GOVERNMENT REGULATION
of 16 July 2025
amending Government Regulation No 189 / 2019 Coll., on the method of determining the value of dwellings which the debtor is not obliged to issue for redemption
The Government orders pursuant to § 398 (6) of Act No. 182 / 2006 Coll., on the bankruptcy and methods of its resolution (insolvency law), as amended by Act No. 31 / 2019 Coll.:
Čl. I
Government Decree No. 189 / 2019 Coll., on how to determine the value of dwellings which the debtor is not obliged to issue for redemption is amended as follows:
1. In Paragraph 4 (1), the words "the prices of the underlying property 'are replaced by the words" Property prices'.
2. In Article 4 (1), the words "The statistical value shall be determined on the basis of the average purchase price and the average size corresponding to the county or district and the size of the debtor's municipality; in the case of Prague, the capital of Prague is used instead of the county and the district of Prague is used according to the decree governing the valuation of the property (1). Where the set of prices does not contain information for the municipality of the respective size in the district of the debtor's residence, the data for the municipality of the respective size in the region of the debtor's residence shall be used. The size of the debtor's municipality shall be replaced by" The statistical value shall be determined on the basis of the average purchase price and the average size corresponding to the district or, where applicable, the size of the debtor's municipality; in the case of Prague, the City of Prague is used instead of the district. Where the set of prices does not contain information for the municipality of the respective size in the district of the debtor's residence, the data for the municipality of the respective size in the region of the debtor's residence shall be used. The size of the debtor's village. "
3. In Paragraph 4, the following paragraph 3 is inserted after paragraph 2:
"(3) Where the debtor's residence constitutes a joint ownership interest in the case, the statistical value of the dwelling established in accordance with § 5 or 6 shall not be reduced by the size of the joint ownership interest. '
Paragraphs 3 and 4 shall be renumbered paragraphs 4 and 5.
4. In Article 4 (4), the words "in accordance with the procedure laid down in paragraph 1 on the value of the land 'are replaced by the words" the house by a coefficient of the value of the land referred to in paragraph 7'.
5. In Paragraph 4 (5), the words "for the third quarter of the year preceding the 1 year of the bankruptcy decision 'are deleted.
6. Paragraph 5 (1) reads as follows:
"(1) The statistical value of the apartment is determined as the product of the average size of the apartment in m ² in the district and the purchase price per m ² according to the size of the municipality in the district, listed in the table of the price package" 2-4. Average prices of apartments in the Czech Republic in the period (...) according to the districts depending on the size of the municipalities (in CZK / m ²). "
footnote 1 is deleted.
7. In Paragraph 5 (2), the words "'shall be deleted. Average prices of apartments in the Czech Republic in years (...) depending on the size of the municipalities" "are replaced by" 2-4. Average prices of apartments in the Czech Republic in the period (...) according to the districts depending on the size of the municipalities (in CZK / m ²) "."
8. § 6 to 8 reads:
§ 6
Statistical value of the family home
(1) The statistical value of the family house is determined as the product of the average size of the family house in m ² in a given district and the purchase price per m ² according to the size of the municipality in the given district, listed in the table of the package prices "1-4. Average prices of family houses in the Czech Republic in years (...) according to districts depending on the size of the municipalities (in CZK / m ²)."
(2) The statistical value of the family house referred to in paragraph 1 may be at least two-tenths and no more than twice the product of the average size of the family house in m ² for the whole Czech Republic and the purchase price for m ² for the whole Czech Republic, listed in the table of prices "1-4. Average prices of family houses in the Czech Republic in years (...) according to districts depending on the size of the municipalities (in CZK / m ²)."
§ 7
Value coefficient of land
(1) The weighting of the value of the land shall be determined according to the size of the municipality of the debtor's residence.
(2) The coefficient for the value of the land is:
(a) 1,2 in the case of a municipality of up to 1 999 inhabitants;
(b) 1,25 in the case of a municipality between 2 000 and 9 999 inhabitants;
(c) 1,3 in the case of a municipality between 10 000 and 49 999 inhabitants;
(d) 1,35 if it is a municipality of over 50 000 inhabitants.
§ 8
Price increase coefficient
(1) The price increase coefficient shall be determined from the statistical table referred to in Article 4 (5) "2.1. Indices of realised prices of older flats," sub-table "Index (average 2010 = 100)" from index values for "Czech Republic total" share of value for the last published quarter and values for the same quarter prior to 3 years of bankruptcy decision.
(2) The index share is rounded to 2 decimal places. "

Efficacy
This Regulation shall take effect on 1 September 2025.
