THE LAW
of 9 April 1960
on elections to national committees
The National Assembly of the Czechoslovak Republic decided on the following Act:
Election system
Basic provisions
(1) The working people elect, as members of the national committees, experienced and socialist countries dedicated to citizens who are actively organising and helping to unify the creative forces of workers in their efforts to fully develop socialist society.
(2) Elections to national committees are held on the basis of general, equal and direct voting rights by secret ballot.
General electoral law
(1) All citizens of the Czechoslovak Republic who have reached the age of 18 on the day of the election, regardless of nationality, sex, religion, employment, residence, social origin, property conditions and former activities, have the right to vote in national committees.
(2) However, the right to vote shall not be exercised by citizens who have been legally sentenced to the loss of voting rights for as long as the loss of that right persists and citizens who have been legally deprived of all or part of their capacity for mental illness.
Any citizen of the Czechoslovak Republic who has the right to vote may be elected to the National Committee and reached the age of 21 on the day of the election.
Members of the Armed Corps shall have the same right to vote and to be elected as all citizens.
Voting lists
Entry into the electoral list
(1) All citizens of the Czechoslovak Republic who have the right to vote are included in the electoral list according to their place of residence.
(2) Citizens who, after drawing up a list of voters, acquire or lose their voting rights shall be added to or withdraw from the list of voters.
(3) Each voter can only be entered in one voter list.
Establishment of electoral lists
(1) The electoral lists shall be drawn up by the local national committee's Board according to the constituencies.
(2) The list of voters from members of the armed corps who are housed in the group shall be drawn up by their master.
(3) Election lists are common for election to national committees of all grades.
Unloading of electoral lists
(1) No later than 30 days before the election date, the Council of the local national committee shall draw up electoral lists so that citizens can consult them in official rooms. The Council of the local national committee shall inform citizens of the landing of the electoral lists in the usual manner.
(2) In municipalities where there are more than 5000 persons on the electoral lists, the Council of the local national committee will arrange for a list of voters living in the house to be included in each house. The Council of the National Committee may also take such action in municipalities with fewer than 5000 persons on the electoral lists.
Opposition procedure
(1) Any citizen may, orally or in writing, draw the advice of the local national committee on errors and irregularities in the electoral list and propose a correction. The Council shall decide on the alert within 3 days and either make an appropriate correction in the electoral list or inform the complainant in writing of the reasons for the correction.
(2) If the application is rejected, the citizen may submit it to the People's Court responsible under the constituency. The Court of First Instance shall act in due time after oral hearing by order. This decision is final. Otherwise, the general provisions of the Civil Code apply mutatis mutandis. According to the court's decision, the council of the local national committee will make a correction to the electoral list. Proceedings before a court shall not be subject to a judicial fee.
Election card
Voters who, from the time the electoral lists are unloaded to the election date, as well as voters who, for serious reasons, will not be able to vote in the constituency in whose electoral list they are registered, shall issue an election card at their request and remove it from the electoral list. The Voting Card authorises the entry on the list of voters in another constituency. The minutes shall be carried out by the Board of the local national committee of new residence (place of residence), on the day of the elections by the District Election Commission. On entry, the voter card is withdrawn and added to the voter list.
Election circuits, districts and commissions
Election circuits
General provisions
(1) Elections to national committees are held according to the constituencies.
(2) A national committee member shall be elected in the constituency. A village of up to 600 inhabitants consists of one constituency in which all members of the local national committee are elected.
(3) Replacements are not elected.
Creating constituencies
(1) Election circuits for elections to the National Committee shall be established by the Board of the National Committee for which elections are to be held and shall publish lists of constituencies no later than 55 days before the election date.
(2) To be elected to local national committees and local national committees, according to the size of municipalities (cities), the municipalities of
(a) up to 600 inhabitants, one constituency in which the local national committee is designated as 9 to 15 members of the local national committee;
(b) between 600 and 1500 inhabitants of 15 and 25 constituencies;
(c) from 1500 to 5000 inhabitants of 25 to 35 constituencies;
(d) from 5000 to 10 000 inhabitants 35 to 45 constituencies;
(e) from 10 000 to 20 000 inhabitants of 45 to 70 constituencies;
(f) between 20 000 and 50 000 inhabitants 70 to 100 constituencies;
(g) over 50 000 inhabitants from 100 to 120 constituencies.
(3) The regional national committees will be elected according to the size of the district in the counties of up to 135 000 inhabitants of 60 to 90 constituencies and in the counties of over 135 000 inhabitants of 90 to 120 constituencies.
(4) For elections to city national committees in Bratislava, Brno, Ostrava and Pilsen, so many constituencies will be created for every 1000 inhabitants to have one constituency, but not more than 150 constituencies. There will be as many constituencies as there will be for election to local national committees in these cities.
