laying down the details of equivalence and the conditions for recognition of the diploma certificate issued by foreign schools
The Ministry of Education of the Czech Socialist Republic provides in an agreement with the Ministry of Health of the Czech Socialist Republic and after consulting other participating central bodies pursuant to § 27 paragraph 4 of the Act of the Czech National Council No. 77 / 1978 Coll., on State Administration in Education:
Preliminary provisions
This decree regulates, on the one hand, the issue of verification clauses on certificates of graduation or equivalent examination issued by a foreign school in cases where the equivalence of the certificate is established by an international agreement and, on the other hand, the conditions for the recognition of such certificates in cases where equivalence is not established by an international agreement. 1)
In cases where the international agreement provides for the equivalence of the certificate of graduation or similar examination, the certificate issued by the foreign school and bearing the verification clause shall be valid in the territory of the Czech Socialist Republic from the date on which the relevant international agreement entered into force; if the certificate has been issued after that date, it shall be valid on the date of issue.
Verification of the certificate
(1) The application for a certificate of verification shall be submitted to the Regional National Committee responsible for the place of residence (hereinafter referred to as the Regional National Committee). The application shall be accompanied by the original of the certificate and its certified translation in the Czech or Slovak language. When submitting an application, the applicant shall prove that he is a Czechoslovak national citizen and if he is a foreigner, he has a residence permit in the territory of the Czechoslovak Socialist Republic.
(2) The Ministry of Education of the Czech Socialist Republic, at secondary medical schools, will determine the Ministry of Health of the Czech Socialist Republic in contentious and unclear cases, which school is the closest to the study.
Verification clause
The verification clause shall be issued by the Regional National Committee in accordance with the model set out in Annex 1.
Recognition of the certificate
A certificate of graduate or similar examination issued by a foreign school shall be valid unless equivalence is established by an international agreement, on the date of the decision on its recognition.
Conditions for recognition
(1) Only a certificate issued by a foreign school of the same level as those providing full secondary or higher education in the Czechoslovak Socialist Republic can be recognised.
(2) The application for recognition shall be submitted to the Regional National Committee. 2) The application shall be accompanied by the original of the certificate and its certified translation in the Czech or Slovak language. Unless otherwise provided by international agreements, the authenticity of the signatures and the stamp on the original documents must be verified by the Ministry of Foreign Affairs of the State in which the school which issued the certificate is situated and by the competent Czechoslovak representative office. At the time of submission, the applicant shall prove that he is a Czechoslovak State citizen, and if he is an alien, that he has a residence permit in the territory of the Czechoslovak Socialist Republic.
(3) The Regional National Committee may require the applicant to carry out a pre-filled test; determine the date and place of the exam and, after consulting the Ministry of Education of the Czech Socialist Republic, determine the subjects from which the additional examination will take place.
Additional test
(1) The supplementary test will take place in the spring period in March and in the autumn period in October; in exceptional cases, an exceptional deadline may be set.
(2) As a general rule, the complementary examination shall consist of oral and, where appropriate, written examinations of subjects or parts thereof which are taught at Czechoslovak secondary school, unless they have been classified as applicants at a foreign school, with the exception of Czech language and literature.
(3) The additional test shall be carried out before the panel. The Commission shall be at least four members. The chair of the Commission is the Regional School Inspector, the members of the Committee are teachers of the subjects from which the supplementary examination is held. The school where the examination takes place shall be determined and appointed by the Regional National Committee by the chairman and members of the Commission.
(4) The overall result of the supplemental test is assessed by the Panel. A proposal made by most members of the Commission shall be adopted. In the event of a tie, the chairman shall vote.
Verification clause
After the decision on recognition of the diploma certificate or similar test has been taken, the Regional National Committee shall issue a verification clause in accordance with the model set out in Annex 2.
Common and final provisions
(1) The certificate bearing the verification clause (Sections 4 and 8) issued by the Regional National Committee in the Slovak Socialist Republic is valid also in the territory of the Czech Socialist Republic.
(2) The Regional National Committee shall keep a record of the issue of verification clauses.
This decree does not apply to equivalence and recognition of certificates issued by foreign schools which correspond in the Czechoslovak Socialist Republic to secondary military schools, secondary schools of the National Security Corps and secondary schools of the Czech Socialist Association.
(1) The Directives of the Ministry of Education and Culture of 18 March 1957 No 770 / 57A II / 3 on the novification of the foreign diploma certificate (adult exam), published in the Collection of Instructions for the Executive Authorities of the National Committees, No 1957, No 6, No 21, are hereby repealed.
(2) For secondary schools:
1st Decree of the Ministry of Education of the Czech Socialist Republic No. 83 / 1974 Coll., on the equivalence and recognition of the Certificate and Diplomas of Education issued in the Union of Soviet Socialist Republics, as amended by Decree No. 147 / 1976 Coll.;
2nd Decree of the Ministry of Education of the Czech Socialist Republic No. 146 / 1976 Coll., on the recognition of the equivalence of documents of graduating from secondary, secondary, professional and university schools and documents of award of degrees.
This Decree shall take effect on 1 April 1981.
