GOVERNMENT REGULATION
of 15 December 2004
delimiting the Bird Region of the New Doomske Basin - Blacksmith
The Government orders pursuant to § 45e paragraphs 1 and 2 of Act No. 114 / 1992 Coll., on Nature and Landscape Conservation, as amended by Act No. 218 / 2004 Coll.:
Subject matter
(1) The birds' zone of the New Doomske Peat - Kovárský (hereinafter referred to as the "bird area") is defined.
(2) The birds' areas are protected by the populations of tetra (Tetrao tetrix) and yellow grey (Picus canus) and their biotopes.
(3) The purpose of the protection of the birds' area is to preserve and restore ecosystems relevant to birds' species as referred to in paragraph 2 on their natural grounds of enlargement and to ensure conditions for the conservation of the populations of those species in a favourable conservation situation.
Definition of bird area
(1) The birds' area is situated in the territory of the Ústí Region and the Karlovy Vary Region, in the cadastral territories of Bečov, Brandov, Black Potok, Dolina, Gabrielina Hutí, Háj u Loučná pod Klínovec, Mount Saint Catherine, Mount Sebestian, Horní Halje, Jezeří, Jilm, Kalek, Kotlina, Kovářská, Kryštofova Hamra, Lesná v Krusné Mountains, Malá Háž, Měděnek, Menhartice u Křemov, Interhoří u Chomutov, Mikulovice v Krány Mountains, Nachetín, Nachetín u Kalku, Nová Ves u Křimova, Osvov, Vodnov, Půvna, Podhůří u v u nad nad nad nad nad, Příšíčíčícíčíčícící, Ráčíčíčíčíčínov, Radenov, Rány, Rány,
(2) The territorial demarcation and description of the border of the bird area are set out in Annex 1 to this Regulation; the indicative graphical representation of the bird area is given in Annex 2 to this Regulation.
(3) The map documents of the scale 1: 50 000, in which the territory of the bird region is drawn, are stored in the central list of nature protection1) and in electronic form at the Ministry of the Environment, the Regional Office of the Ústí Region, the Regional Office of the Karlovy Vary Region and the municipal offices of the municipalities with extended scope in whose administrative district the bird area is located.
Activities to which the consent of the nature protection authority is required
(1) Only with the prior agreement of the competent authority of nature protection (2) may the territory of municipalities be located in the birds' area outside the concurrently built and stoppable (3)
(a) change the type of land and the means of usingit (4);
(b) carry out activities causing a change in the level of established surface and groundwater levels which could cause a change in the biotope of the species for which the bird area is established;
(c) maintain drainage systems;
(d) organise sports competitions and other events with public participation, carried out outside permanent sports areas and marked tourist routes;
(e) to draw up new tourist, cycling, riding and ski tracks5),
(f) conduct an aerial application of biocides and substances which may alter the chemical properties of the soil environment;
(g) use chemical agents for rodent control in agricultural and forestry management.
(2) Prior consent of the competent nature conservation authority is not required
(a) the activities referred to in paragraph 1 (a), where such activities are subject to a decision under a specific legislation (6) and have been given an opinion by the competent nature conservation authority;
(b) the activities referred to in paragraph 1 (b), if they are carried out in accordance with the rules on water control (7);
(c) the activities referred to in paragraph 1 (c), in the case of the maintenance of a reinforced forest outbound road, allowing for year-round operation, or of a reinforced and unpaved outbound road, allowing seasonal operation;
(d) in the implementation of road operations8);
(e) the activities referred to in paragraph 1 in the case of activities carried out under specific legislation9) in the territory of the designated conquest area and exclusive bearings.
Efficacy
This Regulation shall enter into force on the day of its publication.

