DECLARATION
of 22 February 2022
on the control of the operated heating and combined heating and ventilation system
The Ministry of Industry and Trade provides pursuant to § 14 (4) of Act No. 406 / 2000 Coll., on Energy Management, as amended by Act No. 165 / 2012 Coll., Act No. 318 / 2012 Coll., Act No. 310 / 2013 Coll. and Act No. 103 / 2015 Coll., ("the Act ') for implementation of § 6a (6) of the Act:
§ 1
Subject matter
This decree implements the relevant European UnionRegulation (1) and provides for
(a) the method of determining the nominal output of the heating system operated or the combined heating and ventilation system;
(b) the scope, frequency and manner of monitoring of the heating and combined heating and ventilation systems;
(c) the model and content of the report on the control of the heating system; and
(d) requirements for the building automation and control system.
§ 2
Heat source
For the purposes of this Decree, the heat source shall be a part of a heating or combined heating and ventilation system which produces heat energy for the heating of liquid or air intended for space heating by means of:
1. combustion of fuels;
2. direct conversion of electricity into thermal energy;
3. use of environmental energy or heat recovery from the air removed from the building by a heat pump;
4. changes in the wavelength of electromagnetic radiation; or
5. direct use of environmental energy.
§ 3
Method for determining the rated output of the operated heating system or combined heating and ventilation system
The rated output of the operated heating system or combined heating and ventilation system shall be determined as the sum of the rated output of all installed heat sources or of the connection power of the heat supply system. For residential buildings, only sources which supply more than one unit with heat are considered.
§ 4
Scope and frequency of control of the heating or combined heating and ventilation system
(1) The control of the heating system or the combined heating and ventilation system covers accessible parts of the heat source, with the exception of the heat source, which is exclusively used for technological processes, the distribution system and the sharing of heat energy, the regulation system and the automation and control system. In the case of a combined heating and ventilation system, the control shall also apply to the forced ventilation system if it is part of the air heating system. The control of the forced ventilation system shall not be carried out if this control has already been carried out in the building under the control of the air conditioning system and combined air conditioning and ventilation systems under the legislation governing the control of the operated air conditioning systems and combined air conditioning and ventilation systems.
(2) The control of the heating or combination heating and ventilation system newly put into service must be carried out within 3 years of entry into service. Subsequently, the frequency check referred to in paragraph 3 shall be carried out.
(3) For a heating or combined heating and ventilation system already in operation, the check shall be carried out periodically, at least every 5 years.
§ 5
Method of monitoring the heating system or combined heating and ventilation system
(1) Control of the heating or combined heating and ventilation system is carried out under typical operating conditions.
(2) The control of the heating or combined heating and ventilation system shall include an evaluation of:
(a) dimensioning pursuant to Article 6; and
(b) operating parameters pursuant to Section 7.
(3) The energy specialist or the person referred to in Article 6a (4) (b) of the Act (hereinafter referred to as the energy specialist) with the contracting entity for the control of the heating or combined heating and ventilation system provides for a plan for the control of the heating or combined heating and ventilation system, which is formulated on the basis of its visual inspection and analysis of the available supporting documents.
(4) The documentation for the operation of the heating system or the combined heating and ventilation system shall be requested by an energy specialist from the owner of the building, the unit owners' community or, if the unit owners' community has not been established, the administrator.
(5) The plan for the control of the heating system or the combined heating and ventilation system contains an inventory of recommendations and conditions for the evaluation of the heating system or the combined heating and ventilation system.
§ 6
Method of assessment of dimensioning
(1) The energy specialist shall carry out an evaluation of the dimensioning of the operated heating system or combined heating and ventilation system according to the project documentation processed in accordance with the legislation governing construction documentation (2). If this project documentation is not available, the energy specialist shall carry out a check by calculation according to Annex 1 to this Decree.
(2) The assessment of the dimensions of the heating system or combined heating and ventilation system shall not be carried out where:
(a) there has been no major change in the completed building or the change in the heating or combined heating and ventilation facilities since the last inspection;
(b) the heating system or the combined heating and ventilation system is equipped with an internal combustion heat source with a power of at least 30% of its rated output and is connected to an automated and control building system capable of controlling without subsequent data collection and evaluation; or
(c) the heat source also supplies heat energy for technological purposes and this supply is not measured.
