on protection against floods
The Government of the Slovak Socialist Republic orders pursuant to Section 22 of the Slovak National Council Act No. 135 / 1974 Coll., on State Administration in Water Economy:

ČÁST PRVNÍ

Preliminary provisions
§ 1
(1) Protection against floods is a set of measures to prevent and prevent damage to the lives and assets of citizens and society in the event of floods.
(2) The water catchment area means a temporary significant rise in the water flow level which threatens to pour water out of the trough or in which water is poured out of the trough and may cause damage; This applies mutatis mutandis to internal waters, the departure of ice and the risk of the safety or stability of the water works.
(3) A flood risk shall be considered a situation identified by the flood plans or, where appropriate, a situation marked by the forecast flood service, a country
(a) when the specified water condition is reached at a rising trend in water flow;
(b) in the expected sudden melting according to meteorological forecasts;
(c) in intensive or prolonged precipitation.
(4) Internal waters are waters which occur in the territory protected by water-based components (hereinafter referred to as the "protected area '), in particular waters which cannot flow naturally in the increased condition of water in the recipient.

Measures to protect against floods
§ 2
Types of flood protection measures
The flood protection measures shall be:
(a) flood plans;
(b) flood inspections;
(c) forecast, reporting and warning flood service;
(d) patrol service,
(e) safety and rescue work.
§ 3
Flood plans
(1) The preparation of flood protection shall be included in flood plans to be drawn up at all stages of flood authorities. The flood plans shall include a detailed identification of the tasks and responsibilities of flood authorities, other bodies and organisations and citizens in flood protection measures.
(2) Flood plans contain plans for safety and rescue operations; consist of text and graphic part.
(3) The plans for the safety work are drawn up by watercourses managers and waterworks managers (owners, users). Rescue plans shall be drawn up by the national committees following the plans for security work. The flood plans shall also be drawn up by authorities and organisations whose objects may be threatened by flooding.
(4) Watercourses managers organise the development of plans for security works in their territorial districts; draw up plans for the security works which remain within the plans for the watercourses managed by them, the plans drawn up by the managers of other watercourses (hereinafter referred to as "small watercourses') and the managers (owners, users) of water works and other objects on and at risk of water flows; The plans shall be submitted by zoning to the District National Committees.
(5) Local (urban) national committees draw up rescue plans and submit them to the Regional National Committee.
(6) The Regional National Committees shall bring the security work plans submitted into line with the rescue work plans, supplement them and approve them as a district flood plan; the approved flood plans shall be submitted to the Regional National Committee.
(7) The Regional National Committees shall bring the flood plans of the District National Committees into line, if necessary supplemented and approved; the approved flood plans are submitted to the Ministry of Forestry and Water Management of the Slovak Socialist Republic (hereinafter referred to as "the Ministry ') and to the Ministry of Interior of the Slovak Socialist Republic, which will coordinate and, where appropriate, complement them and bring them into line with the entire river basin. The Ministry shall submit to the Central Flood Commission, which shall approve them as a comprehensive flood plan of the Slovak Socialist Republic, in compliance with the said and, where appropriate, supplemented flood plans and amendments thereto.
(8) The approved flood plans shall be reviewed annually and supplemented and adapted as necessary so that their amendments and additions can be approved by the end of the year.
§ 4
Degree of flood activity
(1) The following levels of flood activity are laid down in flood plans:
Grade I - alert state,
Level II - alert status,
Level III - threat status.
(2) The alert state occurs
(a) when reaching the water condition specified in the flood plan and increasing water trend on the water flow; It is generally a condition where water rises from the trough and reaches the heel of the dam; on watercourses not provided with barriers when the water level rises and approaches the shore line,
(b) in the expected sudden melting according to meteorological forecasts;
(c) on internal waters where the water level in adjacent water streams is higher than that of internal waters
(3) The alert status is hereby declared
(a) when reaching the water condition specified in the flood plan and the rising trend of water in the water stream, on watercourses not provided with dams, if the water in the trough reaches the shore line and has an increasing trend;
(b) at the beginning of the melting season, if predicted to expect a rapid rise in water levels or at the expected departure of the ice,
(c) on internal waters, provided that the maximum level of internal water laid down in the handling order is complied with by continuous water pumping.
