DECLARATION
of 20 September 2021
on the details of the handling of end-of life vehicles
The Ministry of the Environment ("the Ministry ') provides, pursuant to § 107 (5), § 108 (1) (k), § 108 (3), § 109 (7), § 110 (7) and § 112 (7) of Act No. 542 / 2020 Coll., on end-of-life products (" the Act'):
§ 1
Subject matter
This decree implements the relevant provisions of the European Union1), following the directly applicable regulations of the European Union2) and provides for
(a) the content of the operational rules of end-of-life and end-of-life vehicles;
(b) particulars of the certificate of acceptance of the end-of-life vehicle to the end-of-life vehicle collection facility;
(c) technical requirements for end-of-life vehicle collection and concentration devices;
(d) the extent and manner of continuous recording and reporting of end-of-life vehicles and other waste by the operator of the end-of-life vehicle collection facility and the end-of-life vehicle processor;
(e) technical requirements for the processing of end-of-life vehicles and end-of-life vehicles;
(f) parts of end-of-life vehicles which must be dismantled before further processing;
(g) the method of dismantling hazardous parts of end-of-life vehicles and the method of draining service liquids from end-of-life vehicles;
(h) the extent and manner of keeping records of materials and parts for reuse by end-of-life processors;
(i) how to calculate the level of reuse and recycling or other use of selected end-of-life vehicles and parts thereof;
(j) the conditions for preparation for reuse and storage of reusable parts;
(k) the range of data maintained in the Information System for the management of end-of-life information on vehicles (hereinafter referred to as the Information System); and
(l) the particulars of the vehicle repair document and the functionality of the part of the vehicle.
§ 2
Operating rules of installations and technical requirements for end-of-life and end-of-life vehicles collection and treatment facilities
(1) The content of the operating order of end-of-life vehicles is set out in point 1 of Annex 1 to this Regulation and the content of the operating order of end-of-life vehicles is set out in point 2 of Annex 1 to this Regulation.
(2) The technical requirements for equipment for collecting end-of-life vehicles and for concentrating end-of-life vehicles are set out in point 1 of Annex 2 to this Regulation.
(3) The technical requirements for the processing of end-of-life vehicles and end-of-life vehicles are set out in point 2 of Annex 2 to this Regulation.
(4) Excluded and disassembled parts of end-of-life vehicles which will not be reused, the end-of-life vehicle processor will classify and classify waste according to the Catalogue (3).
(5) Where the processor of end-of-life vehicles after the dismantling of hazardous parts and recovery of operating fluids referred to in point 2.4 of Annex 2 to this Regulation and the dismantling of all parts which must be dismantled in accordance with point 2.5.1 of Annex 2 to this Regulation before further treatment of end-of-life vehicles, he shall transmit the end-of-life vehicle to another processor, classifying it as specified in the Waste Catalogue (3).
§ 3
Forms of certificate of acceptance of end-of-life vehicle to end-of-life vehicle collection facilities
The operator of the end-of-life vehicle collection facility shall issue a written certificate of acceptance of the end-of-life vehicle to the end-of-life vehicle collection facility in accordance with Annex 3 to this Regulation.
§ 4
Scope of data kept in the Information System
(1) The information system shall keep data on end-of-life vehicles admitted to end-of-life vehicle collection facilities as required in the end-of-life vehicle acceptance certificate to end-of-life vehicle collection facilities referred to in Annex 3 to this Regulation.
(2) In addition, the data referred to in paragraph 1 shall include the photographic documentation of the status of end-of-life vehicles received pursuant to Paragraph 108 (1) (l) of the Act. Photographs constituting a photodocumentation shall not be blurred and shall have a resolution such that the overall state of the vehicle becomes apparent and a legible indication of the VIN identification number from which the end-of-life vehicle can be clearly identified. Photo documentation contains 3 photos that capture
(a) the overall view of the end-of-life vehicle from which it can be identified is the apparent status of the end-of-life vehicle received and it is clear that it is located at the time of the acquisition of the photodocumentation at the premises of the installation operator to collect end-of-life vehicles;
(b) the state of equipment of the end-of-life cab; and
(c) the VIN identification number.
(3) The operator of the end-of-life vehicle collection facility shall insert remote access to the photodocumentation information system referred to in paragraph 2 within 96 hours of the entry of the data referred to in paragraph 1.
§ 5
Scope and manner of continuous recording and reporting of end-of-life vehicles and other waste by the operator of the end-of-life vehicle collection facility and the end-of-life vehicle processor
(1) The operator of the end-of-life vehicle collection facility and the processor of end-of-life vehicles shall keep a continuous record of the waste and its handling methods in accordance with Annex 4 to this Regulation. Registration shall include:
(a) the date of receipt of the waste and the registration number;
(b) data on the end-of-life vehicle taken over and data on the transmitting person within the scope of Annex 3 to this Regulation;
(c) the name and surname of the person responsible for keeping the register.
