amending certain regulations of the Government in the context of the adoption of a government regulation laying down requirements under the acts and standards of good agricultural and environmental condition for the areas of cross-compliance rules and the consequences of infringements for the granting of certain agricultural aid
The Government directs pursuant to § 2b (2) and § 2c (5) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll., Act No. 85 / 2004 Coll., Act No. 441 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll., and pursuant to § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act No. 128 / 2003 Coll., Act No. 341 / 2005 Coll., Act No. 291 / 2009 Coll. and Act No. 179 / 2014 Coll.:
Amendment of the Government Regulation laying down certain conditions for granting separate sugar payment to sugar growers
In Article 2 (1) (d) of Decree-Law No 45 / 2007 Coll., laying down certain conditions for granting the separate payment for sugar to sugar beet growers, as amended by Decree-Law No 480 / 2009 Coll. and Decree-Law No 308 / 2014 Coll., the words "Annex 2 to Government Regulation No 309 / 2014 Coll., on determining the consequences of a breach of the cross-compliance of certain agricultural aid 'are replaced by the words" Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll., on laying down requirements under acts and standards of good agricultural and environmental condition for areas of cross-compliance and the consequences of infringements of certain agricultural aid'.
Transitional provision
Proceedings initiated under Government Regulation No. 45 / 2007 Coll., as effective before the date of entry into force of this Regulation, and until the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No. 45 / 2007 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation laying down certain conditions for granting the single area payment of agricultural land and certain conditions for providing information on the processing of agricultural products originating in land put up for rest
Government Regulation No. 47 / 2007 Coll., laying down certain conditions for the granting of the single area payment for agricultural land and certain conditions for the provision of information on the processing of agricultural products originating in the land put up for rest, as amended by Government Decree No. 83 / 2009 Coll., Government Decree No. 480 / 2009 Coll., Government Decree No. 369 / 2010 Coll., Government Decree No. 448 / 2012 Coll., Government Decree No. 400 / 2013 Coll., Government Decree No. 308 / 2014 Coll. and Government Decree No. 50 / 2015 Coll., are amended as follows:
1. in Article 3 (1) (c), the words "Annex 2 to Government Regulation No 309 / 2014 Coll., on the determination of the consequences of a breach of cross compliance of the granting of certain agricultural aid" shall be replaced by the words "Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll., on the establishment of requirements under acts and standards of good agricultural and environmental condition for areas of cross compliance and the consequences of infringements of certain agricultural aid,";
2. in Articles 4 (1) (d) and 4 (3), the words "Annex 2 to Government Regulation No 309 / 2014 Coll., on the determination of the consequences of a breach of cross compliance of the granting of certain agricultural aid" shall be replaced by the words "Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll."
Transitional provision
Proceedings initiated pursuant to Government Regulation No 47 / 2007 Coll., as effective before the date of entry into force of this Regulation, and by the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No 47 / 2007 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for the implementation of agri-environmental measures
In Article 4 (2) (c) (1) of Government Regulation No 79 / 2007 Coll., on the conditions for the implementation of agri-environmental measures, as amended by Government Regulation No 308 / 2014 Coll., the words "for areas of cross-compliance rules listed in Annex 1 and good agricultural and environmental status standards for areas of cross-compliance referred to in Annexes 1 to 4 to Government Regulation No 48 / 2017 Coll., on the determination of the requirements according to acts and standards of good agricultural and environmental status for areas of cross-compliance for the provision of certain agricultural aid 'are replaced by the words" and standards for areas of cross-compliance referred to in Annexes 1 to 4 to Government Regulation No 48 / 2017 Coll.
Transitional provision
Proceedings initiated pursuant to Government Regulation No 79 / 2007 Coll., as effective before the date of entry into force of this Regulation, and until the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No 79 / 2007 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies for afforestation of agricultural land
In Article 6 (1) (c) of Decree-Law No 239 / 2007 Coll., laying down the conditions for granting subsidies for afforestation of agricultural land, as amended by Decree-Law No 148 / 2008 Coll. and Decree-Law No 308 / 2014 Coll., the words "Annex 2 to Decree-Law No 309 / 2014 Coll., on determining the consequences of a breach of the cross-compliance of certain agricultural aid 'are replaced by the words" Annexes 2 and 4 to Decree-Law No 48 / 2017 Coll., on laying down requirements under acts and standards of good agricultural and environmental condition for areas of cross-compliance and the consequences of infringements of certain agricultural aid';
Transitional provision
Proceedings initiated pursuant to Government Regulation No. 239 / 2007 Coll., as effective before the date of entry into force of this Regulation, and not final before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No. 239 / 2007 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation laying down certain conditions for granting separate payment for tomatoes for processing
In Article 2 (1) (d) of Decree-Law No 95 / 2008 Coll., laying down certain conditions for granting separate payment for tomatoes for processing, as amended by Decree-Law No 480 / 2009 Coll. and Decree-Law No 308 / 2014 Coll., the words "Annex 2 to Decree-Law No 309 / 2014 Coll., on determining the consequences of the infringement of the cross-compliance of certain agricultural aid 'are replaced by the words" Annexes 2 and 4 to Decree-Law No 48 / 2017 Coll., on the setting of requirements under acts and standards of good agricultural and environmental condition for areas of cross-compliance and the consequences of infringements of certain agricultural aid'.