(4) The threat status is declared
(a) on water courses when reaching the water conditions specified in the flood plan; in the case of a lower water condition, if the alert state lasts for 20 days or if the dam is wet, or if other unforeseen circumstances arise that may cause a larger magnitude; on watercourses not provided with dams, if the water comes out of the trough and can cause significant damage,
(b) on the leaving of the ice, if there is a direct risk of freezing or if the constipation has started to form;
(c) on internal waters, where the water rises at full capacity of the service station and is continuously operated above the maximum level specified by the handling order;
(d) if the water is poured over the dam or if the dam is ruptured and caused by ice constipation in a flood.
(5) The alert state ceases
(a) when the water is reached as specified in the flood plan, if the water in the water stream has a downward trend;
(b) on watercourses not provided with dams if water falls below the shore line,
(c) on internal waters where the level in adjacent water streams is lower than the level of internal water and internal water can be carried out by self-falling.
(6) The state of alert and the state of alert are withdrawn,
(a) if the water situation in the water stream falls below the level laid down in the flood plan or if the facts on the basis of which the alert or threat status has been declared are absent;
(b) the water which has poured the protected area is largely taken into the water stream and the necessary technical measures have been taken to avoid damage.
(7) The state of emergency and the state of danger declare and withdraw
(a) the local (urban) national committee,
(b) for the territory of several municipalities of the same district and for the territory of the district district of the national district,
(c) for the territory of several counties of the same region and for the territory of the regional national committee;
(d) for territories exceeding the territory of the region, the Central Flood Commission;
(e) at border flows, the Central Flood Commission, unless another flood authority so believes.
§ 5
Flood inspections
Surveying shall be carried out to determine whether there are no deficiencies in water flows, water works and other objects on water flows, in protected and flood areas and in objects in those territories which could cause or increase the risk of flooding. Flood inspections shall be carried out by flood authorities, watercourses managers and administrators (owners, users) of water works and other objects in accordance with flood plans at least once a year, usually before the spring season.
§ 6
Prediction, reporting and warning flood service
(1) The forecast flood service shall inform flood authorities and, where appropriate, other authorities and organisations of the possibility of a flood being created and of any other dangerous development thereof, of the hydrometeorological elements relevant for the generation and development of the flood, in particular the expected water conditions or flows in selected profiles. This service is provided by the hydrometeorological institute in Bratislava as instructed by the Ministry.
(2) The report and warning flood service warns the population against the risk of flooding at the flood site and at the places below on the water stream, alerts flood authorities and other bodies and organisations to develop the flood situation and submits the reports and reports necessary for its assessment and management of flood protection measures. The report and warning flood service is organised and secured by the Ministry and the National Committees.
§ 7
Patrol service
(1) The patrol service monitors the development of the flood situation and ascertains the data required for the performance of the reporting and warning flood service and for the management and coordination of measures against flooding.
(2) The patrol service shall be set up by watercourses managers, watercourses managers (owners, users) and other watercourses at risk and by local (urban) national committees according to flood plans.
§ 8
Security and rescue work
(1) Security works are technical measures to prevent and protect against floods on water courses, on water works and other objects on water courses, as well as on protected and flood areas, including interventions for the safe passage of ice in watercourses. At the time of the danger of flooding and during the flood,
(a) the protection of dykes against waveform, leaks, erosive influences, fables and protection against overflow of the dam;
(b) protecting the riverbed and the banks of the watercourse against their disturbance and damage.
(c) the removal of barriers to continuous drainage;
(d) the disturbance of ice cells and constipation,
(e) exceptional handling of water-works,
(f) the closure of the dam opening,
(g) the removal of water from the flooded territory;
(h) the removal or removal of internal water;
(i) the construction of secondary flood protection lines.