(2) Operators of end-of-life vehicle collection facilities and end-of-life vehicle processors shall send a summary of the end-of-life vehicle data from the interim registration ("the annual report ') referred to in Annex 4 to this Regulation.
(3) The annual report sent by the end-of-life processor shall include a summary of the materials and parts for reuse.
(4) The notification obligation shall be fulfilled by means of an integrated environmental reporting system or a Ministry data box intended to fulfil environmental reporting obligations under the Integrated Environmental Pollution Register Act and the Integrated Environmental Reporting System (4) by sending an annual report in electronic form in accordance with Annex 4 to this Decree.
§ 6
Scope and method of keeping records of materials and parts for reuse
The end-of-life vehicle processor shall keep separate records of individual materials and parts for re-use which have undergone re-use preparation in the framework of the continuous record of waste and handling operations.
§ 7
Method of calculating the level of reuse and recycling or other use of selected end-of life vehicles and parts thereof
(1) The re-use and recovery levels are calculated as a percentage by dividing the sum of the mass of the parts ready for re-use and the mass of the recycled and energy-used waste from the selected end-of-life vehicles by the number calculated as the sum of the actual weight of the selected end-of-life vehicles and the weight of the waste transferred from the previous year on 1 January of the reporting year from which the weight of the residual waste was deducted on 31 December of the reported year.
(2) The re-use and recycling levels are calculated as a percentage by dividing the sum of the mass of the parts ready for re-use and the mass of the recycled waste from selected end-of-life vehicles by the number calculated as the sum of the actual mass of the selected end-of-life vehicles and the weight of the waste transferred from last year on 1 January of the reporting year from which the weight of the residual waste was deducted on 31 December of the reporting year.
(3) The weight is given in tonnes to three decimal places.
§ 8
Conditions for the re-use and storage of reusable parts
(1) The manufacturer of end-of-life vehicles shall prepare for the re-use of the reusable part, where appropriate in view of the status and history of the end-of-life vehicle from which the reusable part is to be dismantled.
(2) The re-use preparation process may include, in particular, checking the functionality, repair, cleaning or ensuring adequate corrosion protection.
(3) Reusable parts shall be stored in spaces intended for these purposes, separately from waste for further processing.
(4) In case the part cannot be re-used when checking the part, it is waste.
§ 9
Details of the vehicle repair document and the functionality of the part of the vehicle
The model of the vehicle repair document and the model of the vehicle part functional document for the cross-border transport of vehicles or parts thereof are set out in Annex 5 to this Regulation.
§ 10
Transitional provisions
(1) The certificate of acceptance of an end-of-life vehicle to an end-of-life vehicle collection facility shall be issued in accordance with Annex 6 to this Regulation by 31 December 2022.
(2) Data on end-of-life vehicles and persons from whom end-of-life vehicles have been taken over shall be sent to the Information System by 31 December 2022 within the scope of the data referred to in Section 4 (2) and Annex 6 to this Regulation.
(3) In the years 2021 to 2024, the interim record shall be kept and the annual report for the year shall be submitted in accordance with Annex 7 to this Decree.
§ 11
Notification of technical regulation
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
§ 12
Efficacy
This Decree shall take effect on 1 October 2021.

Content of the operating schedule of the installation
1. The operating rules of end-of-life vehicles collection facilities shall include:
1.1. Basic details of the establishment: the name of the establishment, the identification number of the establishment, the identification of the owner and the operator (trade name and registered office in respect of the legal person or business firm, or the name and address of the place of business and, where applicable, the address of the place of permanent residence in respect of the natural person authorised to do business, and the identification number), including the information on the statutory representatives and telephone links to them, the names and surnames of the heads of staff of the establishment, the address and data on the land on which the establishment is located (the parcel number of the land and the name of the cadastral territory; in the case where the land is kept in two numerical lines in the cadastral territory and is a building plot, also an indication of this fact), the annual design capacity of the installation, the maximum immediate capacity of the installation.
1.2. Nature and purpose of the installation: an overview of the types of waste for which the installation is intended and which are generated by its operation and classification according to the Waste Catalogue (3), the purpose for which the installation is intended.
