on the admission procedure, graduation and final examination in the school year 2019 / 2020
The Ministry of Education, Youth and Sports sets out, pursuant to § 81 (11) of Act No. 561 / 2004 Coll., on Pre-School, Basic, Medium, Higher Vocational and Other Education (Education Act), as amended by Act No. 179 / 2006 Coll., Act No. 217 / 2007 Coll., Act No. 242 / 2008 Coll., Act No. 243 / 2008 Coll., Act No. 49 / 2009 Coll., Act No. 378 / 2009 Coll., Act No. 331 / 2011 Coll., Act No. 472 / 2011 Coll., Act No. 370 / 2012 Coll., Act No. 82 / 2015 Coll., Act No. 178 / 2016 Coll., and Act No. 101 / 2017 Coll., and pursuant to § 51 of Act No. 135 / 2020 Coll., on Specific Rules of Reception for Certain Species Education and their Finalisation in the School Year 2019 / 2020:

GENERAL PROVISIONS
§ 1
This decree regulates the details of the course and evaluation of the entrance exam, the final examinations and the rules for the admission procedure in the school year 2019 / 2020.

ČÁST DRUHÁ

ACCEPTANCE PROCEDURE
§ 2
(1) If the applicant has submitted a secondary school application or a field of education where a single entrance exam is held, second in order, he shall take a single entrance exam at that second school.
(2) For serious reasons, the Centre for the Survey of the Results of Education (hereinafter referred to as "the Centre ') may, with the consent of the applicant, change the school in which the candidate takes the uniform entrance exam.
§ 3
Invitation to the admission test
(1) The invitation to conduct the entrance examination shall include in particular information on:
(a) the estimated number of candidates admitted;
(b) the criteria for the admission procedure laid down by the school director;
(c) the place and time of the applicant's school entrance examination in accordance with Section 4 (2);
(d) the place and time of the uniform entrance examination for candidates who first indicated the school where the uniform examination takes place or for candidates referred to in Article 2 (1);
(e) the content of the acceptance test;
(f) an indication of the field of education to which the admission examination will take place;
(g) the form of the acceptance test;
(h) the list of authorised aids for its operation; and
(i) the organisational guidelines in particular in relation to the outbreak of SARS CoV-2.
(2) The invitation shall be sent by the school principal to the tenderer no later than 5 working days before the date of the first date of the school entrance exam in due time or 5 working days before the date of the first replacement date of the school admission exam, or 10 working days before the date of the uniform entrance exam if the school entrance examination is not carried out and the candidate takes the uniform entrance exam at that school. The invitation shall also be sent by the school director to the e-mail address if it is indicated on the application.
(3) The dates of the school entrance exam and the uniform entrance exam shall be published by the school director in due and replacement time, at the latest by the date referred to in paragraph 2, in a manner which allows remote access.
§ 4
School entrance exam
(1) The scope of the teaching validated by the school admission examination must not exceed the educational content of the Framework Training Programme for primary education for the admission procedure for four years of secondary education and the relative educational content of the Framework Training Programme for primary education for six and eight years of secondary education.
(2) The applicant shall take the school entrance exam in the first time at the school, which he indicated on the application first in the order, and in the second time at the school, which he indicated on the application second in the order.
(3) The Director of the School shall determine the specific dates for the school entrance examination according to the timetable for the examinations set out in the Annex to this Decree.
(4) Paragraphs 1 to 3 also apply to the replacement term of the school entrance exam.
§ 5
Transmission of data from the Centre applications at the alternate deadline
For the replacement date of the uniform entrance exam, the school shall register the applicant within 2 working days of the receipt of the apology, which is in accordance with the requirements laid down in Section 8 of the Act on specific rules for admission to and termination of certain types of education in the school year 2019 / 2020, by entering the apology in the Centre's information system.
§ 6
Test documentation of uniform acceptance tests
(1) The Centre shall provide the school with the test documentation of the uniform acceptance test in the safety deposit box at the latest on the last working day preceding the date of the uniform examination.
