amending Decree No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on water and sewage for public use and amending certain laws (Water and Sewerage Act), as amended
The Ministry of Agriculture provides pursuant to Section 40 of Act No. 274 / 2001 Coll., on Water and Sewerage for Public Use and on the amendment of certain laws (Act on Water and Sewerage), as amended by Act No. 76 / 2006 Coll., Act No. 275 / 2013 Coll. and Act No. 167 / 2023 Coll., to implement Sections 5 (6), 6 (13), 11 (2), 12 (1), 13 (5), 20 (3) and 36 (7), 9 and 10 of this Act:
Čl. I
The Decree of the Ministry of Agriculture No. 428 / 2001 Coll., implementing Act No. 274 / 2001 Coll., on Water and Sewerage for Public Use and on the amendment of certain laws (Water and Sewerage Act), as amended by Decree No. 146 / 2004 Coll., Decree No. 515 / 2006 Coll., Decree No. 120 / 2011 Coll., Decree No. 48 / 2014 Coll., Decree No. 448 / 2017 Coll. and Decree No. 244 / 2021 Coll., is amended as follows:
1. In Section 1 of the Introductory Part of the provision, the words "incorporating the relevant European Union37 provisions' shall be inserted after the words" the Order '.
footnote 37 is replaced by the following:
"37) Council Directive of 21 May 1991 on urban waste water treatment (91 / 271 / EEC). Directive 2000 / 60 / EC of the European Parliament and of the Council of 23 October 2000 establishing a framework for Community action in the field of water policy. Directive (EU) 2020 / 2184 of the European Parliament and of the Council of 16 December 2020 on the quality of water intended for human consumption (recast). '
2. In Article 1a (d), the word "health 'is replaced by the word" hygiene'.
3. At the end of § 1a, the dot is replaced by a comma and the following points (o) and (p) are added:
"(o) by the supplier of the drinking water supply service, the water supply operator who supplies the drinking water with this water supply, and
(p) supplier of the sewage drainage service, the sewage operator, which transmits waste water through this sewage. ';
4. Paragraph 6 (5) reads as follows:
"(5) The collection of the collected data shall be transmitted by the Ministry in electronic form to the regional authorities for the territory of the region and to river basin managers according to their territorial competence by the end of August of the following calendar year. ';
5. Paragraph 7 (8) reads as follows:
"(8) The file of the selected data shall be transmitted by the Ministry in electronic form to the regional authorities for the territory of the region and to river basin managers according to their territorial competence by the end of August of the following calendar year. ';
(6) footnote 5 shall read:

"(14) Where a new part of the water duct is connected to the existing water pipeline, the competent person shall assess whether the supply of drinking water in the quantity requested will adversely affect the supply of drinking water or pressure ratios of existing or new customers. The assessment shall be carried out on the basis of the mandate of the owner or operator of the existing tap and the costs of the investor. The assessment shall be carried out only if the owner or operator of the existing tap reasonably assumes that the connection of the new part of the tap may result in a negative effect on the supply of drinking water or pressure ratios to existing or new customers. ';
18. In Article 16, the words "when assessing the industrial waste water load shall be added at the end of the text in point (e), taking into account the chemical oxygen consumption (COD) load in relation to the ratio to biochemical oxygen consumption (BSK5); if the ratio of BSK5 / COD is 0,5, the COD value - 120 g oxygen / day shall be used '.
19. in Article 16 (i), the word "any" shall be deleted;
20. In Paragraph 22 (7), the word "health 'is replaced by" sanitary'.

