Government Regulation
of 29 July 1952
prohibiting the recruitment of workers who are not duly unattached to a previous employment relationship.
The Government of the Czechoslovak Republic, with the agreement of the President of the Republic pursuant to § 42 (1) of Act No. 241 / 1948 Coll., on the first five-year Economic Plan for the Development of the Czechoslovak Republic (Act on the Five-Year Plan):
(1) National, municipal and cooperative enterprises, offices and authorities of state administration, national committees, other socialist and legal persons, as well as associations and establishments (hereinafter referred to as "undertakings") may accept a worker for employment only if they show, by a record in their identity card, that their immediately prior working (teaching) ratio has been properly unbundled, after the case of a pupil of a vocational training or a school of racing training under Act No. 110 / 1951 Coll., that his training has ended prematurely.
(2) Undertakings may accept persons who do not have relevant employment records on their identity card only if they prove their employment or activity recently by a certificate issued to that effect by the local national committee responsible for their residence. Graduates of second and third-degree schools who, after leaving school for the first time, enter into a working (teaching) relationship will prove their activity by a school certificate.
(3) Records in civil certificates of the beginning and proper termination of the employment (teaching) ratio are carried out by undertakings.
(1) A worker does not need to demonstrate the unbundling of the employment (teaching) ratio in accordance with the provisions of Paragraph 1 (1) or his recent activity in accordance with the provisions of Paragraph 1 (2), if he is to take up a secondary or temporary employment which does not last for more than four weeks.
(2) A member of the temporary staff seconded by an undertaking, with the agreement of the relevant district national committee, to a long-term brigade does not need to demonstrate the termination of an employment relationship under the provisions of Paragraph 1 (1).
(3) An undertaking which has seconded an employee to a long-term brigade may accept it after the end of the period of employment only if the staff member proves by means of an identity card that his employment at the brigade has been duly terminated; any other undertaking may accept it for employment only if the staff member proves by means of an identity card that his job at the brigade and his employment with the undertaking which sent it has been properly terminated.
The head of the undertaking or an authorised staff member who does not fulfil the obligations imposed on him under the provisions of § § 1 and § 2 shall be punished under the provisions of the Administrative Criminal Code, unless the offence is more strictly criminal.
The provisions of this Regulation shall not apply to members of the armed corps.
This Regulation shall enter into force on 1 September 1952; All members of the government will do it.