Territorial demarcation and description of the border Bird areas of the New Doomske Peat - Blacksmith
From the village of Pachenkov, the border of the bird area along the road *) leads to Nová Ves about 950m to the turn of the forest road * *), then in the south direction along the road, which is also a tourist path to the forest road near the Wood pond. It continues south on the road at the east foot of Fox Hill and Bear Rock and then southwest on the way past the Bear Rock to the Red Pit. From there, the border continues along the road with the tourist path west towards Lesna. From Lesná goes south on the road under the electrode about 450m to the level of the cote 877 and then west first along the north edge of the meadow and then through the forest passage overloads the so-called Sunway and along the tributary of the Niva creek continues to Svuhova. The village is about 230m south on the road to the New House. From there goes northwest at the west edge of the meadow about 200m and returns to the road called Telephone, which goes west about 1300m. Northwest of Rooster Hill at cubicle 844, it reaches the road Kalek - Bolebor. After it continues south 560m and then turns northwest and then west after forest communication * * *) to the north edge of the village Zakoutí. From the playground in the northern part of the village, the border under the electricity pipeline north-west goes about 330 m to the spring of the port-coast tributary of Bílina, along the port-coast tributary of Bílina continues southwest on the Radenov - Kalek road, along this road it goes towards the Black Pond. Following the Black Pond dam to the south and further through the forest pass, the border still goes south about 850 km to the booth 806 on the Old Blaten Road and then 180 m to the southeast. Then the border goes along the forest road to the west and then southwest to the local name U hut. Then the border copies the boundaries of the town of Radenov along the forest roads and then the village of Načetín near Kalk to the cabin Hadinec (815m.n.m.). From there it leads west by forest roads to Bear Falls, to booth 828, along the forest road and the road to Chomutovka. Against the current, the border continues along the Chomutovka stream via road No I / 7, 400 metres west of road No I / 7 turns south via cubicle 853 and further along the field road to booth 847 to the edge of the forest. From there, it goes in the southeast direction along the field road along the border of the Mountain of St. Shebestian to booth 834. It also goes south through a line through meadows and pastures and through a railway line about 1600m to the edge of the forest. On the north edge of the forest it goes to cubicle 786.6 and from there on the forest road to the southwest to the Adjunct River at cubicle 740. From there, it continues southwest to the edge of the forest tree at the 400kW line and along the field road to cubicle 785,5. It also goes along the edge of the forest land through the Prunerovský stream to the New Houses on the road Služí - ČD railway station after it to cubicle 770, and turns south around the football field. It continues along the field road and along the edge of the forest areas it goes south towards the Sibenice Hill to the edge of the forest about 230 metres north of the Sibenice Hill cubicle, further along the edge of the woods to road II / 223 on booth 792.8. Following the road, about 570m towards Lysá mountain towards the edge of the forest. North of Lysá hora goes along the edge of the woods to a small water stream at booth 821, then leads a direct link to the northwest to the railway line at booth 815.40 and over the track to the field road. Following the field road he goes southwest to road No II / 223, then along the electric line further southwest to about 1500m via Hamer stream and along road No II / 223 through Kotlin to the railway line at the stop Mědenec. Following the railway line goes to the freight stop Mědenec, the ore mine and further to the edge of the forest near the booth 851. At the edge of the forest to the south by a field road to the south-west on Road II / 223 and through this road the border leads through the Upper Halje to the turn to the Kovářská north of Vysoká Seč. From the crossroads, the border goes south through the forest road through the Vykmanovský Forest, then west, north of the Cross Mountain to Meluzna. Following the Srné - Loučná 540m northwest to the turn of the forest road. This forest road west towards the cubicle On the rocks and southwest of Macecha north to the Hotel Arrival under Klínovec. From there the border goes along the road through Háj, Hájská hill, hunting grounds Vápenka to Kovárský, further along the railway track to the stop Kovářska- town. From there on the way west to the edge of the village Kovářská. From there along the Kovářská road - the dam Adress northeast around the Little, Middle and Big Špičák to the Admission dam. On Route II / 224, the border is southeast, behind the bridge through the Adjunct stream, along the right bank on a reinforced road along the dam, along this road around the Deer Mountain to the state border with Germany, along the state border through the crossing of Mount St. Sebestians to Necetín. From there the border goes west to the pond north of the village and along the edge of the forest goes first southwest, then south across the road to the Nachetín pond and then still along the edge of the forest to the northeast. It continues along the edge of the forest to the southeast around Jindřich Vsi and still along the edge of the forest to the north to the road to Kalk. On this road it goes to the edge of the village Kalek and further southeast at the edge of the forest to the White River. On the field road the border goes northeast to the ponds under the turning houses, north-east about 500m to the road and north-west about 350m. From there, along the field road to the northeast to the forest and along its edge to the Voláren road. Following it to a turn north, where it turns towards the state border formed by the Nachetín creek. After the state border, it continues to turn from the state border at the border stone 15 / 9 towards the Důlní vrch, along the road of Zv. Gabrielka at the booth 688 continues to the Telč stream. Following the Telč creek in the southeast direction to the local name V Hole, from there on the road to Malá Háj and further along the road on the mountain of St. Catherine to the turn and to Pachenkov.
Explanatory notes:
