DECLARATION
of 16 November 2012
amending Decree No 307 / 2002 Coll., on Radiation Protection, as amended by Decree No 499 / 2005 Coll.
According to Section 47 (7) of Act No. 18 / 1997 Coll., on the Peaceful Use of Nuclear Energy and Ionizing Radiation (Atomic Act) and on the amendment and addition of certain laws, as amended by Act No. 13 / 2002 Coll., for the implementation of Sections 4 (7) (a) and 7 (2) of the Atomic Act:
Čl. I
The Decree of the State Office for Nuclear Safety No 307 / 2002 Coll., on Radiation Protection, as amended by Decree No 499 / 2005 Coll., is amended as follows:
1. in Article 2, point (b), including footnote 2, shall be deleted;
Points (c) to (mm) shall be renumbered (b) to (ll).
2. In Section 2, points (d) to (f), including footnote 5a, are deleted.
Points (g) to (ll) shall be renumbered (d) to (ii).
3. in Article 2 (e), the words "preventive care for racing" shall be replaced by "occupational medical services."
footnote 5 is deleted.
4. In Article 2 (h), the words "racing preventive care 'are replaced by the words" occupational medical services';
5. in Article 2, point (m) is deleted;
Points (n) to (ii) shall be renumbered as points (m) to (hh).
6. In Paragraph 28 (1), the words "preventive workers' care for racing 'are replaced by the words" provision of occupational medical services' and the words "such care under special legislation11) 'are replaced by the words" such services under special legislation11).
footnote 11:
"11) Act No. 373 / 2011 Coll., on Specific Health Services. '.
7. In Article 28 (6), the words "Medical equipment 'are replaced by the words" Health service provider'.
8. Sections 60 and 61 are deleted, including the headings.

„§ 62
(1) Diagnostic reference levels are levels of exposure that are not expected to be exceeded when an adult patient weighing 70 kg is examined using standard procedures and good practice.
(2) Diagnostic reference levels are set out in Annex 9.
(3) At each workplace, diagnostic reference levels are established for all examinations normally carried out there, for which diagnostic reference levels are set out in Annex 9 (hereinafter referred to as local diagnostic reference levels). Local diagnostic reference levels may be higher than the diagnostic reference levels set out in Annex 9 only if justified. A significant excess of local diagnostic reference levels shall be investigated by the authorisation holder, the results of the investigation recorded and taken corrective action. ';
10. Article 63 shall be deleted, including the title.
11. Article 66 shall be deleted, including the title.
12. in Paragraph 67 (2):
"(2) The authorisation holder shall conduct an investigation of each medical exposure event leading to the application of an unscheduled dose to the patient and shall report the results of the investigation to the Authority in serious cases. ';
13. In Paragraph 67 (3), the words "intended for medical exposure to children, hereinafter referred to as" intended for medical exposure 'are replaced by the words "intended for medical exposure'.
14. in Article 67 (4), the words "(Article 63 (1))" shall be deleted;
15. in Paragraph 67 (5), the words "Operator of health care" shall be replaced by the words "Provider of health services";

This Decree shall take effect on 1 December 2012.
