DECLARATION
of 7 July 2020
amending Decree No 332 / 2006 Coll., on the crops and propagating material of hops, vines, fruit genera and species and ornamental species, as amended by Decree No 95 / 2018 Coll.
The Ministry of Agriculture shall determine, pursuant to § 3 (8), § 7 (6) (a) to (k), (n), (p), (r), (s) and (u), § 14 (6), § 16 (12), § 19 (17) (a), (b), (c), (f), (h), (i), (m) and (n), § 23 (7), § 23 (8) (a) to (g), § 24a (7) and § 25 (8) of Act No. 219 / 2003 Coll., Act No. 223 / 2009 Coll., Act No. 331.
Decree No 332 / 2006 Coll., on crops and propagating material of hops, vines, fruit genera and species and ornamental species and its putting into circulation, as amended by Decree No 95 / 2018 Coll., shall be amended as follows:
1. At the end of footnote 2, the sentence "Commission Implementing Directive (EU) 2020 / 177 of 11 February 2020 amending Council Directives 66 / 401 / EEC, 66 / 402 / EEC, 68 / 193 / EEC, 2002 / 55 / EC, 2002 / 56 / EC and 2002 / 57 / EC, Commission Directives 93 / 49 / EEC and 93 / 61 / EEC and Implementing Directives 2014 / 21 / EU and 2014 / 98 / EU as regards harmful plant organisms on seeds and other plant propagating material shall be added to the separate line. '.
2. in Article 5 (1) (a) (3), the words "which reduce the quality of propagating material (3)" shall be replaced by the words "under the conditions laid down in Annex 2 to this Decree."
footnote 3 is deleted, including the footnote references.
3. in Article 5 (1) (a), point 5 shall be deleted;
4. in Article 5 (1) (b) (2):
'2. it shall be regularly inspected for the presence of harmful organisms under the conditions set out in Annex 2 to this Regulation, '.
5. in Article 5 (1) (c) (2):
'2. it shall be regularly inspected for the presence of harmful organisms under the conditions set out in Annex 2 to this Regulation, '.
6. In Article 5 (1), at the end of the text in point (d), the words "which is regularly controlled for the presence of harmful organisms under the conditions set out in Annex 2 to this Decree 'shall be added.
7. Paragraph 5 (2) and (3) reads as follows:
"(2) The following requirements shall be met for rootstock, selected vineyards and vine seedlings:
(a) are found free from regulated non-quarantine harmful organisms for the European Union (hereinafter referred to as "RNSO") listed in Annex No 2, Part 2, Sections 1 and 2, to this decree, as regards the genus or species concerned;
(b) in the most appropriate period of the year, taking into account the climatic conditions and conditions for vine cultivation and taking into account the biology of RNŠO relevant to vines, samples shall be taken from them in case of doubt and tested for RNŠO listed in Annex 2, Part 2, Sections 1 and 2 to this Decree;
(c) visual inspections and testing shall be carried out in accordance with the conditions set out in Section 3 of Part 2 of Annex No 2 to this Decree, further inspections being carried out where necessary to ensure the quality of propagating material;
(d) they may be grown only in soil or, where appropriate, in containers with growing media, the soil or substrates being free from any harmful organisms which may host the viruses referred to in Annex 2, Part 2, Section 2, to this Regulation, and the absence of such harmful organisms shall be determined by sampling and testing, sampling and testing, taking into account the climatic conditions and the biology of the harmful organisms which may host the viruses listed in Annex 2, Part 2, Section 2 to this Regulation.
(3) Soil or substrate sampling and testing shall not be carried out where the Institute has concluded, on the basis of an inspection, that the soil is free from any harmful organisms which may host the viruses listed in Annex 2, Part 2, Section 2, to this Decree. Sampling and testing shall also not be carried out if the vine has not been grown on the production soil for at least 5 years and if there is no doubt that there are no harmful organisms present in that soil which may host the viruses listed in Annex 2, Part 2, Section 2, to this Decree. ';
8. In Article 5, paragraphs 4 to 7 are added:
"(4) In the case of sampling and testing, Member States shall apply the European and Mediterranean Plant Protection Organisation (EPPO) protocols or other internationally recognised protocols. In the absence of such protocols, the corresponding protocols established at national level shall apply. In this case, Member States shall make those protocols available to the other Member States and the Commission upon request.
(5) In order to avoid the risk of contamination by harmful organisms which may host the viruses listed in Annex 2, Part 2, Section 2, Section 2, to that decree, the root and vine nurseries shall be established under the conditions laid down in Annex 2 to this Regulation.