(5) It will be created for election to regional national committees according to the size of the region and population of 80 to 150 constituencies.
(6) For elections to the National Committee of the City of Prague, there will be so many constituencies that each 6500 inhabitants will receive one constituency. For elections to the national district committees in Prague, there will be so many constituencies that one constituency will fall for every 1000 inhabitants, but not less than 50 and not more than 80 constituencies.
Election districts
Election districts
(1) For the adoption of ballots and for the census of votes, electoral districts are created in the municipalities, which are common to the national committees of all stages.
(2) Electoral districts and polling rooms for each district shall be determined by the local national committee at the latest 30 days before the election date.
(3) As a general rule, the electoral district is created to include around 1000 voters. For remote settlements or parts of the village, separate electoral districts can be created, if there are at least 50 voters.
(4) Special electoral districts can be created in hospitals, births, sanitariums, welfare institutions, similar institutions and facilities, or parts thereof, but only if there are at least 50 voters.
(5) The forces of the armed corps form special electoral districts, if they have at least 50 voters.
Election Commission
General provisions
(1) Options
the local national committees and the district national committees in Bratislava, Brno, Ostrava and Pilsen are managed by local election committees,
to the municipal national committees of the City Election Commission,
to the District National Committees and the District National Committees in Prague,
to the Regional National Committees of the Regional Election Commission,
to the National Committee of the City of Prague Election Commission of the City of Prague.
(2) Elections in the various constituencies are governed by the Circular Election Commission.
(3) The votes in the various constituencies are managed by the District Electoral Commission.
Election Commission
(1) The election committee governing the election of the national committee shall be set up by the Council of the national committee holding the election no later than 55 days before the date of the election.
(2) The Commission is composed of the President, its Deputy Secretary, the Secretary and other members, from two to four other members, if they are local election committees; of 6 to 10 other members, if it is the Regional Electoral Commission and the Municipal Electoral Commission; of 8 to 10 other members, if it is the Regional Electoral Commission and the Electoral Commission of the City of Prague.
(3) The Commission will form up from representatives of the Communist Party of Czechoslovakia and the workers' organisations, which are grouped in the National Front. Proposals from representatives are submitted by the National Front.
Tasks of the Election Commission
The Election Commission, which directs elections to the National Committee,
(a) oversees the precise observance of the electoral provisions of the national committee;
(b) decide on complaints concerning the malpractice of the District and District Electoral Commission in elections to the National Committee;
(c) examine whether candidates for the national committee run for that national committee in one constituency;
(d) ensure that voting lists are drawn up for election to the national committee;
(e) register the elected members of the national committee;
(f) forward the electoral files to the national committee's mandate committee.
Circular Election Commission
(1) For each electoral district for election to the National Committee, the Board of the National Committee shall set up an Election Commission no later than 50 days before the election date. In a municipality with less than 100 voters, the local election commission performs its tasks.
(2) The Commission shall be composed of the President, its Deputy and its Secretary and of other members, one additional member, if it is for election to local (district) national committees; from 2 to 4 other members, if they are elected to regional national committees, municipal national committees and district national committees in Prague; of 4 to 6 other members, if they are elected to the Regional National Committees and the National Committee of the City of Prague.
(3) The Commission will form up from representatives of the Communist Party of Czechoslovakia and the workers' organisations, which are grouped in the National Front. Proposals from representatives are submitted by the National Front.
Tasks of the Circular Election Commission
Circuit Election Commission for National Committee Elections
(a) register candidates to the National Committee in accordance with the provisions of this Law;
(b) provide regional election committees with voting tickets for election to the national committee;
(c) oversees the electoral process;
(d) establish the results of the electoral elections;
(e) submit a report to the election committee governing the election on the outcome of the election in the constituency;
(f) issue a certificate of election to the candidate elected;
(g) forward the file on the elections to the National Committee.
Regional Electoral Commission
(1) For each electoral district, the council of the local national committee shall, no later than 30 days before the election date, form a district electoral commission which shall be common to the national committees of all grades.
(2) The Commission shall be composed of the President, its Deputy Secretary, the Secretary and between 4 and 8 other members. In constituencies with fewer than 300 voters, the District Electoral Commission has only 1 to 3 other members alongside the President and Secretary.
(3) The Commission will form up from representatives of the Communist Party of Czechoslovakia and the workers' organisations, which are grouped in the National Front. Proposals from representatives are submitted by the National Front.
Tasks of the District Electoral Commission
Regional Electoral Commission
(a) oversees the proper surrender of ballots and watches over the keeping of order in the voting room;
(b) shall add the votes cast for each candidate;
(c) write a double entry on the course of the election and the census of the votes, one copy of which shall be submitted without delay to the competent electoral commission;
(d) submit the files on the elections to the Council of the District National Committee.
Management and supervision
The Election Commission, which directs elections to the national higher-level committee, also manages election commissions set up in the constituency of that national committee.