(2) Rescue work is measures to save lives and property at a time of flood risk and during a flood, in particular:
(a) the work related to the protection and evacuation of the population from the areas of vulnerable or flooded floods, as well as the care of the population (accommodation, catering, health service, etc.) for as long as necessary;
(b) the protection and conservation of property (live and dead inventory, etc.) in these territories, including any early harvest of crops at risk of flooding.

Tasks of national committees in flood protection
§ 9
Local (urban) national committees
Local (urban) national committees as flood bodies in their territorial districts
(a) draw up rescue plans and submit them to the Regional National Committee;
(b) provide manpower and means of goods in the event of flooding, in particular to ensure appropriate equipment of fire protection units by the necessary means and equipment; draw up an inventory of these funds and ensure their proper storage and maintenance;
(c) ensure that management of undertakings and plants, managers (owners, users) of water works and other objects at risk of flooding implement measures to protect against floods in accordance with flood plans;
(d) organise and provide a warning and warning flood service, in particular to warn citizens in the municipality of the risk of flooding (local radio, sound signals, etc.), draw attention to it by local national committees of neighbouring and downstream municipalities and report the risk of flooding to the district national committee;
(e) declare and withdraw the alert and the alert status;
(f) organise, manage and carry out rescue work at a time of flood risk and during a flood; where necessary, require organisations and citizens to fulfil general obligations in the protection against flooding, 1)
(g) ensure the evacuation, temporary accommodation and catering of the evacuated population and, as far as possible, the protection of its property as well as the return of the evacuated population; ensure the necessary hygiene and health care;
h) provide accommodation and catering for persons deployed for security and rescue work outside their home;
(i) provide assistance to watercourses managers, managers (owners, users) of water works and other objects on water streams and within the scope of the threat to safety at the time of the risk of flooding and during the flood, provided that their own forces and means are not sufficient for such work;
(j) provide assistance to neighbouring municipalities in rescue work at a time of flood risk and during the flood, provided that their own forces and means are not sufficient for such work;
(k) carry out flood inspections;
(l) keep records in the flood log.
§ 10
Regional National Committees
Regional National Committees as flood authorities in their territorial districts
(a) oversees how local (urban) national committees perform their tasks in flood protection;
(b) prepare and approve flood plans of the district and submit them to the Regional National Committee;
(c) provide manpower and means of goods in the event of flooding, in particular providing adequate equipment for fire protection units with the necessary means and equipment; draw up an inventory of these funds and ensure their proper storage and maintenance;
(d) organise training and training on flood relief work for relevant personnel of local (urban) national committees and personnel of authorities and organisations in their territorial districts; organise a reporting and warning flood service and, as a rule, perform, once a year, in cooperation with the hydrometeorological institute in Bratislava, instructions on the performance of the reporting and warning flood service,
(e) declare and withdraw the alert and the alert status;
(f) at the time of flood risk, the other authorities and organisations shall, as appropriate, draw attention to the risk of flooding and ensure that they are available and, where appropriate, to their preparedness;
(g) provide sanitary and health care, emergency supply of drinking water to the population and the rendering of flooded wells;
(h) organise, manage and carry out rescue work at a time of flood risk and during a flood; where necessary, require organisations and citizens to fulfil general obligations in the protection against flooding;
(i) provide, at the request of and within the reach of watercourses managers, managers (owners, users) of water works and other objects at water flows, assistance in the security works at the time of flood risk and during the flood, provided that their own forces and means are not sufficient for such work;
(j) provide assistance on request to local (urban) national committees in rescue work at flood risk and during the flood, provided that their own forces and means are not sufficient for such work;
(k) ensure, in cooperation with the relevant management of the links, that, at the time of the risk of flooding or during the flood, an extended or continuous telephone and telegraph service is introduced at the relevant post offices and telephone and telegraph centres for as long as necessary;
(l) require assistance from the Czechoslovak People's Armed Forces (2) and from the Ministry of the Interior in case of a danger of delay and inform the Regional National Committee at the same time; If there is no danger of delay, they shall require such assistance through the Regional National Committee,
(m) require, at the time of the risk of flooding, during the flood and on the departure of the ice through the Regional National Committee, the approval of the Central Flood Commission on the intended release of the ice cells and the congestion of explosives and on exceptional handling of water-works;
(n) carry out flood inspections;
(o) keep records in the flood log.
