DECLARATION
of 19 July 2021
amending Decree No. 208 / 2004 Coll., on minimum standards for the protection of livestock, as amended
The Ministry of Agriculture provides pursuant to Article 29 (1) of Act No. 246 / 1992 Coll., for the protection of animals against abuse, as amended by Act No. 77 / 2004 Coll., Act No. 312 / 2008 Coll., Act No. 291 / 2009 Coll., Act No. 359 / 2012 Coll. and Act No. 501 / 2020 Coll., for the implementation of § 12a, § 12c (2), § 12g (2) and § 29a (2) Act:
Čl. I
Decree No. 208 / 2004 Coll., on minimum standards for the protection of livestock, as amended by Decree No. 425 / 2005 Coll., Decree No. 464 / 2009 Coll., Decree No. 78 / 2012 Coll. and Decree No. 22 / 2013 Coll., is amended as follows:
1. In footnote 2, the words "Council Directive 93 / 119 / EC of 22 December 1993 on the protection of animals at the time of slaughter or killing 'are deleted.
2. In Paragraph 1, the current text becomes paragraph 1 and the following paragraph 2 is added:
"(2) This decree further regulates minimum standards for the breeding of horses, donkeys and their hybrids, which are kept as pets. '
3. In footnote 2a, "(w) 'is replaced by" (v)'.
4. In Article 1a, at the end of point (d), the dot is replaced by a comma and the following point (e) is added:
"(e) an automatic milking system of a robotically complex automatic milking system which, at the same time, ensures the fully controlled movement of the herd in the stables and the requirements of dairy cows for feeding, drinking and rest, using a one-way and selective gate system which divides the stable into different parts and determines whether or not milking is allowed on the basis of criteria established by the farmer and directs the dairy cows to the milking unit or to another part of the barn."
5. footnote 2b shall be deleted;
6. in Paragraph 2 (1), point (k) shall be deleted;
Points (l) to (o) shall be renumbered as points (k) to (n).
7. footnote 2c is deleted.
8. In footnote 4, the words "as amended by Act No. 309 / 2002 Coll., Act No. 162 / 2003 Coll. and Act No. 282 / 2003 Coll. 'are replaced by the words" as amended'.
9. In Paragraph 2 (7), at the end of point (a), the words "; this does not apply in stables with an automatic milking system 'are added.
10. in Article 2 (7), the following point (b) is inserted after point (a):
"(b) in stables with an automatic milking system
1. it is possible to increase the number of housed animals by up to 20% compared to the number of lying boxes, provided that the bulk feed is fed to the animal's own needs and that the animal movement control system ensures that the number of animals in the reclining compartment is not greater than the number of such boxes;
2. the appropriate number of milking units must be provided for the number of dairy cows, there must be no reduction in the throughput of the milking box and excessive accumulation of milking cows, ';
Points (b) to (f) shall be renumbered as points (c) to (g).
11. in Paragraph 2 (8), the words "only if they are trained for this purpose" shall be replaced by the words "raised for that purpose" and at the end of the text of the paragraph, the words "to the kept animals and their environment in which they are kept."
12. in Article 4 (j), the words "only if trained for this purpose" shall be replaced by the words "raised for that purpose" and the words "to the kept animals and their environment in which they are kept" shall be added at the end of the text of the letter.
13. in Article 4, the words' ovine and caprine animals must be examined at least once a day 'shall be inserted at the beginning of point (k);' shall be deleted; the words' shall be deleted and the words' shall be inserted after the word 'more often' shall be inserted 'than those indicated in the first sentence';
14. At the end of the title of Section 5, the words ", donkeys and their cross-breeds raised as livestock 'shall be added.
15. In Section 5 of the Introductory Part of the Provisions, the words "kept as animals' shall be inserted after the words" kept as animals' and the words "kept as animals' shall be inserted after the words" kept as animals'.
16. in Article 5 (d), the words "and, in the case of year-round grazing shelters, if horses do not have direct access to stables" shall be deleted;
17. The following Section 5a is inserted after Section 5:
„§ 5a
Minimum standards for the protection of horses, donkeys and their hybrids kept as pet animals
(1) Paragraph 1a applies mutatis mutandis to horses, asses and their crossbreeds kept as pet animals.
(2) The keeper of horses kept as pet animals and, as appropriate, the keeper of donkeys and cross-breeds of horses and donkeys kept as pet animals must comply
(a) minimum standards of equipment referred to in § 1b;
(b) the general animal husbandry requirements referred to in § 1c;
(c) minimum standards for the protection of horses, donkeys and their cross-breeds referred to in Article 5 (a) and (c) to (n); and
(d) the minimum standards for the protection of horses, donkeys and their cross-breeds referred to in Article 5 (b) and (o) to (q).
(3) Paragraph 2 (d) applies to newly built, reconstructed or first put into service stables as from 1 January 2023.
18.
