DECLARATION
of 22 January 2010
amending Decree No. 323 / 2004 Coll., implementing certain provisions of the Law on wine-growing and wine-growing, as amended by Decree No. 437 / 2005 Coll.
The Ministry of Agriculture provides pursuant to § 42 of Act No. 321 / 2004 Coll., on wine-growing and wine-growing and on the amendment of certain related laws (Vineyard and Wine-growing Act) for the implementation of § 4 (4) (d), § 11 (3) (a), § 12 (7) (b), § 13 (4), § 14 (3), § 16 (11) (b), § 26 (12), § 28 (6) and § 29 (5) of the Act:
Čl. I
Decree No. 323 / 2004 Coll., implementing certain provisions of the Law on wine-growing and wine-growing, as amended by Decree No. 437 / 2005 Coll., is amended as follows:
1. Paragraph 1 (1), including footnote 1a, reads:
"(1) The list of wine grape varieties from which it is permitted to produce quality wine of a specified region is kept in the State Variety Book (1) or in the Variety Books of the other countries of the European Communities. Vine varieties must comply with the conditions laid down in the Regulation of the European Communities for the classification of wine grape varieties (1a).
(1a) Article 120a of Council Regulation (EC) No 1234 / 2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation), as amended by Council Regulation (EC) No 491 / 2009 of 25 May 2009. ';
2. The following Section 4a is inserted after Section 4, including footnotes No 1b to 1d:
„§ 4a
(1) For red wine produced from grapes harvested in the Czech Republic, the total alcoholic strength may be increased to 12% vol. in wine-growing zone A and 12,5% vol. in wine-growing zone B1b).
(2) For wines with a designation of origin produced from grapes harvested in the Czech Republic, the total alcoholic strength may be increased to 15% vol.
(3) For quality wines with the addition of a selection of berries or iced wine, the volatile acid content shall not exceed 30 milliequivalents per litre of wine. In the case of quality wines with the addition of cibeb or straw wine, the volatile acid content shall not exceed 35 milliequivalents per litre of wine (1d).
(1b) Annex XVa (B) (7) (a) to Council Regulation (EC) No 1234 / 2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation), as amended by Council Regulation (EC) No 491 / 2009 of 25 May 2009.
(1c) Annex XVa (B) (7) (b) to Council Regulation (EC) No 1234 / 2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation), as amended by Council Regulation (EC) No 491 / 2009 of 25 May 2009.
1d) Commission Regulation (EC) No 606 / 2009 of 10 July 2009 laying down certain detailed rules for the application of Council Regulation (EC) No 479 / 2008 as regards the types of grapevine products, oenological practices and restrictions to be applied thereto, Annex I C (3). ';
3. Article 6, including the title and footnotes 1e and 1f, reads as follows:
„§ 6
Models for notifications of increase or decrease of acidity, increase of sugar content and sweetening
[For § 12 (7) (b), § 13 (4), § 14 (3) of the Act]
(1) The model of notification for increasing or reducing acidity and enrichment 1e) are set out in Annexes 11 and 12.
(2) The model of the sweetening declaration (1f) is set out in Annex 13.
(3) The models referred to in paragraphs 1 and 2 are published by the Ministry of Agriculture (hereinafter referred to as "the Ministry") in a manner which allows remote access.
(1e) Annex XVa (D) (4) to Council Regulation (EC) No 1234 / 2007 of 22 October 2007 establishing a common organisation of agricultural markets and on specific provisions for certain agricultural products (Single CMO Regulation), as amended by Council Regulation (EC) No 491 / 2009 of 25 May 2009.
(1f) Commission Regulation (EC) No 606 / 2009 of 10 July 2009 laying down certain detailed rules for the application of Council Regulation (EC) No 479 / 2008 as regards the types of grapevine products, oenological practices and restrictions to be applied to them, Annex I D. "
4. In Article 9 (2) (b), the word "clairet 'shall be inserted after the word" clairet'.
5. in Article 9 (2) (h), the words "or" sur lie "shall be inserted after the words" beauty on yeast. "
6. In Article 9, at the end of paragraph 2, the dot is replaced by a comma and the following point (i) is added:
"(i)" chateau "or" château "with the addition of a geographical indication; it is a historical term which relates to a particular environment or to certain wines and is intended for wines coming from an undertaking which actually exists and which is actually called that name. '
7. In Article 9, the sentence "Wines with a protected designation of origin or wines with a protected geographical indication shall be added at the end of paragraph 4 if they are produced by blending white and red wine."
8. In Paragraph 12 (3) (c), "0,5 'is replaced by" 1,5'.
9. Paragraph 13 (5), including footnote 2b, reads:
"(5) The models of crop, production and stock declarations, including their dates of submission in accordance with the provisions of the European Communities (2b), are set out in Annexes 20, 21 and 22.
(2b) Commission Regulation (EC) No 436 / 2009 of 26 May 2009 laying down detailed rules for the application of Council Regulation (EC) No 479 / 2008 as regards the vineyard register, the compulsory declarations and the collection of data for market monitoring, the accompanying documents for the transport of wine products and the wine registers, Articles 12, 13, 14, 15, 16 and Annexes II, III, IV, V. ';
10. In Article 13, paragraph 6 is added:
"(6) The models referred to in paragraphs 1 to 5 shall be published by the Ministry in a manner which allows remote access.";
11. Article 15 shall be deleted, including the title.
12. In Annex 2, footnote * * is deleted.
13. In Annex 3, note (*), the last sentence is deleted.
14. In Annex 4, Part B, point 12, the words "The reference number of the replanting right decision 'are replaced by the words" The register number of the vineyard from which the replanting right originates' and point 16 is deleted.
15. In Annex 6, the word "table 'is deleted.
16. Annex 10 shall read as follows:

Notes:
For pink wine the values prescribed for white wine shall apply.
Limits for density, total dry extract, sugar-free extract, reducing sugars, ash, ash alkalinity, all acid content, bound acids, pH and free SO2 are not fixed. '
17. In Annex 14, in the part "Annexes:" in the last indent, the words "both sensory tests according to the opinion of the Ministry of Agriculture No 19095 / 2008-17220 of 30.7.2008" shall be inserted after the word "composition."
18. Annex No 15 reads as follows:
