DECLARATION
Ministry of Finance
of 17 November 1995
amending and supplementing Decree No. 178 / 1994 of the Ministry of Finance Coll., on the valuation of buildings, land and permanent crops
The Ministry of Finance provides pursuant to § 2 (2) (b) of the Act of the Czech National Council No. 265 / 1991 Coll., on the competence of the authorities of the Czech Republic in the field of prices, as amended by Act No. 135 / 1994 Coll.:

Decree No. 178 / 1994 Coll., on the valuation of buildings, land and permanent crops, is amended as follows:
Article 1 (2) reads as follows:
"(2) The hall is a building with one or more floors in which the sum of the individual open spaces defined by vertical structures, floors and the lower face of ceiling or roof structures, of each space size of at least 400 m3, is more than two thirds of the built-up space; The vertical structures defining the inner open spaces shall not be considered as internal stand-alone support elements (columns, pillars) and vertical structures not exceeding 1,7 m height; the built-in area of the hall shall be at least 150 m2. The method of measuring and calculating the measurements is set out in Annex 1. ';
2. in the second sentence of Paragraph 2 (4), footnote 2 shall be deleted and the words "intended for joint use" shall be moved to the end of the sentence and supplemented by footnote 2).
3. In Paragraph 2, the following sentence is added at the end of paragraph 5: "For the purposes of the valuation, the non-residential space and the share of the common parts of the house shall be included, even if they are located outside the house, as well as the share of the accessories of the house and other buildings, including their accessories intended for shared use.2) '.
4. In Article 2 (6), the words "in an apartment 'are replaced by the words" apartment' and the words "in a non-apartment 'are replaced by the words" non-residential'.
5. In Paragraph 2 (7), the first words "which have elapsed since the year following the year 'are replaced by" which has elapsed since the year' and in the third sentence the words "counted 'are inserted after the words" derived year'.
6. in Paragraph 2 (8) (a), the following sentence is inserted after the words "to build-up 4)" and the following sentence is inserted: "where the maximum permissible building capacity of the land is determined by a special regulation, the building plot shall be only the part corresponding to the permissible limit for construction, 4a)
4a) E.g. the Decree of the National Committee of the City of Prague No. 5 / 1979 Coll. NVP on general technical requirements for construction in the capital of Prague, as amended by the Decree of the capital of Prague No. 1 / 1994 Coll. of Prague. "
7. In Paragraph 2 (8), the last sentence is replaced by the following: "A building plot for valuation purposes is not a plot which is built solely by underground or above ground lines, including their accessories, underground structures which do not reach the level of terrain, underground parts and accessories of structures for transport and water management not forming part of the buildings. The building plot for valuation purposes is also not a plot built by wells, fences, supporting walls, monuments, statues, etc. 4b)
4b) Paragraph 5 (2) of Decree No. 126 / 1993 Coll., implementing Act No. 265 / 1992 Coll., on Minutes of Property Rights and Other Property Rights, and Act No. 344 / 1992 Coll., on the Real Estate Register of the Czech Republic (cadastral Act).
8. In Paragraph 2 (9), the dot is deleted at the end of the sentence and the words "with a depth of water at the discharge device at normal levels in the growing season of 0,5 m and above are added."
9. In Paragraph 2 (12), the word "ponds' is replaced by" water tanks'.
10. In the second sentence of Paragraph 3, the words "or when used in contravention of the law 'are inserted after the words" allowed'.
11. in Article 4, the following paragraph 1 is inserted:
"(1) The buildings and halls are valued, which cannot be classified according to the purpose of their use among the buildings valued under § 5 to 12. '
Paragraphs 1, 2 and 3 shall become paragraphs 2, 3 and 4.
in paragraph 2, the words "paragraph 2 'are replaced by the words" paragraph 3';
12. in Article 4 (3), formula K3 reads:

"K3 = 2,10v + 0,30 for buildings

K3 = 2,80v + 0,30 dost 0,60 for halls
where v is the average floor height in metres,
2,10, 2,80, 0,30 and 0,60 are constants. "
13. in Article 4 (3), the term "-" is deleted from the formula for K4 and the definition of n starting with "n is the sum" and ending with "K4." is replaced by the following text:
"n is the sum of the volume shares of structures and equipment with above-standard equipment listed in Annex 14 in Table 1 for buildings and in Table 2 for halls less the sum of the volume shares of structures and equipment with sub-standard equipment identified from those tables. Furthermore,
1. if the design present in the construction site is not listed in the list of structures and equipment in the relevant table of Annex 14, its volume share of the cost of its acquisition shall be determined at the time and place of the valuation, multiplied by a coefficient of 1,852 and added to the sum of the volumes of the shares; the amount of other volume shares does not change;
2. if the construction of the structure referred to in the relevant table of Annex 14 is missing, its fixed volume shall be multiplied by 1,852 and deducted from the sum of the volumes. ';
14. in Article 5, a comma and the word "piece" are inserted after the words "unit of measurement m3, m2, m."