(6) In addition to compliance with plant health and soil requirements, propagating material shall be produced in accordance with the crop site, production site or area requirements set out in Sections 1 and 2 of Part 2 of Annex 2 to this Regulation in order to achieve a restriction on the presence of harmful organisms listed in that Annex.
(7) Visual inspections of the crops and control of other requirements laid down in this Decree for vine propagating material are carried out by the Institute. "
9. In Article 7 (1), "Annex 5 'is replaced by" on the Institute's website'.
10.Paragraph 8 (3) reads as follows:
"(3) The evaluation of the seed crops shall be recorded in an annex to the application on the Institute's website."
11. in Article 15 (9), the words "or in cartons" are replaced by the words "cartons or individual seedlings to the final consumer,"
12. in Paragraph 18 (1) (g), "EC" is replaced by "EU."
13. in Paragraph 18 (2), the words "these particulars" shall be replaced by the words "particulars of the plant passport."
14. In Paragraph 18, paragraphs 7 and 8 are added:
"(7) The propagation material of ornamental plants shall have the following characteristics:
(a) at least at the time of visual inspection at the place of production, it shall be found practically free of all harmful organisms listed in Annex 11 to this Decree and the presence of RNSO on propagating material of ornamental plants put into circulation shall not exceed, at least at the time of visual inspection, the thresholds set out in Annex 11 to this Decree;
(b) at least on visual inspection, they shall be practically free of all harmful organisms which reduce the use value and quality of such propagating material other than harmful organisms listed in Annex 11 to this Regulation or any symptoms thereof; and
(c) it must also comply with the requirements concerning RNSO, quarantine harmful organisms for protected zones and RNSO laid down in the implementing acts adopted pursuant to Regulation (EU) 2016 / 2031 of the European Parliament and of the Council of 26 October 2016 on protective measures against harmful organisms of plants, as amended, as well as measures adopted pursuant to Article 30 (1) of that Regulation.
(8) Visual inspections and any sampling shall be carried out by the supplier of propagating material. "
15. In Annex 2, under the heading of the Annex, the following heading is inserted: "Part 1 - Quality requirements for vine propagating material '.
16. In Annex No 2, Part 1, point 1, in the sentence below the table, the words "and rootstock cuttings' are inserted after the words" rootstocks'.
17. In Annex No 2, Part 1, point 3, Table 3 reads:

1) Pre-basic propagating material, basic propagating material and certified propagating material
(a) Candidatus Phytoplasma solani Quaglino et al.
(i) the vine is produced in areas known to be free from Candidatus Phytoplasma solani Quaglino et al., or
(ii) no symptoms of Candidatus Phytoplasma solani Quaglino et al have been observed on the vine at the production site during the last complete growing season; or
(iii) the following conditions concerning the presence of Candidatus Phytoplasma solani Quaglino et al.:
- all vines in rootstock and selected vineyards intended for the production of source propagating material and basic propagating material showing signs of the presence of Candidatus Phytoplasma solani Quaglino et al. have been removed, and
- all vines in rootstock and selected vineyards intended for the production of certified material showing symptoms of the presence of Candidatus Phytoplasma solani Quaglino et al. have been at least removed from propagating material, and
- where propagating material intended for marketing shows signs of the presence of Candidatus Phytoplasma solani Quaglino et al., the whole lot of that material shall be treated with hot water or other appropriate means in accordance with EPPO protocols or other internationally recognised protocols to ensure that it is free from Candidatus Phytoplasma solani Quaglino et al.
(b) Xylophilus ampelinus Willems et al.
(i) the vine is produced in areas known to be free from Xylophilus ampelinus Willems et al., or
(ii) no signs of Xylophilus ampelinus Willems et al have been observed on the vine at the production site during the last complete growing season; or
(iii) the following conditions concerning the presence of Xylophilus ampelinus Willems et al are met:
- all vines in root and selected vineyards intended for the production of initial propagating material, basic propagating material and certified material showing signs of the presence of Xylophilus ampelinus Willems et al. have been removed and appropriate hygiene measures have been taken, and
- the vine at the production site showing symptoms of the presence of Xylophilus ampelinus Willems et al., after cutting, is treated with a bactericidal agent to ensure that Xylophilus ampelinus Willems et al., and
- where propagating material intended for marketing shows signs of the presence of Xylophilus ampelinus Willems et al., the whole lot of that material shall be treated with hot water or other appropriate means in accordance with EPPO protocols or other internationally recognised protocols to ensure that it is free from Xylophilus ampelinus Willems et al.