(3) In the case of a forced ventilation system, check the flow of the supplied air to achieve the required internal air quality. Air quality shall be assessed on the basis of measurements or the dose of air delivered per person. The intake air dose is determined by the number of persons, the development of pollutants or other ventilation requirements.
§ 7
Method of evaluation of operational parameters
(1) Where the heating system or the combined heating and ventilation system is equipped with an automation and control system capable of regulation without subsequent data collection and evaluation, the energy specialist shall only carry out a visual evaluation of the operating parameters of the heating system. In the case of combustion heat sources, the operating parameter referred to in paragraph 2 (a) shall also be checked.
(2) Operating parameters are evaluated by an energy specialist
(a) by verifying the efficiency of the heat source by the direct method set out in Annex 2 to this Decree; where it is not possible to use the direct method, the efficiency of the combustion heat source shall be verified by an indirect method within the scope of Annex 2 to this Decree; If, for technical reasons, it is not possible to use either a direct or indirect method, the energy specialist shall describe those technical reasons and make an expert estimate,
(b) on the basis of a visual inspection of the accessible parts of thermal energy distribution and control elements;
(c) on the basis of a visual inspection of the accessible heat-sharing facilities and their operational control;
(d) on the basis of a visual inspection of the accessible devices of the forced ventilation system and a check of their operation;
(e) checking the operating conditions of the forced ventilation system equipment, taking into account at least the adjustment of any air flow reductions at a time when the space is not fully used;
(f) verification of the heat-hydraulic balancing of the heating system from the implementation report if it has been carried out since the last inspection.
(3) If the supporting documents demonstrating compliance with the temperature fluid parameters are not supported, the energy specialist may carry out a verification of its quality in accordance with Annex 3 to this Decree.
§ 8
Content and model of report on control of heating or combined heating and ventilation systems
(1) The report on the control of the heating or combined heating and ventilation system contains:
(a) identification details of the owner of the building, of the unit owners' community or, where the unit owners' community has not been established, the administrator, contracting authority, energy specialists and the registration number of the report on the inspection of the heating system from the Ministry's records of the activities carried out by energy specialists, in accordance with the model of the heating system control report set out in Annex 4 to this Regulation;
(b) identification of the building, its description and description of the subject matter of the inspection;
(c) conclusions from the control carried out, including recommendations and options to improve the energy efficiency of the heating system proposed by the energy specialist;
(d) evaluation of the dimensioning, operational parameters and setting and functionality of the automation and control system, if it is part of the heating system;
(e) a list of recommendations to ensure the energy-efficient operation of the controlled heating or combined heating and ventilation system and a proposal for other options for efficient energy management within the scope of Annex 4 to this Decree;
(f) an annex to the report on the control of the heating or combined heating and ventilation system containing at least:
1. a list of all supporting documents requested and provided;
2. the heating system control plan referred to in Article 5 (3);
3. photo documentation from visual inspection,
4. a set of calculations, measurement and evaluation of the dimensions and efficiency of the heat source;
5. evaluation of the dimensioning and operating conditions of the forced ventilation system equipment.
(2) The model of the report on the control of the heating or combined heating and ventilation system is set out in Annex 4 to this Regulation.
§ 9
Requirements for building automation and control system
(1) The building's automation and control system, which is not subject to the obligation to provide the building heating system operated or the combined building heating and ventilation system, must be equipped with:
(a) a continuous electronic monitoring function which evaluates the efficiency of the operation of the systems and alters and provides information in the event of a significant decrease in efficiency and maintenance if necessary, and allows the storage of energy consumption measurement outputs for at least 12 months;
(b) management to ensure optimum production, distribution, storage and use of energy.
(2) An automation and control system other than residential buildings which is not subject to an obligation to provide an operating heating system or a combined heating and ventilation system shall be capable of:
(a) continuously monitor, register and analyse energy consumption and enable it to be regulated;
(b) allow storage of output from energy consumption measurements for at least 12 months;
(c) compare the energy performance of the building over time in relation to the need, identify the reduction in the efficiency of the building's technical systems and inform the operator of the building's control system of the possibilities of improving energy efficiency;
(d) enable communication with connected technical systems of the building and other appliances in the building as well as interoperability with equipment of different types and from different manufacturers.