(2) The test documentation of the uniform acceptance test shall consist of test notebooks, record sheets for writing the test solution, and other documents and files relating to the uniform acceptance test for individual tenderers.
(3) Other documents relating to the uniform admission test are:
(a) the list of tenderers,
(b) a report on the conduct of the uniform examination in the classroom;
(c) guidelines for ensuring uniform entrance examination in the classroom; and
(d) other auxiliary materials.
(4) The head of the school or his authorised staff shall take over the safety deposit box from the person authorised by the Centre and check its integrity. Both take-overs will be confirmed by a transfer record.
(5) For the replacement term of the single admission examination, the Centre shall make available to schools the test documentation of the uniform admission examination for individual applicants and other documents through the Centre's information system no later than 2 hours before the uniform entrance examination is carried out in the replacement period set by the Ministry.
§ 7
Duration and duration of the uniform entrance exam at school
(1) The course of the uniform entrance exam in the classroom is provided by the contracting teacher. Immediately before the start of the uniform entrance test, the awarding teacher shall take over the test documentation of the uniform admission test. Furthermore, the awarding teacher shall proceed in accordance with the instructions for ensuring the conduct of the uniform entrance examination in the classroom.
(2) The Czech language and literature test takes 70 minutes. The math test takes 85 minutes.
(3) In the course of the uniform entrance examination, tenderers may use only authorised aids set by the Centre.
(4) The report on the conduct of the uniform entrance exam in the classroom shall state any circumstances which might affect its course and evaluation, including any objections of the tenderers applied immediately after the completion of the entrance examination.
(5) Record sheets and other documents are stored in the school in the manner laid down by the Charter Act and the File Service. The time limit shall be at least 5 years after the end of the admission procedure.
§ 8
Security and organisational incident and resolution
(1) A security incident means an event where a person who is not entitled to do so becomes familiar with the information identified as publicly accessible. If a safety incident occurs during a single entrance exam or at the time when a safety deposit box is stored at a school with a test documentation of a uniform entrance examination is placed, or if there is knowledge of the fact that a safety incident occurred at the school during that period, the school director shall immediately notify the Centre.
(2) Where a security incident threatens the proper conduct of a single admission test, the tenderers concerned by the security incident shall carry out a single admission test within a time limit set by the Ministry.
(3) An organisational incident shall mean an event which prevents the proper conduct of a uniform entrance test, or part thereof, at school, and is not a security incident within the meaning of paragraph 1. If an organisational incident occurs during a single entrance examination, or part thereof, at a school, the school director shall notify the Centre without delay.
(4) Where an organisational incident endangers the proper conduct of the uniform entrance examination, or parts thereof, at school, the Centre, after consultation with the school director, shall determine the further procedure by which the proper conduct of the uniform entrance examination is ensured. If necessary, the school director, after consulting the Centre, shall ensure that a uniform entrance exam is held within a deadline set by the Ministry.
§ 9
Access to the Centre's evaluation
The Centre shall make the assessment of the uniform entrance exam available to all schools indicated by the applicant in the application for secondary education and for which the obligation to conduct the uniform admission examination applies.
§ 10
Publication of the results of the admission procedure
(1) The school director shall publish in a publicly accessible place at the school and in a way that allows remote access
(a) the ranking of tenderers according to the outcome of the evaluation in the recruitment procedure; and
(b) the criteria for the admission procedure.
(2) The order of tenderers shall be published under the registration number. The registration number shall be assigned to the candidate at the school at the latest on the day of the entrance examination before the start of the examination or the candidate has been awarded, if the admission to the education of the Gymnasium with sport preparation is required, before the start of the talent examination. In the event that the entrance examination is not held or is not required to take place in accordance with the criteria of the admission procedure, the applicant shall be informed in writing by the principal of the school at the same time as the information on the absence of the entrance examination.
