DECLARATION
of 29 January 2015
on the establishment of protection zones of the natural health source of the pelloid bearing Hamr in the Lake and the definition of specific protective measures
According to § 46 (3) (b) of Act No. 164 / 2001 Coll., on Natural Medical Resources, Natural Mineral Water Resources, Natural Spa and Spa Areas and on the amendment of certain related laws (Spa Act):
§ 1
Establishment of protection zones
(Articles 21 (1), 22 (5) and 23 (3) of the Spa Act)
(1) In order to protect the natural medical source of the pelloid bearing Hamr in the Lake (hereinafter referred to as "the source"), Liberec County, protection zones I and II are established.
(2) Level I protection zone consists of the territory on which the source is located. The territory consists of land parcels number 422 / 43, 422 / 44, 422 / 45, 422 / 46, 444 / 1, 444 / 2, 443 / 3, 443 / 4, 443 / 5, 445, 623 / 1 and 623 / 2 in the cadastral territory of Hamr in the Lake.
(3) The definition of the protection zone I is graphically marked in a copy of the cadastral map in the scale 1: 4 000, which is shown in Annex 1 to this decree, on the base map of the Czech Republic, on the scale 1: 10 000, which is shown in Annex 2 to this notice, and on the base map of the Czech Republic, on the scale 1: 50 000, which is shown in Annex 3 to this notice.
(4) The Class II protection zone is located on the cadastral territory of Hamr in Jezera and Břevniště pod Ralskem and is graphically marked on the base map of the Czech Republic in the scale 1: 10 000, which is shown in Annex 2 to this decree, and on the base map of the Czech Republic in the scale 1: 50 000, which is shown in Annex 3 to this decree.
§ 2
Definition of specific safeguard measures
(Articles 22 (5), 23 (3) and 24 (2) and (3) of the Spa Act)
(1) Access to the part of the first-degree protection zone in the place where the source is being extracted shall be prohibited in accordance with the spa law.
(2) The protection zone II of the source is prohibited
(a) establish public burial sites;
(b) to build highways and long-distance pipelines;
(c) to build or operate petrol stations and oil boilers;
(d) to build or operate waste landfills and to store waste;
(e) place field fertilizers and silage storage facilities;
(f) to export the contents of immediate pit, urine pit and manure of livestock to land;
(g) to build or operate permanent storage areas for petroleum products, fertilisers and chemical products;
(h) apply chemical plant protection products for which the quality or quantity of groundwater or source cannot be clearly excluded;
(i) carry out work for the drainage and treatment of watercourses likely to jeopardise the natural groundwater regime, except for the conduct of routine water flow management and land under water flow management;
(j) carry out mellioration work;
(k) to build or operate objects for agricultural production, industrial production objects and other objects in which it is a significant component of the technology of handling defective substances which may endanger the quality of surface or groundwater;
(l) load grazing areas of livestock in an intensity above 1 livestock unit / ha1) and carry out single-tail grazing;
(m) to place feeding grounds and watercourses within 25 m of watercourses and contaminated areas;
(n) discharge waste water and defective substances which may endanger the quality of surface or groundwater, into surface or groundwater waters and into the water flow flowing through the bearing, including their application to the surface of the terrain;
o) to set up camps, campsites and other temporary accommodation facilities without ensuring the disposal of waste water into an immediate pit or public sewerage;
p) implement wells and heat pumps and build wells,
(q) carry out mining activities, mining activities and tear work;
(r) to use non-inert sprinkler materials to treat communications;
(s) to carry out wood extraction on forest land other than by means of broaching or by means of extraction where the width of the bare mower does not exceed the average height of the harvested crop; or
(t) manage in the woods of a special destination in such a way that the natural groundwater regime could be adversely affected.
(3) The prohibitions set out in paragraph 2 (q) shall not apply in the protection zones I and II of the source in the territory in which the protection zones overlap with the protected bearing area of the Guard under the Ralsk and the mining area of Hamr under the Ralsk III.
§ 3
Efficacy
This Decree shall take effect on 1 March 2015.