PUBLIC NOTIFICATION
§ 36a
(Paragraph 36 (9) of the Law)
(1) The data published under Paragraph 36 (9) of the Act are:
(a) to the owner of the pipeline or sewerage and to the operators of the duct or sewerage which are:
1. the name and, where applicable, the name, surname and address of the place of residence of the person, or the registered office, if any, if it is a natural person, or the name or business name and address of the registered office, if it is a legal person;
2. the identification number of the person, if any, or a similar indication; and
3. telephone connection, e-mail address and data box identifier,
(b) the extent of the operator's authorisation by the owner pursuant to Article 8 (2) of the Act, namely whether:
1. the operator shall be obliged to allow connection to the water duct or sewerage and to supply drinking water or to drain waste water and to clean waste water pursuant to Article 8 (5) of the Act, or whether this obligation has not been transferred to the operator by the owner;
2. the operator is obliged to enter into a contract with the customer for the supply of water or waste water pursuant to Article 8 (6) of the Act or whether this obligation has not been transferred to the operator by the owner; information with valid data relating to the supply of drinking water and the supply and treatment of waste water with the customer must be published,
3. the right to payment of water or water charges pursuant to § 8 (13) and (14) of the Act shall be exercised by the owner or operator;
(c) the location of the water duct system or sewerage system, the name of the respective municipality, part of the municipality and the cadastral territory;
(d) a water supply system or sewerage system which is:
1. the jurisdiction of the water line to the water duct system referred to in point 1 (b). C Annex No 1 to this Decree or the relevance of sewerage to the sewerage system referred to in point 1 (b). C of Annex 3 to this Decree,
2. the population information referred to in point 3 of Annexes 1 and 3 to this Decree,
3. the technical information referred to in point 3 (b). A, point 3 (B), point 3 (C). B1 of Annex 2 to this Decree, including data on water losses per km of the converted length of the water supply line and the percentage of water losses in the pipe network referred to in point 3.3 of Annex 5 to this Decree or an indication of the purposeful inclusion of the sewer network as referred to in point 4.1 of Annex 3 to this Decree,
(e) technical requirements for:
1. internal water supply, including the indication of prohibited materials for internal distribution and information on the prohibition of the interconnection of water supply lines with another water source;
2. internal sewage including the introduction of prohibited materials for internal distribution,
3. water connections, including the indication of the conditions for the location of the water meter for measuring the water delivered and the requirements for the location of the horizontal shaft and the requirements for the water assembly and pressure conditions and recommendations,
4. sewer connections,
(f) method for determining quantities
1. delivered drinking water by measuring the water-meter or guide numbers where the water is not collected;
2. effluent effluents, by measuring the effluent effluents to the sewerage, by measuring the effluent which may subsequently be discharged into the sewerage, or by reference to the indicative number of the annual water requirement if the amount of effluent effluents to the sewerage is not measured, or by measuring the collected water;
3. discharges of withholding waters, by calculation as provided for in Annex 16 to this Decree, or by measurement, where the sewerage system so provides;
(g) the possibility of interruption or limitation of the supply of drinking water and the disposal of waste water, indicating the method of replacement water supply and the disposal of waste water, where appropriate, the planned withdrawal period and the restrictions on the supply of drinking water and the disposal of waste water associated with maintenance or planned repairs and their notification;
(h) the quality of the drinking water supplied under the Public Health Protection Act;
(i) the obligation to comply with the sewerage rules, including the publication of general binding provisions and limits on maximum permitted pollution of the approved sewerage system and the maximum level of pollution of treated waste water including the indication of substances whose discharge into the sewerage is prohibited;
(j) the calculation of the price for the water and bilge for the current calendar year as set out in Annex 19b to this Decree;
(k) the extent, conditions and manner of exercise of the rights arising from the liability for defective performance referred to in the complaint rules, in particular:
1. where the claim can be claimed,
2. form and methods of application of the claim,
3. requirements for content requirements of claims,
4. time limit for the application of the claim,
5. the way in which the complaint is handled;
6. Method of handling the claim; and
7. Jurisdiction of administrative bodies in the field of customer protection,
(l) the possibility of reducing water consumption and its efficient use in accordance with local conditions, the reduction of the risks posed by water leakage and the health risks associated with water stagnation, the possible threat to human health, including recommendations on health and consumption, or an indication of where information on potential threats to human health, including health and consumption, can be found on the website;
(m) the possibility of limiting the draining of withholding water into the sewerage, such as by accumulation and subsequent use, seeping on land or evaporation; and
(n) complaints lodged by the customer with the owner of the water duct or sewerage or operator, as appropriate, and statistics on such complaints.
(2) The format and structure of the database data set referred to in paragraph 1 (a) to (d) and (n) are set out in Annex No 26 to this Regulation.
§ 36b
(Paragraph 36 (10) of the Law)
The owner of the water duct or sewerage or operator, as appropriate, shall indicate in the information to the customer about the water and sewer:
(a) the address of the sampling point;
(b) the beginning and end of the invoicing period, in the event of a price change for each period separately;
(c) the quantity of drinking water or waste water delivered invoiced in m3, indicating the initial and final state of the water meter or the method of determining the quantity, indicating the guide number referred to in Annex 12 to this Regulation, in the event of a change in the price for each period separately;
(d) the price for the aqueous and bilge for the invoicing period, in the event of a price change for each period separately;
(e) the invoiced amount of the fixed component for aqueous or bulky when the fixed component is applied;
(f) a comparison of the water consumption for the sampling point for at least the last 2 invoicing periods, if available;
(g) a reference to the complaint order; and
(h) a link to the website containing the information referred to in Article 36a. ';
The 16th shall be renumbered the 17th.
26. In Annex No 1, the sentence "Code of the Water Authority - Code of the cadastral territory of the end of the supply line - IČO of the owner - character for the water line, that is 1 for the supply lines and behind the slash is the order of the water lines if the same owner on the same cadastral territory has multiple water ducts. 'is replaced by the phrase" Number assigned in the Water and Sewerage Information System'.
27. 31. In Annex 5, the explanatory note to point 3 of the sentence "Loss of water in the pipe network: Water losses due to leakage due to leakage of piping or fittings, water losses during accidents and overdraining of water, water losses resulting from inaccuracies of water meters, higher charges than those corresponding to invoicing according to annual indicative numbers and losses caused by water theft are shown. Water losses per km of the converted length of the water supply line: They are reported as the volume of water losses in l per km of the converted pipe length per DN 150 per day, i.e. the volume of water without own consumption and other non-invoiced water.
Water not invoiced: This is the difference between the amount of water produced for the implementation and the water invoiced. It includes, in particular, water losses and own consumption and other non-invoiced water. '
32. In Annex 5, in the explanatory note to point 5, and in Annex 6, point 4, the word "monitoring 'is replaced by" reduced analysis'.

