DECLARATION
of 26 February 2025
amending Decree No. 505 / 2006 Coll., implementing certain provisions of the Social Services Act, as amended
The Ministry of Labour and Social Affairs provides, pursuant to § 119 (2) of Act No. 108 / 2006 Coll., on Social Services, as amended by Act No. 261 / 2007 Coll., Act No. 206 / 2009 Coll., Act No. 366 / 2011 Coll., Act No. 313 / 2013 Coll., Act No. 254 / 2014 Coll. and Act No. 38 / 2025 Coll., to implement § 33a (3), § 35 (2), § 73 (3), § 75 (1), § 76 (1), § 91 (3) (c) and § 99 (3) of this Act:
Decree No. 505 / 2006 Coll., implementing certain provisions of the Social Services Act, as amended by Decree No. 166 / 2007 Coll., Decree No. 340 / 2007 Coll., Decree No. 239 / 2009 Coll., Decree No. 162 / 2010 Coll., Decree No. 391 / 2011 Coll., Decree No. 389 / 2013 Coll., Decree No. 218 / 2016 Coll., Decree No. 387 / 2017 Coll., Decree No. 34 / 2022 Coll., Decree No. 440 / 2022 Coll., Decree No. 378 / 2023 Coll., Decree No. 195 / 2024 Coll., is amended as follows:
1. in § 6 (2) (b) (1), § 10 (2) (b) (1), § 11 (2) (b) (1), § 12 (2) (b) (1), § 13 (2) (b) (1), § 14 (2) (b) (1), § 15 (2) (b) (1), § 16 (2) (b) (1), § 18 (2) (b) (1), § 32 (2) (2) (1) and § 35 (2) (b) (1), "CZK 255" shall be replaced by "CZK 260";
2. in § 6 (2) (b) (2), § 10 (2) (b) (2), § 11 (2) (b) (2), § 12 (2) (b) (2), § 13 (2) (b) (2), § 14 (2) (b) (2), § 15 (2) (b) (2), § 16 (2) (b) (2), § 18 (2) (b) (2), § 32 (2) (2) and § 35 (2) (b) (2) (2), "CZK" shall be replaced by "115 CZK";
3. In § 10 (2) (c), § 13 (2) (a), § 14 (2) (a), § 15 (2) (a), § 16 (2) (a), § 18 (2) (a) and § 35 (2) (a), "CZK 305" is replaced by "CZK 315."
4. the words "point 2" shall be added at the end of the introductory part of the provision in Paragraph 17 (2) (a).
5. in Article 17 (2) (c) of the introductory part of the provision, the words "(a) (1) (a) (a)" shall be inserted after the number "1."
7. After Paragraph 35, the following Section 35a is inserted:
Mental health centre
Basic activities in the provision of social services in mental health centres shall be provided to the extent that:
(a) skills training for self-care, self-sufficiency and other social inclusion activities:
1. training and support for finding the strengths of a person with a view to supporting their recovery and capacity for social inclusion;
2. training and support for day-to-day planning,
3. training for the operation of standard equipment and appliances,
4. household care training, in particular clothing care, cleaning, small maintenance work, kitchen operation, shopping,
5. self-care training, children or other household members,
6. exercise of independent movement, including orientation in both internal and outdoor space,
7. training of skills required for official tasks, such as handwritten signature,
8. Training skills to identify your own risk situations and set up self-care in the field of mental health and well-being as a prevention of social exclusion, including through the promotion of brokering experience in recovery,
(b) facilitating contact with the social environment:
1. promoting the facilitation of entry and maintenance of studies, employment, housing, health and other specialised care, interest activities and participation in self-help groups;
2. practice behavior in various social situations,
3. training of common and alternative means of communication, contact and information work;
(c) educational, educational and activity activities:
1. brokering or reporting information on the impact of mental illness on the life of a person, his family and a circle of loved ones;
2. the consolidation of acquired motor, mental and social skills and skills,
3. early detection and intervention of persons with mental illness or at risk of developing it, including the conduct of assertive searches and contact with such persons;
4. support for the mapping of needs with a view to reducing risk behaviour for persons with ordered protective treatment;
(d) assistance in the exercise of rights, legitimate interests and in the provision of personal matters:
1. reporting on the possibilities for obtaining both financial and professional support;
2. information service and brokering services,
3. assistance in communication leading to the exercise of rights and legitimate interests, in the direct involvement in defence activities of the group of persons with whom the person agrees,
(e) socio-therapeutic activities:
socio-therapeutic activities, the provision of which leads to the development or maintenance of personal and social skills and skills promoting social inclusion. ';
8. In Article 36 (a), the word "constitutional 'is replaced by the word" berths' and the words "except for social-health care provided under relief services, weekly stationary services, homes for disabled persons, homes for elderly people and homes with special regime 'are added.
9. the following Part Four is inserted after Part Three:
REQUIREMENTS FOR THE SERVICES OF THE COMMUNICATION AUTHORITY
(1) The place of provision of a social service in which a residence service is provided as a community service shall be located at least 250 metres by air from another place of provision of a social service in which a residence service is provided for the same circle of persons not provided as a community service. The same circle of persons means persons with disabilities, seniors, children, families with children, persons socially excluded or persons at risk of social exclusion.
(2) The total number of persons to whom residence services are provided as community services at multiple points of social services, less than 250 metres apart by air, must not exceed 18. The maximum number of persons who can be provided as community service in one place of service is 18, in single or double rooms, and the capacity of each apartment unit in the apartment building is maximum of 6 persons. On one parcel, residence services may not be provided as community services in the sum of more than 18 persons. '
Parts four to nine shall be referred to as parts five to ten.
10. In Annex 2, point 2, including the title:

| b) Poskytovatel má písemně zpracována vnitřní pravidla, ve kterých vymezuje situace, kdy by mohlo dojít ke střetu jeho zájmů se zájmy osob, kterým poskytuje sociální službu, včetně pravidel pro řešení těchto situací; podle těchto pravidel poskytovatel postupuje; |
| c) Poskytovatel má písemně zpracována vnitřní pravidla pro přijímání darů; podle těchto pravidel poskytovatel postupuje. |
11. In Annex 2, point 7, including the title:
'7. Complaints concerning the provision of social services

| a) Poskytovatel informuje srozumitelnou formou osoby o možnosti podat stížnost, jakou formou stížnost podat, na koho je možno se obracet, kdo bude stížnost vyřizovat a jakým způsobem a o možnosti zmocnit k podání stížnosti jinou osobu; s těmito postupy jsou rovněž prokazatelně seznámeni zaměstnanci poskytovatele; |
| b) Poskytovatel informuje osoby o možnosti a podmínkách prověření vyřízení stížnosti ministerstvem, a to v případě nesouhlasu osoby s vyřízením stížnosti nebo v případě, kdy stížnost nebyla vyřízena ve stanovené lhůtě; |
| c) Poskytovatel informuje osoby o dalších možnostech podat stížnost na jeho zřizovatele, popřípadě zakladatele nebo na instituci sledující dodržování lidských práv a základních svobod osob, a to včetně jejich označení. |
12. In Annex 2, point 15, including the title, shall read:
"15. Improving the quality of social services

| a) Poskytovatel má písemně zpracovaná pravidla pro průběžné sledování a hodnocení souladu poskytování sociální služby se základními zásadami sociální služby stanovenými zákonem o sociálních službách a jím definovaným posláním, cíli a zásadami poskytované sociální služby a podle těchto pravidel postupuje; pravidla zahrnují obsah, metody, způsob a četnost průběžného sledování a hodnocení a postup poskytovatele podle kritérií uvedených v písmenech b) až d); |
| b) Poskytovatel průběžně sleduje a hodnotí, zda poskytování sociální služby vychází z individuálně určených potřeb a cílů osob, kterým poskytuje sociální službu; |
| c) Poskytovatel průběžně sleduje a hodnotí, zda vytváří podmínky pro zachování a rozvoj individuálních schopností a pro uplatnění vlastní vůle osob, kterým poskytuje sociální službu; |
| d) Poskytovatel průběžně sleduje a hodnotí soulad poskytování sociální služby se základní zásadou sociální služby zachovávat důstojnost a dodržovat lidská práva a základní svobody osob, kterým poskytuje sociální službu, včetně sledování a hodnocení rizik a možných pochybení poskytovatele, která vedou k porušování této zásady; |
| e) Poskytovatel využívá získané poznatky z průběžného sledování a hodnocení pro rozvoj a zvyšování kvality poskytované sociální služby; |
| f) Poskytovatel má písemně zpracována vnitřní pravidla pro zjišťování spokojenosti osob s poskytováním sociální služby; podle těchto pravidel poskytovatel postupuje; |
| g) Poskytovatel zapojuje do hodnocení poskytované sociální služby také zaměstnance a další zainteresované fyzické a právnické osoby; |
| h) Poskytovatel využívá stížnosti jako podnět pro rozvoj a zvyšování kvality sociální služby. |
Efficacy
This Decree shall enter into force on 1 March 2025, with the exception of:
(a) point (10) of Article I, which shall take effect on 1 January 2026; and
(b) Article I (6), which shall take effect on 1 January 2029.
