GOVERNMENT REGULATION
Czech Socialist Republic
of 23 March 1977
on regional planning in the Czech Socialist Republic
The Government of the Czech Socialist Republic orders pursuant to § 16 paragraph 3 of Act No. 145 / 1970 Coll., on National Economic Planning (hereinafter referred to as "the Act"):
BASIC PROVISIONS
(1) The comprehensive and harmonious development of the areas is one of the decisive preconditions for an efficient, smooth and proportionate development of the national economy. The planned management of the development of areas ensures regional planning, which is an integral part of the nation's economic planning.
(2) Regional plans are an essential tool for managing the development of areas.
Regional planning shall focus on the following main objectives and tasks:
(a) the achievement of a rational regional structure of the national economy;
(b) the identification and development of basic functions to be performed by each area in the context of the need for the development of socialist social division of labour and resulting from the natural and economic conditions of the areas and from the approved housing structure;
(c) creating balanced economic and social proportions in the regional organisation of production and non-production sectors and in environmental care;
(d) to guide the rational development of settlements, in particular by the deployment of housing and civil and technical facilities;
(e) rational deployment of sectors, disciplines and activities with regard to the specific conditions and resources of each area in order to create conditions, in particular, for effective territorial specialisation, cooperation and production management;
(f) an assessment of the degree of economic and social level of each area and the determination of the prospective objectives of their development;
(g) addressing the regional balance of resources and labour needs, their skills, age and biological structures, the distribution of youth and the regulation of migration of the population.
REGIONAL PLANS
System of regional plans
(1) Regional plans are part of the state plans for the development of the national economy of the Czech Socialist Republic. In view of the length of the planning period, it shall be subdivided into:
(a) long-term prospects for the development of areas;
(b) medium-term regional plans;
(c) implementing regional plans.
(2) The long-term prospects for the development of areas are set out in the guidelines for a comprehensive and harmonious development of areas based on the interlinks between regional and sectoral development elements. An integral part of the long-term prospects for development of areas is the assessment of the needs and resources of economic development and the determination of the stage and coordinated follow-up in the implementation of the projects of development and construction of areas.
(3) The medium-term regional plans specify the regional proportionality of the objectives and tasks in the development of the various sectors of the national economy and determine the ways and procedures to ensure the comprehensive development of the economy of the areas. The medium-term regional plans are based on the long-term prospects for development of areas and guidelines for drawing up the medium-term state plan for the development of the national economy of the Czech Socialist republity.1)
(4) The implementation plans specify the tasks of the medium-term regional plans mainly in the labour force and investment construction sector, including housing. In doing so, they are based on the guidelines for the development of the National Economy of the Czech Socialist Republic.
Regional planning
(1) The development of regional plans shall be based on the principle of consistency between national, regional and economic plans, provided in particular by the systematic exchange of information, confrontations and unification of the opinions of all institutions and organisations involved in the planning process.
(2) The regional plans include tasks, limits and indicators for the activities of the authorities and organisations in the area concerned; they also contain economic instruments differentiated according to the conditions of the sector, sectors and areas.
(3) The basic elements for the establishment of regional plans are:
(a) sub-studies and concepts of area development;
(b) analyses of the current and proposed levels of use of the natural and economic resources of each area, conditions and barriers to their further rational development;
(c) regional balance, in particular:
1. the population, the resources of the labour force and the youth and their distribution;
2. housing fund,
3. the territorial distribution and use of building capacities linked to investment construction;
(d) measures and decisions to regulate employment;
(e) decisions to deploy investment actions;
(f) measures and decisions to deploy housing by user and territory;
(g) specific sectoral and sectoral concepts, considerations and analyses on the state and development of the sector in areas and proposals for economic plans;
(h) approved settlement structure;
(i) land planning documentation and land planning documents.
Regional planning units
(1) The basic territorial unit of regional planning is the territory of the region.
(2) For the development of certain types or parts of regional plans, the breakdown by district or by selected locations, including their catchment area, or by industrial or residential conurbations, may be used.
(3) In individual cases determined by the Government of the Czech Socialist Republic, regional plans are also drawn up for other territorial units.
