DECLARATION
of 22 December 2008
on the protection of animals at public appearance and during breeding
The Ministry of Agriculture provides, pursuant to Paragraph 29 (1), for the implementation of Section 7a (7) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 312 / 2008 Coll., hereinafter referred to as "the Act":

SUBJECT MATTER OF THE ADJUSTMENT
§ 1
This decree sets out the model of the application for the approval of animal protection rules at public stage and the application for the approval of animal protection rules at the time of rearing, the content of the instructions of persons on the protection of animals at the time of public appearance, the formalities for the protection of animals at the time of rearing and the conditions of breeding of dogs and cats as regards breeding animals.

§ 2
Application for approval of animal protection rules for the public appearance of animals
The model for the application for approval of the animal protection rules for the public appearance of animals is set out in Annex 1 to this Regulation.
§ 3
The requirements of the animal protection rules in the public appearance of animals
The order of protection of animals in public appearance includes:
(a) the name which must include the words "Order of protection of animals at public appearance" and the indication of which type of animals the order of protection of animals at public address, which organiser and what activity is carried out with animals;
(b) the name and, where applicable, the name, surname, date of birth and place of permanent residence of the organiser, and, where appropriate, the address for service, if it is not the same as the place of permanent residence, if it is a natural person; the name, names, surname, identification number, if any, and place of business of the organiser, if any, if any, of the natural person involved; name or business name, identification number, if assigned, and address of the organiser's registered office, if any,
(c) the purpose of the animal protection rules in the public appearance of animals;
(d) the species and, where appropriate, the number, sex and age category of animals involved in the public appearance of the animals, the restrictions for each species, breed or age category of animals in relation to the activity carried out, in particular the restrictions on the participation of lactating females and females in the second half of pregnancy;
(e) the manner in which animals are handled, describing and characterising the activities carried out with the animals at public appearance; a description of the individual performances or tricks and environments in which they are carried out, including how the animals used are protected against suffering and how the animals are secured against leakage,
(f) a description of the equipment, equipment, equipment used for handling, demonstration or other animal activity;
(g) a description of the premises in which the public appearance is carried out and the protection against injury to animals; where the public appearance takes more than one day, a description of the housing areas of the animals, their size and equipment, the manner and frequency of feeding and drinking, the requirements to ensure the necessary feed, water and their necessary supplies,
(h) means of ensuring the well-being and protection of animals when transferring or transporting to public appearances, the type and dimensions of the transport equipment and its equipment; a description of the facilities and equipment used for the loading and unloading of animals, unless provided for by law or other legislation1),
(i) the method of first aid and veterinary care,
(j) the way in which persons actively taking part in the public appearance of animals are taught in relation to the protection and well-being of animals;
(k) the conditions and facts under which the organiser is entitled to suspend or exclude the person who has infringed the conditions and to exclude the animal from the public appearance of the animals,
(l) the validity of the animal protection rules in public appearance,
(m) the signature of the applicant,
(n) the date of approval, the signature of the staff member of the Ministry of Agriculture and the stamp of the Ministry of Agriculture.
§ 4
Content of lessons from persons who are actively involved in the public appearance of animals on the protection of animals at the public stage
The organiser shall instruct those who actively participate in the public appearance of the animals of:
(a) the peaceful and decisive treatment of animals in order to ensure that the animals are well-off, are not irritated or abused and the risk of injury is minimised;
(b) the prohibition of access of unauthorised persons who are not in charge of handling animals to premises where the animals are cared for or where the area for public appearance is reserved;
(c) the need to treat a sick or injured animal with caution and take special care, the need to pay particular attention to access to animals which appear dangerous and the need to ensure the presence of other persons when handling them;
(d) the need to ensure, when carrying out operations by a competent person (2), such as veterinary procedures, at the place where the operation is carried out, the necessary number of other persons who have been instructed to provide possible synergy, unless it is an emergency procedure for immediately saving the life and health of the animal;
(e) the use of appropriate means of fixation of the animal in the handling of restless animals or the administration of soothing preparations by a veterinarian;
(f) increased attention to animals and their protection against suffering in situations accompanied by noise or other negative stimuli, the need to take into account the fact that animals usually come into an unfamiliar environment, from different groups, are not accustomed to each other, or may show defensive reactions,
(g) measures in the event of emergency situations, in particular in the event of the release of the animal outside the designated premises or fire, and obligations to prevent such situations.

