DECLARATION
of 29 January 2010
amending Decree of the Ministry of Transport No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended
The Ministry of Transport provides pursuant to § 52 of Act No. 114 / 1995 Coll., on Inland Navigation, as amended by Act No. 358 / 1999 Coll. and Act No. 118 / 2004 Coll., for the implementation of § § 9 (1), § 10 (2) and (6) and § 18 (2) of this Act:
Decree No. 223 / 1995 Coll., on the eligibility of vessels to operate on inland waterways, as amended by Decree No. 83 / 2000 Coll., Decree No. 186 / 2005 Coll., Decree No. 6 / 2006 Coll., Decree No. 38 / 2006 Coll., Decree No. 173 / 2009 Coll. and Decree No. 388 / 2009 Coll., are amended as follows:
1. At the end of the text of footnote 1, the words "Directive 2009 / 100 / EC of the European Parliament and of the Council of 16 September 2009 on the mutual recognition of inland navigation certificates' shall be added.
2. Paragraph 6 (4) reads as follows:
"(4) The small vessel certificate shall be equipped with small vessels, as referred to in Article 2 (1) (b), subject to registration, and small vessels subject to registration and intended for navigation abroad for the purpose of recreation of their operator shall be equipped with an international certificate for recreational craft. The model of the small vessel's certificate is set out in Annex 5 to this Decree. The model international certificate for recreational craft is set out in Annex 6 to this Decree. ';
3. In Annex 1, point 3.03.1, "4.02 'is replaced by" 3.02'.
4. In Annex 1, point 3.05.1, "4.01.2 'is replaced by" 3.01.2'.
5. In Annex 1, point 4.10.1, "5.07 'is replaced by" 4.07'.
6. In Annex 1, point 5.08.1, "9.20 'is replaced by" 9.19'.
7. In Annex 1, point 7.02.6, "3.04.3 'is replaced by" 2.04.3'.

30. In Annex 1, point 23.09.1, "paragraphs 1.1 or 1.2 'is replaced by" Cap. 23.09.1.1 or 23.09.1.2';
31. In Annex No 1, point 24.02.2 (a), the words "to separate hydraulic tanks according to cap. 5.02.1," and "to 6.03.8" shall be replaced by the words "to cap. 6.03.7 and to cap. 6.04.2," after the heading "7.05.13," shall be inserted the words "to cap. 7.06," after the heading "9.01.3," after the heading "9.02.1 to 9.02.3, to cap. 9.12.3 (b),";
32. in Annex No 1, point 24.02.2 (e), "5.061" is replaced by "5.06.1, Cap. 5.08.1," after "9.05.4," the words "Cap. 9.12.2 (d), Cap. 9.19," and "15.02.10," are inserted after "Cap. 15.06.6 (c) on any escape route through the kitchen, Cap. 15.06.7,";
33. in Annex 1, point 24.02.2 (g), the words "Chapter 5.02.1, 5.03.1 on dual control valves for hydraulic power units and separate piping for the second propulsion unit for hydraulic power units," shall be inserted after the words "requirements."
34. In Annex No 1, point 24.02.2 (j), the words "the second sentence 'after heading 9.01.1 are deleted, the number" 9.20' is replaced by the number "9.19 ', the number" 9.21' is replaced by "9.20 'and the words" 2.03.1 (a)' are replaced by the words "cap 4.06.1 '.
35. in Annex 1, point 24.02.2 (k), the words "and the requirements of Chapter 6.04.2 for vessels whose wheelhouse has been arranged to drive by one person using radar and for which direction of movement can be reached directly from the wheelhouse" shall be inserted after the heading "1.1.1995.
36. in Annex 1, point 24.02.2 (m), the words "Cap. 15.02.15," shall be inserted after the words "Cap. 15.03.7 and 15.03.8," the words "15.06.6 (b) to (d)" shall be replaced by "15.06.6 (b) and (d)," the words "Cap. 15.06.7," and the words "second sentence" after heading 15.11.12 shall be deleted and the words "Cap. 15.11.17," shall be replaced by "Cap. 15.11.16,";
37. in Annex 1, point 24.02.2 (r), the second number "6.12.1" is replaced by "6.12.2," after "9.11.4," the words "Cap. 11.07.2 and 11.07.3," after "11.13," the words "Cap. 15.01.1 (c)," and after "15.02.12," the words "15.06.6 (c) are added to no escape routes through machinery; ';
38. in Annex 1, point 24.02.2 (q), "6.07.2" is replaced by "6.02.2."
39. in Annex 1, the following points (u) and (v) are added at the end of the text of point 24.02.2:
"(u) the requirements of Chapter 11.04 at the latest on the issue or renewal of the certificate of the vessel after 1 January 2035 for vessels whose keel was laid after 31 December 1994 for other vessels in service when the entire cargo hold was restored.