§ 11
Receipt of tenderers following a new decision
(1) A candidate who has not been admitted to education will express his willingness to be adopted on the basis of a new decision by submitting a request for a new decision to the school director within 3 working days of the date of service of the decision not to take it. The applicant who has fulfilled the conditions of the admission procedure but has not been accepted on account of the number of applicants received must be informed together with the notification of the decision not to accept.
(2) The school director shall accept the application if another tenderer whose application for admission to education at that school has been granted does not submit a registration or subsequently withdraw the registration and the tenderer who made the application pursuant to paragraph 1 fulfilled the conditions of the admission procedure, but his application was rejected on the basis of the number of candidates admitted.
(3) If the expected number of candidates admitted is not met in accordance with the procedure laid down in paragraph 2, the school director may address another candidate who has fulfilled the conditions of the admission procedure, but his application has been rejected on account of the number of applicants admitted.
(4) When receiving candidates on the basis of a new decision, the school director shall follow the order of the applicants in accordance with the results of the recruitment procedure.
(5) The principal of the school on which the candidate has submitted the registration note shall, at the latter's request, forward the registration card if he submits a new decision on admission.
(6) The applicant will use the entry note at the school which gave him a new decision.

ČÁST TŘETÍ

MOTOR TEST
§ 12
(1) In the spring trial period in 2020, the persons who submitted the application shall take the course of the examination in accordance with the rules laid down in this Decree.
(a) the graduation examination for that period;
(b) a repair or replacement test for that period; or
(c) because of the repetition of the examination or part of the examination on the basis of a decision given in the context of the review procedure and the results of the graduation examination under Section 82 of the Education Act.
(2) In the autumn trial period in 2020, persons who have submitted an application for the spring trial period of 2020 and
(a) apply for their first repair or replacement test; or
(b) repeat the graduation examination or part thereof on the basis of a decision given in the course review procedure and the results of the graduation examination under Section 32 of the Act on Specific Rules for Admission to certain types of education and their termination in the school year 2019 / 2020.
(3) The framework timetable for the examination is set out in the Annex to this decree.
§ 13
Didactic tests shall be initiated at the same time each time according to a uniform time schedule.
§ 14
More detailed rules for applying for the graduation exam
(1) The deadline for submitting an application for the first correction test or replacement test ("application"), the model of which is set out in Annex 1 to Decree No. 177 / 2009 Coll., for the autumn trial period in 2020 is no later than 25 July 2020.
(2) In the application, the student shall indicate:
(a) the name, names and surnames, school, class and field of education, form of education, birth number, otherwise the date of birth and place of birth, citizenship,
(b) the names of the test subjects for compulsory examinations of the common part of the final examination;
(c) the names of the test subjects of the compulsory profile part of the graduation examination;
(d) the names of the optional test subjects of the common part of the graduation examination;
(e) the names of the optional test subjects of the profile section of the graduation exam;
(f) a description of the test subject to be held by the pupil in the common and profile sections of the graduation examination in the language of the national minority;
(g) the classification of a pupil with the recognition of the conditions for holding the graduation examination in the category and group listed in Annex 2 to Decree No 177 / 2009 Coll. in order to adapt the conditions for holding the joint part of the graduation examination;
h) the requirement of the pupil according to § 20 (4) sentence of the third school law to adjust the conditions and manner of the examination from the Czech language and literature.
(3) The application referred to in paragraph 2 (g) shall be accompanied by the pupil's recommendation to the educational institution to grant the conditions for the completion of the graduation examination. This recommendation shall be incorporated into the school curriculum under Section 28 (2) (f) of the Education Act. The application referred to in paragraph 2 (h) shall be accompanied by an officially certified copy of the educational documents issued by a school outside the Czech Republic, including their translation into the Czech language; in case of doubt as to the accuracy of the translation, the school director shall be entitled to require the production of an officially certified translation of the educational documents.
(4) The application for the repair test or replacement test shall be submitted by the pupil to all or parts of the tests of the relevant test subject for which he has failed or failed. An application for a correction test or replacement test shall be filed at the school in accordance with the rules laid down by the Charter Act and the File Service. The time limit shall be 5 years.