STABILITY OF THE INSTITUTIONS AND ORGANISATIONS IN THE REGIONAL PLAN PROCESS
Government of the Czech Socialist Republic
The Government of the Czech Socialist Republic, in accordance with the basic guidelines of regional policy established by the Government of the Czechoslovak Socialist Republic2)
(a) it shall:
1. principles for the development of individual areas;
2. principles for guidelines on the distribution of industries and industries in the Czech Socialist Republic and in its various areas;
3. the conditions of the regional subsidy policy and the amounts of the subsidy,
b) approves, as part of the state plans for the development of the national economy of the Czech Socialist Republic, the draft regional plans.
Czech Planning Commission
The Czech Planning Commission ensures the regional proportionality of the development of the national economy in the territory of the Czech Socialist Republic. To that end,
a) carry out an analysis of the economic development in the various areas of the Czech Socialist Republic;
(b) propose to the Government of the Czech Socialist Republic the principles of development of areas and measures to implement them;
c) draws up and presents to the Government of the Czech Socialist Republic as part of the draft State Plan for the Development of the National Economy of the Czech Socialist Republic draft regional plans, including proposals for economic instruments;
(d) issue guidelines on the development of regional plans following a uniform methodology for the development of state plans, 3)
e) Coordinates the activities of the central authorities of the Czech Socialist Republic, as well as the Regional National Committees and the National Committee of the City of Prague (hereinafter the "Regional National Committees") on the regional planning section;
(f) issue binding opinions after discussion of proposals for the deployment of production forces [§ 8 (1) (a), § 11 (1) (b)] on proposals for the deployment of structures which are the nature of binding tasks of the State Plan or of particularly important centralised structures or are designed to be deployed outside the headquarters of the circumstantial meaning (4) and on proposals for the deployment of the labour force;
g) Organises the monitoring of the implementation of regional plans in cooperation with the Czech Statistical Office.
Central authorities, central management and socialist organisations
(1) The central and central management authorities (5) ensure rational and effective development in the economic plans of the organisations managed by them in areas consistent with the regional plans. To that end,
(a) discuss with the Czech Planning Commission and the relevant national committees the development tasks of their managed organisations in each area, in particular proposals for the deployment of production forces and the development of employment and requirements for the development of the non-productive sector;
(b) to the extent specified by the guidelines, draft their economic plans by area and submit them to the Czech Planning Commission and the relevant Regional National Committees;
(c) carry out, at the same time as the schedule of tasks of the State Plan, a breakdown of the tasks of the Regional Plan and submit the selected indicators to the extent specified by the guidelines of the Czech Planning Commission and the Regional National Committees.
(2) The authorities referred to in paragraph 1 and the socialist organisations shall submit to the Czech Planning Commission and the Regional National Committees methodological guidance, as appropriate, as agreed by the Czech Planning Commission or the Czech Planning Commission, requested supporting documents for drawing up proposals for long-term prospects for development of areas. They shall provide the relevant national committees with supporting documents on the measures to be taken when they concern the development of the territorial districts of the national committees and the needs of citizens, in particular on the important investments planned, on the deployment of plants and establishments and on changes in the employment of the population.
Regional National Committees
(1) Regional National Committees
(a) ensure the regional proportionality of the development of the economy on their territory;
(b) in accordance with the political and economic guidelines of the Government of the Czech Socialist Republic, develop comprehensive proposals for long-term prospects for development of areas, proposals for medium-term regional plans and implementation plans and submit them to the Czech Planning Commission; These proposals are discussed with the Regional National Committees and National Committees of the cities of Brno, Ostrava and Pilsen (hereinafter the "Regional National Committees'), which also inform and implement the approved proposals,
(c) issue decisions on the regulation of employment and the distribution of labour and housing, on the basis of specific rules, 6)
(d) issue binding opinions on proposals for the deployment of buildings where their publication is not for other bodies (§ 7 (f), § 10 (1) (e), § 10a (2)),
(e) propose to the competent authorities the abolition and inclusion of obsolete and inefficient establishments and non-prospective production in the plan, setting out, together with the competent authority, the conditions for the abolition of obsolete and inefficient establishments and non-prospective production, and requiring the competent authorities to apply penalties to organisations which do not comply with these conditions; 13)
(f) establish the conditions for the implementation of an approved settlement structure, develop proposals for the economic structure of settlements of peripheral importance and their indicative size;
(g) check the performance of the tasks of the regional plans.
(2) The Regional National Committees provide basic background for the development of regional plans, in particular:
(a) analyses of natural and economic conditions and resources;
(b) analyses of the development of production and non-production sectors within the region;
(c) analyses of the state and development of the economic and social level;
(d) analyses of the development of the settlement structure;
(e) regional balance sheets, in particular:
1. the population, the resources of the labour force and the youth and their distribution;
2. housing fund,
3. the territorial distribution and use of building capacities linked to investment construction;
(f) indicators of area development and summaries of these indicators (pasports).
Regional National Committees
(1) Regional National Committees
(a) cooperate with the regional national committees in developing the concept of district development and make comments on the proposals for regional plans; the proposals for the development of the district are discussed with local national committees in the central municipalities, which also inform the approved concepts and their implementation,
(b) develop long-term prospects of regional development for the territory of the counties or, where appropriate, their smaller territorial units;
(c) participate in the implementation of the approved settlement structure; develop proposals for economic development and indicative centres of local importance,
(d) check the performance of the tasks of the regional plans in their territory;
(e) issue binding opinions on proposals for the deployment of buildings for the provision of services to the population and buildings of local importance;
(f) conduct the paspors and surveys of regional economic and social development indicators.
(2) The Regional National Committees participate in the processing of:
(a) analyses of natural and economic conditions and resources;
(b) analyses of the development of non-production sectors in the district and proposals for further development;
(c) analyses of the development of the settlement structure;
(d) regional balance sheets;
(e) other basic starting materials for the establishment of regional plans to be determined by the Regional National Committee.
Urban National Committees
(1) Urban National Committees
(a) express their views on the proposals for binding opinions issued by the Czech Planning Commission, the Regional National Committees and the Regional National Committees on proposals for the deployment of selected investments, in particular in terms of natural resource requirements, housing, impact on the creation and protection of the environment, as well as on proposals for the abolition of obsolete and non-prospective production, and, where appropriate, give incentives for such cancellations; 15)
(b) deliver opinions on the intentions, concepts and other measures of centrally managed economic, cooperative and other organisations as far as they concern the development and construction of the city and citizens' needs, 16) as well as on proposals for development concepts and economic plans of organisations providing services managed by national higher-level committees. 17)
(2) The municipal national committees of the first category shall give binding opinions on proposals for the deployment of buildings for the provision of services to the population and to buildings of local importance outside the scope of paragraph 1. 15)
COMMON AND FINAL PROVISIONS
(1) Czech Planning Commission and Regional National Committees to carry out their tasks in the area of regional planning
(a) require central authorities, central management bodies and socialist organisations to draw up draft regional plans to provide information and supporting evidence on the current and planned development of the individual sectors, disciplines and activities by area, 7)
(b) discuss with the central authorities and central management bodies the development tasks of their managed socialist organisations relating to the overall development of the economy on the territory of the regions, in particular as regards the preparation of important investment projects and measures concerning the deployment of establishments and establishments and changes in the employment of the population; similar negotiations are held with socialist organisations, 8)
(c) provide the central authorities, central management bodies and socialist organisations with the documents and information necessary for their activities in terms of economic development of the areas. 9)
(2) The relevant provisions of the law apply to the participation of workers and other citizens in the creation, security and control of the implementation of regional plans and the forms of security, control of implementation and amendments thereto. 10)
This Regulation shall not apply to tasks included in a specific part of the State plans, in particular those on the defence and security sectors. 11)
(1) Procedure for national committees to organise and coordinate the pooling of funds and activities governed by specific provisions. 18)
(2) The scope and method of detecting socio-economic information for the purposes of regional planning and monitoring the implementation of regional plans are laid down in specific provisions. 12)
This Regulation shall enter into force on the day of its publication.
