Government regulation on employer's obligations in accidents at work

GOVERNMENT REGULATION
of 20 August 2025
on the employer's obligations in relation to accidents at work
The Government orders pursuant to § 105 (7) of Act No. 262 / 2006 Coll., Labour Code, as amended by Act No. 185 / 2011 Coll., Act No. 365 / 2011 Coll. and Act No. 318 / 2025 Coll.:
§ 1
This Regulation implements the relevant provisions of the European Union1), builds upon the directly applicable provisions of the European Union2) and regulates the manner and formalities for the registration of accidents, the notification of an accident at work and the transmission of a record of an accident at work, the breakdown of accidents at work and the range of authorities and persons reporting an accident at work and the transmission of a record of an accident at work.
§ 2
Breakdown of accidents at work
Work accidents are subdivided into
(a) a fatal accident at work, meaning that the damage to health resulting from the accident on which the staff member has died no later than 1 year after the date of the accident at work,
(b) a serious accident at work which means an accident which is sustained by the hospitalisation of an employee affected by an accident of more than 5 consecutive calendar days, or where, due to the nature of the injury, such a period of hospitalisation is to be assumed, or a life-threatening or mass-scale accident under another legislation governing the safety and health of workers at work and the safety of operations in the mining and mining activity and in the activity carried out by the mineralway3);
(c) an accident at work which has injured a staff member with a temporary incapacity of more than 3 calendar days, and which is not serious or fatal;
(d) an accident at work for which temporary incapacity for work has not been caused or temporary incapacity for work not exceeding 3 calendar days.
§ 3
_
(1) The employer shall keep a record of all accidents in the injury book (4) in electronic or paper form. The record shall contain the following information:
(a) the name and, where applicable, the names and surnames (hereinafter referred to as "the name") of the accident of the disabled employee (5);
(b) the date and time of the accident;
(c) the place where the accident occurred;
(d) the activity in which the accident occurred;
(e) the total number of persons injured;
(f) the type of injury and the injured part of the body referred to in Annex 1 to this Regulation, if this information is known to the employer,
(g) a description of the accident,
(h) the type of accident referred to in Article 2;
(i) the source of the injury;
(j) causes of injury;
(k) the names of the witnesses to the accident; and
(l) the name and working title of the person who recorded the data.
(2) Where an accident occurred by an injured worker (Sess6) or temporarily assigned 7) to another employer and an accident occurred with that employer, that employer shall notify the accident to the employer without undue delay by accident of the affected worker. The data referred to in paragraph 1 shall be recorded in the accident books by both employers.
(3) The employer shall, at his request, issue a certified copy or extract of the accident data from the accident report. In the event of a fatal accident, the employer shall issue such documents to the members of the family of the staff member at their request.
§ 4
Notification of an accident at work and sending an alert on an accident at work
The notification of an accident at work and the transmission of a record of an accident at work to the relevant Regional Labour Inspectorate or to the relevant Regional Mining Authority pursuant to Articles 5 (1) and 6 (1) shall be made electronically by the employer through the Portal of the State Office of the Labour Inspection (hereinafter referred to as "the Office Portal '), with the formalities laid down in Annexes 2 and 3 to this Regulation and in the format and structure published by that Office.
§ 5
Notification of an accident at work
(1) The employer shall report a serious or fatal accident at work through the Office's portal without undue delay
(a) the Regional Labour Inspectorate, according to the place where the accident at work occurred, where, under another legislation (8), it, the staff, the natural or legal person or their activities are subject to the jurisdiction of the labour inspection authorities; or
(b) the Regional Mining Authority, according to the place where the accident at work occurred, if its activity, workplace or technical establishment is subject to the supervision of the authorities of the State Mining Administration in accordance with another legislation9).
(2) The employer shall report an accident at work to the trade union organisation and representatives in the field of occupational safety and health (10) without undue delay if he is working with the employer.
(3) The employer shall declare an accident at work without undue delay to the competent department of the Police of the Czech Republic according to the place where the accident at work occurred, if they indicate that a criminal offence has been committed in connection with the accident at work or in the event of a fatal accident at work.
(4) The employer shall report an accident at work without undue delay to the health insurance undertaking with which the worker was insured when the accident occurred.
(5) The notification referred to in paragraphs 2 to 4 shall be sent by the employer electronically or in paper form. Annex 2 to this Regulation shall apply mutatis mutandis to the details of the notification.
Sending an alert on an accident at work
§ 6
(1) The employer shall send, through the Office's portal, a record of the accident at work, with the exception of the accident at work referred to in Article 2 (d), no later than 15 working days after the date on which he became aware of the accident at work,
(a) the Regional Labour Inspectorate, according to the place where the accident at work occurred, where, under another legislation (8), it, the staff, the natural or legal person or their activities are subject to the jurisdiction of the labour inspection authorities; or
(b) the Regional Mining Authority, according to the place where the accident at work occurred, if its activity, workplace or technical establishment is subject to the supervision of the authorities of the State Mining Administration in accordance with another legislation9).
(2) For the purpose of ensuring the signature of accidents at work of the affected employee, witnesses, representatives of workers for safety and health at work, representatives of the trade union organisation and employer, the employer shall print the record of the accident at work referred to in paragraph 1 from the Office's portal and have it signed or stored electronically and shall ensure that it is signed by recognised electronic signatures. The employer shall keep a signed record of the worker's accident at work for 10 years.
(3) After a copy of the record of the accident at work referred to in paragraph 2, the employer shall, without undue delay, forward the accident to the worker, the workers' representatives for safety and health at work and the representatives of the trade union organisation, if they are working with the employer. In the event of a fatal accident at work, he shall forward a copy to the family members of the accident at the staff member concerned.
§ 7
The employer shall send the record of the accident at work referred to in Article 6 (2) electronically or in paper form no later than 15 working days from the date on which he became aware of the accident at work,
(a) the territorial competent department of the Police of the Czech Republic, according to the place where the accident at work occurred, indicates that a criminal offence has been committed in connection with the accident at work or in the event of a fatal accident at work;
(b) a health insurance undertaking with which the worker has been insured in the event of an accident at work.
§ 8
The employer shall send the record of the accident at work referred to in Article 6 (2) electronically or in paper form for the purpose of the liquidation of claims due to the statutory insurance of the employer's liability for accidents at work or occupational disease as well as to the organisational unit of the insurance undertaking with which he is insured for this purpose.
§ 9
Updating the record of an accident at work
(1) If the employer becomes aware of the facts leading to a change in the data contained in the posted job accident alert referred to in Article 6 (1), he shall update the record of the work accident in the Office portal without undue delay and send it through the Office portal to the Regional Labour Inspectorate or the Regional Mining Office according to the place where the work accident occurred.
(2) Paragraph 6 to 8 on the alert on an accident at work applies mutatis mutandis to the updated alert on an accident at work.
§ 10
Transitional provision
The employer's obligations in the event of an accident at work before the date of entry into force of this Regulation shall be governed by Government Regulation No 201 / 2010 Coll., as effective before the date of entry into force of this Regulation.
§ 11
Repeal
They shall be deleted:
1. Government Decree No. 201 / 2010 Coll., on the method of recording accidents, reporting and sending an accident record.
2. Government Regulation No. 170 / 2014 Coll., amending Government Regulation No. 201 / 2010 Coll., on the method of recording accidents, reporting and sending an accident record.
§ 12
Efficacy
This Regulation shall take effect on 1 January 2026.

