on the verification of the authenticity of the signature or conformity of the copy or of a copy with the master's instrument
The Ministry of Transport and Communications provides, pursuant to § 85 (1) of Act No. 61 / 2000 Coll., on Maritime Navigation (hereinafter "the Act ') for the implementation of § 35 (2) of the Act:
Verification of signature authenticity
(1) By verifying the authenticity of the signature (hereinafter referred to as "legalisation"), the master of the ship verifies that the natural person on the ship, in the presence of the vessel, has signed the instrument by his own hand or has already been recognised as having signed it before.
(2) A natural person shall present a valid official document issued by a State authority, containing the information referred to in paragraph 3 (a), to prove his identity.
(3) Legalisation shall be indicated on the list in the form of a verification clause containing:
(a) the name, surname, birth number or date of birth of the applicant;
(b) an indication of how the applicant is identified,
(c) the serial number under which the legalisation is entered in the verification book;
(d) stating that the natural person has signed the instrument himself or herself before the master of the ship, or that he or she has recognised the signature on the instrument as his or her own;
(e) the place and date of legalisation;
(f) the signature of the master by hand and the imprint of the round boat stamp.
(4) The master of the ship is not responsible for the contents of the instrument by way of legalisation.
(5) If the master does not control the language in which the charter is issued, he may refuse legalisation.
(6) The master of the ship shall not legalise the signature on a list containing no text.
Verification of compliance of the copy or copy with the instrument
(1) Verification of the conformity of a copy or a copy with a document or a part thereof (hereinafter referred to as "vision") shall be marked on a certified copy or a copy in the form of a verification endorsement on each sheet, provided that these are not bundled. The clause states
(a) whether the copy or copy conforms to the instrument from which it was drawn up and whether the document is the original or certified copy or copies and how many sheets it consists of;
(b) the number of sheets contained in the copy;
(c) whether the copy or the copy is complete or partial;
(d) the serial number under which the visibility is recorded in the verification book;
(e) place and date of vision;
(f) the signature of the master by hand and the imprint of the round boat stamp.
(2) The master of the ship shall carry out the vision referred to in paragraph 1 only on the ship on which he shall act as master.
(3) The master of the ship shall not make a vision
(a) a copy or a copy of the identity card, military card, passport and other card, holding books, cheque, lottery ticket, geometrical plan, feature and technical drawings;
(b) if the copy or copy submitted does not correspond to the original,
(c) if it does not control the language in which the instrument is issued; or
(d) if they are in a list which is visible, changes, supplements, inserts or cuts which could weaken its credibility.
(4) The master of the ship shall not verify the truthfulness of the facts listed in the instrument.
The master of the ship shall keep a record of the legalisation and vision in the tied verification book in accordance with the form set out in the Annex.
Efficacy
This decree shall take effect on the 15th day following that of its publication.