1.3. Brief description of the installation: description of the technical and technological equipment of the installation (means of concentrating, storage, handling, way of protecting the rock environment at waste sites, etc.), situation chart of the establishment with an indication of the boundaries of the installation and the locations characteristic of the installation (e.g.: access roads to the installation, location of the mass detection equipment, dismantling facilities, storage area, assembly site of hazardous waste, location for the acquisition of photo-documentation of completed vehicles, storage of spare parts, administrative facilities, etc.).
1.4. Technology and operation of equipment: the obligation to operate equipment in all technological operations in the installation, the acceptance of waste - administrative procedure and practical procedure for the control of waste quality, the duty to operate (e.g. to detect waste weight, to perform visual inspection, to issue relevant documents, the method and procedure for recording waste), further waste management - method of marking waste, packaging of waste, placing of waste in equipment.
1.5. Organizational provision of equipment operation.
1.6. Keeping records of waste entering and leaving the facility.
1.7 Measures to limit the negative effects of equipment and emergency measures.
1.8. Measures to ensure safety of operation and protection of the environment and human health.
1.9. Model operating journal.
1.10. Description of the closure measures.
2. The working order of the end-of-life vehicle shall contain all the data specified in the operating order of the end-of-life vehicle collection facility (paragraph 1) and the following:
2.1. Annual design processing capacity, annual design processing capacity of authorised activity (technology) and daily design capacity.
2.2. Detailed qualitative characteristics of waste to allow them to be admitted to the installation.
2.3. Description of the method of processing end-of-life vehicles, separately taken over parts of vehicles and other waste in the installation.
2.4. Useful materials obtained from and quantities of waste in relation to the waste received.
2.5. Monitoring of equipment operation - selection of indicators of the expected effects of the operation of the facility on the surrounding area, method and frequency of monitoring and documentation, measurement of noise emissions, monitoring of the amount, quality and actual characteristics of waste, groundwater and surface water in accordance with other regulations, impact on the working environment, etc.
2.6. Information that is necessary for the factually correct and environmentally sound processing of end-of-life vehicles or parts thereof, for selected vehicles provided by the vehicle manufacturer, including information on safe and environmentally sound processing of end-of-life vehicles with connected traction batteries.
2.7. A description of the procedures leading to the re-use of vehicle parts and a description of the handling of reusable parts and materials intended for re-use preparation (preparation procedure for re-use, concentration, labelling).
2.8. Keeping records of parts and materials intended for reuse to the following extent:
(a) name or designation;
(b) the type of vehicle (make, model),
(c) the date of re-use preparation.

Technical requirements for the handling of end-of-life vehicles and end-of-life vehicles and equipment for collecting and processing end-of-life vehicles
1. Technical requirements for end-of-life vehicle collection and concentration devices
1.1. A place to take over end-of-life vehicles and a place to concentrate end-of-life vehicles before moving them to a processing facility shall be provided with:
(a) a surface area ensuring that no risk or contamination of surface or groundwater is present;
(b) end-of-life mass detection devices;
(c) cleaning aids, substances for leakage of leaked operational charges, equipment for the removal of leaked liquids, waste collection equipment;
(d) equipment enabling the movement of no longer mobile end-of-life vehicles.
1.2. When concentrating end-of-life vehicles in an installation, the operator of the installation shall take all necessary measures to avoid leakage of service charges (e.g. oils, fuels, coolant, braking and air conditioning charges). End-of-life vehicles shall not be placed on each other and shall not be concentrated in the side or roof position.
1.3. The points for receiving and concentrating end-of-life vehicles, waste concentration and reusable parts and materials intended for re-use shall be clearly marked and shall allow the following activities to be carried out in the installation:
(a) receiving end-of-life vehicles, identifying their mass and carrying out relevant records and keeping records;
(b) the concentration of end-of-life vehicles.
1.4. End-of-life vehicles with connected traction battery shall be concentrated separately from other end-of-life and waste vehicles and according to the manufacturer's instructions.
2. Technical requirements for end-of-life and end-of-life equipment
2.1. The places of acceptance, concentration of end-of-life vehicles, the treatment of end-of-life vehicles, waste concentration and re-usable parts and materials intended for re-use shall be clearly identified and equipped in accordance with point 1.1. In addition, it shall allow the installation to carry out the activities referred to in points 1.2, 1.3, 1.4 and the following activities:
(a) the withdrawal and withdrawal of other hazardous parts of end-of-life vehicles;
(b) the concentration of end-of-life vehicles and parts thereof without the materials and components referred to in paragraph 2.4.1.
(c) dismantling;
(d) preparation for reuse;
(e) concentrating reusable parts which do not contain any liquids;
(f) concentrating reusable parts containing liquids;
(g) concentration of waste destined for recovery or disposal;
(h) the concentration of residual bodies for transport or further processing.