§ 10
Synergies of the owner of individual heating or combined heating and ventilation installations
(1) Where the contracting authority is not the owner of an installation which is part of the subject-matter of the inspection and where the objective of controlling the heating system or the combined heating and ventilation system so requires, the energy specialist shall ask the owner of the installation to cooperate.
(2) An energy specialist shall, in a demonstrable manner, request from the owner of the heating system or combined heating and ventilation system the information necessary for carrying out its inspection.
(3) In the event that the owner of the installation does not provide the energy specialist with the required data, the energy specialist shall use a commented expert estimate. The data thus used shall be referred to as "expert estimate 'and shall be given in accordance with Annex 4 to this Order.
§ 11
Transitional provisions
(1) The owner of a building, unit owners' community or, where the unit owners' community has not been established, the AIFM shall ensure that the heating system or combined heating and ventilation system is controlled in accordance with this Regulation, unless it is not a boiler and heat energy distribution, not later than 1 year after the date of entry into force of this Decree.
(2) In the case of the inspection of the boiler and of the thermal energy distribution carried out pursuant to Decree No. 194 / 2013 Coll., on the control of boilers and heat energy distribution, which has expired more than 5 years after the date of entry into force of this Decree, the owner of the building, the unit owners' community or, in the event that the unit owners' community has not been established, the administrator shall ensure the control of the heating or combined heating and ventilation system under this Decree within 2 years of the date of entry into force of this Decree.
(3) In the case of the inspection of the boiler and of the thermal energy distribution carried out pursuant to Decree No. 194 / 2013 Coll., from which less than 5 years have elapsed since the date of entry into force of this Decree, the period of periodic inspection pursuant to § 4 (3) of this Decree shall run from the last day of the calendar year in which the inspection of the boiler and distribution under Decree No. 194 / 2013 Coll.
§ 12
Repeal
Decree No. 194 / 2013 Coll., on the control of boilers and thermal energy distribution, is deleted.
§ 13
Efficacy
This Decree shall take effect on 1 March 2022.

Evaluation of heat source dimensioning
In order to assess the accuracy of the heat source dimensioning to the heating requirements of the building, heating or preheating of the ventilation air or hot water preparation, a comparison of the annual energy consumption of the heat source with the installed heat output of the heat source for heating and hot water preparation shall be used for:
(a) combustion heat sources and absorption heat pumps according to the relationship
DS = QRPn
(b) heat compressor sources - heat pumps according to relationship
DS = 3,0 * QRPn
Where is he:
DS (hr) parameter expressing the ratio of annual fuel consumption with installed heat output of the heating and hot water system - annual use of installed heat output in hours; if the DS value is less than 1,500 hours, the energy specialist shall state the justification or the draft measure.
QR (kWh) annual energy consumption in fuel for combustion sources and absorption heat pumps or annual electricity consumption, or other fuel for heat compressor propulsion - heat pump,

Technological demand
Assessment of the dimensioning of the heat source in the heating or combined heating and ventilation system, which also ensures heat demand for technological purposes.
1. If the heat source supplies heat energy for both heating, heating or preheating of the ventilation air, hot water preparation and technological purposes, no dimensioning control shall be carried out.
2. If the heat source supplies heat energy for both heating, heating or preheating of the ventilation air, hot water preparation and technological purposes, and heat energy consumption for technological purposes is measured, the total heat energy consumption for heating, heating or preheating of the ventilation air, hot water preparation shall be done. The dimensioning check shall then be carried out in accordance with point (a) of this Annex.

Methodology for measuring the efficiency of the heat source
(1) The efficiency of the heat source is determined by a direct or indirect method where:
(a) the direct method of determining the efficiency of the heat source consists of the determination of the ratio of the amount of heat transmitted to the heat carrier to the amount of heat brought to the heat source by fuel and air in the same period of time;
(b) the indirect method of determining the efficiency of the combustion heat source shall consist of determining the loss of the appreciable heat of the flue gas (chimney loss) referred to in paragraph 3 and the concentration of carbon monoxide (CO) emissions by measuring and subsequently calculating the total loss referred to in paragraph 2.