15. in Paragraph 6 (2), the term "-" shall be deleted from the formula for K4 and in the first sentence of the definition "n" shall be inserted after the words "in Annex No 14," and the second sentence shall read: "The procedure referred to in points 1 and 2 of the definition in Section 4 (3) shall also apply."
16. Article 6 (3) reads as follows:
"(3) If a family house is used for other purposes than housing, to an extent that does not alter the nature of its use, the whole building will be valued as a family house. If the nature of the use changes, the construction will be valued in accordance with Section 4. '
17. Article 6 shall be added to the following paragraphs 4 and 5:
"(4) The economic parts, whether operationally or constructively linked to the residential part, shall be valued on the basis of the actual purpose of the application in accordance with the relevant provisions of this Decree, the residential part, if it meets the criteria of the family house, being valued in accordance with § 6. Coefficient K1 to K4 shall be determined separately for the economic part, independently of the residential part.
(5) Similarly, the evaluation of the holiday cottage and holiday home shall be carried out if part of it serves other purposes. ';
18. In Article 7 (2), the term "- 'shall be deleted from the formula for K4 and in the sentence of the first definition of n, the words" Table 4' shall be inserted after the words "Annex 14 'and the second sentence shall read:" Furthermore, the procedure referred to in points 1 and 2 of the definition in Section 4 (3) shall apply.'.
19. Article 8 shall be added to the following paragraph 3:
"(3) The basic price referred to in paragraphs 1 and 2 shall be multiplied by the coefficient K5 shown in Annex 13."
20. In Paragraph 9 (2), the following sentence is added at the end: "Limit coefficients 0,90 and 1,10 may be exceeded only exceptionally on the basis of conclusive justification."
21.
"(1) The price of the well shall be determined by multiplying the number of m depth of the well by the price shown in Annex 10 and adding the price of the accessories. The well price thus calculated shall be multiplied by the coefficient K5 shown in Annex 13. ';
22. in Article 11 (1), the words "and adjusted in accordance with paragraph 3" shall be deleted.
23. In Paragraph 12, the dot is deleted at the end of paragraph 1 and the words "multiplied by the coefficient K5 set out in Annex No 13 'are added.
24. in Article 12, paragraph 2 and the designation of paragraph 1 shall be deleted;
25. Article 13 (2) reads as follows:
"(2) The price of the building, which is a cultural monument, is determined according to the relevant Sections 4 to 12, Sections 17 and 19. This price shall be added to the price of works of art and art, which are part of the construction, as determined by expert opinion. '
Paragraph 3 shall be deleted.
26. in Article 14 (1) and (2), the words "in the building" including note 10) shall be deleted, the words "the building" shall be replaced by the words "construction" and in the second paragraph the words "secondary buildings" shall be inserted after the words "which exclusively serve joint use."
27. In the first sentence of Section 15, comma and the words "and, if there is no project documentation, according to the expected state of the construction after completion," are inserted after the words "building office."
28. In Paragraph 17, the following words are replaced by a comma at the end of the period: "or by comparison with the price of a comparable construction according to the relevant criteria established under this Decree. '
29. in Article 19 (1), "Sections 4 to 12, 14 and the price of cultural monuments" shall be replaced by "Sections 4 to 14."
30. In the first sentence of Paragraph 20, the words "or its valued parts' and the words" in which 'are replaced by' in which 'are deleted. In the second sentence, the following words are added for the words "free-of-charge apartments':" except for rental house owners' apartments which were not rented at the time of the valuation '. The last sentence is released.
31. in Article 21 (1), the words "or parts thereof" shall be deleted, the words "or parts thereof shall be deleted with the symbol CV."
32. In Paragraph 23 (1), the comma is deleted after the words "building land" and the words "except for the land referred to in paragraph 2," In point (c), the word "Jeseník 'is deleted and in point (e) the following words are inserted after the word" inhabitants': "and in Jeseník '.
33. In Paragraph 23 (2), the words "(a) to (i)" shall be inserted in the first sentence after the words "paragraph 1" and in the second sentence, the words "price" shall be replaced by the words "that price."