§ 5
Application for approval of animal protection rules for breeding
The model for the application for approval of the animal protection rules for breeding is set out in Annex 2 to this Regulation.
§ 6
Forms of animal protection rules for breeding
(1) The order of protection for animals in breeding includes:
(a) the name which must include the words "Code of Animal Protection in Breeding," and the indication of which animal species is concerned by the Code of Animal Protection in Breeding and which is carried out by the breeder;
(b) an association of legal or natural persons engaged in animal husbandry or an entrepreneur engaged in animal husbandry, the name or, where applicable, the names, surnames, identification number, if assigned, and the place of business, if any, of the natural person involved; name or business name, identification number, if assigned, and address of the registered office, if applicable,
(c) the purpose and objectives of the rules on animal husbandry in relation to the protection and welfare of animals;
(d) the type and expected number of animals kept;
(e) the basic biological characteristics, known physiological and ethological requirements of the species concerned, the conditions for breeding animals, in particular the provision of care for the female in heat, the pregnant female and the female and pups after birth,
(f) a description of the premises, facilities and equipment for the breeding and care of the species, where appropriate, the characteristics or descriptions of the breeding technologies providing for those conditions, recommended systems and basic facilities for animal care and welfare in pet animals;
(g) the procedures laid down for the protection of the species concerned, for ensuring their health and well-being, the principles for monitoring the inheritance of health and the genetic characteristics observed;
(h) permitted means of killing an animal or a population control procedure, if necessary;
(i) the conditions for the protection and well-being of the animal species in question, a description of the method and equipment to be used for transport, with a definition of the space for the species in question, unless they are provided for by law or other legislature1);
(j) the validity of the animal welfare rules;
(k) the signature of the applicant,
(l) the date of approval, the signature of the employee of the Ministry of Agriculture and the stamp of the Ministry of Agriculture.
(2) As a general rule, the Code of Animal Protection in Breeding shall be revised and adapted over a five-year period according to current scientific knowledge, practical experience or recommendations of international breeding organisations and international animal protection organisations.
§ 7
Conditions for breeding dogs and cats
(1) An association of legal or natural persons engaged in animal husbandry, and breeders who are members thereof, or entrepreneurs engaged in animal husbandry business, must comply with the following conditions when breeding dogs:
(a) reproduction of breeding animals is permitted for:
1. small breeds up to 50 cm of faucet height from the day ending on the 14th month of age to the day ending on the 8th year of age in bitches, from the day ending on the 14th month to the unlimited in dogs,
2. large breeds over 50 cm of faucet height from the day of the end of the 17th month of age to the day of the eighth year in the case of bitches, from the day of the end of the 17th month to indefinitely in the case of dogs,
(b) in bitches who have completed their 8th year of age, pregnancy is possible only on the basis of the veterinary certificate of examination of the animal at the beginning of the heat, with the benefit that the health status of pregnancy allows without excessive risks;
(c) artificial insemination can only be carried out by a person of competence (3);
(d) the female suckling only the number of pups corresponding to her health status as assessed by the veterinarian, other viable pups must be provided by the breeder for replacement nutrition;
(e) the maximum number of litters in breeding female is 3 over a period of 24 months, including litters where the female gives birth to only one puppy, the ideal number is one litter per year;
(f) the minimum age for taking puppies from the female is 50 days.
(2) An association of legal or natural persons engaged in animal husbandry, and breeders who are members thereof, or entrepreneurs engaged in animal husbandry business, must comply with the following conditions when keeping cats:
(a) reproduction of breeding animals shall be permitted for cats from the date of the end of the first year of age to the date of the end of the ninth year of age, for cats from the date of the end of the first year of age to the limit; in exceptional cases, cover shall be possible from the date of the end of the ninth month of age, only on the basis of confirmation by the veterinarian of the examination of the animal at the beginning of the heat, with a favourable indication of the overall health and physical maturity of the particular animal;
(b) in cats who have completed the ninth year of age, pregnancy is only possible on the basis of the veterinary certificate of examination of the animal at the beginning of the heat, with the benefit that the health status of pregnancy allows without excessive risks;
(c) the maximum number of litters of a breeding cat is 3 over a period of 24 months, including litters where only one cat is given birth;
(d) the cat must only breast-feed a number of kittens which correspond to its health status, as assessed by the veterinarian, to other viable kittens, the breeder must provide for alternative nutrition;
(e) the minimum age for cat kittens is 84 days.

FINAL PROVISIONS
§ 8
Decree No. 192 / 2004 Coll., on the protection of animals in breeding, public appearances or sediments, is repealed.
§ 9
This decree shall take effect on the day of its publication.