(2) The efficiency of the combustion heat source shall be determined according to the following relationship:

(3) Chimney loss

(4) Measurement of carbon monoxide (CO) emissions in combustion plants
(a) perform as an additional measurement to declare the acceptability of the combustion process setting;
b) converts to unit [mg.m-3] for reference oxygen content
O2ref = 3% for gaseous and liquid fuels,
O2ref = 10% for solid fuels.
(5) The measurements referred to in paragraph 4 shall be made:
(a) during the heating season; for combustion heat sources connected to a chimney with a natural stroke according to a harmonised technical standard governing chimneys and smoke pipelines (CSN 73 4201 Comines and smoke pipelines - Design, implementation and connection of fuel appliances), the outdoor temperature shall not exceed 5 ° C at the time of measurement;
(b) according to the methodology prescribed by the gas analyser manufacturer,
(c) by taking flue gases in the middle of their current at a measuring point on the flue-pipe connecting the chimney to the combustion heat source located on a flat section of the flue-pipe; the distance between the measuring hole and the exhaust throat of the combustion heat source shall be approximately twice the maximum three times the external diameter of the exhaust outlet; the measuring section shall be located behind the last technological total of the combustion source in which the characteristics of the flue gas are changed, i.e. a particulate separator or a supplementary exchanger; where a tension limiter is installed on the flue-pipe, the measuring hole shall be placed in front of that limiter; where this is not possible, the limiter shall be closed and its tightness ensured; and
(d) at steady-state operating conditions where the temperature of the output heating medium does not change significantly.
(6) The measurements referred to in paragraph 4 need not be made where the data referred to in paragraphs 3 and 4 obtained from measurements made in accordance with the requirements of paragraph 5 are not more than two years old.
(7) The measured and calculated values are compared to the reference values which are:
ηref = 92% and COref = 200 mg.m-3 for gaseous and liquid fuels;
ηref = 83% and COref = 1000 mg.m-3 for solid fuels.
The combustion heat source shall be compatible if the determined efficiency is η ≥ ηref and the measured amount of carbon monoxide is CO ≤ COref.
(8) The verification of the efficiency of the heat source also includes visual inspection, which contains at least control
(a) the manufacturer's label (source identification), accompanying technical documentation (installation and use instructions) and operational documentation;
(b) the external state of the combustion heat source, including insulation and indicative temperature of the external surfaces; the surface temperature of the isolated parts of the source shall not exceed the ambient temperature of 30 ° C;
(c) leakage and leakage of fuel or heat;
(d) the state of accessible internal space of the combustion heat source, the functionality and completeness of all parts;
(e) the functionality of control and safety equipment;
(f) ensuring sufficient supply of combustion air to the combustion heat source;
(g) the fuel used and its storage (in the case of solid fuel), in particular whether it corresponds to the heat source manufacturer declared fuel quality requirements, whether it is of normal commercial quality under the legislation governing the permissible level of pollution and its detection (3), and whether it corresponds to the fuel specified by the boiler manufacturer or in the operating permit (4);
(h) evidence of the competence and proper maintenance of the flue gas routes under the legislation governing the cleaning, inspection and revision of the flue gas course5),
(i) documents of inspection of technical condition and operation5) in the case of solid fuel hot water boilers up to a rated power of 300 kW.
(9) Where more than one combustion heat source is included in a heating system or combined heating and ventilation system, measurements shall be made and the efficiency and emissions of carbon monoxide shall be recorded separately for each heat source.

Heating water quality control procedure
If an already processed analysis of the heating water containing the evaluation of parameters is not submitted during the inspection, the parameters shall be measured on the spot according to the following procedure:
(a) A sample of the heating water shall be taken into a glass container of 0,5 l (ideally a fully filled glass bottle with a oblique stopper and a standard cut (so called oxygen).
(b) Allow the sample to cool to 25 ° C.
c) After cooling the sample, a multifunction apparatus shall be used to measure pH, conductivity and dissolved oxygen.
The data obtained shall be provided in the report on the control of the heating system or combined heating and ventilation system.