TECHNICAL INDICATORS FOR THE WATER QUALITY CONTROL PLAN

ČÁST 1

MODELS OF SAMPLES IN CONTROL PROFILE
The sampling points in the control profiles are:
(a) in the inflow of raw water used for drinking water treatment and for untreated water; samples of raw water shall be taken before the first technological intervention; where raw water is supplied from several water sources, samples shall be taken from their mixture; the control of individual sources shall be carried out where the quality of mixed raw water is worse than for category A2;
(b) during the treatment of water by a technological line where the treatment technology exists; water control during treatment by a technological line shall be carried out, where possible, between stages; the control points and the scope and frequency of the parameters monitored for each stage shall be determined by the person responsible for the adjustment technology;
(c) after filtration or at the outlet of the water treatment plant where the efficiency of the filtration is checked by measuring opacity as an operating parameter; the site of opacity monitoring shall be determined by the person responsible for the treatment technology;
(d) on the output of the water produced from the water treatment plant, the output of the water produced hygienically secured;
(e) strategic distribution network sites, including water jams;
(f) where drinking water flows from taps intended for human consumption; These places shall be determined in accordance with the legislation governing sanitary requirements for drinking and hot water.

ČÁST 2

MINIMUM SCOPE OF SUSTAINABLE WATER DIFFERENCE REQUIREMENTS
The following types of analysis are distinguished according to the scope of the indicators and depending on the necessary monitoring requirements:
1. COMPLETION
2. CHANGED DIFFERENCE
3. OPERATIONAL DISTRIBUTION
1. COMPLETE DIFFERENCE OF DEROGED RAW WATER
A complete analysis of the raw water shall be carried out within the scope of Table 1. In the case of raw water for water treated in frequency according to Table 4 and whenever the raw water is first classified in the category referred to in Section 22 and subsequently for the confirmation of the raw water category. In the case of raw water for water without adjustment in frequency according to Table 5.
Only raw water for water without treatment may be reported as raw water analysis unless there is evidence of any change in the quality of the water by transport, a sample taken on the distribution network as close as possible to the source. Where possible, this sampling shall be carried out in parallel with the raw water for analysis of microbiological indicators.
Samples and analysis to the extent of complete raw water analysis shall be provided to the holder of the accreditation certificate, to the holder of the laboratory's good functioning certificate or to the authorisation holder.
The scope of the parameters of the complete raw water analysis shall be extended to include indicators that result from a risk assessment carried out in accordance with the legislation governing river basin management plans and plans for the management of flood risks or legislation governing sanitary requirements for drinking and hot water, for a given raw water source. The results of the assessment and risk management of parts of the river basin associated with the points of collection of water for human consumption shall be provided by the relevant river basin administrator to individual water supply operators in electronic and editable form.

1) It shall be determined in the context of a possible or proven occurrence on the basis of the assessment and management of the risks of parts of the river basin associated with the sampling points under the legislation governing river basin management plans and plans for the management of flood risks for a given source of raw water and, at the first time, the inclusion of raw water in the category referred to in § 22, but at least every six years.