2.2. Only two end-of-life vehicles are possible to concentrate on each other without technical measures. It is only possible to concentrate on more than two end-of-life vehicles with technical measures to ensure their stability. It is only possible to concentrate end-of-life vehicles on each other if they no longer contain service charges and other parts that have dangerous properties (catalogue number 16 01 06).
2.3. The end-of-life vehicle equipment shall have sufficient equipment for safe dismantling and subsequent management of waste traction batteries and comply with the instructions provided by the manufacturer of the selected vehicles to the processor under Section 103 (3) of the Act.
2.4. The method of dismantling parts of end-of-life vehicles having dangerous properties and the method of draining service liquids from end-of-life vehicles.
2.4.1. The dismantling of hazardous parts and defuelling of end-of-life vehicles shall be carried out in such a way that all hazardous parts, liquids and charges are concentrated separately.
2.4.2. When dismantling, traction batteries shall be removed in accordance with safety standards and in accordance with the instructions provided by the manufacturer of the selected vehicles to the processor under Section 103 (3) of the Act.
2.4.3. If the end-of-life refrigerating system of the vehicle is not damaged or released before being taken into the device, the air conditioning device shall be discharged by means of a closed system. When discharges of liquids from all end-of-life vehicle systems, the liquids shall either be drained or discharged to the maximum extent possible to meet the objectives of re-use and recovery referred to in Section 109 (3) of the Act. A suction device shall be used to discharge the service charges from closed tanks, in the case of tanks without discharge holes, an opening shall be created to allow gravity discharge.
2.5. End-of-life vehicle dismantling
2.5.1. Parts of end-of-life vehicles which must be dismantled before further processing:
(a) batteries and tanks for liquefied gas or compressed gas;
(b) potentially explosive components (e.g. airbags) if they cannot be deactivated;
(c) service charges (fuel, motor oil and transmission oil, distribution order oils, hydraulic oils, coolant, antifreeze, brake fluids, air conditioning system charges) and any other liquid contained in a selected end-of-life vehicle if not necessary for the reuse of the relevant parts;
(d) all components containing lead, mercury, cadmium and hexavalent chromium, if technically feasible.
2.5.2. Minimum technical requirements for the processing of end-of-life vehicles and processing operations to support recycling, which must always be carried out by the first processor:
(a) removal of the catalyst;
(b) removal of metal components containing copper, aluminium and magnesium, unless these metals are separated during crushing;
(c) the removal of tyres, including the reserve, if it is submitted for processing together with the end-of-life vehicle, and the bulk of plastic components (bumpers, instrument panel and liquid tanks, etc.), provided that these materials are not separated during crushing so that they can be effectively recycled as materials;
(d) removal of glass.
2.5.3. If the conditions laid down in paragraphs 2.4. and 2.5.1. are met, it is possible to re-rank the end-of-life vehicle from the catalogue number 16 01 04 * under the catalogue number 16 01 06 without excluding the hazardous properties of the end-of-life vehicle.
2.5.4. The end-of-life vehicle processor shall process the end-of-life vehicle classified under catalogue number 16 01 06 either by himself or by hand to another end-of-life vehicle processor.

Explanatory notes:
Sheet No 1 - Identification
Reporting year - the year for which the information is provided shall be reported.
Furthermore, the data necessary for the reporting of summary records are identified. If it is necessary to include the information in the interim waste register, this is stated in the explanatory note.
SO ORP / SOP code - the code of the district administrative district with extended scope, the municipal office of which carries out the inspection and processing of the report or administrative district of the capital city of Prague with transferred competence, which carries out the reporting and processing check.
Zero reporting - "Yes' shall be reported if the collection or processing facility has not managed waste and has not interrupted operations throughout the previous calendar year.
Installation operator identification - the operator's identification data relating to its seat shall be provided. The information is also given in the framework of the interim waste register.
IČO - the installation operator identification number shall be provided; if the ICO is less than eight digits, it shall be completed from left to zero to the total number of eight seats. The information is also given in the framework of the interim waste register.
Business name / surname and surname - to be entered in the trade register or trade register. The information is also given in the framework of the interim waste register.
Street, No., No., Municipality, Postal Code - the address details of the operator shall be given.
SO ORP / SOP code - the code of the administrative district of the municipality with the extended scope or administrative district of the capital city of Prague with the transferred scope in which the operator of the installation is located.
IČZÚJ - the identification number of the basic territorial unit of the municipality in whose administrative territory the operator of the establishment has its registered office. The number shall be given according to the single code list of the basic territorial units of the Czech Republic issued by the Czech Statistical Office.
