of 16 June 1956
on the International Convention replacing the Convention on the International Cold Institute, negotiated on 21 June 1920 and amended on 31 May 1937, negotiated in Paris on 1 December 1954.
On 1 December 1954, the International Convention replacing the Convention on the International Cold Institute, negotiated on 21 June 1920 and amended on 31 May 1937, was negotiated in Paris.
The President of the Republic ratified this Convention on 31 January 1956 and the instrument of ratification was deposited with the French Government on 27 March 1956. According to its Article XXXIV, it therefore became effective for the Czechoslovak Republic on 27 March 1956.
The Czech translation of this Convention is declared as a separate part of the Annex to the Collection of Laws. *)

INTERNATIONAL CONVENTION
replacing the Convention on the International Cold Institute, negotiated on 21 June 1920 and amended on 31 May 1937.
Governments of the member countries of the International Cold Institute,
Believing that low-temperature science is constantly developing, opening new perspectives for progress and prosperity,
taking the view that the use of artificial cooling is extended to new areas,
Believing that the exchange of perishable food between the different nations of the globe is increasing, allowing for more effective and more effective international solidarity with regard to nutrition, but causing the need for more significant refrigerating agents to handle and conserve these foods,
CONSIDERING that the Convention establishing the International Institute of Cooling, negotiated on 21 June 1920 and amended on 31 May 1937, does not fully comply with the requirements of the nature of the scientific and technical situation created by this situation and the current economic situation,
agree on the following provisions:
PURPOSE - NAME - MONITORING - SCOPE.
Purpose, title and seat.
(1) The Parties agree to cooperate closely in the study of scientific and technical problems relating to cooling and the development of the use of cooling that increases people's well-being.
(2) To this end, they undertake to maintain and maintain the International Institute of Cooling (hereinafter referred to as "the Institute '), whose registered office is in Paris.
Scope.
The purpose of the Institute is to, in the international field, in everything relating to the study of cooling, the production of cold and the use of cooling:
(a) assist in the development of scientific research in different Member States and promote technical and economic studies on a national and international scale;
(b) collect scientific, technical and economic information and documents, as well as texts of laws and regulations;
(c) facilitate teaching and popularisation of science and technology;
(d) publish all documents and studies the extension of which may be useful;
(e) facilitate the development of the use of cooling, in particular in the fields of agriculture and nutrition, industry and hygiene and health;
(f) make recommendations to governments and international organisations and, in particular, propose measures to improve and harmonise legislation;
(g) has been in contact with national and international associations interested in securing its action programme;
h) Organised International Congress;
(i) take all measures to promote the idea and use of cooling.
MEMBERS.
Member States, approaches.
The members of the Constitution shall, as Member States, enjoy rights and subject to the obligations defined by this Convention:
(a) the Contracting States;
(b) territories designated by those States when signing this Convention and appearing on the annexed list;
(c) States which are not Contracting States to this Convention if they accede to the said Convention and if the Executive Committee decides to adopt them;
(d) territories which are not included in the list set out above if the Contracting States responsible for their international contacts inform the Institute thereof and if the Executive Committee decides to accept them.
Groups of Member States.
(1) In order to enable Member States to participate in the Institute's activities according to the importance of their economy and the interest they have in cooling problems, six groups of Member States shall be established; those groups shall be characterised in particular by the amount of cash contributions, the number of votes in the negotiations and the number of publications received free of charge by the Member States.
(2) Each Member State shall designate the group to which it wishes to be included.
Outputs and changes of the group.
Each Member State shall have the right to withdraw from the Constitution or to transfer to a lower group if it notifies it at least one year in advance. The transfer to a higher group may be made at any time by payment of a supplement to the corresponding allowance.
Representation of the establishment or association.
Under their own responsibility, Member States will be able to be fully or partially represented in the rights and obligations of the Constitution by eligible institutions or associations.
Contact with national associations.
Each Member State shall endeavour to associate with the Institute's work the main scientific, technical, cultural and professional associations which are interested in cooling issues.
Honorable members.
In exceptional cases, persons who have played a particularly important role in the cold science and in the cold industry and in the benefactors of the Institute may receive the title "Honourable Member" of the Institute from the Executive Committee's resolution.
Members.
(1) Eligible companies and eligible individuals involved in the development of cold science and the cold industry and undertake to make regular contributions, the amount and payment of which are determined by the Administrative Committee, may be appointed by the "associated members" of the Institute from the resolution of this Administrative Committee.
(2) Under the conditions laid down in the Protocol on the implementation of this Convention, members of the Association shall receive periodic publications, may participate in the work of commissions and meetings and may consult the documentation of the Constitution.
INSTITUTIONS AND ACTIVITIES.
General Assembly.
General Assembly clearance.
(1) The Institute is subject to the powers and supervision of the General Assembly.