Central and Slovak Electoral Commission
(1) The Central Electoral Commission for National Committees is responsible for the senior management and supervision of national committees. The body of this Commission in Slovakia is the Slovak Election Commission for National Committees.
(2) The President, his Deputy, Secretary and the number of other members of the Central Electoral Commission are appointed by the Bureau of the National Assembly on a proposal from the Central Committee of the National Front. The President, his Deputy, the Secretary and the necessary number of other members of the Slovak Electoral Commission shall be appointed by the Bureau of the Slovak National Council on a proposal from the Central Committee of the Slovak National Front.
Resolution of electoral commissions
(1) Election commissions may be quorum if an absolute majority of members are present.
(2) The Election Commission shall act by an absolute majority; in the event of a tie, the chairman's vote shall be taken.
Candidates
Design of candidates
(1) Candidates for election to national committees are candidates for the National Front as a union of workers, peasants and working intelligence. The National Front - associated with the Communist Party of Czechoslovakia's Social Organisation of the Working People - proposes as candidates the leading socialist builder of workers, members of single agricultural cooperatives, working intelligence and other workers.
(2) The assembly of workers, peasants and other workers at races, offices and villages and the assembly of soldiers and members of the other armed corps submit proposals to the candidates of the National Front.
(3) Candidates are designed for individual constituencies. One or more candidates may be proposed for each constituency. For elections to a local national committee in a municipality which forms a single constituency, as many candidates as the designated number of members of the local national committee or more candidates may be proposed.
Registration of candidates
(1) Candidates for elections to national committees are registered by the National Front at the District Election Commission, no later than 30 days before the election date.
(2) Candidates are registered by constituency. However, no one can stand for election to the same national committee in more than one constituency.
(3) The application shall be accompanied by a declaration by the candidate to agree to his or her candidacy and, where appropriate, a report on the meeting of the organisation or assembly of workers where the candidate was proposed.
(1) The District Electoral Commission is obliged to register all duly proposed candidates.
(2) A complaint against a refusal to register a candidate may be lodged within 2 days to the Election Commission, which shall direct elections to the national committee to which the citizen is candidate. Her decision is final.
Announcement
The District Electoral Commission shall publish the names, surnames, age and employment of all registered candidates at the latest.
(a) 25 days before the election date to the Regional National Committees and the National Committee of the City of Prague, the District National Committees, the City National Committees in Bratislava, Brno, Ostrava and Pilsen and the District National Committees in Prague,
(b) 15 days before the election date to the other municipal and district national committees and local national committees.
Voting lists
(1) All registered candidates must be listed on ballots.
(2) Voting lists must take the form laid down and be reproduced in the quantities required.
Membership of candidates in election committees
Candidates may not be members of district or district electoral committees, where they are proposed as members of the National Committee.
Election agitation
Every working organisation and every citizen of the Czechoslovak Republic have the right to freely agitate for a registered candidate in the press, meetings and other ways.
Options
Announcement of elections
Election Day
(1) The national committee election date shall be determined by the Bureau of the National Assembly no later than 60 days in advance.
(2) Elections to national committees of all grades are held on the same day on the territory of the whole state. The elections take place on a day of work.
(3) The elections are held on a specified day from 7 am to 18 pm. In the capital city of Prague, cities which are based on the Act on the Territorial Classification of the State by regional and regional national committees, as well as in all municipalities with at least 10 000 inhabitants, elections are held on the designated day from 7 am to 22 pm. If local needs so require, the start of the elections may be set for an earlier hour.
Informing voters
(1) The Regional Electoral Commission shall keep the voters informed of the time and place of the elections in the last 15 days prior to the election date by incessantly announcements or otherwise.
(2) In municipalities with more than 1000 registered voters, the District Electoral Commission will ensure that a legitimate ballot is drawn up for each voter showing the necessary voting data. At the same time, they will arrange for the legitimate ticket to be delivered to the apartment.
Voting procedure
Preparations in the Election Room
The President of the District Electoral Commission shall check the ballot box and seal it before the election starts in the presence of the members of the Commission. It will also check whether a list of voters and ballots is ready. Then the vote will be taken.
Voting ballot boxes
Special spaces shall be designated in the ballot rooms in order to ensure the secrecy of the vote. No one must be present in these spaces at the same time as the voter or the electoral commission.
Voting time
(1) Each voter shall vote in person. Representation is not admissible.
(2) The voter who has arrived in the election room will hand over a legitimate ticket and will receive ballots after the entry in the electoral list. If the voter does not have a legitimate ticket and if he does not know the members of the District Electoral Commission, the commission may ask him to prove his identity.
(3) A voter who has arrived in an election room with an electoral pass will be put on the electoral list by the District Election Commission. The minutes shall be signed by the President and the Secretary of the District Electoral Commission; Voting cards shall be connected.
