on the derogating provision of continuous weekly rest for certain workers
The Government of the Czech Socialist Republic, after consulting the Czech Trade Union Council, hereby orders pursuant to Paragraph 92 (3) of the Labour Code ("the Code '):
Exceptional reduction of continuous rest in the week
If, for operational reasons, it is not possible to provide staff of organisations managed by the central authorities of the Czech Socialist Republic or national committees with a continuous rest period of at least 32 hours per week (Section 92 (1) of the Code), the management organisation may schedule the working hours so that the rest period is at least 24 hours
(a) where the status of workers needs to be substantially increased for a transitional period not exceeding five months in a calendar year;
(b) in transport, cultural, health, social care and continuous establishments,
provided that the individual staff members have a continuous rest period of at least 32 hours at least once every three weeks.
(1) In the case of works where the working hours are unevenly distributed according to the labour law of the superior central authority of the Czech Socialist Republic (Section 85 (2) of the Code) for the entire calendar year, the management organisation may schedule the working hours so that, in periods with a higher need for work, a continuous rest period of at least 32 hours per individual worker every two weeks shall be provided.
(2) Continuous rest of the week may also be provided for, to the extent referred to in the preceding paragraph, farm-animal care and plant-production work during peak agricultural work.
Derogation of continuous rest in the week and its exceptional shortening
(1) When working on designated construction works, in designated assembly and repair works, where the working hours are laid out by way of derogation (Section 85 (1) of the Code), the head of the organisation may, according to the employment regulations of the superior central authority of the Czech Socialist Republic, arrange the working hours so that a continuous rest of at least 64 hours every two weeks for individual workers. The construction and work referred to in the previous sentence shall be determined by that central authority after consultation with the relevant trade union body.
(2) The management organisation may, exceptionally, schedule working hours under the conditions referred to in the preceding paragraph in such a way that the continuous rest period shall be at least 48 hours in the course of work
(a) to avert the consequences of natural events;
(b) as a result of accidents in construction buildings;
(c) in technological processes which cannot be interrupted;
provided that a continuous rest period of at least 64 hours at least once every four weeks falls on individual workers.
Final provisions
Decree of the Government of the Czech Socialist Republic No. 159 / 1976 Coll., on the exceptional reduction of continuous rest in the week is hereby repealed.
This Regulation shall enter into force on the day of its publication.