(5) The Director of the School shall transmit the data referred to in paragraphs 2 and 3 to the Centre for the Autumn Examination by 31 July 2020 at the latest.
(6) Changes in the data of the pupil referred to in paragraph 2 (a) and (g) which have taken place since the transmission of the data to the Centre shall be notified without delay by the Director of the School of the Centre. Changes in the data of the pupil referred to in points (c) and (e) of paragraph 2 which occurred during the period following the transmission of the data to the Centre due to the transfer of the pupil pursuant to § 66 (4) of the Education Act or the change in the field of education pursuant to § 66 (3) of the Education Act shall be notified without delay by the Director of the Centre School. Changes according to the second sentence may be made at the latest by the beginning of the profile part examination.
(7) The school shall send the pupil a certified extract from the Centre's information system no later than 5 days after the transmission of the Centre's data pursuant to paragraph 5. In the event of non-compliance with the information contained in the extract, the pupil shall send the correct data to the school within 5 days.
§ 15
The school director shall clearly acquaint the pupil with the conditions for the completion of the graduation examination and the legal representative of the minor student with the modifications to the conditions and manner of the examinations referred to in Annex 3 to Decree No 177 / 2009 Coll. in the spring test period no later than 14 days before the first test or part of the final test and the autumn test period no later than the month before the first test or part of the final test.
§ 16
The school director shall clearly identify the pupil with the date and place of the final examination, no later than 5 days before the date of the specific examination.
Testing from Czech language and literature in the common part of the graduation exam
§ 17
The Czech language and literature test takes 75 minutes.
§ 18
(1) The oral examination of the test subject of Czech language and literature takes no more than 15 minutes. The preparation for the oral test takes 20 minutes.
(2) From the school list of literary works made available by the school director, the pupil prepares his own list of 20 literary works according to the criteria for selecting the oral examination of the common part according to the catalogue. The applicant shall submit his own list to the school director within 5 days of the renewal of the possibility of the presence of pupils in secondary schools for the spring trial period and by 25 July 2020 for the autumn trial period for the repair or replacement examinations. If the student does not submit his own list of literary works by the specified date, he draws lots for all the works included in the school list of literary works for the examination of working papers. The school director shall provide working papers for pupils for works from their own lists of literary works.
(3) The working list consists of an extract from the artistic text, an extract from the non-artistic text and a definition of the structure of the oral examination.
(4) The school director can use the already created working list from the Centre's job list.
(5) For the oral examination of the common section, the student draws a working list number in front of the examination committee. On one day, a working list for the same literary work may not be drawn twice; in which case, the pupil draws lots again.
Foreign language examination in the common part of the graduation exam
§ 19
(1) Testing from the test subject of a foreign language may be conducted from
(a) English,
(b) French;
(c) German,
(d) the Spanish language; or
(e) Russian language.
(2) The didactic test from the test subject of a foreign language takes 100 minutes, of which 40 minutes will listen to the part of the test and 60 minutes the part of the test verifying reading and language knowledge and skills.
§ 20
(1) The oral test of the common part of the test subject of the foreign language takes a maximum of 15 minutes. The preparation for the oral test takes 20 minutes.
(2) For the oral examination of the common section, the pupil shall receive one numbered working sheet, the number of which he draws. The working list shall be drawn up in duplicate; one for the pupil and one for the evaluator.
(3) Each working list shall contain, in a unique combination, as decided by the Director of the School, either three test tasks processed by the Centre and one test role processed by the School (hereinafter referred to as the "school test role ') according to the draft established by the Centre, or four test tasks processed by the Centre. The paper form of the relevant working sheet shall be made by the school through the Centre's information system from a set of test tasks processed by the Centre and, where appropriate, from one school test task. Only the school director and evaluators are familiar with the content of the school test tasks before the oral examination. Topics for the processing of school test tasks established and published by the school director pursuant to Decree No. 177 / 2009 Coll. are valid for the spring and autumn trial period of 2020.
