DECLARATION
of 16 February 2018
amending Decree No. 210 / 2012 Coll., implementing certain provisions of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material, as amended
The Ministry of Industry and Trade, in agreement with the Ministry of Foreign Affairs, the Ministry of Defence and the Ministry of Interior, pursuant to Section 33 of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material and on the Addition of Act No. 455 / 1991 Coll., on Business Business (Trade Code Act), as amended, and Act No. 140 / 1961 Coll., the Criminal Act, as amended, as amended, as amended, as amended, and Act No. 248 / 2011 Coll., for the implementation of Section 5 (3):
Decree No. 210 / 2012 Coll., on the implementation of certain provisions of Act No. 38 / 1994 Coll., on Foreign Trade in Military Material, as amended by Decree No. 85 / 2014 Coll., Decree No. 48 / 2015 Coll., Decree No. 308 / 2016 Coll. and Decree No. 171 / 2017 Coll., is amended as follows:
1. footnote 1 shall read:
"(1) Directive 2009 / 43 / EC of the European Parliament and of the Council of 6 May 2009 simplifying the conditions for transfers of defence-related products within the Community, as amended."
2. In Annex 1, the title in SVMe 7 reads as follows:
"Chemicals," "biological agents," "riot control agents," radioactive materials, related equipment, components and materials: ';
3. In Annex 1, in SVMe 7, point (a) reads:
"a." Biological agents "or radioactive materials which have been selected or modified to increase efficiency in human or animal loss, damage to technology or damage to crops or the environment; ';
4. In Annex 1, in SVMe 7, in point d., the words "" riot control agents' are replaced by the words "riot control substances'.
5. In Annex 1, in SVMe 7, Note 1, the words "" riot control agents' are replaced by the words "riot control substances'.
6. In Annex 1, in SVMe 8, the following point 41 is added at the end of point a.:
'41. FTDO (5,6- (3 ', 4' -furazano) -1,2,3,4-tetrazinephroxy); '
7. In Annex 1, SVMe 8, point 3, the following text is added:

9. In Annex 1, in SVMe 8, the following semicolon and h are added at the end of point (g):

1. powder of the following materials with a particle size in any direction below 250 µm and not specified elsewhere in SVMe 8:
a. Aluminium;

Technical notes
1. "Reactive materials" are specially designed to induce exothermic reactions only at high shear speed and to be used as cumulative liners or warheads' coats.
2. Powder, reactive materials' is made, for example, by a process of high energy ball grinding.
3. Forms, reactive materials' are made for example by selective laser sintering. '
10. In Annex 1, in SVMe 8, Note 3, the word "explosives' is replaced by" explosives'.
11. in Annex 1, in SVMe 18, in the Note, points (d) to (h) read:

14. In Annex 1, in the Definitions of Terms used in this list under SVMe 17 "Robot ', point d. is replaced by the following:
"d. is equipped with user programmability 'by means of a learning / playback method or by means of an electronic computer which may be a programmable logic controller, i.e. without mechanical intervention.
"User programmability 'means the possibility of access which enables the user to insert, modify or replace" programmes' in a manner other than:

Efficacy
This Decision shall enter into force on 5 March 2018.