Notes to Table 1:
Indicator No 37 is expressed as the sum of the concentrations: (benzo (b) fluorantene, benzo (k) fluorantene, benzo (ghi) perylene, indeno (1,2,3-cd) pyrene. If the substance is not quantitatively detected, zero is added to the sum.
Indicator No 38 is expressed as the sum of individual pesticides and their relevant metabolites. These are pesticides which are likely to be present in crude water, according to the pesticides used in the territory. If the substance is not quantitatively detected, zero is added to the sum.
Indicator No 39: all individual pesticides and their significant metabolites likely to occur in raw water shall be monitored, in particular those resulting from the conclusions of the risk assessment carried out under the legislation governing sanitary requirements for drinking and hot water or the assessment and risk management of parts of the river basin associated with the water collection sites implemented under the legislation governing river basin management plans and flood risk management plans for the raw water source concerned.
Indicators 40 and 41: Only one indicator can be selected for TOC and CHSKMn.
To indicator 47: It shall be established as an indication value for the decision on the analysis of other indicators, in particular organic micropollutants, from the achievement of A1 254 = 0,08.
PFAS sum is the sum of per- and polyfluorinated alkylated compounds that are considered to be at risk in drinking water, i.e. in particular perfluorobutanoic acid (PFBA), perfluoropentanoic acid (PFPA), perfluorohexanoic acid (PFHxA), perfluoroheptanoic acid (PFPA), perfluorodecanoic acid (PFDA), perfluorodecanoic acid (PFDA), perfluorodecanoic acid (PFDA), perfluoroundecanoic acid (PFBS), perfluoro-dodecanoic acid (PFFDA), perfluoro-dodecanoic acid (PFFFFDA), perfluorodecanoic acid (PFDA), perfluorodecanoic acid (PFDA), Perfluorodecanosulphonic acid (PFDA), Perfluorodecanoic;
The selected substances shall be monitored if, when assessing and managing the risks of parts of the river basin associated with the sampling points under the law governing the river basin management plans and the legislation governing the health requirements for drinking and hot water, the relevant river basin administrator concludes that the presence of selected substances in the given water source is likely, or if it is demonstrated in the framework of the monitoring of the quality of groundwater and surface water carried out in order to determine the water status under the Water Law of exceeding 30% of the limit value for drinking water under Decree No. 252 / 2004 Coll., which sets out sanitary requirements for drinking and hot water and the frequency and extent of control of drinking water, as amended, for this parameter. The selected substances shall be monitored from the time of transmission of the information on their likely occurrence or the outcome of the monitoring by the river basin administrator.
Indicator 59: This indicator shall be established where this results from risk assessment and management in accordance with the legislation governing river basin management plans and plans for the management of flood risks or legislation governing sanitary requirements for drinking and hot water. If presence in raw water is detected at a concentration of > 50 PTJ / 100 ml, an analysis shall be carried out after each adjustment step to determine the log value of the removal via existing barriers within the treatment.
Indicators 60 and 63: Only for surface water or if groundwater is affected by surface water.
Indicator No 61: Only applicable to surface water based on the assessment and management of the risks of parts of the river basin related to the points of water collection carried out under the legislation governing river basin management plans and plans for the management of flood risks for a given raw water source and in the event of a massive occurrence of sinuses.
2. SHORT DISTRIBUTION OF RAW WATER
The reduced raw water analysis serves to specify the raw water category in accordance with § 22 and to monitor the quality constantly. The results of the operational analyses shall also be taken into account.
In the year when the raw water category is confirmed by full analysis, the complete analysis shall replace the reduced analysis.
Within the scope of the reduced analysis, indicators according to Table 2 are included, the reduced analysis is extended by:
(a) indicators from the complete analysis of raw water which exceed more than 75% of the limit value for drinking water pursuant to Decree No. 252 / 2004 Coll., laying down the hygiene requirements for drinking and hot water and the frequency and scope of the control of drinking water, as amended; if subsequent analyses for 2 calendar years show a decrease in value below 75% of the limit value for drinking water according to Decree No. 252 / 2004 Coll., the indicator may be excluded from the monitoring in the short analysis. The condition is that at least 2 analyses will be carried out in a given calendar year,
(b) indicators equal to or exceeding the value of Category A 2 determined in the previous categorisation of raw water (as set out in Annex 13 to this Decree);
(c) indicators which result from risk assessment and risk management carried out in accordance with the legislation governing sanitary requirements for drinking and hot water, or risk assessment and management of parts of the river basin associated with the collection points carried out in accordance with the legislation governing river basin management plans and flood risk management plans for the raw water source concerned; the results of the assessment and management of the risks of parts of the river basin related to the points of collection of water for human consumption shall be provided to individual water supply operators in electronic and editable form by the relevant river basin manager,
(d) indicators that vary significantly during the year (occurrence of the indicator in two categories such as seasonal changes).
Samples and analysis in the range of shortened raw water analysis shall be ensured for the holder of the accreditation certificate, for the holder of the laboratory's good functioning certificate or for the authorisation holder.
