DECLARATION
Minister for Foreign Trade
of 28 March 1967
on the designation of Czechoslovak Filmexport and Czechoslovak Television for certain export and import activities for films and television records
The Foreign Trade Minister shall, in agreement with the Minister of Finance, the Minister of Culture and Information and the Central Director of Czechoslovak Television pursuant to § 2 paragraphs 1 and 2 and § 20 of Act No. 119 / 1948 Coll., on the state organization of foreign trade and international mail:
The company "Czechoslovak Filmexport" *) is determined to carry out some other foreign business activities in addition to those which it performs pursuant to § 4 (1) vl. naříč. 13 / 1962 Coll., on the new organization of Czechoslovak film. The authorisation of the company "Czechoslovak Filmexport 'on the external trade section therefore includes:
1. Export
(a) cinematographic films and film material of all kinds for cinema screening and television broadcasting;
(b) films and film material for television, unless the manufacturer is Czechoslovak television;
(c) films and film materials of all kinds intended for purposes other than sub (a) and (b), with the exception of television films, materials and records under the export authorisation of Czechoslovak television.
2. Imports
(a) cinematographic films and film material of all kinds for cinema screening and television broadcasting;
(b) cinematographic films and film material intended solely for television broadcasting;
(c) films and film materials of all kinds intended for purposes other than sub (a) and (b), with the exception of television films, materials and records under the import authorisation of Czechoslovak television.
Czechoslovak TV * *) is intended to perform some other foreign business activities in addition to those which it performs pursuant to § 3 (e) of Act No. 18 / 1964 Coll., on Czechoslovak Television. The right of Czechoslovak television on the external trade section therefore includes:
1. Export
television films and television recordings produced by Czechoslovak television for use of all kinds (for television and cinema). This also applies to documentary film material intended only for television broadcasting, where the assignment of broadcasting rights is included in the price of the material.
2. Imports
television films, materials and television recordings, as well as documentary film material intended only for television broadcasting, for which the assignment of broadcasting rights is included in the price of the material.
The definition of the scope between the Czechoslovak Filmexport and the Czechoslovak Television (hereinafter referred to as "the two organisations') set out in Sections 1 and 2 applies also to the exchange of cinematographic and television films, film materials and records.
Czechoslovak Filmexport is exclusively entitled to conclude contracts with foreign interested parties for the production of cinematographic films. Contracts for the production of television films may be concluded by both organisations, either separately or jointly, with foreign candidates; contracts for the production of television records are concluded exclusively by Czechoslovak television.
(1) A film for the purposes of this Decree means a comprehensive work of film to which the exclusive right as a whole applies; film materials of all kinds (newscast, batches, etc.) means positive copies or other types of propagating material. This applies to cinematographic and television films and materials. A television record means the capture of a television piece other than a film technique.
(2) The exclusive authorisation of Artie, a foreign trade firm, *) is not affected by this decree.
This decree shall take effect on 15 April 1967.
