on the termination of secondary school education by the final examination and the termination of education in the Conservatory by discharge
The Ministry of Education, Youth and Sports (hereinafter referred to as "the Ministry ') provides, pursuant to Sections 76 and 91 (1) of Act No. 561 / 2004 Coll., on pre-school, primary, secondary, higher vocational and other education (the Education Act):

TERMINATION OF EDUCATION IN MIDDLE TESTS
§ 1
Final examination in the fields of education in which secondary education is achieved
(1) Theoretical examination of professional subjects is an oral examination. For the theoretical examination of professional subjects, the school director sets 20 to 30 topics, one of which the pupil draws.
(2) If provided for in the school curriculum, the theoretical examination of the subjects may be divided into two separately classified examinations, or may be part of the written or graphical solution to the task.
(3) If the theoretical test is divided into two separately classified tests, the preparation for each test shall take at least 15 minutes and each test shall take not more than 15 minutes. If the theoretical test from professional subjects is not divided into two separately classified tests, the preparation for the test shall take at least 15 minutes and the test shall not exceed 15 minutes. If a written or graphical solution of the task is included, the chair of the test committee may extend the preparation period by up to an additional 15 minutes.
(4) The practical examination of vocational subjects is held by the pupil before the theoretical examination of professional subjects. For the practical examination of technical subjects, the school director shall set 3 to 5 topics, one of which shall be selected for the group of pupils appointed by the school director. The test takes a maximum of 240 minutes.
(5) The final examination will take place in June at the dates set by the school director.
§ 2
Final examination in the fields of education in which secondary education is achieved with a certificate
(1) Individual individually classified final examinations shall be carried out in the order: written examination, practical training and oral examination. For serious organisational reasons, the school director may determine the order of examinations differently.
(2) The written examination lasts a maximum of 240 minutes.
(3) The number of subjects of practical examinations shall be determined by the school director. If the school director sets more than one topic, the student draws one topic. The practical examination shall be carried out by the pupil for a maximum of 3 days; in the field of education of group 82 Arts, used art takes a practical examination of 2 to 4 weeks. In one day, the practical test shall last a maximum of 7 hours.
(4) For the oral examination, the school director shall determine 25 to 30 subjects covering at the same time the area of competence and professional application of the pupil, from which the student draws one topic. The preparation for the oral test shall take at least 15 minutes and shall take not more than 15 minutes. If a graphical or written solution is included, the Chairman of the Examination Committee may extend the preparation period by up to another 15 minutes.
(5) The final examination will take place in June at the dates set by the school director. In the fields of education, where the practical examination lasts between 2 and 4 weeks, the school director may set the deadline for the final examination from 20 May. The term of the practical examination before 20 May may be determined by the school director in agreement with the Ministry. The school director may set a different deadline for the final examination in the event of termination of the training in the context of retraining under the special legislation (1).
§ 3
Test Panel
(1) The Trial Board (2) has permanent members and other members. The permanent members are the President, Vice-President and Class Teacher of the Tested Students.
(2) The other members of the Commission are:
(a) for the final examination referred to in § 1, teacher of professional subjects (3) and associate,
(b) for the final examination provided for in § 2 of the vocational trainingteacher (3), the teacher of the vocational subjects (3) and the practitioner, or the representative of the dual provider as an associate with the advisory vote.
(3) The associate referred to in paragraph 2 (a) shall be understood as a teaching staff member teaching the same or related subject.
(4) A practitioner shall be the one who carries out an activity related to the particular or related field of education in which the final examination is held.
(5) The Director of the School shall be appointed by the Vice-President and other members of the Examination Committee by 15 March of the relevant school year.
(6) The Vice-President of the Examination Committee shall be appointed as a teaching staff of the secondary school in which the examinations are held, who has been engaged in direct teaching activities for at least 5 years.
(7) A training teacher who is not an employee of a legal person who carries out the activities of the school in which the examinations are carried out and a representative of the dual provider shall be appointed by the school director after consulting his employer.
(8) In the event that a member of the Examination Board cannot perform his duties in the long term for serious reasons, the appointing authority shall withdraw him and appoint a new member of the Panel. It shall be represented by the Vice-President in the short-term absence of the Chairman of the Examination Committee in the final examination.