Proceedings initiated pursuant to Government Regulation No 95 / 2008 Coll., as effective before the date of entry into force of this Regulation, and until the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No 95 / 2008 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies for the conservation of the forest-based economic population under the Natura 2000 measure in forests
In Section 5 of the Government Decree No. 147 / 2008 Coll., laying down the conditions for the grant of subsidies for the conservation of the economic population of forest land under the Natura 2000 measure in the forests, as amended by Decree No. 51 / 2009 Coll., Decree No. 76 / 2013 Coll., Decree No. 308 / 2014 Coll. and Decree No. 29 / 2016 Coll., paragraph g:
"(g) the applicant shall, in accordance with the cross-compliance rules set out in Annexes 1 to 4 to Government Regulation No 48 / 2017 Coll., establish requirements according to the acts and standards of good agricultural and environmental condition for the areas of cross-compliance and the consequences of their infringement for the granting of certain agricultural aid, throughout the calendar year on soil blocks, or parts thereof, kept in the land register on the applicant and on the grassland groups included in the title under Government Regulation No 53 / 2009 Coll., Government Regulation No 29 / 2016 Coll. or included in the title of the economic file; and ';
Transitional provision
Proceedings initiated under Government Regulation No. 147 / 2008 Coll., as effective before the date of entry into force of this Regulation, and until the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No. 147 / 2008 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies on forestry-environmental measures
In Section 5 of Government Decree No. 53 / 2009 Coll., on the establishment of conditions for granting subsidies on forestry environmental measures, as amended by Government Decree No. 108 / 2012 Coll., Government Decree No. 75 / 2013 Coll., Government Decree No. 308 / 2014 Coll. and Government Decree No. 29 / 2016 Coll., paragraph (f) read:
"(f) the applicant shall, in accordance with the cross-compliance rules set out in Annexes 1 to 4 to Government Regulation No 48 / 2017 Coll., establish the requirements according to the acts and standards of good agricultural and environmental condition for the areas of cross-compliance and the consequences of their non-compliance for the granting of certain agricultural aid, for the whole calendar year on soil blocks, or parts thereof, kept in the soil register on the applicant and on the grassroots groups classified under Government Regulation No 147 / 2008 Coll., Government Regulation No 29 / 2016 Coll. or in the title to improving the species composition; and ';
Transitional provision
Proceedings initiated pursuant to Government Regulation No. 53 / 2009 Coll., as effective before the date of entry into force of this Regulation, and not final before the date of entry into force of this Regulation shall be completed in accordance with Government Regulation No. 53 / 2009 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation laying down certain conditions for the payment of cows kept in a system of market milk production
Government Regulation No. 87 / 2010 Coll., laying down certain conditions for the payment of cows kept in a system with market milk production, as amended by Government Regulation No. 369 / 2010 Coll., Government Regulation No. 61 / 2012 Coll., Government Regulation No. 448 / 2012 Coll., Government Regulation No. 400 / 2013 Coll. and Government Regulation No. 308 / 2014 Coll., are amended as follows:
1. in Article 4 (2) (a), the words "Annex 2 to Government Regulation No 309 / 2014 Coll., on the determination of the consequences of infringements of the cross-compliance of the granting of certain agricultural aid" shall be replaced by the words "Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll., on the setting of requirements under acts and standards of good agricultural and environmental condition for areas of cross-compliance and the consequences of infringements of certain agricultural aid,";