§ 11
Regional National Committees
Regional National Committees as flood authorities in their territorial districts
(a) oversee the performance of their tasks in flood protection by the district national committees;
(b) draw up and approve flood plans for the region and submit them to the Ministry of the Interior of the Slovak Socialist Republic;
(c) provide manpower and means of goods in the event of flooding, in particular providing adequate equipment for fire protection units with the necessary means and equipment; draw up an inventory of these funds and ensure their proper storage and maintenance;
(d) regulate and control the training and training of flood protection organised by the District National Committees and organise training and training of relevant personnel of the District National Committees; ensure and manage the organisation of reporting and warning flood services;
(e) declare and withdraw the alert and the alert status;
(f) organise and manage rescue work at a time of flood risk and during a flood; where necessary, require organisations and citizens to fulfil general obligations in the protection against flooding;
(g) provide, at the request of and within the reach of watercourses managers, waterworks managers (owners, users), water works and other objects at water streams, assistance in the security works at the time of flood risk and during the flood, provided that their own forces and means are not sufficient for such work;
(h) provide assistance on request to the district national committees in rescue work at flood risk and during the flood, provided that their own forces and means are not sufficient for such work;
(i) ensure, in cooperation with the relevant Directorate of Communications, that, at the time of the risk of flooding or during the flood, an extended or continuous telephone and telegraph service is established at the relevant post offices and telephone and telegraph centres for the duration of the need.
(j) require assistance from the Czechoslovak People's Army and the Ministry of the Interior in the event of a danger of delay and inform the Central Flood Commission at the same time; If there is no danger of delay, they shall require such assistance through the Central Flood Commission.
(k) require, at the time of the risk of flooding, during the flood and on the departure of the ice, the approval of the Central Flood Commission for the intended release of the ice cells and congestion of explosives and for extraordinary handling of water-works.
(l) carry out flood inspections;
(m) concentrate flood reports and summary reports of the District National Committees and regularly submit to the Central Flood Commission an overall report with any proposal for the necessary measures;
(n) keep records in the flood log.
§ 12
Subcommittee of the National Committees
(1) The County National Committees and the Regional National Committees set up flood commissions to carry out their tasks in flood protection. Local (urban) national committees shall set up flood committees as required.
(2) The members of the flood committees of the Regional National Committees are generally: Head of the Agriculture and Forestry Department, Head of the Finalisation Department and Head of the Transport Department of the Regional National Committee, Head of the Regional Fire Protection Inspection, Chief of Public Security Administration, Chief of the Regional Civil Defence Staff, Representative of the Water Management Organisation, Representative of the State Forest Organisation, Representative of the State Melioration Administration, Chief of the Regional Military Administration, Regional Health Officer, or representatives of other bodies and organisations.
(3) The water commission of the District National Committees is composed similarly to the flood committee of the Regional National Committees.
(4) The members of the flood committees of local (urban) national committees are, as a general rule, the secretaries and relevant managers of the local (urban) national committee, the head of the fire brigade, the representative of the Public Security Administration, the chairman of the single agricultural cooperative, representatives of production organisations or, where appropriate, organisations eligible for intervention or assistance in flood protection.
(5) The Board of the National Committees shall, as appropriate, set up technical staff as their expert advisory and executive bodies.