(4) The Centre shall make available a set of test tasks processed by the Centre to the Director of the School through the Centre's information system no later than 7 days before the start of the oral examination at the School.
(5) For the oral examination of the common section, the same working list number may not be drawn twice in one day. The student draws lots from at least five working lists.
§ 21
Examination of Mathematics in the Common Part of Graduate Examinations
The math diagnostic takes 120 minutes.
Organisation of the common part of the graduation exam
§ 22
(1) The Centre shall deliver the relevant test documentation to the test site in safety deposit boxes no later than the last working day preceding the start of the didactic tests.
(2) The test documentation of the graduation exam shall consist of the entry of tests including a test book for the didactic test, a sound recording for the listening part of the foreign language test, a record sheet for the writing of the didactic test solution by the pupil and other documents and files relating to the common part of the graduation exam.
(3) The safety deposit box also contains:
(a) the list of pupils,
(b) a test report in the classroom;
(c) guidelines for contracting entities;
(d) security envelopes for completed record sheets and student attendance lists;
(e) other auxiliary materials.
(4) The principal of the school shall take over the safety deposit box for the test site from the person authorised by the Centre and check its integrity. Both take-overs will be confirmed by a transfer record.
(5) On the day of the relevant examination in accordance with the uniform timetable, the school director, in the presence of the Commissioner, shall open a safety deposit box and remove from it the test documentation of the graduation exam for the relevant test subject and classroom. Then the safety deposit box will be sealed. The school director shall transmit the test documentation to the contracting authority in the presence of the Commissioner, not earlier than 20 minutes before the start of the relevant examination. The transmission of the documentation shall be confirmed by a record of the transmission.
(6) In the classroom where the test will take place, the contracting authority shall check the integrity of the packaging of the examination documentation and unseal it. The contracting authority shall record the disclosing of the test report in the classroom.
(7) The contracting authority shall pass out the examination and record sheets, or any other part of the examination documentation to the pupils, and shall begin the examination within a specified time frame.
§ 23
Each pupil sits in a separate bench during the didactic test. In one classroom, there may be a maximum of 17 pupils, in the case of pupils with recognised conditions for the completion of the graduation examination, a maximum of 14 pupils.
§ 24
(1) The contracting authority shall select, immediately after completion of the examination according to the uniform time schedule from pupils filled in the record sheets of the didactic tests together with the presentation sheet, check their completeness, store the record sheets and the presentation sheet in the security envelope and record the deposit in the report on the course of the graduation exam in the classroom. The security envelope shall be forwarded to the Commissioner without delay. The Commissioner and the contracting entity shall confirm the transmission of the security envelope in the transfer record.
(2) The Commissioner shall immediately transfer the record sheets and presentation documents to the electronic form and send them to the Centre via the Centre's information system; then the Commissioner shall transmit the record sheets and the attendance lists to the school director and confirm both transfers in the transfer record.
(3) After completion of the examinations, the Director of the School shall, at the request of the Centre, arrange for the transmission of the safety deposit box to the Centre in a manner specified by the Centre.
(4) Record sheets are stored in the school in the manner laid down by the Act on archiving and file service. The time limit shall be 5 years.
§ 25
Graduation thesis and her defence before the probationary graduation committee in the profile section of the graduation exam
(1) If the student does not give up work for serious reasons within the time limit set by the school director, he shall apologize in writing to the school director at the latest on the day fixed for the graduation; If the school director accepts the student's apology, he shall set a deadline for the student's graduation. If the student does not submit the graduation work within the deadline set by the school director without a written apology stating the serious reasons, if his apology has not been accepted, or if the student does not submit the graduation work within the specified deadline, the examination shall be deemed to have failed.
(2) The period for drawing up and defending graduate work may continue before the 21st day from the date of renewal of the possibility of the presence of pupils in secondary schools.
§ 26
Oral examination before the Trial Graduate Committee in the profile section of the Trial Trial
(1) The school director shall publish 20 to 30 topics for each oral examination. The published topics shall also be maintained for the repair and replacement tests.
