Parties to the General Agreement and to all States which, under the Treaties in force, are entitled to the highest benefit in the field of customs duties in the Republic of Czechoslovakia from 8 July 1951. This provision also applies to Annex A (instrument X - Czechoslovakia) to the Protocol, which contains the conventional duty rates agreed for imports into Czechoslovakia.
The Minister for Foreign Affairs will announce by decree in the Collection of Laws the extension of the Protocol to other states.
If some acceding States in the Protocol do not become Parties to the General Agreement on Tariffs and Trade within the prescribed time limit, the Minister of Finance may declare, in an agreement with the Foreign Ministers and Foreign Trade, in accordance with Article 4 of the Protocol to the General Agreement on Tariffs and Trade negotiated in Torquay by decree in the Collection of the Laws on the Revocation of Customs Discounts negotiated with them.
The Protocol was negotiated in English and French. The original text in both languages was published by the United Nations and came out in New York.
In the annex to this Government Order, the Protocol is published in the original English and French versions and in the Czech translation. The list X - Czechoslovakia, annexed to it, is published in the original English version and in the Czech translation.
The signature of Czechoslovakia has been made subject to the condition that it does not imply either direct or indirect recognition of West Germany and South Korea and their legal capacity to accede to the Protocol.
This Protocol is published in the Annex to the Collection of Laws on page 5.

to the General Agreement on Tariffs and Trade negotiated in Torquay.
Governments which are Contracting Parties to the General Agreement on Tariffs and Trade on a date that is the date of this Protocol (in the next "current Contracting Party" or "General Agreement"), the Government of the REPUBLIC OF AUSTRIA, the FEDERAL REPUBLIC OF GERMANY, the REPUBLIC OF KOREIA, PERU, the REPUBLIC OF FILLIPIN AND THE REPUBLIC OF TURKEY (in the next "acceding Government") and the Eastern REPUBLIC of URUGUAA, which may accede to the General Agreement within the framework of the Protocol on Access negotiated in Anneca in accordance with the Decision of the Contracting Parties of 9 November 1950 (in the next "Uruguay"), "
TAKING INTO ACCOUNT the results of the negotiations concluded in Torquay,
HAVE AGREED, via their representatives, on the following provisions:
1.
(a) Subject to the provisions of this Protocol, any acceding governments whose access has been decided pursuant to Article XXXIII of the General Agreement shall, as from the date on which this Protocol enters into force under paragraph 11, give provisional effect to:
(i) Parts I and III of the General Agreement; and
(ii) Part II of the General Agreement is fully compatible with its laws in force at the date of this Protocol.
(b) The commitments referred to in paragraph 1 of Article I of the General Agreement, with a reference to Article III thereof, as well as the commitments referred to in paragraph 2 (b) of Article II with a reference to Article VI, shall be deemed to fall within Part II of the General Agreement for the purposes of this paragraph.
(c) For the purposes of the General Agreement, the instruments listed in Annex B shall, from their entry into force in accordance with paragraph 11, be considered as instruments of acceding governments annexed to the General Agreement.
2. The date on which this Protocol enters into force for the acceding Government pursuant to paragraph 11 thereof, that Government shall become a Contracting Party as provided for in Article XXXII of the General Agreement.