Tasks of other institutions, organisations and citizens
§ 13
Watercourses managers and waterworks managers (owners, users)
(1) Watercourses managers and waterworks managers (owners, users)
(a) develop, supplement and specify plans for security work; small watercourses managers shall submit them to water-relevant water-flow managers, the water-water catchment area of which they belong,
(b) provide, in accordance with the flood plans, for the labour force and the means of securing security work;
(c) organise and carry out safety work on water courses, on water works and other objects on water courses and in so far as they are in charge of the risk;
(d) draw up an inventory of the sites at risk of flooding and an inventory of the objects on and around water streams which may increase the risk of flooding or ice-jams (construction sites such as bridges and bridges, built-up structures, etc.),
(e) propose to flood authorities the announcement and withdrawal of levels of flood activity;
(f) perform a patrol service on watercourses, water works and other objects in their management during flood risk,
(g) carry out regular flood inspections at water courses, on water works and other objects in their management;
(h) perform exceptional handling of water-works at the time of flood risk and during the flood, with the agreement and in accordance with the instructions of the Central Flood Commission;
(i) monitor the formation of ice jams and, according to their effectiveness, disturb and chop ice jams, disrupt ice jams using explosions with the consent and guidance of the Central Flood Commission;
(j) participate in reporting and warning flood services in cooperation with national committees; draw the attention of the national committees in good time to the risk of flooding in order to prepare rescue work and, where appropriate, assist the national committees in the security work;
k) require, if necessary, assistance from Czechoslovak People's Army and the Ministry of the Interior in security work through the Central Flood Commission;
(l) carry out water courses, water works and other objects in their management after the water catchment area and report the result to the authorities; analyse the experience and knowledge of the previous floods and apply them to the improvement of security work plans;
(m) keep records in the flood log.
(2) Watercourses managers shall coordinate the security work of small-scale watercourses managers and managers (owners, users) of water works and other watercourses in their territorial districts and provide them with technical assistance on request and, as far as possible, material assistance.
(3) Watercourses managers concentrate reports on the flood situation from small watercourses managers and submit summary reports for their territorial districts to the Ministry and the Regional National Committees.
§ 14
Managers (owners, users) of real estate for watercourses and other organisations
(1) Managers (owners, users) of real estate in watercourses are required to take the measures imposed on them by the competent national committee to prevent or mitigate the risk of flooding or the harmful consequences of flooding, unless it is under the applicable rules for other persons; perform security work on objects in their management (use).
(2) On built-up buildings or their integrated parts on watercourses or in flood areas, the investor and the contractor of the construction or technological part of the construction shall adequately perform the tasks of controllers (owners, users) of the water works referred to in Section 13 in order to protect against floods, each on the part of their activities.
§ 15
Managers (owners, users) of other water-based property or endangered territory
(1) On water courses, the seafarers (owners, users) ensure the protection of vessels and equipment used to sail against flooding; it follows the instructions of the authorities of the State Navigational Administration, the water flow manager and the flood authorities.
(2) Managers (owners, users) of property in the immediately endangered territory or in the flooded territory ensure its rescue, including any early harvest.
§ 16
Public fire protection units
Public fire protection units shall carry out the tasks assigned to them by their superior national committees as flood authorities in order to protect against floods, in particular the management and implementation of emergency work interventions. They shall ensure proper treatment and, where appropriate, storage of the means of storage entrusted to them for flood work. They shall draw up rescue plans as necessary and submit them to their superior national committees.
§ 17
National Security Corps services
The flood protection authorities require the assistance of the National Security Corps services, in particular the brokering of connections, the protection of the health and lives of citizens, the provision of public order and the protection of property.
§ 18
Czechoslovak People's Army and Interior Army Units
The Central Flood Commission, if necessary, requires assistance from the Czechoslovak People's Army and the Ministry of the Interior to protect against floods; If there is a danger of delay, this assistance is also required by the flood committees of the District National Committees and the Regional National Committees. The Ministry works with the Czechoslovak People's Army and the Ministry of the Interior in drawing up their aid plan.
§ 19
Citizens in flood protection
(1) Citizens of flood protection (flood service) are obliged, on the basis of flood plans, at the time of flood activity to come to a designated place at the earliest opportunity.
(2) Organisations are obliged to provide workers (members of cooperative organisations) with leave to the extent necessary to fulfil their obligations related to flood service.3)
(3) Citizens who have taken part in a flood service according to flood plans shall be certified by the competent flood authority. The remuneration for this period and compensation for overtime work shall be paid or paid to the organisations referred to in paragraph 2 by the competent flood authority or organisation in which the flood service was carried out.
