DECLARATION
of 28 June 2006
amending Decree No 356 / 2002 of the Ministry of the Environment Coll., laying down the list of pollutants, general emission limits, the way in which reports and information are transmitted, the detection of the amount of discharges, the darkening of smoke, the permissible levels of bother with odour and the intensity of odours, the conditions of authorisation of persons, the requirements for keeping operational records of air pollution sources and the conditions for their application
According to Article 55 (3) of Act No. 86 / 2002 Coll., on Air Protection and on the amendment of certain other laws (Act on Air Protection), as amended by Act No. 92 / 2004 Coll., Act No. 180 / 2005 Coll., Act No. 695 / 2004 Coll., Act No. 385 / 2005 Coll. and Act No. 212 / 2006 Coll., ("the Act ') for the implementation of Article 10 (2) of the Act:
Decree No. 356 / 2002 Coll., establishing the list of pollutants, the general emission limits, the means of transmission of reports and information, the detection of the amount of pollutants discharged, the darkness of smoke, the permissible levels of odour and odour harassment, the conditions of authorisation of persons, the requirements for maintaining the operational record of air pollution sources and the conditions for their application are amended as follows:
1. In Article 1 (c), the comma after the word "group 'is replaced by" a' and the words "for odour and permissible level of odour harassment 'are deleted.
2. in Article 1 (e), the words "smell intensity and permissible levels of odour harassment," shall be deleted;
3. in Article 2, points (r), (s), (t), (u), (v), (w), (x), (y), (z), (aa) and (bb) are deleted;
4. In Article 5 (1), the comma after the word "groups' is replaced by" a 'and the words "for odour substances' are deleted.
5. Paragraph 5 (2) is deleted.
6. Article 15 shall be deleted;
7. In Paragraph 18 (1), the words "the determination of odour units, the degree of odour harassment," shall be deleted.
8. In Annex 1, point 9 is deleted.
9. In Annex 2, points 2 and 3, including the title, are deleted.
(10) Annexes 7 and 8 are deleted.
11. In Annex 13, point 1.22 (f), the comma after the word "substances' is replaced by the dot and the words" including odoriferous substances, so as to avoid their occurrence in concentrations harassing the population in the indolates of adjacent municipalities or, where appropriate, ecosystems located in its emission trail 'are deleted.
12. In Annex No 14, point 7 is deleted.
Efficacy
This Decree shall take effect on 1 August 2006.