(c) sex;
(d) citizenship;
(e) the address of the place of stay and the address of service if different;
(f) the relationship of the employee with the employer
1. in employment,
2. in service,
3. in a legal relationship based on a non-employment agreement,
4. a person performing activities or providing services outside the employment relationship (§ 12 of Act No. 309 / 2006 Coll.); or
5. others,
(g) the date on which the legal relationship under Part II (f) (1) to (3) arises.
III. The address of the workplace or other place where the accident occurred if different from the employer's seat.
IV. Characteristics of the workplace or other place where the accident occurred.
V. Activities involving an accident at work.

(d) economic activity according to the Classification of Economic Activities (CZ-NACE) (b) in which the accident occurred.
III. Data on accidents affecting workers

(d) citizenship;
(e) the address of the place of stay and the address of service if different;
(f) the relationship of the employee with the employer
1. in employment,
2. in service,
3. in a legal relationship based on a non-employment agreement,

VIII. Description of the accident, location, causes and circumstances in which the accident occurred.
IX. Information on whether the alcohol has been checked for accidents and, where appropriate, the result of that check.
X. Information on whether the presence of other addictive substances has been checked for accidents at the affected worker and, where appropriate, the result of that check.
XI. Regulations which have been infringed in connection with a work accident and by whom they have been infringed.
XII. Measures taken to prevent recurrence of an accident at work.
XIII. Expression of accidents caused by the employee affected, witnesses to the accident at work and representatives of workers for safety and health at work and representatives of the trade union organisation if they are working with the employer.
XIV. Data on the person reporting the accident at work for the employer
(a) name,
(b) telephone number and e-mail address,
(c) employment or relationship with the employer.
XV. Date of record of the accident at work and name
