authorising holdings in foreign-exchange foreign-exchange residents' holdings and transfers of foreign-exchange resident shares to a foreign legal person with business in foreign-exchange abroad
The Federal Ministry of Finance, the State Bank of Czechoslovakia and the Federal Ministry of Foreign Trade pursuant to § 34 (3) of Foreign Exchange Act No. 162 / 1989 Coll., as amended by Act No. 109 / 1990 Coll., provides:
In the application for authorisation to participate in business abroad (hereinafter referred to as "participating '), the foreign exchange pencil shall indicate:
(a) the name (s), registered office (s) and subject matter of the foreign exchange domestic business (s);
(b) the name (s), registered office (s), business subject matter and legal form of the foreign enterprise;
(c) the amount of the capital of a foreign undertaking;
(d) the amount of the share of the foreign exchange resident in a foreign enterprise, the source of its financing, the currency and the method of its reimbursement;
(e) calculation of the return on funds incurred by the foreign exchange domestic;
(f) the characteristics of the foreign exchange stranger involved in a foreign enterprise and its holding.
Similarly, the foreign exchange seal shall proceed when requesting a change in the amount of the equity.
In the application for authorisation to transfer the foreign exchange domestic holding to a foreign legal person with a business activity (hereinafter referred to as the "holding ') to foreign exchange foreign exchange foreign exchange seal, the foreign exchange seal shall indicate:
(a) name (s) and address (es);
(b) the name (name), the registered office (residence) and the object of the business (activity) of the foreign legal person in which the foreign exchange seal is participating;
(c) the amount of the existing, transferred and resulting holding;
(d) the price at which the holding is transferred;
(e) the name (s), registered office (es) of the foreign exchange foreign exchange foreign exchange agent to which the holding is transferred.
The Decree of the Federal Ministry of Foreign Trade and the Federal Ministry of Finance No 1 / 1977 of 28 February 1977 concerning property business abroad in the acquisition of raw materials and materials in non-socialist countries published in 1 / 1977 of the FMZO Bulletin and registered in 11 / 1977 of the Law Collection and the Decree of the Federal Ministry of Foreign Trade and of the Federal Ministry of Finance No 5 / 1983 of 8 April 1983 on the authorisation of holdings abroad related to the implementation of international trade, international transport and international dispatch published in 5 / 1983 of the FMZO Bulletin and registered in 21 / 1983 of the Law Bulletin is hereby repealed.
This decree shall take effect on the day of its publication.