(2) The General Assembly shall in particular have the following authorisations:
(a) giving general directives on the activities and work of the Institute;
(b) to establish a Protocol on the implementation of the Convention, which shall include in particular the manner in which the various provisions of this Convention are implemented, the status of employment and the internal rules of the General Assembly;
(c) electing the President and Vice-President of the Executive Committee;
(d) elects the President and Vice-President of the Technical Council and the President and Vice-President of the Commissions supplementing the Technical Council.
Composition and activity of the General Assembly.
(1) The General Assembly shall be composed of representatives designated by the Member States or eligible establishments and associations to be represented.
(2) The number of representatives of each Member State shall be as follows:
6 for Group 1,
5 for Group 2,
4 for group 3,
3 for Group 4,
2 for group 5,
1 for group 6.
(3) Representatives who are unable to attend a meeting have the right to represent one of their species at the General Assembly.
(4) The General Assembly shall hold regular meetings every 4 years. In addition, it shall be convened at a special meeting of its own decision or at the request of the Executive Committee.
(5) The General Assembly shall act by a majority of 2 / 3 of the representatives present or their alternates. However, in the election of the President of the General Assembly, in the election of the President and Vice-Presidents of the Executive Committee, and in the election of the members of the Technical Council, the absolute majority of the votes of the representatives present or their alternates shall be taken by the majority of the votes of the President and by the majority of the members of the Technical Council, respectively, in equal votes.
(6) The Director shall, by the power of his office, be the Secretary of the General Assembly.
Chairman of the General Assembly.
(1) The General Assembly shall elect a President when the ordinary session is opened.
(2) The chairman cannot be elected more than twice in a row.
(3) If the President is unable to chair a meeting, he or she shall be replaced by a Vice-President of the Executive Committee.
(4) The President of the General Assembly shall be invited to meetings of the Executive Committee, the Technical Council and the Management Committee and shall attend them with an advisory vote.
Executive Committee.
Authorization of the Executive Committee.
The Executive Director of the Institute shall be entrusted to the Executive Committee.
(a) The Executive Committee shall be responsible for implementing the directives of the General Assembly.
(b) It shall have full supervision over the administration of the Constitution.
c) Appoints the Director by secret ballot.
(d) It shall be settled in the budget.
(e) Approves agreements to be negotiated with other establishments.
(f) It shall take all measures necessary for the operation of the Constitution at all.
(g) It shall appoint delegates to the Administrative Committee.
(h) In addition, during the period between the meetings of the General Assembly, it shall be entitled to take a provisional decision on the items falling within the scope of the approval of the General Assembly, which shall be submitted for approval to the General Assembly at its next meeting.
Composition and activity of the Executive Committee.
(1) The Executive Committee shall consist of delegates designated by the Member States or eligible establishments and associations to be represented, one delegate per Member State.
(2) Any Member State or any establishment or association to be represented may also designate a alternate delegate.
(3) Each delegate in the Executive Committee shall have as many votes as the Member State he represents has representatives at the General Assembly.
(4) The President of the General Assembly, the President and the Vice-Presidents of the Technical Council, as well as the Chairpersons of the commissions, are invited to the Executive Committee and participate in it with an advisory vote.
(5) The Executive Committee shall meet at a regular meeting once a year. It shall meet at an extraordinary meeting at the initiative of its President or at the request of the Administrative Committee.
(6) The Executive Committee shall act by a majority of 2 / 3 of the votes. However, when choosing a director, an absolute majority is sufficient if the choice is not ensured after two rounds. The Committee shall act by an absolute majority in the other elections to be held by the Executive Committee, in which case the chairman shall have a decisive vote in the event of a tie.
(7) The Director shall, by the power of his office, be the Secretary of the Executive Committee.
(8) Where necessary, the Executive Committee shall establish internal rules within the framework of the Convention and the Protocol on Implementation.
The President and Vice-Presidents of the Executive Committee.
(1) The President of the Executive Committee and the Vice-President shall be elected by the General Assembly at a proper meeting of three to six.
(2) Neither the President nor the Vice-Presidents may be elected to the same office more than twice in a row.
(3) If the President or a Vice-President ceases to be a delegate in the Executive Committee or resigns for a period of four years, the Executive Committee shall elect an alternate at the next meeting at the earliest, the authorisation of the successor shall cease at the end of the four-year period concerned.
(4) The President and Vice-Presidents of the Executive Committee are invited to meetings of the Technical Council and participate in them with an advisory vote.
The Administrative Committee.
Authorisation, composition and operation of the Administrative Committee.
(1) The Administrative Committee shall be responsible for monitoring the activities of the Institute between the meetings of the Executive Committee and within the framework of the resolutions of the General Assembly and of the Executive Committee, and in particular for examining the financial and annual budget issues of the Executive Committee.
(2) The Administrative Committee includes the Chairman of the Executive Committee, who, by his authority, is the Chairman of the Administrative Committee, three members elected every four years by the Executive Committee and three members elected by the Technical Council every four years. These six members cannot be chosen more than twice in a row.
