THE LAW
of 23 October 2014
amending Act No. 229 / 2013 Coll., on the treatment of certain items usable for defence and security purposes in the Czech Republic (Act on the Management of Security Material), as amended by Act No. 64 / 2014 Coll.
Parliament has decided on this law of the Czech Republic:
Act No. 229 / 2013 Coll., on the treatment of certain items used for defence and security purposes in the Czech Republic (Act on the Management of Security Material), as amended by Act No. 64 / 2014 Coll., is amended as follows:
1. In Article 4 (1), the third sentence is deleted.
2. In Article 5 (3) (b), the words "who has been declared guilty of an offence in the last 3 years" shall be replaced by the words "who poses a serious danger to internal order and security by his actions, for which he has been declared guilty of committing more than one offence in the last three years."
3. In Article 6, paragraphs 2 and 3, including footnote 8, are deleted and the designation of paragraph 1 is deleted.
4. In Article 7 (1), the part of the sentence of the second sentence in front of the semicolon, including the semicolon and footnote 8, shall be deleted and the words "if you wish 'shall be replaced by the words" Will'.
5. Paragraph 8 (2) is deleted.
Paragraph 3 shall become paragraph 2.
6. Paragraph 10, including the title, reads:
Security of safety material
(1) The person handling the safety material shall provide it with appropriate safeguards against theft or abuse.
(2) The method of security referred to in paragraph 1 and its technical execution shall be consistent with the nature, quantity and risks associated with the secured safety material. In particular, the purpose of the security of the security material shall be to ensure that the security material is not misused by an unauthorised person to endanger life, health, property or the environment. ';
7. in Article 15 (2) (a), the words "paragraph 1" shall be deleted;
8. In Article 15 (2) (c), the words "and a valid document of security or a valid certificate of a natural person 'are deleted.
9. In Article 16 (2), the words "paragraph 1 'are deleted.
10. in Article 17 (1), point (a) is deleted and the designation (b) is deleted;
11. in Article 17 (2), the words "paragraph 1" shall be deleted;
12. in Article 17 (3) (a), the words "(b)" shall be deleted;
13. in Article 17 (3) (b), the words "paragraph 1 (a) or" shall be deleted;
Transitional provisions
1. Proceedings initiated before the date of entry into force of this Act shall be completed under the Security Material Management Act, as amended by this Act.
2. A registration certificate issued under the Safety Material Management Act before the date of entry into force of this Act shall be deemed to be a registration certificate under the Safety Material Management Act, as amended by this Act.
Repeal
Decree No. 376 / 2013 Coll., on Technical Requirements for Security Material, is deleted.
Efficacy
This Act shall take effect on the day of its publication.