34. In Paragraph 23 (3), the following sentence is added at the end: "A set of real-life parcels consisting of a built-up area and a garden, in the absence of agricultural land, or other land registered in the cadastral of real estate, or an unbuilt part of the original building plot, which was created for use of the building and which is owned by the same entity, shall be regarded as a single functional unit. '
35. in the sentence of Paragraph 23 (4), the first words "walkways and parks, areas of airports and ports" shall be replaced by the words "areas of airports and ports, if not used for business for remuneration, walkways and parks, or land for such purposes (4)."
36. In Article 25 (1), the words "Table 1 'are deleted, in the first sentence of paragraph 3, the words" paragraphs 1 and 2' are added after the words "agricultural parcels' and paragraph 5 is deleted.
37. Note 18) reads as follows:
"18) Decree of the Ministry of Agriculture No. 215 / 1995 Coll., establishing a list of cadastral territories with assigned average prices for agricultural parcels."
38. In the first sentence of Article 26 (1), "prices' is replaced by" prices'; in paragraph 3, "type of culture 'is replaced by" method of use'; in paragraph 4, "Prices' is replaced by" Basic price '.
39. in Paragraph 27 (1), the words "Infertile land" shall be replaced by the words "economically unused land and barren land" and the words "large water tank" shall be deleted; in paragraph 2, the following is inserted after the words "forest land ':" and water areas'.
40. The title of Part Four is: "VALUATION OF AQUATIC FLOTS."
(41) In Article 28 (3), the words "small" shall be replaced by the words "others," in paragraph 5, the words "as the replacement price of the building (CSR)" shall be replaced by the words "according to the cost required for its acquisition at the place of construction at the time of its valuation," in the last sentence, the words "reproductive" shall be deleted and paragraph 7 shall read:
"(7) Water areas on which there are no buildings are valued at CZK 0.50 per m2."
42. In the second sentence of Paragraph 29 (4), the words "or extrapolation, as the case may be, 'are deleted and the following words are added after the word" interpolation': "after an assessment of the true state of the forest '.
43. In Paragraph 29 (5), the following sentences are added at the end: "If the wash is lower than the minimum wash for the group of timber set out in Annex 22, the lowest wash shall be used for the valuation. Where the forest economic plan indicates a wash higher than that laid down in Annex 22 for the group of trees, the highest wash shall be used for the valuation. ';
44. In Paragraph 29 (9), the words "the age value factor fa shall be determined by appropriately extrapolating the justification for the procedure 'are replaced by the words" the age value factor fa shall be one'.
45. in Paragraph 30 (3), the words "the total cost of the culture covered by the age of culture c is replaced by the words" the sum of the costs incurred in each year by the age of culture indicated. "
46. In Paragraph 31 (1), the words "forest crops' are replaced by the words" wood groups' and in paragraph 2, the words "the basic price shall be reduced by only one deduction, the value of which is the highest 'shall be replaced by the words" the basic price may exceptionally be reduced by up to 90%'.
47. Paragraph 32 shall be added to paragraph 3:
"(3) Where a group of trees is located on non-forest land with forest land on forest land, it shall be valued in accordance with Articles 29 to 31 or 33 even if it is less than 50 trees or is less than 1000 m2 in size. '
48. In Article 33 (1), the following shall be inserted after the words "Forestry": "on forest and non-forest parcels having an area" and the words "on area" shall be deleted.
49. In Paragraph 35, the following paragraph 2 is inserted after paragraph 1:
"(2) If the construction is intended or used for different purposes, it shall be valued according to the predominant purpose of use, provided that this clearly can be determined, taking into account the soil and attic areas of agricultural buildings used for the storage of agricultural products. If this is not possible, the number of units of measurement of the construction used for the same purpose shall be valued at the price for the relevant unit of measurement laid down in the Order. Soil and basement spaces, if not used or adapted for use for a specific purpose, shall be divided by the ratio of the volumes of enclosed spaces used for different purposes and shall be valued at the price set out in this decree, except for Article 6, for that purpose of use. ';
Paragraphs 2 and 3 shall become paragraphs 3 and 4.
50. Paragraph 35 (3) reads as follows:
"(3) The price of the property valued, including buildings without foundations, shall be rounded to ten crowns. '
51. in Paragraph 36 (2), the words' for 1994 and 1995 'shall be deleted.
52. In the sentence of point 1 (1) of Annex 1, the second words "but not more than 10 cm 'shall be replaced by" for buildings valued in accordance with Sections 4, 6 to 9 and 12';
point 1 (3) (b) shall read as follows:
"(b) above-ground high-current and low-current lines as the sum of the shortest air distances between the aid, without account being taken of deflection,"
in point 1 (3), the following point (c) is added:
"(c) above ground lines of others in actual lengths.";