Amendment of the Government Regulation laying down certain conditions for granting specific support to farmers
Government Regulation No. 60 / 2012 Coll., laying down certain conditions for granting specific support to farmers, as amended by Government Regulation No. 448 / 2012 Coll., Government Regulation No. 60 / 2013 Coll., Government Regulation No. 400 / 2013 Coll., Government Regulation No. 308 / 2014 Coll. and Government Regulation No. 50 / 2015 Coll., are amended as follows:
1. in Article 3 (4) (d), the words "Annex 2 to Government Regulation No 309 / 2014 Coll., on the determination of the consequences of infringements of the cross-compliance of the granting of certain agricultural aid" shall be replaced by the words "Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll., on the setting of requirements according to the acts and standards of good agricultural and environmental condition for areas of cross-compliance and the consequences of infringements of certain agricultural aid,";

Amendment of the Government Regulation on closer conditions for implementing measures of the common organisation of the markets in agricultural products in the field of wine-growing and wine-growing
In Article 2 (8) of Government Regulation No 142 / 2014 Coll., laying down the conditions for the implementation of measures of the common organisation of the markets in agricultural products in the field of wine-growing and wine-growing, as amended by Government Regulation No 308 / 2014 Coll., the words "Annex 2 to Government Regulation No 309 / 2014 Coll., on the determination of the consequences of the infringement of the cross-compliance of certain agricultural aid 'are replaced by the words" Annexes 2 and 4 to Government Regulation No 48 / 2017 Coll., on the setting of requirements under acts and standards of good agricultural and environmental condition for areas of cross-compliance and the consequences of infringements of certain agricultural aid'.

Amendment of the Government Regulation on the conditions for granting payments to areas with natural or other specific constraints
Government Regulation No. 72 / 2015 Coll., on the conditions for granting payments for areas with natural or other special constraints, as amended by Government Regulation No. 113 / 2015 Coll. and Government Regulation No. 64 / 2016 Coll., is amended as follows:

In Article 8 (2) (c) of Decree-Law No 185 / 2015 Coll., on the conditions for granting subsidies under the afforestation measure of agricultural land and amending certain related regulations of the Government, the words "Annexes 1 and 2 to Government Regulation No 309 / 2014 Coll., on the determination of the consequences of a breach of the cross-compliance of certain agricultural aid, as amended by Government Regulation No 50 / 2015 Coll. 'are replaced by the words" Annexes 1 to 4 to Government Regulation No 48 / 2017 Coll., on the determination of requirements under acts and standards of good agricultural and environmental status for areas of cross-compliance and the consequences of infringements of certain agricultural aid'.

Proceedings initiated pursuant to Government Regulation No. 185 / 2015 Coll., as effective before the date of entry into force of this Regulation and until the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No. 185 / 2015 Coll., as effective before the date of entry into force of this Regulation.
Amendment of the Government Regulation on the conditions for granting subsidies under forestry, environmental, climate and forest protection measures
In Article 8 (1) (d) of Government Regulation No 29 / 2016 Coll., on the conditions for granting subsidies under forestry and climate services and forest protection measures and amending certain related government regulations, the words "Annexes 1 and 2 to Government Regulation No 309 / 2014 Coll., on the determination of the consequences of non-compliance with the provision of certain agricultural aid, as amended by Government Regulation No 50 / 2015 Coll. 'are replaced by the words" Annexes 1 to 4 to Government Regulation No 48 / 2017 Coll., on the determination of requirements according to acts and standards of good agricultural and environmental condition for areas of cross compliance and the consequences of non-compliance with certain agricultural aid'.
Transitional provision
Proceedings initiated pursuant to Government Regulation No. 29 / 2016 Coll., as effective before the date of entry into force of this Regulation, and until the date of entry into force of this Regulation, shall be completed in accordance with Government Regulation No. 29 / 2016 Coll., as effective before the date of entry into force of this Regulation.
EFFECTIVE
This Regulation shall enter into force on 1 March 2017.
