GOVERNMENT REGULATION
of 17 May 2006
amending Government Regulation No 181 / 2004 Coll., laying down closer conditions for the implementation of the common market organisations as regards the system of granting export subsidies for agricultural products and processed agricultural products, as amended by Government Regulation No 99 / 2005 Coll.
The Government orders pursuant to § 2b (2) of Act No. 252 / 1997 Coll., on Agriculture, as amended by Act No. 128 / 2003 Coll. and Act No. 441 / 2005 Coll., and under § 1 (3) of Act No. 256 / 2000 Coll., on the State Agricultural Intervention Fund and on the amendment of certain other laws (Act on the State Agricultural Intervention Fund), as amended by Act No. 441 / 2005 Coll.:
Government Regulation No 181 / 2004 Coll., establishing the closer conditions for the implementation of the common market organisations as regards the system of granting export subsidies for agricultural products and processed agricultural products, as amended by Government Regulation No 99 / 2005 Coll., is hereby amended as follows:
1. Paragraph 1, including the title and footnotes 1 and 1a, reads as follows:
Subject matter
This Regulation (1) regulates, following the directly applicable provisions of the European Communities (1a) (hereinafter referred to as "the European Communities'), the detailed conditions for the implementation of the common market organisations as regards the system of granting export subsidies for agricultural products and processed agricultural products.
1) It is issued for the implementation and within the limits of the law, the content of which allows for an adjustment following the directly applicable regulation of the European Communities by the Government.
(1a) Commission Regulation (EEC) No 32 / 1982 of 7 January 1982 laying down the conditions for granting special export refunds on beef and veal, as amended. COMMISSION REGULATION (EEC) No 1964 / 1982 of 20 July 1982 laying down the conditions for granting special export refunds on certain cuts of boned beef, as amended. Council Regulation (EC) No 3448 / 1993 of 6 December 1993 laying down the trade arrangements applicable to certain goods resulting from the processing of agricultural products, as amended. COMMISSION REGULATION (EC) No 800 / 1999 of 15 April 1999 laying down common rules for the system of export refunds on agricultural products, as amended. Commission Regulation (EC) No 1291 / 2000 of 9 June 2000 laying down common detailed rules for the application of the system of import and export licences and advance fixing certificates for agricultural products, as amended. Commission Regulation (EC) No 1043 / 2005 of 30 June 2005 implementing Council Regulation (EC) No 3448 / 93 as regards the system of granting export refunds on certain agricultural products exported in the form of goods not covered by Annex I to the Treaty and the criteria for fixing the amount of such refunds, as amended. '
2. In Article 2, the words "European Communities Regulations (1) 'are replaced by the words" European Communities Regulations (1a)'.
(3) Paragraph 3b, including footnote 4d, is deleted.
4. Paragraph 4 (1) and (2), including footnotes 5 to 7, read:
"(1) A manufacturer whose products are to be exported in the form of regular exports under European Community rules (5) shall apply to the Fund for registration to this end.
(2) The manufacturer shall attach to the application for registration of the manufacturer referred to in paragraph 1:
(a) proof that he is an entrepreneur (6);
(b) the manufacturer's declaration using the form issued by the Fund
1. the composition of the product to be exported in the form of regular exports (7), indicating the quantities of basic products and products resulting from their processing and the own six-digit registration number under which the Fund will register this declaration,
2. the losses incurred in the production of the product to be exported in the form of regular exports (7).
5) Article 10 of Commission Regulation (EC) No 1043 / 2005.
6) Article 2 of the Commercial Code.
7) Article 49 (2) of Commission Regulation (EC) No 1043 / 2005. '
5. Article 5 shall be deleted, including the title;
Transitional provision
Applications made pursuant to Government Regulation No 181 / 2004 Coll., as effective by the date of entry into force of this Regulation, shall be assessed in accordance with Government Regulation No 181 / 2004 Coll., as effective by the date of entry into force of this Regulation.
Efficacy
This Regulation shall enter into force on 31 May 2006.