(a) The instrument relating to the current Contracting Party or Uruguay, as listed in Annex A, shall take effect on the 30th day following the date on which this Protocol is signed by that Contracting Party or Uruguay, or on the 46th day following the date of this Protocol, but at any time at a later date.
(b) Parts of the documents contained in the Annex This Protocol, which is the result of the negotiations and agreements referred to in paragraph 1 of Article XXVIII of the General Agreement, may, by agreement of the Parties, be entered into force after the date of this Protocol and before the date laid down in subparagraph (a), provided that:
(i) that the replacement arrangements negotiated at the place of the rebates or reductions contained in the existing instruments of the General Agreement will not be put into effect later than those appeals or reductions; and
(ii) that any government wishing to bring into force part of its instrument referred to in this subparagraph shall notify the Secretary-General of the United Nations at least 30 days in advance of the date on which the measure envisaged becomes effective.
(c) Parts of the instruments contained in Annex A which are the result of negotiations and agreements in accordance with the procedure laid down by the Contracting Parties may, subject to the agreement of the Contracting Parties, be put into effect before the date laid down in the subparagraph (a), provided that the arrangements negotiated as compensation for the rebates or reductions contained in the existing instruments of the General Agreement are not put into effect later than such appeals or reductions.
(d) As soon as any instrument has become effective under subparagraph (a) or as soon as any part of the instrument has been put into effect under subparagraph (b) or (c), such instrument or part of the instrument (together with all the provisions of the instrument in Annex A relating to that part) shall become the instrument of the Government concerned forming part of the General Agreement. Where the treatment provided for in Annex A for certain goods differs from that laid down for the same goods in the current instrument of the General Agreement relating to the same Government, the treatment provided for in the instrument contained in Annex A shall apply, provided that that instrument remains in force under the provisions of this Protocol.
(e) For the purposes of this Protocol, the "existing instruments" of the General Agreements mean the instruments annexed to the General Agreement and to the Protocol on the conditions of access agreed in Annecy, as amended by the provisions of all the instruments repair and modification protocols or (ii) any other measure which was effective on 28 September 1950 and which was made in agreement with the specific provisions of the General Agreement or in accordance with the procedure laid down by the CONTRACTING PARTIES.
4. Any government which has signed this Protocol may at any time suspend or revoke, in whole or in part, any discount contained in the relevant instrument annexed to this Protocol which it finds to have been originally negotiated with a Government which has not signed this Protocol, provided that:
(i) a government which suspends or withdraws any such discount in whole or in part shall inform all Contracting Parties, the acceding Governments and Uruguay within 30 days of the date of suspension or cancellation and shall consult any Party having a substantial interest in the product concerned on request;
(ii) any such suspensions or cancellations shall cease to be effective on the 30th day following the date on which the Government with which they were originally negotiated signs this Protocol;
(iii) this paragraph does not entitle the cancellation or suspension of the replacement arrangements resulting from the negotiations or agreements referred to in subparagraphs (b) and (c) of paragraph 3, unless any cancellation or reduction of the discounts entered into the existing instruments of the General Agreement for which such replacement arrangements have been negotiated is suspended or cancelled for an equal period of time.
5.
(a) Whenever the date of this Agreement is referred to in Article II of the General Agreement, the date of this Protocol shall be understood as regards the instruments annexed to this Protocol.
(b) Whenever, in paragraph 6 of Article V, subparagraph 4 (d) of Article VII and in paragraph 3 (c) of Article X of the General Agreement, the date of this Agreement is referred to, for each acceding government, to be 24 March 1948.
(c) Where paragraph 11 of Article XVIII of the General Agreement refers to the dates of 1 September 1947 and 10 October 1947, it is understood as regards each acceding government, 1 November 1950 and 15 January 1951 respectively.
(d) Where paragraph 1 of Article XXVIII The General Agreement refers to 1 January 1951, as regards the instruments annexed to this Protocol, 1 January 1954.
6.
(a) In the text of paragraph 1 of Article XXVIII The General Agreements shall be deleted from "Starting from 1 January 1951 'and replaced by" Starting from 1 January 1954'.
(b) The signature of this Protocol under paragraph 10 shall be deemed to be the deposit, within the meaning of paragraph 2 of Article XXX of the General Agreement, of the instrument of acceptance of the amendment referred to in paragraph (a).
(c) The amendment referred to in the subparagraph (a) shall become effective in accordance with paragraph 1 of Article XXX of the General Agreement as soon as this Protocol is signed by two thirds of the governments that will be Contracting Parties at that time.
(d) Notwithstanding the provisions of the subparagraph (c), the amendment referred to in the subparagraph (a) shall not be effective as regards the discounts initially agreed by the Contracting Party signing this Protocol with the Contracting Party which neither signed this Protocol nor the Declaration on the continued validity of the instruments of the General Agreement on Tariffs and Trade annexed to the Final Act signed in Torquay on 21 April 1951.
7.
(a) The provisions of the General Agreement to be implemented by the acceding Government are contained in the text annexed to the Final Act of the Second Meeting of the Preparatory Committee of the United Nations Conference on Trade and Employment, taking into account the corrections, amendments, additions or other adaptations made by the following Contracting Acts:

as well as any other contractual acts drawn up by the CONTRACTING PARTIES which may be effective on the date on which this Protocol becomes effective for the Government concerned.
(b) The signature of this Protocol acceding to the Government means that the Government accepts the corrections, amendments, additions and other adaptations to the General Agreement, made by the contractual acts listed in the subparagraph (a), as well as all other contractual acts drawn up by the CONTRACTING PARTIES and open to adoption which have not yet been in force on the date on which this Protocol enters into force for the Government concerned. Such acceptance shall become effective on the same day as the signature of this Protocol by this Government.
(c) Without prejudice to any measure taken by a Contracting Party within the meaning of Article XXXV, the signature of this Protocol shall constitute a Contracting Party or Uruguay - unless something derogatory is declared to it at the time of its signature - that it accepts the corrections, amendments, additions or other adaptations to the General Agreement made by the Contracting Parties listed in the subparagraph (a), as well as any other Contracting Parties and open for adoption which have not yet been signed or accepted by that Contracting Party or Uruguay on the date of signature of this Protocol by that Contracting Party or by Uruguay; This acceptance shall become effective on the date of signature.
8. Any acceding government which has signed this Protocol may terminate at any time the provisional application of the General Agreement; the statement shall take effect 60 days after receipt by the Secretary-General of the United Nations of a written notification thereof.
9.
(a) Any acceding government which has signed this Protocol and has not submitted a notice of termination pursuant to paragraph 8 may, on the date on which the General Agreement referred to in Article XXVI enters into force, accede to the Agreement under the conditions laid down in this Protocol by deposit with the Secretary-General of the United Nations an instrument of access. Access shall become effective on the day on which the General Agreement pursuant to Article XXVI enters into force or on the 30th day following the entry into force of the instrument of access, but at any later date.
(b) Access to the General Agreement referred to in the subparagraph (a) will be deemed to have been accepted for the purposes of paragraph 2 of Article XXXII of the Agreement under its Article XXVI, paragraph 3.
10.
(a) The original text of this Protocol shall be open for signature by the Parties and by the acceding Governments on 21 April 1951 in Torquay. It will then be deposited with the Secretary-General of the United Nations and will be open for signature at the headquarters of the United Nations from 7 May 1951 to 21 October 1951 for the current Contracting Parties and the acceding Governments and Uruguay, provided that Uruguay has previously signed the Protocol on the conditions of access negotiated in Annecy, in accordance with the decision of the CONTRACTING PARTIES of 9 November 1950.
(b) The Secretary-General of the United Nations shall immediately send a certified copy of this Protocol to all members of the United Nations and other governments participating in the United Nations Conference on Trade and Employment, as well as to all governments having an interest, and shall inform them of any signature of this Protocol, of any deposit of the instrument of accession referred to in paragraph 9 (a) and of any notification pursuant to paragraph 3 (b) or 8.
(c) The Secretary-General of the United Nations is hereby authorised to register this Protocol in accordance with Article 102 of the Charter of the United Nations.
11. Provided that a decision has been taken within the meaning of Article XXXIII The General Agreement on the approval of the acceding government's access, this Protocol, including the instrument relating to the acceding government and contained in Annex B, will become effective for that acceding government
(a) on 20 July 1951, if this Protocol is signed by the acceding Government on 20 June 1951, or
(b) on the 30th day following the date on which it was signed by the acceding government, unless the acceding government was signed by the latter on 20 June 1951.
The date of this protocol will be 21 April 1951.

(1) Plemenný dobytek ras uvedených v saz. čís. 64 a 65 se vyclí v dovozu sjednanými sazbami, předloží-li dovozce předepsané osvědčení, vydané Jednotným svazem českých zemědělců nebo Jednotným svazem slo- venských rolníků. Toto osvědčení musí být potvrzeno nálezem československého úředního zvěrolékaře, pověřeného zvěrolékařskou prohlídkou při dovozu, že jde v souhlase s údaji příslušného dobytčího pasu o dovoz plemenného dobytka ras uvedených v osvědčení.
(2) Bavlněná příze a tkaniny z bavlněné příze uvedené
v poznámkách k saz. čís. 183-188 a k saz. čís. 189-192 budou požívat výhod podle těchto poznámek, budou-li při dovozu doprovázeny osvědčením výrobce země původu, že příměs umělých vláken nečiní více než 10% celkové váhy příze.

Československým celním orgánům se vyhrazuje právo přezkoumat správnost osvědčení rozborem vzorků dováženého zboží.
(3)Sazební číslo 452 zahrnuje také kosy a srpy zcela
nebo částečně pokostované, lakované, bronzované, leštěné nebo s barvami popouštěcími (vzniklými při kalení), jakož i popsané písmem podle patrony, ozdobené vybroušenými čarami nebo tečkované údery kladivem, i když tečkování tvoří řádky nebo vzory.
(4) Při celním projednávání armatur se nepřihlíží
k ucpávkám jakéhokoli druhu.
Všeobecné poznámky.
Specifické celní sazby Kčs 50.- a méně za 100 kg
se rozumějí z hrubé váhy.