§ 4
Classification and evaluation of the final test
(1) The classification of each final test test shall be based on the following benefit scale:
(a) 1 - excellent,
(b) 2 - praiseworthy,
(c) 3 - good,
(d) 4 - sufficient;
(e) 5 - insufficient.
(2) If the organisation and duration of the written or practical examination exclude the permanent presence of the test panel during the test, the panel member present shall propose the classification of the test panel.
(3) The classification of all final tests shall be included in the overall evaluation of the final test.
(4) The overall assessment of the pupil for the final examination is carried out by the examination panel according to the following scale:
(a) benefit from honours if the total average of the pupil's classification for the final examination is not more than 1,5;
(b) benefit (a) if the pupil does not have a degree of benefit of 5 - insufficient from any final examination;
(c) has not benefited if the pupil has a degree of benefit of 5 - insufficient from a final examination.
(5) The evaluation of the written examination and the practical examination shall be notified to pupils no later than 1 week before the oral examination, except in the cases referred to in the second sentence of Paragraph 2 (1). The total evaluation of the final examination, including the evaluation of individual tests, shall be notified to the pupil by the chairman of the examination committee on the day on which the pupil completed the examination.
§ 5
Corrections and replacement tests
(1) Timetable 4) The Director of the School, the dates of the replacement examination4) The Examination Board shall be set up in September, December and the deadline referred to in Sections 1 (5) and 2 (5). Dates shall be published by the school director at least 2 months before the examinations are conducted in a publicly accessible place at the school and in a way that allows remote access. In the event that the examination committee recognises the reasons for the absence of the pupil (7), it may, in agreement with the pupil, set the deadline for the replacement examination by 30 June of the school year concerned.
(2) The applicant shall notify the school director in writing of the date by which he wishes to take the corrective or replacement test. The notice must be delivered to the school director not later than 1 month before the examination. The first and second sentences shall not apply if the date of the replacement examination is determined in agreement with the pupil by 30 June of the school year concerned.
(3) Pupils who have not passed the final examination by the deadline laid down in Sections 1 (5) and 2 (5) on account of the failure to complete the final year of education and who have completed the last year of education by 31 August of the school year concerned at the latest shall take the final examination in the month of September of the following school year by the deadline set by the Examination Board.
§ 6
Additional conditions for the final examination
(1) The subjects or other comprehensive sections of the course from which the final examination takes place are set out in the framework and school curriculum.
(2) The examinations are held at the school where pupils were educated. The practical examination may also take place at the workplaces of other persons where practical instruction is held on the basis of an agreement concluded between the legal person performing the school's activities and that person.
(3) In individual examinations, pupils may use the aids provided for in the subject of work.
(4) During the oral test, the same topic may not be drawn twice for one test committee on one day.
(5) A period of 60 minutes shall be considered as one hour for the purpose of the practical test.
(6) The school director may recognise a student who has previously obtained a secondary education or a secondary education with a certificate as a single final examination, provided that his or her content corresponds to the test which the pupil should take.
(7) The School shall issue a final examination certificate or a final examination certificate and a teaching certificate to pupils who have successfully passed the final examination no later than 7 days after the final panel meeting.

TERMINATION OF EDUCATION IN THE ABSOLUTORY CONSERVATOR
§ 7
Discharge in Conservatory
(1) The defence of graduate work, the theoretical examination of vocational subjects, the examination of a foreign language or the examination of an artistic-pedagogical preparation (5) shall take place within the time limits set by the school director between 1 and 30 June; in the case of pupils also holding a graduation examination in the same year, from 1 June to 31 July.
(2) The subject of graduate performance and the subject of graduate work shall be determined by the school director no later than 6 months before the beginning of the school discharge. The student shall submit the graduate thesis in 3 copies no later than 1 month before the date of the defence to the graduate director.
(3) Graduate performance may be individual or group. Graduating performance may take the form of a public appearance. Graduation may not take place until 10 February of the school year concerned. On the day of graduation, the student does not participate in teaching.