c) Arabis mosaic virus, Grapevine fanleaf virus, Grapevine Leafroll-associated Virus 1 and Grapevine Leafroll-associated Virus 3
(i) the following conditions concerning the presence of Arabis mosaic virus, Grapevine fanleaf virus, Grapevine Leafroll-associated Virus 1 and Grapevine Leafroll-associated Virus 3 are met:
- no symptoms of any of the viruses listed have been observed on vines in rootstocks and selected vineyards intended for the production of source propagating material and basic propagating material, and
- the signs of the presence of those viruses have been observed in up to 5% of the vines in the rootstock and selected vineyards intended for the production of certified material and the vines have been removed and destroyed, or
(ii) all vines in rootstock vineyards and selected vineyards intended for the production of source propagating material and all source propagating material shall be kept in insect-protected establishments to ensure that they are free from Grapevine Leafroll-associated Virus 1 and Grapevine Leafroll-associated Virus 3
d) Viteus vitifoliae Fitch
(i) the vine is produced in areas known to be free from Viteus vitifoliae Fitch; or
(ii) the vine is grafted on a Lateus vitifoliae Fitch-resistant rootstock; or
- all grapevines in rootstock and selected vineyards intended for the production of source propagating material and all source propagating material are kept in insect-protected establishments and no symptoms of Viteus vitifoliae Fitch have been observed in the last completed growing season, and
- where propagating material intended for marketing shows signs of the presence of Viteus vitifoliae Fitch, the whole lot of that material shall be treated by fumigation, hot water or other appropriate means in accordance with EPPO protocols or other internationally recognised protocols to ensure that it is free from Viteus vitifoliae Fitch.
2) Standard propagating material
(a) Candidatus Phytoplasma solani Quaglino et al.
(i) the vine is produced in areas known to be free from Candidatus Phytoplasma solani Quaglino et al., or
(ii) no symptoms of Candidatus Phytoplasma solani Quaglino et al have been observed on the vine at the production site during the last complete growing season; or
(iii) all vines in selected vineyards intended for the production of standard material showing signs of the presence of Candidatus Phytoplasma solani Quaglino et al. have been at least removed from propagating material; and
- where propagating material intended for marketing shows signs of the presence of Candidatus Phytoplasma solani Quaglino et al., the whole lot of that material shall be treated with hot water or other appropriate means in accordance with EPPO protocols or other internationally recognised protocols to ensure that it is free from Candidatus Phytoplasma solani Quaglino et al.
(b) Xylophilus ampelinus Willems et al.
(i) the vine is produced in areas known to be free from Xylophilus ampelinus Willems et al., or
(ii) no signs of Xylophilus ampelinus Willems et al have been observed on the vine at the production site during the last complete growing season; or
(iii) the following conditions concerning the presence of Xylophilus ampelinus Willems et al are met:
- all vines in selected vineyards intended for the production of standard material showing symptoms of the presence of Xylophilus ampelinus Willems et al. have been removed and appropriate hygiene measures have been taken, and
- the vine at the production site showing symptoms of the presence of Xylophilus ampelinus Willems et al., after cutting, is treated with a bactericidal agent to ensure that Xylophilus ampelinus Willems et al., and
- where propagating material intended for marketing shows signs of the presence of Xylophilus ampelinus Willems et al., the whole lot of that material shall be treated with hot water or other appropriate means in accordance with EPPO protocols or other internationally recognised protocols to ensure that it is free from Xylophilus ampelinus Willems et al.
c) Arabis mosaic virus, Grapevine fanleaf virus, Grapevine Leafroll-associated Virus 1 and Grapevine Leafroll-associated Virus 3
Symptoms of the occurrence of all viruses (Arabis mosaic virus, Grapevine fanleaf virus, Grapevine Leafroll-associated Virus 1 and Grapevine Leafroll-associated Virus 3) have been observed in up to 10% of the grapes in selected vineyards for the production of standard material and the vine has been removed from the propagating material
d) Viteus vitifoliae Fitch
(i) the vine is produced in areas known to be free from Viteus vitifoliae Fitch; or
(ii) the vine is grafted on a Lateus vitifoliae Fitch-resistant footstool, or
(iii) where propagating material intended for placing on the market shows signs or symptoms of the presence of Viteus vitifoliae Fitch, the whole lot of that material shall be treated with fumigation, hot water or other appropriate means in accordance with EPPO protocols or other internationally recognised protocols to ensure that it is free from Viteus vitifoliae Fitch. ';
19. Annex 5 shall be deleted;