(2) The pupil draws one topic immediately before the oral examination begins. The preparation for oral testing takes 15 minutes. If the nature of the examination so requires, the school director may provide for an extension of the duration of preparation for the oral examination, but not more than 30 minutes. The oral exam shall take no more than 15 minutes.
(3) The same topic cannot be drawn twice during the oral test on one day.
§ 27
Written exam in the profile section of the graduation exam
(1) The school director shall determine the subjects and test roles of the written examination and the manner in which it is to be conducted. If more than one topic is specified, the pupil chooses one topic immediately before the start of the test. If a student does not choose a subject until the beginning of the written examination, he will draw one topic from a specified menu of topics.
(2) The length of the written examination shall be determined by the school director, but the maximum duration of the written examination shall be 300 minutes.
§ 28
Practical exam in the profile part of the graduation exam
The practical examination may take place even before the 21st day following the renewal of the possibility of the presence of pupils in secondary schools
§ 29
Combinations of forms in the profile section of the graduation exam
If the school director determines a combination of two or more forms for the examination, each part of the examination shall be carried out in accordance with the provisions of this Decree relating to the appropriate form of examination.
§ 30
Replacement exam from a foreign language in the profile part of the graduation exam
(1) The compulsory or optional foreign language examination in the profile part of the graduation examination may be replaced by a standardised examination under the Education Act, which attests to the pupil's language skills at level B1 or higher under the Common European Framework of Reference for Languages.
(2) A written request for replacement of the examination shall be submitted by the student to the school director no later than 10 days after the renewal of the possibility of the personal presence of pupils in secondary schools for the spring exam and 25 July 2020 for the autumn exam. The application shall always include a document or an officially certified copy of the document of successful completion of the standardised language examination.
§ 31
Differences in the course of the graduation examination for pupils with the language of the national minority
(1) The examination of the language of a national minority shall be carried out in the form of an oral examination before the examination committee and written examination.
(2) A student of a school or a class with a language of instruction of a national minority who consists of a common or a profile part of a graduate examination in the language of a national minority shall state that fact in the application.
(3) A pupil may choose the language for each graduation exam.
Evaluation of tests of the common part of the graduation examination
§ 32
(1) The Ministry will publish the criteria for the assessment of the examinations and partial tests of the common part of the graduation examination and the criteria for the overall evaluation of the graduation examination in a manner that allows remote access not later than 21 days before the start of the common part of the graduation examination.
(2) The didactic test is evaluated by the Centre. The Centre shall make the results of the didactic tests available to the Director of the School through the Centre's information system in the spring trial period no later than 7 days after the date of the didactic test, in the autumn trial period no later than 7 days after the date of the didactic test. They shall be made available to pupils no later than the following working day following receipt of the results. In the spring examination period, the school director shall make the results available to pupils by listing the results of the didactic tests. The extract, provided with facsimile signature of the Director of the Centre, shall be made by the Director of the School through the Information System of the Centre for each pupil who carried out the didactic test.
(3) The dates of the opening of oral examinations from the Czech language and literature and from a foreign language in the relevant classes will be communicated by the Director of the Centre through his information system 14 calendar days before the first didactic test.
(4) Evaluation of the pupil from the oral examination of the common part of the test subjects Czech language and literature and foreign language will be proposed by evaluators to the examination committee after completion of the examinations on the given trial day. One of the evaluators shall record the evaluation of the oral examination of the common part in the report on the results of the oral examination of the common part of the pupil's graduation exam. The final assessment of the oral examination of the common section based on the conformity of the two evaluators and the approved Trial Graduation Board shall be forwarded by the President of the Trial Trial Board to the Director of the School without undue delay and shall be communicated to the pupil publicly. Data on the final evaluation of the oral examination of the common part will be sent by the school director to the Centre via the Centre's information system.
§ 33
(1) The limits for the success of the didactic tests shall be indicated by the Centre in the test books of the didactic tests for the test.
(2) The pupil will pass the exam or partial examination successfully if he reaches at least the limit of success.