(3) The Administrative Committee shall meet at least three times a year on the initiative of its chairman.
(4) It shall be settled by a majority of votes, whereby the President's vote shall take a decision on the equality of votes.
(5) The Director shall be the Secretary of the Administrative Committee by the authority of his office.
(6) Where necessary, the Administrative Committee shall establish internal rules which shall be submitted for approval to the Executive Committee.
Technical Council and Commission.
Authorisation, composition and operation of the Technical Council.
(1) Technical and scientific problems falling within the scope of the Constitution are studied by the Technical Council and the Commission.
(2) The Technical Council includes the President, one to three Vice-Presidents and the President and Vice-Presidents of the Commission. The function of Chairman of the Technical Council shall be incompatible with that of Chairman or Vice-President of the Commission.
(3) Members of the Technical Council who are unable to attend a meeting have the right to be represented by one of their species.
(4) The President of the General Assembly and the President and Vice-Presidents of the Executive Committee are invited to meetings of the Technical Council and participate in them with an advisory vote.
(5) The President and Vice-President of the Technical Council shall be elected every 4 years by a proposal from the outgoing Technical Council of the General Assembly at a proper meeting. They may not be elected more than twice in a row to the same function.
(6) In the period between the meetings of the General Assembly, the Executive Committee shall replace the members who resign or who are unable to perform their duties, in which the mandates of the new members elected in this way shall cease at the same time as those of the other members.
(7) The Technical Council shall meet at a regular meeting once a year. It shall meet at a special meeting at the initiative of its President or at the request of one third of its members.
(8) It shall be settled by a simple majority of the members present, in which case the chairman shall have a decisive vote in the event of a tie.
(9) The Director shall, by the authority of his office, be the Secretary of the Technical Council.
(10) Where necessary, the Technical Council shall establish internal rules within the framework of this Convention and the Protocol on Implementation.
Authorisation, composition and activities of the commissions.
(1) The number of commissions and their authorisation are determined by the Implementation Protocol.
(2) Each Commission shall have a chairman, one or more Vice-Presidents and one or more Secretaries.
(3) The President and Vice-Presidents shall be elected by the General Assembly at its ordinary session. They may not be elected more than twice in a row to the same function.
(4) If neither the President nor any of the Vice-Presidents of a commission is a member of the country in which the next International Congress takes place, the Executive Committee may, on a proposal from the delegate of that country, designate another Vice-President whose function ends at the same time as the work of the Congress.
(5) The other members of the commissions shall be appointed by the Technical Council on proposals from the Presidents of the commissions, taking into account the recommendations of the Member States. The Technical Council may delegate to its Chairman an authorisation to carry out appointments between its meetings.
(6) The Secretaries shall be appointed by the Technical Council, acting on proposals from the Presidents of the commissions, which may delegate to its President the power to make appointments between its meetings.
(7) A member of the Commission who has not attended meetings or had written participation in the work of the Commission for two consecutive years shall be deemed to be a resign.
Working groups.
Working groups.
Working groups can be set up to prepare solutions to certain problems that the Institute is interested in.
Directorate.
Director.
(1) The activities of the Institute shall be provided by the Director, with the assistance of staff of regular and auxiliary staff.
(2) The Executive Committee shall elect the Director by secret ballot. Its obligations and powers shall be defined in the Implementation Protocol.
(3) The Director shall be the Secretary of the General Assembly, the Executive Committee, the Administrative Committee and the Technical Council, under the authority of his office.
Good and helpful staff.
(1) The staff member shall be appointed and dismissed by the Director, both in full and in part. Their rights and obligations shall be defined by the Protocol on Implementation.
(2) However, the appointment of regular staff is valid only after approval by the Administrative Committee.
International cold store gatherings.

(1) The Institute is usually scheduled to organise the International Cooling Congress every four years.
(2) The Programme is approved by the Executive Committee and the Organisation may be entrusted to one or more Member States of the Institute.
Publications.
Publications.
(1) The work of the Technical Council and of the commissions and information of any kind collected by the Directorate is the subject of periodic publications published by the Institute and written in the official languages of the Institute.
(2) The Implementation Protocol lays down the conditions under which a certain number of copies of these publications are distributed free of charge to the Member States.
(3) The Institute may also use any other means of dissemination suitable for the fulfilment of its mission.
FINANCIAL ENVIRONMENT.
Sources of the Constitution.
The costs necessary for the activities of the Institute shall be covered by:
(a) the regular annual contributions and the exceptional contributions of the Member States;
(b) revenue from the subscription of periodic publications, the sale of publications and documents, the advertising of publications and any activity carried out under this Convention;
(c) contributions, donations and references which may be legally attributable to him;
(d) income from his property.
Budget.
(1) The Executive Committee shall examine the financial report of the previous year at a regular annual meeting. The budget of the Executive Committee shall be voted on for next year at the ordinary annual meeting.
(2) The Executive Committee may transfer to the Administrative Committee certain adjustments to the current budget.