(v) the requirements of Chapter 15.03.9, Chapter 17.05.2 and 17.05.3 after conversion of the vessel. ';
40. In Annex 1, point 24.02.3 reads as follows:
"24.02.3 Where a part of a vessel is changed or converted in operation, the relevant provisions of Chapter 24.02.2 shall not apply in relation to that part of the vessel. The replacement of an existing part for a part with the same technology or part of the same type shall not constitute an exchange according to the previous sentence. ';
41. in Annex 1, point 24.03.2 (c), the words "Chapter 15.05" shall be inserted after the words "15.04."
42. In Annex 1, point 24.03.2, the following point (d) is added at the end of the text:
"(d) the requirements of Chapter 6.05.2 at the latest on issue or renewal of the certificate of the vessel."
43. In Annex 1, point 24.03.5, the words "(a) 'are deleted.
44. In Annex 1, point 24.03.6, "15.11.2 'is replaced by" 15.11.12'.
45. Points 24.06.1 to 24.06.14 shall become points 24.05.1 to 24.05.14.
46. In Annex 1, point 24.05.12, "10.03a 'is replaced by" 11.13'.
47. in Annex 1, point 24.05.13 (a), "15.09" is replaced by "15.09.1."
48. in Annex 1, point 24.05.13 (b), the words "Chapter 15.09.5 (b), (c), (f), (i)" shall be inserted after the words "Chapter 15.09.10," and after the number "15.11.17," the words "Chapter 15.15.8 on alarm systems," shall be inserted;
49. in Annex 1, point 24.05.13 (d), "15.03.15" is replaced by "15.03.10," between "15.06.9 (a) to (c)," and "last sentence" is inserted after "15.06.10 (b) second sentence," the words "Chapter 15.26.13" are inserted;
50. In Annex 1, point 24.05.13 (e), the words "Chapter 15.06.6 (c) on any escape route through the kitchen, Chapter 15.07," shall be inserted at the beginning of point 24.05.13 (e).
51. in Annex 1, point 24.05.13 (f), the words "on any escape route through the machinery spaces" shall be inserted after the words "15.06.6 (c)."
(52) In Annex 1, the following points (h) and (i) are added at the end of point 24.05.13:
"(h) Cap 15.03.1 to 15.03.6 on the issue or renewal of a vessel certificate after 1 January 2045 and on the increase of the maximum permissible number of passengers.
(i) the requirements of Chapter 15.03.9, after conversion of the vessel. ';
53. In Annex No 1, the following points 24.05.15 to 24.05.19 are added at the end of point 24.05:
"24.05.15 Fixed fire-fighting systems with CO2 installed between 1 January 1995 and 31 March 2003 shall continue to be authorised if they comply with Article 10.03 (5) of the Rhine Maritime Inspection Regulation as in force on 31 March 2002.
24.05.16 Recommendations from the Central Commission for the Navigation of the Rhine issued between 1 January 1995 and 31 March 2002 concerning Article 10.03 (5) of the Rhine Maritime Inspection Regulation as applicable on 31 March 2002 shall continue to be valid until the Community certificate has been issued or renewed after 1 January 2035.
24.05.17. Cap 10.05.2 (a) shall apply until the Community Certificate has been issued or renewed after 1 January 2035 only if these devices have been installed on vessels whose keel has been laid after 1 October 1992.
24.05.18 For passenger ships certified before 1 January 2006 and equipped with collective life-saving devices according to Chapter 15.09.5 before 1 January 2006, those means shall be considered as an alternative to personal life-saving devices.
24.05.19 In the case of passenger ships certified before 1 January 2006 and equipped with collective life-saving devices as referred to in Chapter 15.09.6 before 1 January 2006, those means shall be considered as an alternative to personal life-saving devices until the issue or renewal of the Community Certificate after 1 January 2010. ';
54. In Annex 1, point 24.06.4, the words "and 24.04.5 'are deleted.
55. in Annex 1, point 24.06.13 (a), "15.09, first sentence" is replaced by "15.09.1, first and second sentences";
56. in Annex 1, point 24.06.13 (c), "15.15.9" is replaced by "15.15.8."
57. in Annex No 1, point 24.06.13 (d), the number "15.03.15" is replaced by "15.03.1," the number "1506.9" is replaced by "15.06.9" and the words "the second sentence" after the number 15.11.12 are deleted;
58. In Annex 1, point 24.06.14 reads as follows:
"24.06.14 Where a part of a vessel is changed or converted in operation, the relevant provisions of Chapter 24.05.5 to 24.05.13 shall not apply in relation to that part of the vessel. The replacement of an existing part for a part with the same technology or part of the same type shall not constitute an exchange according to the previous sentence. ';
59. In Annex 1, point 24.07, "24.07 'is replaced by" 24.06'.
60. In Annex 1, point 24.07.1, "24.07.1 'is replaced by" 24.06.1'.
61. In Annex 1, point 24a.04.5, "3 'is replaced by" 2'.
62. In Annex 1, point 24a.05.1, "24.07 'is replaced by" 24.06'.
63. In Annex No 2, point 1.01.5, in the second sentence, the words "except recreational craft and water scooters' shall be inserted after the words" not applicable '.
64. the following Annexes 5 and 6 are inserted after Annex 4:

This decree shall take effect on the day of its publication.