Implementation of the report and contact details - details to be given for the completion of the report and for the person completing the summary report or for the person responsible for keeping the interim record. The information is also given in the framework of the interim waste register.
Date - date of completion of the report in dd.mm.yyyy.
Name and surname - the name and surname of the person completing the summary report or the person responsible for keeping the interim register. The information is also given in the framework of the interim waste register.
The e-mail address, telephone - contact details shall be provided per person filling in the summary report or the person responsible for keeping the interim register. The information is also given in the framework of the interim waste register.
Note - If necessary, the reporting agent shall make a comment on the reported report, which shall be additional information for the reporting processor. A note shall also be provided as regards the transmission of waste samples for research purposes.
Event confirmation - if the XN63 code is used in the annual report, the event announcer will document the event by attaching a document with confirmation in pdf format.
Device identification - whether it is an end-of-life vehicle collection device or an end-of-life vehicle processor, it is necessary to distinguish in this case whether it is an end-of-life vehicle dismantling or crushing device. The information is also given in the framework of the interim waste register.
Installation identification number (IČZ) - the identification number of the end-of-life vehicle collection or processing facility allocated by the Regional Authority shall be provided. The information is also given in the framework of the interim waste register.
Contractual involvement in the municipal waste management system - if the installation has a contract with the municipality under the Waste Act to participate in the municipal waste management system, such as using containers for sorting collection or collection of waste, etc., "Yes' shall be indicated, if it does not have a contract and ensures the management of the waste otherwise," No 'shall be reported.
Waste involving in the municipal waste management system - the catalogue of waste numbers and the names of waste according to the Waste Catalogue with which the facility is involved in the municipal waste management system.
Installation name - the device name used shall be given.
Type of installation - the classification is to be given according to the information in the MŽP (ISOH) Waste Management Information System of the establishment register carried out by the Regional Authority. Data added from the ISOH Register of equipment.
BAT of technology - to be reported according to the data from the ISOH Register of equipment recorded by the Regional Authority. Data added from the ISOH Register of equipment.
Authorisations and authorised activities - whether they are waste facilities pursuant to Article 21 (2) of Act No. 541 / 2020 Coll. In addition, all regional authorities authorised activities in the waste facility according to Annex 2 to Act No. 541 / 2020 Coll. The data are added from the ISOH Register of equipment.
An integrated permit has been issued for an installation - "Yes' shall be entered when an integrated permit has been issued for a waste facility under Act No. 76 / 2002 Coll., on Integrated Pollution Prevention and Control, on an Integrated Pollution Register and on amending certain acts, as amended.
PID (IPPC device code) - to be given according to the device identification in the integrated MRU prevention information system. Device identifier in 12-digit code format consisting of MZP and numbers. It is completed when an integrated authorisation under the Integrated Prevention Act has been issued for an installation.
Equipment supported by the OPRU (latest OP) - "Yes' shall be given if the equipment has been financially supported by the Operational Programme Environment (last period declared by the OPRU). It shall be indicated annually without any link to the specific year in which the aid was granted.
Have you produced or managed waste containing persistent organic substances under Annex IV to Regulation (EU) 2019 / 1021 of the European Parliament and of the Council? - "Yes" shall be indicated if the notifier has such waste or "No" if he does not. If the notifier has such waste, he must complete sheet 6.
Street, No., No., Municipality, Postal Code - the address details of the facility for collecting or processing end-of-life vehicles shall be given. The information is also given in the framework of the interim waste register.
SO ORP / SOP code - the code of the administrative district of the municipality with the extended scope or administrative district of the capital city of Prague with the transferred scope in which the device for collecting or processing end-of-life vehicles is located. The information is also given in the framework of the interim waste register.
IČZÚJ - the identification number of the basic territorial unit of the municipality corresponding to the given address data shall be provided. It is given according to the single code list of the basic territorial units of the Czech Republic issued by the Czech Statistical Office. The information is also given in the framework of the interim waste register.

Explanatory notes:
It shall also cover each record in the interim record.
All quantities shall be given in tonnes to three decimal places.
(a) Sheet 2 is used only to report data on the quantities of end-of-life vehicles taken over and handed over, separately taken over by the various parts of the selected vehicles and on the production and management of waste generated in the processing of selected end-of-life vehicles.
(b) The quantity of production and treatment of each type of waste resulting from the processing of selected end-of-life vehicles shall be indicated on a separate line.
(c) Operators of end-of-life vehicle collection facilities may not produce any waste, so they shall only record the quantities of completed-life vehicles taken over, concentrated or transferred and their parts. Wastes resulting from the operation of the plant, e.g. municipal waste, contaminated sorbents, etc., shall be recorded on sheet 3.