(4) For the theoretical examination of professional subjects, the examination of artistic and pedagogical preparation and the examination of a foreign language, 25 to 30 topics are set, one of which is chosen by the pupil.
(5) The preparation for each examination (the defence of graduate work, the theoretical examination of professional subjects, the examination of a foreign language or the examination of an artistic-teaching preparation) takes at least 20 minutes. The defence of graduate work, the theoretical examination of professional subjects or the examination of art-teaching training takes no more than 30 minutes, the examination of a foreign language takes no more than 15 minutes.
(6) If a pupil is educated in a single field of education in two main fields at the same time, he / she may take an examination from the graduate or from the artistic training, both of these main fields.
§ 8
Test committee for discharge in the Conservatory
(1) The Trial Board (6) has permanent members and other members. The President and Vice-President shall be permanent members. The other members are the teacher of the relevant subject, the head of graduate work, the head of graduate performance, the opponent and the associate.
(2) The President of the Examination Board shall be appointed by the Regional Office by 5 February of the relevant school year at the latest; the members of the Examination Board shall be appointed by the Director of the School by 5 February of the relevant school year at the latest. The appointment shall also cover replacement and repair tests.
(3) In the event that a member of the Examination Board cannot perform his duties in the long term for serious reasons, the appointing authority shall withdraw him and appoint a new member of the Panel. In the event of a short-term absence of the Chairman of the Examination Committee in discharge in the Conservatory, the Vice-President shall represent him.
§ 9
Classification and evaluation of discharge in the Conservatory
(1) The classification of the various parts of the discharge in the Conservatory is carried out according to the following benefit scale:
a) 1 - excellent,
b) 2 - very well,
(c) 3 - good,
(d) 4 - failed.
(2) The classification of a pupil from individual examinations is proposed by individual examiners, for graduate performance leading to graduate performance, for graduate work leading to graduate work. The head of graduate thesis proposes classification based on a written peer review and the course of the defence of graduate work.
(3) The overall evaluation of the Conservatory discharge shall include the classification of all parts of the Conservatory discharge. The overall evaluation of the Conservatory discharge shall be carried out by the Examination Panel according to the following scale:
(a) it has benefited with honours if the overall average of the pupil's classification for the Conservatory discharge is not more than 1,5, the graduate performance is classified as grade 1 - excellent and the pupil does not benefit worse than 2 in the classification according to paragraph 1 - very well,
(b) benefit (a) if the total average of the pupil's classification for the Conservatory discharge is more than 1,5 and the pupil has not complied with the degree of benefit of 4 in any part of the class referred to in paragraph 1;
(c) it has not benefited if, in some part of the discharge, the student has a degree of benefit under paragraph 1 4 - failing.
(4) The assessment of the individual tests shall be notified to the pupil on the day on which they were conducted. A general discharge evaluation shall be notified to the student by the President of the Examination Commission on the day on which the pupil has completed his discharge in the Conservatory.
§ 10
Other conditions for discharge in the Conservatory
(1) The subjects or other comprehensive sections of the school, of which the school director sets out the subjects for discharge, are set out in the school curriculum.
(2) Oral examinations and defence of graduate work are held at the school where pupils were educated.
(3) The same topic cannot be drawn twice during the oral test on one day.
(4) Teachers may take examinations from a foreign language which is taught at school.
(5) The school director may recognise a single discharge test for a pupil who has previously received a higher professional education in a conservatory if his or her content corresponds to a test that a pupil should take.
(6) Pupils who have successfully completed their discharge in the Conservatory shall be issued by the School within 7 days of the school's completion of its discharge certificate in the Conservatory and the diploma of a Conservatory graduate with the appropriate designation of the Conservatory graduate.

COMMON PROVISIONS
§ 10a
Remuneration of the chairmen of the final examinations and of the chairmen of the Conservatory Examination Committees
The Chairman of the Final Trials Examination Committee and the Chairman of the Conservatory Discharge Examination Committee shall receive a reward of CZK 130 for each starting hour of the President's work. The number of hours of activity shall be reported by the President to the Director of the School. The remuneration shall be payable at the regular time of payment of the salary or salary for staff members in employment.

§ 11
Efficacy
This decree shall take effect on the day of its publication.