„§ 12
Minimum standards for the protection of runners
(1) Minimum standards for the protection of runners of ostrich species (Struthio camelus), dandu dandu (Rhea americana) and emi brown (Dromaius novaehollandiae) lay down the following conditions:
(a) the fencing of the holding is at least 180 cm high, rounded in corners, strong and safe enough to avoid injury to runners in the event of an impact. The device must be secured against the intrusion of larger species of wild animals or stray dogs,
(b) the minimum size for each adult ostrich of two fingers is 300 m2;
(c) the minimum size for each adult pamp or emu-brown nano is 100 m2.
(2) Stables or shelters for two-toed ostrich, pampa nada and emi brown must be airy, ventilable and prevent draught. The height of the ceiling shall permit free movement of the standing animal. All passages shall allow safe movement of the animal without injury.
(3) The minimum area of the stable or shelter per two-toed ostrich is for:
(a) an adult piece of 5 m2 where the minimum total area for this category is 30 m2;
(b) a young piece between 1 and 2 years of age gradually increased from 2 m2 to 4 m2, where the minimum total area for this category is 30 m2;
(c) chicken from hatching up to 1 year gradually increased from 0,3 m2 to 2 m2, where the minimum total area for this category is 5 m2.
(4) The minimum area of the stables or shelter per pampus or emi brown is for:
(a) an adult of 2 m2, where the minimum total area for this category is 15 m2,
(b) a young piece between 1 and 2 years of age gradually increased from 0,8 m2 to 1,5 m2, where the minimum total area for this category is 15 m2;
(c) chicken from hatching to 1 year of age is gradually increased from 0,15 m2 to 0,8 m2 when the minimum total area for this category is 2 m2.
(5) Individually, ostrich may be kept two-toed, nandu pampus and emi brown only for as long as is necessary in the event of illness, injury or aggressive behaviour. In doing so, he must be allowed to see and hear other birds in breeding.
(6) The provisions of paragraphs 3 and 4 apply to newly built, reconstructed or first put into service stables for ostriches, dandruff nandu dandi dandu dandu dandu dandu dandu dandu dandu dandu dandu dandu dandu dandu dandu dandu dandu danda dandu danda dandu danda danda danda danda danda danda danda danda danda. '
19. Paragraph 13, including the title, reads:
„§ 13
Minimum standards for rabbit protection
(1) The breeder must ensure that premises for rabbit breeding allow rabbits to:
a) Stand up, lie down and turn around without any difficulty, and take a seat with your ears upright,
(b) lie in a relaxed position with extended pelvic legs,
(c) perform normal movements when taking care of the body's surface, feeding, water and biting; and
(d) show other behaviour, such as exploratory behaviour and, if appropriate, nesting behaviour and maternal behaviour.
(2) In all buildings, the breeder must ensure that the light intensity is sufficient for rabbits to see each other, so that they can examine their surroundings and develop normal activities. The light mode and intensity of light shall be such as to prevent behavioural and health problems. The breeder must follow a 24-hour cycle with sufficiently long uninterrupted periods of darkness, consisting of approximately one third of the day, so that the animals can relax and show their night activities. The period of dimming is provided to rabbits under the lighting regime.
(3) For solid-floor housing systems or litter boxes, the breeder shall provide suitable material, in particular straw, hay, wooden sticks, to reduce the aggressiveness of rabbits and to cut their teeth. In the case of grate housing, the breeder shall provide wooden sticks or other suitable material which does not cause the technology to fail.
(4) The outside cages for rabbits must be insulated, well ventilated and designed so that rabbits can maintain their thermal balance without difficulty and must be designed to protect rabbits from wind, direct sunlight, precipitation, heat, cold and moisture.
(5) The female rabbits must have access to their nest boxes at least three days before their expected birth in order to create a nest. The breeder must provide the rabbits with sufficient material to build the nest, in particular straw, shavings or other natural materials. All lactating female rabbits must be able to get away from their young.
(6) Female rabbits with pups must have visual or auditory and olfactory contact with members of the same species.
(7) Young rabbits must not be weaned for less than 28 days.
(8) Carnage rabbits which have not yet grown up must not be housed individually. The fixed floor housing system or bedding boxes shall have a specific area covered with suitable bedding. In the case of grate housing of rabbits, the cages shall be fitted with a perforated plastic floor or a plastic platform in part of the floor.
(9) Paragraphs 1 to 8 shall apply to establishments in which more than 100 adult rabbits are kept.
(10) The provisions of paragraphs 2 to 4 and 6 to 9 shall apply to all rabbit breeding establishments from 1 January 2023. The provisions of paragraphs 1 and 5 shall apply to all rabbit breeding establishments from 1 January 2030. ';

Final provision
This Decree was notified in accordance with Directive (EU) 2015 / 1535 of the European Parliament and of the Council of 9 September 2015 laying down a procedure for the provision of information in the field of technical and information society services.
Čl. III
Efficacy
This Regulation shall enter into force on 1 September 2021.
